Add a sanitary sewer clean out at the property line. 2. There is no sanitary sewer service to this site. The applicant has requested that the City install service to the site as a public improvement project. To date, the only quote we received was over $25,000. In order to advertise the project for bids, we must get council authorization. I sent Mr. Hechter the attached letter outlining his options in regard to sanitary sewer installation. 3. If Mr. Hechter installs the sanitary sewer as part of the building project, he must obtain permits from the county and MnDOT to work in the right-of-way. In regards to the issuance of a building permit, the following needs to be corrected: 1 . The trash enclosure materials of rock faced concrete block matching the principal structure are acceptable. However, it has been brought to our attention that the setback for the trash enclosure is 15 feet from the side property lines. Considering that your lot is a corner lot, the interior lot lines are considered side lot lines. I would suggest locating the trashlrecycling enclosure to two of the stalls adjacent to the north side of the building and locating those two stall where the trash enclosure was originally proposed. You will not lose any parking this way. 2. The submittal of a cost breakdown of the landscaping (including irrigation, plantings, sod, and landscaping materials) and a letter of credit for 125% of those costs is required prior to issuance of a building permit. 3. Signs require separate permits (including temporary banner signs). The proposed setbacks on your plan have been changed and meet the required setback for ground monument signs of 10 feet. 4. Considering that your have one extra parking stall, I would recommend that you eliminate a stall on the north row closest to the driveway. The first stall is only setback 13 feet from the drive entrance. This is barely enough room for a small car not to block the first stall. 5. Roof top screening of mechanical units is required. The units must be screened as seen from the street. Please provide a lay-out of the roof with locations of the roof-top mechanical equipment. The closer the units are to the parapet, the more effective screening will become. Please indicate how you intend to screen the units. Thank you for your attention to this matter. Box 167 Bayport, MN 55003 RE: Public Improvement Project for Nor.thgate Center Mr. Hechter: We have received your letter dated July 22, 1997. The staff has continued to work on your request for a public improvement project to extend sanitary sewer service to your Northgate Center property. The 429 process requires the following steps: 1. City Council approval of the preparation of plans and specifications. 2. Since the estimate is less the $25,000, the City staff may obtain quotes for the project. If the cost is greater than $25,000, the project must be bid. 3. The City Council must authorize the award of the contract for the project. Due to the above steps, the 429 process may take longer and be more expensive than a private development project. The staff has reviewed this project and prepared an engineering estimate. Attached you will find a copy of this estimate, along with a new copy of the Special Assessment Agreement and Waiver. This copy of the waiver has the dollar amounts of the project and the terms of the repayment. Please review and sign this copy of the agreement. Once we have received a signed copy, we will forward your request to the City Council for authorization to proceed. If we receive a signed copy of the agreement by August 22, 1997, we can schedule this item for the Council meeting on September 2, 1997. It is our intention to process your request as quickly as possible. However, as I noted above, the statutory requirements of the 429 process can result in some time delays. It is also important that you are aware that your property will be the only property benefiting from this project. As the only benefiting property owner, you will be assessed the entire cost of the project. Thank you for your attention to this matter. RECITALS A. Property Owner is the fee owner of the real property located in Scott County, Minnesota, described on Exhibit A attached hereto, with a street address of , Prior Lake, Minnesota 55372, and identified as tax: parcel number R25-936-008-0 ("Subject Property"). B. Property O'vvner has requested the City install sanitary sewer improvements which will serve and benefit the Subject Property. C. Property Owner acknowledges the sanitary sewer improvements benefit the Subject Property in an amount equal to or exceeding the amount referenced in paragraph 3 above. - 4. ASSESSIVIENT TO SUBJECT PROPERTY ONLY. Property Owner acknowledges that no other party will be charged or no other property will be assessed for the improvements described in this Agreement. 5. ASSESSMENT AiVIOUNT. Upon City's determination of the full amount of the assessment, City shall notify Property Owner. Thereafter, City shall certify such amount to Scott County for payment in accordance with applicable procedures. The staff has continued to work on your request for a public improvement project to extend sanitary sewer service to your Northgate Center property. However, due to the bidding and authorization requirements, the 429 process may take longer and be more expensive than a private development project. The staff has reviewed this project and prepared an engineering estimate. Attached you will find a copy of this estimate, along with a new copy of the Special Assessment Agreement and Waiver. This copy of the waiver has the dollar amounts of the project and the terms of the repayment. Please review and sign this copy of the agreement. Once we have received a signed copy, we will forward your request to the City Council for authorization to proceed. If we receive a signed copy of the agreement by August 7,1997, we can schedule this item for the Council meeting on august 18, 1997. It is our intention to process your request as quickly as possible. However, as I noted above, the statutory requirements of the 429 process can result in some time delays. Your site plan has been approved with the following conditions: 1. Sanitary sewer service must be extended to serve the site. 2. The items outlined in the attached memorandum from Sue McDermott, Assistant City Engineer, dated May 28, 1997, must be addressed. 