Dear Mr. Kruger:
The City of Prior Lake has completed the site plan review for the Airtouch Cellular
Communications Equipment Building on the Crest Water Tower site. The site plan and
landscaping plan you submitted, dated "Received, February 26, 1997" is hereby approved
subject to the following conditions:
1. Airtouch Cellular is responsible for repairing any damage to the existing roadway
occurring as a result of construction;
You may now proceed with your lease agreement and your building permit application.
Questions about the lease must be directed to Ralph Teschner, City Finance Director. Any
questions aQout the building permit process or requirements must be directed to Gary
Staber, City Building Official.

Dear Jane:
I have had the Site Plan (Sheet No. Zl) dated January 10, 1997 revised to show a twelve
(12) foot wide paved driveway running around the base of the water tower, and to show how
that driveway connects to the parking area for the property to be leased to AirTouch. However,
as you can see, such driveway has been marked "Provided by others" because it is the intent of
AirTouch to begin its construction at this location after Sprint, and so (as you have explained)
Sprint will be the party responsible for the installation of this driveway.
As required, I enclose three (3) copies of this plan. I understand that you will mark one
of this copies as "Approved" and return the same to me. Please contact me immediately if the
plan enclosed requires any further modification.

PROPOSED INGRESS AND EGRESS EASEMENT DESCRIPTION
A 15.00 foot easement over and across that part of Outlots A and B, SAND POINTE 3RD ADDITION,
according to the recorded plat thereof, Scott County, Minnesota. The centerline of said easement is
described as commencing at the southwest corner of said Outlot A, thence on an assumed bearing of
North 82 degrees 58 minutes 36 seconds East, along the south line of said Outlot A, a distance of 127.95
feet; thence easterly a distance of 109.39 feet, along a tangential curve, concave to the northwest, having
a radius of 855.49 feet and a central angle of 7 degrees 19 minutes 34 seconds, along said south line of
Outlots A and B to the point of beginning of the centerline to be described; thence North 8 degrees 33

Dear Mr. Kruger:
The City of Prior Lake has completed the site plan review for the Airtouch Cellular
Communications Equipment Building on the Crest Water Tower site. As I mentioned in our
telephone conversation today, the site plan and landscaping plan you submitted, dated
"Received, February 5, 1997" is in general compliance with City requirements; however, this
site plan must show the road around the water tower. Once you have submitted a revised
site plan showing this road, we can approve the site plan with the following conditions:
1. The road around the water tower must have a 4" aggregate base and a 2" bituminous
surface on a 12' width (see attached cross section).
2. Airtouch Cellular is responsible for repairing any damage to the existing roadway
occurring as a result of construction.
Once the site plan is approved, you may proceed with your lease agreement and your
building permit application. Questions about the lease must be directed to Ralph Teschner,
City Finance Director. Any questions about the building permit process or requirements
must be directed to Gary Staber, City Building Official.

Dear Ms. Kansier:
I have been asked by my partner, Jay Littlejohn, to follow up with you concerning the
additional plan requirements for the proposed equipment building for this facility which are set
forth in fax to Jay dated January 17, 1997 and your letter to Jay dated January 21, 1997.
The original Site Plan (Sheet No. ZI) dated January 10, 1997 has been revised to show
(i) a separation between the eastern edge of the roof of the equipment building on the U S
WEST lease site and the western boundary of the Sprint lease site of twenty (20) feet, five and
one-half (5-1/2) inches, (ii) that the roof overhang of the equipment building falls within the
boundaries of the U S WEST lease site, and (iii) a fifteen (15) foot wide paved driveway running
to the western boundary line of the U S WEST lease site.
In addition, the landscaping plan described in your January 17, 1997 fax has been
prepared (Sheet No. Ll), which shows (i) the trees (evergreens and ash) surrounding the existing
equipment building on the site, (ii) the proposed locations for the Colorado spruce and amur
maples to be planted as a part of the U S WEST development, (iii) a materials list for those
plantings and details for the planting of those trees, and (iv) a partial topography for the entire
water tower site, which demonstrates that the floor level for the U S WEST equipment building
is approximately three (3) feet above, and more than forty (40) feet to the South of, the storm
water detention pond along the northern portion of the water tower property.

