We are writing this letter in request of a variance for the construction of two 10' by
10' decks off of the back of our home at 5615 Forest Court. We are requesting this
variance for a number of reasons whi.ch we would like you to consider. Our builder,
T. M. Kearney Construction, did not make us aware of the fact that our cui de sac lot,
which is wide and short, would present a problem with our future plans to build two
decks off of the back of our house. Had we been made aware by our builder that we
would not be able to make use of our two slidinc class doors off the back of our house
we would have never put them on. At present we cannot use these two sliding glass
doors, as they are both well above ground. There was never any mention of the fact
that our home was being built at the minimum distance from the back of our lot line and
that our sliding glass doors were going to be of no real use. Whether this was an
oversight on our part, (although we were all first time home buyers and certainly were
not abreast of all the city ordinances), or the fault of our realtor, the builder or the city
inspector, it would certainly be unfortunate if we were unable to use the sliding glass
doors on our house as they were designed to be used. We feel that the lack of the
proposed decks would lower the value of our home. We also would like to make note
of the fact that the size of our home is very comparable to the others in our cui de sac
and therefore it is the shape of our lot that makes this variance necessary in order to
construct our proposed decks. For the above mentioned reasons, we feel that it would
be extremely appropriate that we receive a variance to build the proposed decks on our
property. Thank you for your consideration.

Dear Edward's:
The Planning Department received an application for a variance on June 2, 1997 from
you. Upon review of the application materials, and in preparation of public hearing
notices, it has become apparent that your application is incomplete. The survey
submitted shows the house as proposed with the proposed decks drawn on the survey.
There are no setback dimensions to the proposed decks shown.
To continue processing your application, the survey needs to be updated to show the
house as built and the proposed decks need to be drawn on the survey to scale with the
exact proposed setbacks indicated. When a variance is granted, it is for a specific
distance (or other criteria). We need to know what distance you are proposing to build
your decks from the property lines The revised survey with dimensions and proposed
decks will be required upon submittal of a building permit, if the variances are granted.
As a result of an incomplete application, we are not scheduling your request on the June
23, 1997 Planning Commission meeting. We will resume processing your request upon
submittal of a complete application and schedule your item to be heard by the Planning
Commission soon thereafter..

The Planning Commission will review the proposed construction and requested variance
against the following criteria found in the Zoning Ordinance.
