In conformance with provisions between the City of Prior lake and David Hansen
regarding the installation of landscaping and watering equipment we hereby issue this
Irrevocable Letter of Credit in the amount of$ 17,500.
The drafts drawn under this Letter of Credit are to be endorsed hereon and must bear the
clause "drawn under the Security Bank & Trust Company Letter of Credit No. 0080-2,
dated November 23, 1998.
Security Bank & Trust Company agrees with the City of Prior Lake that as holder ofthe
Letter of Credit that the same shall be duly honored upon demand at Security Bank &
Trust Company on or before November 10, 1999.
This Letter of Credit is subject to the uniform customs practice for Commercial
Documentary Drafts/ICC Publication No. 400.
Except as otherwise expressly stated herein, the Letter of Credit shall be subject to and
governed by the laws of the State of Minnesota, including the Uniform Commercial code
as applies to Letters of Credit.

AGREEMENT
This Agreement dated iJ/Jv'tmbvr ~5 ,1998 by and between the CITY OF PRIOR
LAKE, a Minnesota municipal corporation (hereinafter "City"), whose address is 16200
Eagle Creek Avenue, SE, Prior Lake, Minneso~a 55372, and DAVID O. HANSEN

Recitals .
WHEREAS, Developer is the owner and developer of certain property located at
17001 Fish Point Road, Prior Lake, Minnesota, legally described as
follows:
That part of Lot I, Block 2, WATERFRONT PASSAGE ADDITION,
Scott County, Minnesota described as follows:
Beginning at the northwest comer of Lot 2, Block 2, of said plat; thence
North 00 degrees 10 minutes 44 seconds East plat bearing along the west
line of said Lot I, Block 2, a distance of 147.00 feet; thence along a
tangential curve concave to the west, having a radius of 526.00 feet, a
central angle of 02 degrees 50 minutes 26 seconds, an arc length of
26.08 feet; thence North 82 degrees 30 minutes 56 seconds East (not
tangent to said curve) a distance 195.73 feet; thence South 85 degrees 59
minutes 04 seconds East a distance of 217.67 feet; thence South 00
degrees 10 minutes 44 seconds West a distance of 184.60 feet to the
intersection with the easterly extension of the north line of said Lot 2,
Block 2, of said plat; thence North 89 degrees 49 minutes 16 seconds
West along said easterly extension and the north line of said Lot 2,
Block 2, a distance of 410.52 feet to the point of beginning.

'\VHEREAS, Developer's application for variances to the Property to waive the
requirements for in-ground irrigation of landscaped areas and rooftop
screening was denied by the Board of Adjustment on August 24, 1998;
and
WHEREAS, Upon Developer's appeal of the Board of Adjustment decision to the
City Council, the City Council on September 21, 1998 upheld the
decision of the Board of Adjustment; and
WHEREAS, The City has prepared a new zoning ordinance which will be considered
by the Prior Lake City Council wherein the provisions dealing with in-
ground irrigation systems and rooftop screening differ from those

provisions in the current zoning ordinance; and
WHEREAS, In considering the Developer's appeal from the denial for the variance it
. had applied for, the City Council found the hardship criteria for
granting a variance from the current zoning ordinance did not exist and
the Developer's request for a variance was premised mainly on
economic and policy considerations; and
WHEREAS, . The City Council recognizes the costs to comply with the provisions in
the current zoning ordinance pertaining to in-ground irrigation systems
and rooftop screening may exceed the costs to comply with the
applicable corresponding provisions proposed in the new zoning
ordinance currently under consideration; and
WHEREAS, The City Council at the present time believes final action on the
proposed new zoning ordinance will be completed by December 7, 1998
and the ordinance will become effective sixty (60) days thereafter; and
WHEREAS, The City Council agrees that it would be reasonable for the City and
Developer to await the contemplated adoption of the new zoning
ordinance as it relates to the provision described herein, rather than
requiring Developer to immediately comply with the provisions in the
current ordinance.
NOW THEREFORE, in consideration of the mutual promises and covenants set forth
herein, the sufficiency of which is not disputed, the City and Developer agree as follows:

2. NEW ZONING ORDINANCE: The City has until July 21, 1999 to adopt a new
zoning ordinance.
3. FAILURE TO ADOPT NEW ZONING ORDINANCE: If the City fails to adopt
a new zoning ordinance by July 21, 1999, the Developer will comply with the
provisions in the current zoning ordinance by September 21, 1999.
4. ADOPTION OF NEW ZONING ORDINANCE: If the City adopts a new zoning
ordinance prior to July 21, 1999, the Developer will comply with the provision
therein pertaining to in-ground irrigation systems and rooftop screening within sixty
(60) days of its adoption, regardless of its effective date.
5. IRREVOCABLE LETTER OF CREDIT: Developer agrees to extend irrevocable
Letter of Credit No. 0080-2 issued by Security Bank and Trust Company, Glencoe,
Minnesota ("Bank") until September 21, 1999 and to extend the coverage of the
Irrevocable Letter of Credit to provide for compliance with the terms of this

Agreement as set forth herein. Developer shall, within five (5) days from the
execution of this Agreement by both parties, provide the Bank by certified mail-return
receipt requested, a copy of this Agreement. Developer shall provide City with a
copy of the postal receipt as evidence that the Bank has been advised that its
Irrevocable Letter of Credit No. 0080-2 has been extended to assure compliance with
this Agreement, including any costs the City may incur to enforce the terms of this
Agreement.
IN WITNESS WHEREOF, the City and Developer have executed this Agreement as of
the day and year first set forth above.

Construction 70 Plans
Required Changes
General Plan Revisions:
1. The plan must identify the location of any utility equipment located outside of the
building. If this equipment is located on the roof, it must be screened from view, and
the plans must identify the screening.
2. The trash enclosure must have a roof.
3. A lighting plan is required. All lighting must meet the provisions outlined on the
attached sheet.
4. The fire hydrants in the area must be identified on the survey so we can determine
if all parts of the building are located within 150' of a hydrant. If the building is not
adequately covered, an additional hydrant may be required.
5. The landscaping plan must be revised to include the following information:
a) A legend detailing, the type, number and size of each planting.
b) The plan must be drawn to scale and the scale indicated on the plan.
c) The plan must be signed by a registered landscape architect.
d) Any area on the site which is not landscaped or covered by building or parking
must be sodded.
e) An irrigation plan must be included as part of the landscaping plan.
t) A total of 30 perimeter trees are required. Deciduous canopy trees must be at
least 2 1/2 caliper inches in diameter (measured 6" above grade), and coniferous
trees must be at least 6' tall. Ornamental trees 1 3/4" in diameter may be
substituted for canopy trees at a ratio of 2 ornamental trees for each required
canopy tree. At least 10% of the canopy trees and deciduous trees must exceed
the minimum size (to 3 1/2" caliper and 8' high respectively).
g) Landscape islands shall be at least 5% of any parking area over 6,000 square
feet. Our review of your plans indicate at least one more landscape island in the
front parking area is required.
Building Permit Requirements:
1. A certificate of survey showing the building, setbacks, parking areas, and elevations
is required as part of the building permit application.
2. Separate permits will be required for any signage on the building. Signage will be
permitted according to the attached requirements.
3. Two sets of the structural plans, signed by a structural engineer, are required as part
of the building permit application.

loading docks or other means of handling materials brought to or
removed from the site shall be on those sides of buildings which do
not fac_e any roadway or proposed roadway.
6. Utility Equipment: All utility equipment, such as heating and
-ventilating equipment, meters and other devices shall be completely
screened from eye-level view of adjacent residential properties and
streets. If on the ground, the equipment shall be screened with a
screen wall, berm or landscaping. If on the roof, the equipment shall
be screened with a parapet or screen wall of materials compatible
with the principal structure. Vertical or horizontal wood slats, fencing
or similar materials are not an acceptable screening material.

7. Trash Handling: Dumpsters, trash, trash handling equipment and
recycling equipment shall be stored within the principal structure, or
within an accessory structure of the same materials as the principal
structure which is completely enclosed with closed doors and a roof.
8. Lighting: Lighting fixtures shall be of a downcast, cutoff type,
e-oncealmg the light source from view and preventing glare from
spilling into residential areas. Lighting levels shall be measured in
foot candles five feet (5') off the ground or floor level. The following

(a) Wall Signs: Each principal building shall be allowed wall
signage equal to ten percent (10%) of the area of the front building
elevation facing a public street. No individual sign may exceed two
hundred (200) square feet.