However, these plans do not show the driveway to the U S WEST lease site extending
around the base of the water tower, as mentioned at item 2 of your January 21, 1997 letter. It
is our understanding that Sprint has already agreed, as a part of its obligations under its lease
with the City, to pave the area surrounding the water tower, and so it should not be necessary
for U S WEST to provide for the same on its plans.
As required, I enclose three (3) copies of each of these plans. This submittal should
permit the City to complete its site plan review process, and so be in a position (upon approval
of the zoning text amendment) to prepare for execution the Water Tower Antennae Agreement
with U S WEST. In connection with that preparation, I also enclose (i) a copy of the Survey
of the water tower property prepared by Sunde Land Surveying Inc. (last revised January 24,
1997) containing legal descriptions for that property, for the proposed U S WEST lease site, and
for the proposed easement for ingress and egress to that lease site from Cedarwood Street, (ii)
a sheet also prepared by that surveyor and dated January 24, 1997 with those same legal
descriptions, and (iii) a copy of the form of Exhibit D to Water Tower Antennae Agreement
which has been completed with the materials to be used for the U S WEST equipment building.
Please contact me immediately if the plans enclosed require any further modification, or
if there is additional information required for the preparation of the Water Tower Antennae
Agreement.

Dear Jay:
The Building Department, Engineering Department and the Planning Department have completed the
site plan review for the proposed US West equipment building at the above site. The following
changes/additions must be made before we will approve this site plan:
1. The site plan must include topographic information and existing landscaping. We are especially
interested in the location of the proposed building to the top of the slope of the stormwater
detention pond on the he north side of this property, adjacent to Highway 42.
2. The area to your lease site must be paved. You must also pave any parking area on your lease
site, adjacent to the building. In addition, the driveway to your site must be extended around the
water tower.
3. The overhang of your building must be completely on your lease area.
4. As I mentioned in the FAX I sent you on January 17, 1997, you must also submit a landscaping
plan. The Engineering staff has also noted that no landscaping rock may be used on the site, due
to vandalism problems we have experienced in the past.
Please submit at least three (3) copies of the revised plans to me. Once I have received therevisions,
I will schedule another review meeting.

I have completed a preliminary review of your plan. Before we can proceed, the following changes or
additions are necessary:
1. The lease area you show appears to be too close to the Sprint area. There must be a 20' separation
between the buildings; it appears your lease area is 10' from the Sprint building.
2. A landscaping plan is required. As you prepare this landscaping plan, please keep in mind the following
points:
. The purpose of the landscaping is to screen the building from the road and the adjacent residential
area. It is not necessary to screen it from the water tower or other equipment buildings.
. For screening purposes, coniferous trees work best, although some combination of coniferous and
deciduous trees may be appropriate and attractive.
. Coniferous trees must be at least 6' high; deciduous trees must have at least a 2 1/2" caliper.
The Engineering and Building Departments have not yet completed their reviews. I will forward any
comments they have as soon as possible. Please let me know if you have additional questions.

Communications Equipment Buildings
We have received two requests for communications equipment buildings at the
Crest Water Tower site. As you know, the recent amendment to the Zoning
Ordinance requires site plan approval by the City Engineer, the Building Official
and the Planning Director for these buildings.
Attached are the site plans. I am hoping we can review these plans tomorrow,
sometime during the DRC meeting. Please let me know if you have any

Dear Ms. Kansier:
Thank you for taking the time to speak with me before and after the city council meeting
on January 6, 1997 and for speaking with me on the telephone today about this site. As you
requested, I have enclosed three (3) copies of the site plans and elevations for the proposed
cellular installation on one of your city's water towers.
As staff requested, we have moved the proposed location of the equipment shelter so that
it is 30 feet from the base of the water tower. I understand that, when my client discussed this
installation with city staff months ago, staff requested that our proposed building be constructed
with an exterior that matches the existing building that AT&T Wireless has at the site. This will
be done, and the elevations on this drawing bear that out. Finally, you asked that the site plan
contain contours of sufficient detail so that you could assess whether the ditch or swail to the
north of the building would be affected by the new location. As you can see, the elevation of
the base of the building will be approximately 998 ft. above mean sea level, and the ground
elevation rises above that level to the north of the proposed location.
I understand that staff can now conduct an internal site plan review of the proposal.
When the site is approved, and assuming that the city adopts the zoning text amendment that has
been proposed, we can complete the lease. We hope that site plan review can be completed in
the near future so that I can provide the legal description, building description, approved site

plan and elevations, the legal name of our client (D S WEST NewVector Group, Inc.) and other
materials necessary so that the city attorney can prepare a lease that is ready to be signed
immediately after passage of the zoning text amendment. Working drawings for the site can
then be submitted for approval, and we can begin paying rent and building the site.
Because my client first approached your city in August of last year with its request to
lease this space, we are eager to bring this matter to a close. Therefore, if you need further
information so that this can be completed, please let me know.