3. A Letter of Credit (LOC) must be submitted upon application for building permit. The LOC must be in the amount of 125% of the cost estimate of the landscaping including plantings, sod, irrigation, mulch, etc. A cost breakdown with estimates must be submitted with the LOC. 4. Please be aware that separate sign permits will be required. You should also be aware that this site plan approval is based on the current Zoning Ordinance. If you delay applying for a building permit, any future changes in the Zoning Ordinance (or other City Codes) must be reflected in your building permit application for approval. If you would like a copy of your plans to be stamped for site plan approval, please mail them to me and I will stamp, sign and return them to you. Most of these items can be addressed upon submittal of a building permit application. The greatest issue is the extension of sanitary sewer service to this property. The property owner has denied this request. Both the City Engineer, Greg IIkka, and I have discussed this situation in telephone conversations with you on April 18th. We are in agreement that you have the following options to make the sewer connection: I. Contact the Norex property or the bank located on the west side of Franklin Trail yourself to acquire the necessary easement to connect the sewer to an existing line at TH 13. 2. Consider interior or exterior lift stations to connect the sanitary sewer from your site to an existing line along Westwood Street. 3. Construct the sewer line within the County right-of-way. It is our understanding that the County will allow you to open cut Franklin Trail for sanitary sewer installation. Reconstruction of the roadway would be your responsibility. You have indicated to me in a phone conversation earlier today that you have submitted a plan to install the sewer line to TH 13 by directional drilling beneath the fiber optic cable and other conflicting utilities. Our staff will review your plans for conformance to City standards. It will be your responsibility to obtain all necessary permits from the County and State to work within their right-of-ways. This building needs to be hooked-up to sanitary sewer. Preliminary plans indicate the proposed hook-up to run from your building, north through the easement on the east side of Franklin Trail, up to HWY. 13. As we have recently learned, Scott Rice Telephone has a fiber optics line in the middle ofthe City easement and County R-O- W adjacent to the existing sidewalk. From our discussion with you, there are four possibilities to make the sewer connection: 1. Obtain an easement, east of the existing City easement and County R-O- W along Franklin Trail, from Norex. Upon written request, the City is willing to facilitate the acquisition of an easement from Norex for you. However, any costs for obtaining the easement will be your expense. 2. Consider interior or exterior lift stations. A lift station is a viable option for connecting sanitary sewer on the south side of the site to the existing lines along Westwood Street. The City is not willing to take on the maintenance of any lift stations constructed on this site. 3. Construct the sanitary sewer line within the existing City easement and County R-O- W. This would result in the sewer being placed beneath existing road surface. This would give you the option of running the sewer across Franklin Trail and along the west side of the roadway, if this easement is obtained. · The City needs an easement signed for existing water and storm sewer pipes located on your site. Easements were signed in 1990, but were never recorded. As a new property owner, the City needs to obtain the easements from you. · The installation of another valve on the water service will be necessary. · Profiles of utilities and drainage calculations are required. Please include flows from other sites draining across this site in the calculations. · The installation of a fire hydrant near the south entrance will provide better building coverage of the 150 foot radius each hydrant can cover. · For fire protection, the turning radius offire trucks needs to be addressed. Minimum width for drive aisles are an unobstructed 20 feet to allow the passage of fire protection vehicles. Therefore, the site plan needs to be modified to allow for unobstructed vehicular access behind the proposed building. J · The issues in the Planning Staff report dated March 24, 1997 need to be addressed. Attached is a copy of those issues. At your request, your application for Conditional Use Permit (CUP) and Variances were continued at the March 24, 1997 Planning Commission meeting until April 14, 1997. By April 8, 1997 the Planning Department needs one of the following: a written request to continue the hearing until a specified date, a letter of withdrawal of your applications, or revised plans indicating your request for CUP or variances. As an addition to these items, please be aware that the City received your