For multi-tenant buildings with individual tenant entrances, all
signage must be part of a master sign plan submitted and approved
by the City showing the location and size of all proposed signs in
relation to each exterior elevation and which coordinates the signage
of the building in a consistent and harmonious fashion. Such plan
shall be drawn to scale and indicate building as well as individual
sign locations and dimensions. For multi-tenant buildings with tenant
entrances on a side of the building not facing a public street,
additional signage on these building faces will be allowed up to five
percent (5%) of the area of the front building elevation.

(b) Freestanding Signs: One freestanding sign per principal
building is permitted in addition to wall signs. The freestanding sign
may be no higher than six feet (6') above natural grade and no more
than eighty (80) square feet in area per side, with a maximum of two
(2) sides. Such signs shall not be located within a thirty foot (30')
clear view triangle on corner lots and shall be set back a minimum of
ten feet (10') from the property line or right-of-way line, whichever is
greater. (Setback measurement will be determined from the closest
part of the sign to the property or right-of-way line.)
(c) Directional Signs: Each property shall be allowed three (3)
directional signs of no more than six (6) square feet in area and no
taller than four feet (4') above natural grade. Such signs may be
placed near a driveway and shall be set back five feet (5') from the
street right of way. The purpose of directional signs is to indicate

entries and exits, office locations and other information necessary to
.direct people to areas on site.
(d) Address Numbers: Address numbers no taller than twelve
inches (12") high nor less than four inches (4") are required on each
building for identification purposes.
(e) Ground Monument Sign: One common ground monument
sign shall be allowed at each major entrance into the Business Park
for the sole purpose of identifying the Business Park and/or listing
the businesses therein. Such sign may be no higher than ten feet
(10') above natural grade and no more than one hundred twenty
(120) square feet in area with a maximum of two (2) sides. Such
signs shall not be located within a thirty foot (30') clear view triangle
on corner lots and shall be set back a minimum of ten feet (10') from
the property line or right-of-way line, whichever is greater. (Setback
measurement will be determined from the closest part of the sign to
the property or right-of-way line.)
10. Noxious Matter: The emission of noxious matter shall be
controlled so that no such emission crosses the lot line of the
property from which it originates. Noxious matter shall mean any
solid, liquid or gaseous material, including but not limited to gases,
vapors, odor, dusts, fumes, mists or combinations thereof, the
emission of which is detrimental to or endangers the public health,
safety, comfort or general welfare, or causes damage to property.
The owner of the property and/or the manager of the business shall
comply with a regular inspection schedule as approved by the City
and shall submit reports of such inspections to the City.

11. Restricted Operations: Uses which are accompanied by an
excess of noise, vibration, dust, dirt, smoke, odor, noxious gases,
glare or wastes shall not be permitted. Noise, odors, smoke and
particulate matter shall not exceed Minnesota Pollution Control
Agency standards. Glare, whether directed or reflected, such as from
spotlights or high temperature processes, as differentiated from
general illumination, shall not be visible beyond the lot line of the
property from which it originates.
12. Exceptions For Legal Nonconforming Structures: For properties
with existing development that are rezoned to BP, the following
exceptions will apply.
(a) For legal nonconforming structures in a BP district, new
construction projects for repairs, remodeling or additions to the

structure do not need to meet the standards in this Chapter if the
construction increases the size of a structure by less than ten
percent (10%) or if it increases the assessor's market value by less
than twenty percent (20%). If the construction project increases the
size of a structure between ten percent (10%) and fifty percent (50%)
or if it increases the assessor's market value between twenty percent
(20%) and fifty percent (50%), all the standards in this Chapter do
not need to be met, but will be required to meet a reasonable
proportion of the requirements as determined by the DRC.
(b) For the purposes of determining compliance with the
standards in this Chapter, site work not involving the structures on
site shall be considered separately from work on the structures. For
legal nonconforming uses in the BP District, new construction
projects for repairs, remodeling or additions to the parking lot,
outdoor spaces, landscaping or other exterior areas do not need to
meet the standards in this Chapter if the construction increases the
size of these areas by less than ten percent (10%). Construction
projects involving an expansion of an exterior area between ten
percent (10%) and fifty percent (50%) need not meet all the
standards of this Chapter, but will be required to meet a reasonable
proportion of the requirements as determined by the DRC. For the
purposes of this subsection (H)12(b), adding one inch (1 ") or more of
new material to an existing parking lot surface shall be considered
an increase of one hundred percent (100%) of the area involved.

shell of the building and six for tenant finishes. All of the permits have been finaled and
files closed. The Planning Department has escrow moneys on the landscaping and
outstanding ordinance deficiencies for the shell of the building, permit #97-388. Planner
Jenni Tovar has information on the outstanding items.
Presently there is a tenant business that is occupying a space that does not have a tenant
finish permit. Owner Dave Hanson has been contacted and will apply for a permit.

