Re: Patio area inclusion in our leased premises for the purpose of serving food and
alcoholic beverages.
Dear Sirs and Madam;
Enclosed please find the authorization we received from the owner/manager of Priordale
Mall to utilize the space on the west front and northwest side of our restaurant for the
above described purpose. This is a permanent alteration and amendment to our lease to
utilize said area.
In response to our previous correspondence with you, we have delivered a definition and
drawing of the area, a certificate of insurance covering the service of food and alcoholic
beverages within the defined area and herein the amendment to our lease authorizing the
use of the space.

Outdoor Seating Area at T.J. Hooligans

We have received a request from T.J. Hooligans, a bar/restaurant in Priordale Mall, to
allow outdoor seating according to the attached diagram. We have several concerns
about this arrangement, but my question for you has to do with the consumption of liquor
outside of the restaurant.
City Ordinance Section 3-1-16 (E) states in part "no person shall possess open containers
of alcoholic beverages or consume alcoholic beverages on public streets, public parking
lots, or on parking lots under the control of the liquor licensee outside the licensed
structure or on private property generally open to the public unless possession or
consumption for a specific event on such property is approved by the City Manager in
advance of the event." The applicant has noted no liquor will be served outside, but
patrons will be allowed to purchase alcoholic beverages inside and carry them to the
tables outside. Additionally, while Priordale Mall is private property, the area where the
tables will be located is the sidewalk running in front of the mall.
Please give me your opinion on whether this section applies to the outdoor dining at this
location. If so, we will notify TJ. Hooligans that liquor will not be allowed in the
outdoor seating area. If it does not apply, we will process their request accordingly.

allow to be kept in a motor vehicle upon a public highway a bottle or
receptacle containing alcoholic beverages unless it is kept in the
trunk of the motor vehicle, or, if the vehicle has no trunk, in some
other area of the motor vehicle not normally occupied by the driver
or passengers. (Ord. 91-02, 7-15-91)
(D) No person under eighteen (18) years of age may serve or sell
intoxicating liquor in a retail intoxicating liquor establishment. (Ord.
87-15, 12-7-87)
. (E)
No person shall possess open containers of alcoholic beverages or
consume alcoholic beverages on public streets, public parking lots,
or on parking lots under the control of a liquor licensee outside the
licensed structure or on private property generally open to the public
unless possession or consumption for a specific event on such
property is approved by the City Manager in advance of the event.
The requesting party for such approval shall submit an application to
the City Manager on a form authorized by the City. (Ord. 91-02,
7-15-91)
3-1-17: UNLAWFUL ACTS (MINORS): For the purpose of this
Section, any person under the age of twenty one (21) years
shall be considered a minor.
(A) No person shall sell, barter, furnish, or give alcoholic beverages to a
minor, except that a parent or a guardian of a minor may give or
furnish alcoholic beverages to said minor solely for consumption in
the household of the parent or guardian.
(8) No persons shall induce a minor to purchase or procure alcoholic
beverages.
(C) No minor shall misrepresent his or her age for the purpose of
purchasing alcoholic beverages.
(D) No liquor licensee or permit holder shall permit a minor to consume
alcoholic beverages on the premises, and no minor shall consume
any alcoholic beverage unless in the household of the person's
parent or guardian and with the consent of the parent or guardian.
(E) No minor shall purchase or attempt to purchase any alcoholic
beverage, nor shall any minor have any alcoholic beverage in his or
her possession.