application for CUP and Variances on February 24, 1997. The City has 60 days to take action on all planning and zoning related requests. Your 60 days will expire on April 25, 1997. Therefore, the City is extending your 60 day time period by and additional 60 days, until June 24, 1997, due to your request of continuance, additional information required to be submitted, and time to resolve the sanitary sewer/easement issue. This building needs to be hooked-up to sanitary sewer. Preliminary plans indicate the proposed hook-up to run from your building, north through the easement on the east side of Franklin Trail, up to HWY. 13. As we have recently learned, Scott Rice Telephone has a fiber optics line in the middle of the City easement and County R-O- W adjacent to the existing sidewalk. From our discussion with you, there are four possibilities to make the sewer connection: 1. . Obtain an easement, east of the existing City easement and County R-O-W along Franklin Trail, from Norex. Upon written request, the City is willing to facilitate the acquisition of an easement from Norex for you. However, any costs for obtaining the easement will be your expense. 2. Consider interior or exterior lift stations. A lift station is a viable option for connecting sanitary sewer on the south side of the site to the existing lines along Westwood Street. The City is not willing to take on the maintenance of any lift stations constructed on this site. 3. Construct the sanitary sewer line within the existing City easement and County R-O- W. This would result in the sewer being placed beneath existing road surface. The issues in the Planning staffreport dated March 24, 1997 need to be addressed. Attached is a copy of those issues. At your request, your application for conditional Use Permit (CUP) and Variances were continued at the March 24, 1997 planning Commission meeting until April 14, 1997. By April 8, 1997 the planning Department needs one of the fonowing: a written request to continue the hearing until a specifIed date, a letter of withdrawal of your applications, or revised plans indicating your request for CUP or variances. As an addition to these items, please be aware that the City received your application for CUP and Variances on February 24, 1997. The City has 60 days to take action on all planning and zoning related requests. Your 60 days win expire on April 25, 1997. A reduction of the size of the building could meet the rear yard setback requirement. Changes in the proposed use of the building could reduce the number of required parking stalls. A combination of both of these changes is a viable alternative to the granting of the variances. ALTERNATIVES: 1. Adopt Resolution 97-l0PC (denying the requested variances) and table the CUP review until April 14, 1997 to allow the applicant two weeks (until April 7, 1997) to submit revised plans meeting the criteria of the city code as presented or with changes recommended by the Commission. 2. Adopt Resolution 97-10PC (denying the requested variances) and recommend that the City Council approve the CUP with specific conditions as requested by the Planning Commission. 3. Based upon expressed fmdings of fact, recommend the City Council deny part or all of the applications based upon inconsistency of the proposal with specific regulations of the Zoning and Subdivision Ordinances and/or specific policies of the Comprehensive Plan. RECOMMENDATION: Staff recommends Alternative #1 to deny the requested variance and table the CUP request such that the applicant can address the following: =7> 1. The applicant must submit a landscape plan indicating improvements to be made that meet all criteria of the landscape ordinance (Section 6.10, including an irrigation plan) as indicated in report including screening of parking along Franklin Trail with multiple elements (not just a berm). 2. The applicant must submit a lighting plan that meets City Code lighting standards and is approved by the Planning Department. 3. The applicant must submit a revised site plan indicating: . minimum parking stalls that meet the parking ordinance requirements . a loading berth (can be a designated parking stall) . minimum building setbacks that meet the setback ordinance requirements 97-015PC.DOC 6 JT . 4. The applicant must submit a utility plan indicating location and hook-up of utilities (sewer and water) and storm sewer and run-off directions. The applicant must submit a drainage plan implementing infiltration methods such as those identified in MPCA's Best Management Practices (infiltration trenches, swales, etc.) to be approved by City Engineer. 7. The applicant must submit revised building elevations indicating the type of materials to be used for the exterior finish. The proposed materials must meet the architectural standards as indicated in Chapter 4 of the City Code. The cash dedication is based on the fair market value of the land which is determined to be $6000 per acre. Research from Engineerin9 staff has indicated that there are no sanitary sewer serv~ces stubbed to the subject site. There is a sanitary sewer main in the Westwood Drive right-of-way however, it may not be deep enough to provide gravity flow for the subject site. In any event, it will be the responsibility of the property owner of the subject site to pay for extension of sanitary sewer service to the site and provide the city with the necessary easements for the sewer extension. 4. Another issue concerns access to the subject site. The site is located adjacent to County Road 39. Any proposed curb cuts on Franklin Trail for driveways will require appropriate permit approvals from the Scott County Highway Department.