An inspection on November 10 found the site to be in compliance with the City's
landscape ordinance. While one tree is not planted (on the south side of the
property), the site contains the minimum number of 30 trees required.
Additionally, 23 of the required trees were planted prior to December 12, 1997.
The following details the requirements for a LaC on the irrigation agreement:

Ordinance, assuming the revisions eliminating/reducing irrigation and roof-top
screening are adopted.
I have spoken with Mr. Hansen today about this and he concurs with the

My inspections are complete and my landscape is complete. The letter of credit on file (I
believe it's for $17,000) should be reduced to approximately $7,000 to "cover" the "variance"
amounts for rooftop screening and the in-ground watering system.
Mr. Boyles is in receipt of my screening bid. The in-ground water bid is under $3,000. It totals
less than $6,500.
I must have this Occupancy Certificate immediately. I lost my main permanent lender due to
the lack of the Certificate of Occupancy.

Landscaping is not installed according to plan. Attached is a letter sent to
Mr. Hansen regarding missing and dead trees. typical/y, we have not
issued Certificates of Occupancy until all of the plantings are installed and
alive. The LOC on file is for $17,500 and expires in February 1999.
Considering Mr. Hansen will be replanting his trees in the spring of 1999, I
have asked him for a 6 month extension on his LOC. The landscape
sprinkling has not been installed. A sprinkling system would cost about
$5,000 ($3000 for Hechter's site, $8800 for PL Baptist Church). The
security for the irrigation would be a Letter of Credit (per Ordinance). The
$3200 estimate for roof-top screening is adequate.

Dear Mr. Hansen,
The City has reviewed your revised landscape plan. The plan is no consistent with the
minimum standards set forth in the landscape ordinance. On October 8, a site
inspection was conducted to verify if the planting was completed. The following were
not planted:
· 2 Bonus trees on south side.
· 1 Colorado Blue Spruce located on south side adjacent to loading dock area.
The following were dead:
· 2 Six foot Colorado Spruce trees located along the north west lot line.
· In addition, you have noted that additional trees are dead, and all of the dead
coniferous trees will be replaced in the spring.
We cannot issue a certificate of Occupancy until the dead trees are replaced and all of
the trees are planted according to your approved plan. If you are intending on
replanting the coniferous trees in the spring, your Letter of Credit (LOC) must be
extended until after the trees are to be planted. The LOC on file expires in February
1999. I would suggest the LOC is extended for six months (August 1999) or until a date
when you plan to have all of the trees planted and alive on the site. In addition, the
Planning Department recognizes you are working with the City on resolving the roof-top
screening and irrigation issues as directed by the City Council.

At their September 21, 1998 meeting the City Council directed that the staff:
1. Prepare an agreement with Dave Hansen which confirms he will comply with the
existing or new City ordinances relating to irrigation and rooftop screening for
property at 17001 Fish Point Road subject to proper security and within 90 days of
the new ordinance's adoption but in no case longer than 12 months from September
21, 1998.
2. Provide Dave Hansen with documentation showing he will obtain a permanent
occupancy agreement upon entering into the above agreement.
The purpose of this letter is to address both directions.
The agreement is in preparation. I will share it with you once it is complete. As to
security deposit, the $17,500 irrevocable letter of credit number 0080-2 will fulfill our
needs provided it is extended to September 21, 1999. This action is in conformance with
the City Council's direction that the matter be resolved no later than twelve months from
the date of Council approval.
If you will arrange for the security extension, I will forward the proposed agreement to
you as soon as I receive it.

