Dear Mr, Boyle:
We received your letter about the location of the driveway on Lot 12, Grainwood Park.
The Zoning Ordinance does not really address this situation, so we referred ;your
questions to the City Engineering Department. As you can see from the attached
memo, the City Engineering Department researched the driveway and grading issues at
this site, They have determined that the location of the existing driveway is legal, so
there is no City action we can take at this time.

We have carefully researched the driveway and grading issues related to Lots 12 and 13 of
Grainwood Park. Lot 13 is a vacant lot that gently slopes away from Grainwood Circle towards
the lake. Lot 12 has a house on it and the front yard and concrete driveway slope to the street.
Both driveway accesses for the two lots will connect to Grainwood Circle at the 900 corner that
exists on the street. Both lots will need to share a limited space where the two driveways connect
to the street. It appears that there is adequate space for the future driveway on Lot 13 to connect
to the street. Perhaps the mailbox located on the north lot line of Lot 13 will need to be moved
slightly to provide more space for the future driveway on Lot 13.
The homeowners on Lot 12 have constructed a rock retaining wall and flower garden along the
north edge of Lot 12. The rock retaining wall should be moved slightly to the south to allow for
a drainage swale to be constructed along the lot line. The two neighbors should work together to
accomplish this or to provide an alternative solution.
The future driveway for Lot 13 should slope to the street for the first 10 feet of the driveway.
The driveway should be 6 inches higher than the street to keep storm water runoff from draining
off the street and onto private property. The garage slab of the future house on Lot 13 may well
be less than 18 inches above the top of curb on Grainwood Circle. The design of the future
house may elect to follow the existing slope of the lot which drains away from the street, but the
driveway should still have a high spot to keep storm water runoff in the street.
We have met at the site with the property owners of Lots 12 and 13. The property owners should
work together to resolve this dispute. The City would be happy to be of assistance to require that
drainage swales and proper elevations are maintained.

Re: Driveway dispute at 4277 Grainwood Circle S.E.
Per our telecon of 8/7/96, I have attached portions of three lot
surveys to help describe the situation. The first (Lot 13) is our lot.
The second (Lot 12) is the adjacent lot south of ours. The third (Lot
11) is the lot south of Lot 12. All three are needed to fully define
the public road of concern. The first and third surveys show where
the street pavement (curb line) was before the driveway extension
from Lot 12 covered it.
I have combined the surveys into one drawing (the last attachment)
and located the driveway extension on that drawing as nearly as I
could using measurements to the buildings. As I said he has buried
or removed the survey monument derming the SE comer of our lot.
The previous driveway for Lot 12 ended at the wesl~nllot line of
Lot 12 at curb elevation. The current owners of Lot 12 built the
house and the original driveway and used that driveway without
significant problem for about 10 years.
There was a clay and gravel driveway on Lot 13 (our lot) but it was
obliterated during the building of the driveway extension on Lot 12.
The Lot 13 survey shows the historic location of that driveway. It is
now completely blocked by the new driveway extension from Lot 12
into the public right of way.
Our main issue is that he has raised the elevation of the public right
of way above the curb elevation in front of 50% of out street
frontage, effectively blocking ready access to all of our property
frontage as well as visually uiminishlllg OUI frontage to 25 feet or so.
In addition the grading which is now retaining his elevated grades at
our common lot boundaries is located almost totally on our propertY
rather than being properly retained on his property.
