SUBJECT:
To consid$r a conrlitional use permit for a supply yard located north
of intersection Highway 13 and Anna Trail S.E.
STAFF ANALYSIS:
The subject parcel is approximately 7.3 acres and fronts 270' on
Anna Trail S.E. and 700' on Highway 13. The parcel is zoned B-2
Community Business with the land to the north having a C-1 zoning with
R-2 zoning adjacent to the west and the pprcel south of intersection
Highway 13 and Duluth Avenue being Lirrlited Business.
The applicant is proposing to utilize the land for general commercial and
supply yard tor building materials. According to Prior Lake's Zoning
Ordinance, a supply j.ard in a B-2 zone would require a conditional use
permit. The Comprehensive plan recommends a civic center for this site
which would help pull together the separate commercial areas within the
City, or a variety of commercial at close proximity which would be tied
into the older cOlllllercial district. The proposed use serves more as a
buffer or divider between the old and new commercial districts. Supply
yards must be closely monitored since there is a tendency of those kind
of uses to deteriorate to a point no longer aesthetically pleasing,
especially when the use is centrally located in a community.
other consideration must be given to future businesses north of the
proposed use. With access to Highway 13 limited, a frontage road must
be considered and the proposed building so aituated so as to allow room
for a frontage road.
The applicant is proposing to construct an aprroximately 8()' x 100' metal
building with the front to be of wood siding and used for retail space.
STAFF RECCJ.lMENDATION:
Approve the conditional use permit on the following conditions:
1. All activity related to the supply yard be screened by an
aesthetically pleasing fence no less than 6' in heighth.
2. The parking lot be approved by.the City Pl.anner.
3. The building location be approved by the City Planner.
4. The fence and building must be kept in good repair and maintained.

across the corner of the property which means that this pottion of
land cannot he huilt upon, hut may be utilized as a parkinq lot.

The City received an application for a Conditional Use Permit (CUP) from C.H.
Carpenter Lumber on July 3, 1997. The applicant proposes to construct two
pole type building in a phasing plan. The property is zoned B-2, Community
Business. The Prior Lake Zoning Ordinance requires a conditional use permit for
this type of use in the B-2 district. The applicant obtained a conditional use
permit in 1976 for the original building to allow "Supply Yards" in the B-2 zoning
district (CUP 76-02). The applicants are substantially increasing the structure
beyond original approval, thus an amendment to the original CUP is necessary.
Because the proposed expansion exceeds 10% of the existing gross floor area
or 4,000 square feet, the landscape ordinance applies (Section 5-5-10 C). Credit
can be given for existing material on the site. The applicant is proceeding with a
tree inventory/landscape plan, but is in need of more time. Considering that
notices of public hearing were sent and published, the Planning
Commission must continue the hearing to August 11,1997.

applicant had in mind, the applicant is currently revisiting options. Considering
that notices of public hearing were sent and published and that the hearing
was continued to August 11, 1997 at the last meeting, the Planning
Commission must continue the hearing. Staff is recommending that the
hearing be continued to September 22, 1997. The item will be heard by the City
Council on October 6, 1996. The applicant has been given until September 2,
1997 to submit the required information, such that the notices can be re-sent and
published in the newspaper again. The statutory requirement to complete
zoning requests within 60 days, with a 60 day extension, expires on October 30,
1997. If the city does not make a decision on the req uest by then or if the
applicant does not withdraw, the project becomes automatically approved.

Dear Mr. Meyer;
As a follow-up to our conversation today, the following are outstanding items to complete your
application for amended CUP:
1. Completed and signed CUPILand Use application.
2. Show the watermain in profile, per engineering.
3. You will need a permit from MnDOT to construct the water service on the property line and
dedicate a 10' utility easement to the City OR move the water line 10' in from the property
line and dedicate a 20' utility easement to the City (no MnDOT permit required).
4. Indicate that there is no "gravel driveway" rather gravel storage area on site plan (as per our
discussion there is no vehicle drive, it is used for maneuvering of lumber products via fork-
lifts ).
5. Site plan should show the relocation of the fence.
6. A landscape plan must be submitted. Enclosed are requirements.
We will present this amendment in two phases, with the second building to be completed by July
31,2002. Please provide me with the information as soon as possible, but no later than Friday,
July 18,1997. If the necessary information is not received by then, your item will not be
scheduled for the July 28, 1997 Planning Commission meeting. A subsequent meeting date