This following is in response to the Punchlist Letter of November 24, 1997:
1. Provide parking lot striping and all signs per approved plans -- Spring work
after final lift.
2. Provide bituminous wear course on parking lot per the approved plans --
Spring work.
3. Provide a mylar "as-built" survey of the entire site ... -- Surveyor working on
"as-builts" .
4. Establish turf on entire site per the approved plans -- sod not available in fall,
entire site seeded, north side seeded with DNR seed.
5. Grade swale along south and east side of property ... - Done
6. Remove stockpile of material on City property just west of site ... -- No
material on west. Mr. Friedges from the City of Prior Lake told Dave Hansen he
would take east stockpile for park use.
7. Grade pond on north side of property to match Sheet C-1. Provide actual
survey of pond and call the Engineering Department ... :-- Pond size was not
changed, see "as-built" survey.
8. Remove all debris from the entire site and adjacent properties ... -- Done

Dear Mayor Andren:
I am writing this letter regarding your ordinance pertaining to and requiring that I install a
lawn sprinkler system with the new office/warehouse I'm building at 17001 Fish Point Road
SE in Prior Lake.
First, I don't need it. This system is totally unnecessary. Most of my plantings, trees, etc., shall
be of the evergreen and pine type, which require "personal" watering, etc.
Second, lawn sprinkler systems are a grotesque waste of water! Today, we are trying to
conserve and preserve our most important natural resource -- water. We require toilets that
only use one and one half, gallons to flush (they don'~ work, but the idea is there). We use
"saver"'shower heads, etc: Why would you pass an ordinance to promote wasting water?
Sprinkler systenis are horribly inefficient. I see precious water running down the gutter
wherever they're used. It's just a "lazy" way to accomplish ajob and we pay for it by "waste."
I cannot install this system on my projecUproperty. It's totally against my attitude to conserve
and preserve our precious water.
May I suggest to Prior Lake to repeal this ordinance which promotes, and forces us to waste,
and misuse our water supply. This ordinance is defmitely not needed.

RE: Landscape Plan
Dear Mr. Hansen,
The City has reviewed your revised landscape plan. There is no irrigation shown
on the plan, however, this is being dealt with by your variance application to
waive the requirement. The site requires 30 trees, with atleast 3 oversized trees.
The plan indicates 9 oversized trees. While the total number of trees on the lot,
is 32, credit is only given for certain size and species of trees as stated in the
Landscape Ordinance. The total number of trees given credit for is 22.
The ornamental crab apples are counted as % a tree and the 5' Colorado Spruce
trees must be a minimum of 6' tall. All deciduous trees (River Birch) must be 2%
caliper inches to be given credit for. Weeping Willows are not on the list as
required trees. Therefore, you must revise your plan to show an additional 8
trees that will be planted. Once we receive the plan, we will review it and then
the plantings must be installed, along with resolving the roof-top screening and
irrigation issues, prior to issuance of a Certificate of Occupancy.

The Development Review Committee has completed review of revised plans submitted
August 4,1997 and all additional required information. Your site plan has been
approved with the following conditions:
1. Fire hydrant located on the west side of the building along Fish Point Road must be
relocated to the landscape island located at the northwest corner of the building to
provide additional fire hydrant coverage. You must submit revised plans.
2. The original letter of credit for the landscaping has not been received. I understand
that it has been mailed, and your approval is based on the fax copy received and the
original being mailed.
3. Please be aware that separate sign permits will be required.
The Planning Department has also approved your building permit. Please contact Paul
Baumgartner regarding the status of Building and Engineering approval. Thank you for

General Plan Revisions:
1) The irrigation system is to be designed by a subcontractor. We will submit an
irrigation plan for your records at a later date. .
2) Trash enclosure will have a roof. Architect is dropping off a R'an this morning.
3) Lighting plan and fixture information has been submitted to you.
4) We added a fire hydrant as requested and is shown on the plans that were
resubmitted last week.
5) Revised landscape plan has been submitted to you last week.
6) Dave Hansen's bank is faxing over a letter of Credit for 125% of the landscapel
irrigation costs.

1) Certificate of Survey -- we have submitted to you a signed Civil Engineered
Survey/Site Plan showing building setbacks, parking areas, :and elevations. We
have hired a professional surveyor to layout the building and site. We will fax you
a letter from Paramount Engineering & Design as requested !by Don Rye.
2) Tenants will be required to submit for individual sign permits. .

General Plan Revisions:
1. The plan must identify the location of any utility equipment located outside of the
building. If this equipment is located on the roof, it must be screened from view, and
the plans must identify the screening.
2. The trash enclosure must have a roof matching the principal building.
3. A lighting plan was submitted, however please provide us with drawings of the light
fixtures/shields.
4. The fire hydrants in the area must be identified on the survey so we can determine if
all parts of the building are located within 150' of a hydrant. If the building is not
adequately covered, an additional hydrant may be required.
Building Permit Requirements:
1. A certificate of survey showing the building, parking areas, and elevation is required
as part of the building permit application.

Based on yesterday's inspection, the following issues need to be
submitted/addressed prior to Planning Department approval/sign off:
. Landscape must be installed per approved Landscape Plan or a
revised landscape plan, signed by a registered landscape architect,
must be submitted and approved. A letter of credit is on file for the
landscaping, however the plantings in the field are not reflective of the
approved plan.
. All landscaped areas must be irrigated. Irrigation must be installed per
the approved landscape plan and City Code or a variance must be
granted. All disturbed areas are to be finished with sod/seed as per
approved plan. Natural areas are to be free of obnoxious weeds.
. All roof top units are to be screened per City Code.

Dear Mr. Feider,
The City received your site plan application on July 14, 1997. The Development Review
Committee (DRC) reviewed your site plan on July 17, 1997 and subsequently informed
you of necessary changes prior to site plan approval. On July 31, 1997 the City received
a building permit application for the proposed structure. Unfortunately, the City cannot
issue a building permit until your site plan has been approved by the DRC.
Our conversation today indicated that you have made the necessary changes with the
exception of an irrigation plan and trash enclosure roof. If your irrigation system is to be
designed by a subcontractor, please state this on the landscape plan with language relating
of the submittal of an irrigation plan by your subcontractor at a later date. Your plans
must include a roof on the trash enclosure for approval. I have enclosed the checklist sent
to you on July 17, 1997 noting the required changes.
We need two full size copies to review at Thursday's DRC meeting (8/7/97). These must
be submitted by Monday, August 4, 1997. If all of the necessary changes have been
corrected on the plans, then the DRC will issue a letter of site plan approval along with
approval stamps on a set of the plans for your records. This should not delay the building
permit review of your application. However, if the necessary changes are not done, then
approval will be pending plan changes

5. We didn't touch the pond or any of the shoreline. Final survey was sent to Prior Lake.
We used a 3" slope on the north side so as not to intrude on the pond at all. We
established turf and the slope is erosion free. If any erosion does occur in future (I
seriously doubt it) I will correct with flat, fitted stones.
7. All disturbed areas are corrected.
8. All flush valves are flush with surface.
9. Hydrants will have hydra-finder flags.
Plannina (;ommis.~ion Punch List:
1. All landscape is completed and signed ofT by James Freeman, Designer/Planner for
Carver Nursery. The two "field plantings" are weeping willows and not included in the
"mandatory" plantings. Let's call them a gift to the pond! An irrigation system will not
be installed. In speaking with Mayor Mader, I understand the City has an alternate
plan (an escrow to assure landscape?). Please advise.
2. Rooftop units shall be painted, if City desires, instead of screening.
3. Parking lot all striped and completed.

Construction 70 Plans
Required Changes
General Plan Revisions:
1. The plan must identify the location of any utility equipment located outside of the
building. If this equipment is located on the roof, it must be screened from view, and
the plans must identify the screening.
2. The trash enclosure must have a roof.
3. A lighting plan is required. All lighting must meet the provisions outlined on the
attached sheet.
4. The fire hydrants in the area must be identified on the survey so we can determine
if all parts of the building are located within 150' of a hydrant. If the building is not
adequately covered, an additional hydrant may be required.
5. The landscaping plan must be revised to include the following information:
a) A legend detailing, the type, number and size of each planting.
b) The plan must be drawn to scale and the scale indicated on the plan.
c) The plan must be signed by a registered landscape architect.
d) Any area on the site which is not landscaped or covered by building or parking
must be sodded.
e) An irrigation plan must be included as part of the landscaping plan.
t) A total of 30 perimeter trees are required. Deciduous canopy trees must be at
least 2 1/2 caliper inches in diameter (measured 6" above grade), and coniferous
trees must be at least 6' tall. Ornamental trees 1 3/4" in diameter may be
substituted for canopy trees at a ratio of 2 ornamental trees for each required
canopy tree. At least 10% of the canopy trees and deciduous trees must exceed
the minimum size (to 3 1/2" caliper and 8' high respectively).
g) Landscape islands shall be at least 5% of any parking area over 6,000 square
feet. Our review of your plans indicate at least one more landscape island in the
front parking area is required..
Building Permit Requirements:
1. A certificate of survey showing the building, setbacks, parking areas, and elevations
is required as part of the building permit application.
2. Separate permits will be required for any signage on the building. Signage will be
permitted according to the attached requirements.
3. Two sets of the structural plans, signed by a structural engineer, are required as part
of the building permit application.

Dear Mr. Hansen:
Mayor Mader has referred your July 24 letter to me. I understand you have suggested that
you would be willing to place an escrow deposit with the City to guarantee the necessary
rooftop screening and in-ground sprinkler requirements following adoption ofthe new
zoning ordinance.
The City would consider your proposal under the following conditions:
. The escrow amount is based upon bids provided by you for rooftop screening and in
ground landscape sprinkling as required under the present ordinance to serve the roof
and landscape areas shown on your approved plans. Bids to be approved by the City
Engineer.
. You will provide the City with a certified check in the amount of 125% ofthe bid
amount as the escrow deposit.
. Any work required by the new City ordinance would have to be completed within 90
days of the effective date of the new ordinance.
. The escrow will be released upon approval of the required work by the City. The
escrow agreement will provide that after 90 days, if you have failed to install the
required equipment the City will install the rooftop screening and in-ground
sprinkler. You will provide the City with a non-revocable right of entry to install the
improvements, if necessary.
. You will reimburse the City for all legal fees incurred in connection with preparation
of the necessary documents to secure this transaction.

I believe I may have the solution to "our" variance problem.
I suggest that I place some funds in escrow with the City (Prior Lake already does
do this) to:
1) Do the necessary items requested by the "new" ordinance pertaining to
rooftop fencing -- when it is finally adopted.
2) Perform the requirements adopted in lieu of In Ground Sprinkler Systems
when that ordinance is finalized.
I will do the necessary tasks immediately upon request by the City when the
ordinances are finalized. I will sign your document to this effect.
I must receive my Certificate of Occupancy immediately.

TodaYt I am applying for the two variances I have requested through the normal channels with
the Planning Commission etc. I am submitting a three hundred fIfty dollar fee (which I fully
intend to be reimbursed) to initiate a hearlnglpreventation to obtain the two variances.
rm aware the City of Prior Lake is in the process of pursuing changest modifications, etc., in
these ordinancest but I need my Certificate of Occupancy ASAP. It may take the City months
to fmalize goodt workable ordinances.
As for the roof top unitst I would certainly paint the units. If the City desires and if the City
feels it would create a "cosmetic plus."
The in-ground watering system is totally unnecessary and extremely wasteful. - My
landscape/trees are all in. I certainly will replace any dead trees (I have three to replant at this
moment) and I certainly agree to maintain my topography in an excellent manner.

Dear Mayor Mader:
I am in receipt of your letter dated July 13, 1998. Thank you for your response.
I still feel strongly that the City of Prior Lake should grant me "voluntary" variances on both the
rooftop fencing question and the inground watering system.
These are "outdated" and "improper" ordinances that should, and are, going to be modified or
discarded anyway! It would be absolutely unfair to expect me to pay for a hearing on an ordinance
that is going to be changed!
I'm not asking for variances on well-defined, sensible, everyday, workable ordinances (like setback
or density, etc.), which ~hould go through the proper channels.
Knowing that these two ordinances are going to be changed/modified, etc., the City of Prior Lake
should have volunteered to help me! "Voluntary" variances by the City of Prior Lake are
reasonably, fair, and should have been offered by Prior Lake without any further delay.
Is this something personal with Prior Lake toward me? Did Dave Hansen have the audacity to tell
Prior Lake about two ordinances that need attention and changes? Maybe Prior Lake should thank
me!
Where is this "Welcome builder" or sensible ''work with me" attitude that I feel should exist?
Please stand back and look at these two ridiculous ordinances being focused upon. Need I say
more. The City of Prior Lake is. changing them. .
It would be fair, reasonable, equitable, and very proper and very easy to issue me two voluntary
variances ASAP.
I must receive my certificate of occupancy immediately. All work is complete on this building.

As noted to you during our telephone conversation this past
week, the City Council is currently in the process of
revising our zoning ordinance. The changes being proposed
may affect your property in Prior Lake, so you may wish to
get a copy of the proposed draft. Please be reminded,
however, that the proposed changes must still go through a
public hearing process and final action by the Council
before becoming law.
It is my understanding that although you have expressed an
opinion that the Council should grant variances on your
property, you have not submitted a variance request as
required. If you wish to have the Council consider
variances prior to enactment of a new ordinance, you will
need to submit an appropriate variance request.

Dear Mayor Mader:
I am "miffed" by the response from City Manager, Frank Boyles on my request for "voluntary"
variances on my office/warehouse building.
Your City Attorney seems to think a variance would "waive" the current zoning ordinance
requirement! (See letter copy)
First, this has nothing to do with zoning. Second, the Fencing Ordinance is purely cosmetic!
And, you're going to modify it anyway. Third, variances are given every day in many
communities. They do not waive the ordinance, a variance basically shows COMMON SENSE
being used when a specific ordinance is not broad enough or lends itself poorly to a specific
situation.
I need my certificate of occupancy now. You, Mr. Mayor, and the City Council of Prior Lake
have the authority to issue me the two variances I need.
I feel these variances should be given voluntarily by the City of Prior Lake. And, I hope
quickly.
Certainly, you feel the out-of-date fencing ordinance should be modified to a large extent. The
"Mandatory" watering system is absurd. There should be no question about it!

Your June 15 letter reminded me to provide you this update on the Council's progress in
reviewing the proposed zoning ordinance.
The Council has completed their review of this document. On June 23, they will conduct
what I hope will be their last meeting on this subject to resolve some of the policy issues
they set aside from the earlier meetings. Once they have resolved those policy issues the
document will be prepared for the public hearings which are required to adopt the
ordinance.
With respect to the two issues you have raised their present status is:
RooftoP HV AC Units
The ordinance requirements presently effective for the Business Park will be deleted and
replaced with language which applies to all zoning districts. The new language still
requires screening but allows alternate methods such as painting units to match adjacent
exteriors.
Landscaping Sprinkling
This item is scheduled for discussion at the June 23 meeting.
I know that you are anxious to obtain your certificate of occupancy. Weare working hard
to complete these revisions expeditiously. Unfortunately, my earlier estimate that the
final adoption of the ordinance is would occur in three months is still accurate. However
the effective date is likely to be four to six months because the Council wants to provide a
grace period before the ordinance becomes effective.

Thank you for your letter of May 7, 1998. I do wish to resolve these matters
ASAP.
In my letter to Mayor Mader I requested voluntaIy variances regarding the
rooftop fencing and landscape sprinkling. I still feel tbis would be very
appropriate.
I certainly don't think any variance would "waive" an ordinance. However, I do
feel it would display common sense to realize that vast changes have occurred
over time that render some ordinances out of date!
I need my certificate of occupancy immediately! I cannot mortgage the property,
etc., without it. I feel the variances would be sensible, show good common sense,
and display a good "builder-friendly" attitude to someone who was "invited in
to build."
I will look for a favorable and timely reply.

Dear Mr. Hansen:
Mayor Mader shared your letter with me and asked that I respond.
As you may be aware, the City Council is reviewing the new zoning ordinance which we
intend to implement as soon as possible. Shown below is the status of the topics for
which you have proposed changes:
RoofTop HV AC Screening
The Council discussed these requirements at their April 28 work session. They agreed to
relax rooftop screening requirements by deleting the existing, more aggressive, Business
Park rooftop language and replacing it with the language which applies to all other
districts (copy of new language attached). Under the new language screening is still
required but acceptable screening includes painting HV AC units to match adjacent
exterior surfaces.
Landscape Sprinkling
The City Council has not yet discussed this subject as part oftheir zoning ordinance
review. I expect that they will in the near future. In light of our new water restrictions the
Council may consider whether any modifications are appropriate.
Until the new zoning ordinance is adopted, the existing one is law. I know you are
interested in seeing that these revisions are implemented quickly. I spoke with the
attorney about what we might do to expedite these changes.
The attorney agrees that it would be inappropriate for us to waive the current zoning
ordinance requirements in anticipation of the new ordinance requirements. Instead it
would be more appropriate to wait until the new ordinance is passed (probably within the
