(hereinafter "Property"); and '\VHEREAS, Developer's application for variances to the Property to waive the requirements for in-ground irrigation of landscaped areas and rooftop screening was denied by the Board of Adjustment on August 24, 1998; and WHEREAS, Upon Developer's appeal of the Board of Adjustment decision to the City Council, the City Council on September 21, 1998 upheld the decision of the Board of Adjustment; and WHEREAS, The City has prepared a new zoning ordinance which will be considered by the Prior Lake City Council wherein the provisions dealing with in- ground irrigation systems and rooftop screening differ from those L:\98FILES\98V AR\98-093\HANSONAG.DOC 1 provisions in the current zoning ordinance; and WHEREAS, In considering the Developer's appeal from the denial for the variance it . had applied for, the City Council found the hardship criteria for granting a variance from the current zoning ordinance did not exist and the Developer's request for a variance was premised mainly on economic and policy considerations; and WHEREAS, . The City Council recognizes the costs to comply with the provisions in the current zoning ordinance pertaining to in-ground irrigation systems and rooftop screening may exceed the costs to comply with the applicable corresponding provisions proposed in the new zoning ordinance currently under consideration; and WHEREAS, The City Council at the present time believes final action on the proposed new zoning ordinance will be completed by December 7, 1998 and the ordinance will become effective sixty (60) days thereafter; and WHEREAS, The City Council agrees that it would be reasonable for the City and Developer to await the contemplated adoption of the new zoning ordinance as it relates to the provision described herein, rather than requiring Developer to immediately comply with the provisions in the current ordinance. NOW THEREFORE, in consideration of the mutual promises and covenants set forth herein, the sufficiency of which is not disputed, the City and Developer agree as follows: 1. RECITALS: forth. The recitals set forth above are incorporated herein as if fully set 2. NEW ZONING ORDINANCE: The City has until July 21, 1999 to adopt a new zoning ordinance. 3. FAILURE TO ADOPT NEW ZONING ORDINANCE: If the City fails to adopt a new zoning ordinance by July 21, 1999, the Developer will comply with the provisions in the current zoning ordinance by September 21, 1999. 4. ADOPTION OF NEW ZONING ORDINANCE: If the City adopts a new zoning ordinance prior to July 21, 1999, the Developer will comply with the provision therein pertaining to in-ground irrigation systems and rooftop screening within sixty (60) days of its adoption, regardless of its effective date. 5. IRREVOCABLE LETTER OF CREDIT: Developer agrees to extend irrevocable Letter of Credit No. 0080-2 issued by Security Bank and Trust Company, Glencoe, Minnesota ("Bank") until September 21, 1999 and to extend the coverage of the Irrevocable Letter of Credit to provide for compliance with the terms of this L:\98FILES\98V AR\98-093\HANSONAG.DOC 2 ~ Agreement as set forth herein. Developer shall, within five (5) days from the execution of this Agreement by both parties, provide the Bank by certified mail-return receipt requested, a copy of this Agreement. Developer shall provide City with a copy of the postal receipt as evidence that the Bank has been advised that its Irrevocable Letter of Credit No. 0080-2 has been extended to assure compliance with this Agreement, including any costs the City may incur to enforce the terms of this Agreement. The plan must identify the location of any utility equipment located outside of the building. If this equipment is located on the roof, it must be screened from view, and the plans must identify the screening. 2. The trash enclosure must have a roof. 3. A lighting plan is required. All lighting must meet the provisions outlined on the attached sheet. 4. The fire hydrants in the area must be identified on the survey so we can determine if all parts of the building are located within 150' of a hydrant. If the building is not adequately covered, an additional hydrant may be required. 5. The landscaping plan must be revised to include the following information: a) A legend detailing, the type, number and size of each planting. b) The plan must be drawn to scale and the scale indicated on the plan. c) The plan must be signed by a registered landscape architect. d) Any area on the site which is not landscaped or covered by building or parking must be sodded. e) An irrigation plan must be included as part of the landscaping plan. t) A total of 30 perimeter trees are required. Deciduous canopy trees must be at least 2 1/2 caliper inches in diameter (measured 6" above grade), and coniferous trees must be at least 6' tall. Ornamental trees 1 3/4" in diameter may be substituted for canopy trees at a ratio of 2 ornamental trees for each required canopy tree. At least 10% of the canopy trees and deciduous trees must exceed the minimum size (to 3 1/2" caliper and 8' high respectively). g) Landscape islands shall be at least 5% of any parking area over 6,000 square feet. Our review of your plans indicate at least one more landscape island in the front parking area is required. Building Permit Requirements: 1. A certificate of survey showing the building, setbacks, parking areas, and elevations is required as part of the building permit application. 2. Separate permits will be required for any signage on the building. Signage will be permitted according to the attached requirements. 3. Two sets of the structural plans, signed by a structural engineer, are required as part of the building permit application. Utility Equipment: All utility equipment, such as heating and -ventilating equipment, meters and other devices shall be completely screened from eye-level view of adjacent residential properties and streets. If on the ground, the equipment shall be screened with a screen wall, berm or landscaping. If on the roof, the equipment shall be screened with a parapet or screen wall of materials compatible with the principal structure. Vertical or horizontal wood slats, fencing or similar materials are not an acceptable screening material. ~ 7. Trash Handling: Dumpsters, trash, trash handling equipment and recycling equipment shall be stored within the principal structure, or within an accessory structure of the same materials as the principal structure which is completely enclosed with closed doors and a roof. 8. Lighting: Lighting fixtures shall be of a downcast, cutoff type, e-oncealmg the light source from view and preventing glare from spilling into residential areas. Lighting levels shall be measured in foot candles five feet (5') off the ground or floor level. 't~.,{~ '; ~, (a) Wall Signs: Each principal building shall be allowed wall signage equal to ten percent (10%) of the area of the front building elevation facing a public street. No individual sign may exceed two hundred (200) square feet. r:: For multi-tenant buildings with individual tenant entrances, all signage must be part of a master sign plan submitted and approved by the City showing the location and size of all proposed signs in relation to each exterior elevation and which coordinates the signage of the building in a consistent and harmonious fashion. Such plan shall be drawn to scale and indicate building as well as individual sign locations and dimensions. For multi-tenant buildings with tenant entrances on a side of the building not facing a public street, additional signage on these building faces will be allowed up to five percent (5%) of the area of the front building elevation. t .. 1 ! , (b) Freestanding Signs: One freestanding sign per principal building is permitted in addition to wall signs. The freestanding sign may be no higher than six feet (6') above natural grade and no more than eighty (80) square feet in area per side, with a maximum of two (2) sides. Such signs shall not be located within a thirty foot (30') clear view triangle on corner lots and shall be set back a minimum of ten feet (10') from the property line or right-of-way line, whichever is greater. (Setback measurement will be determined from the closest part of the sign to the property or right-of-way line.) (c) Directional Signs: Each property shall be allowed three (3) directional signs of no more than six (6) square feet in area and no taller than four feet (4') above natural grade. Such signs may be placed near a driveway and shall be set back five feet (5') from the street right of way. The purpose of directional signs is to indicate 695 City of Prior Lake 5-5-15 5-5-15 entries and exits, office locations and other information necessary to .direct people to areas on site. (d) Address Numbers: Address numbers no taller than twelve inches (12") high nor less than four inches (4") are required on each building for identification purposes. (e) Ground Monument Sign: One common ground monument sign shall be allowed at each major entrance into the Business Park for the sole purpose of identifying the Business Park and/or listing the businesses therein. Such sign may be no higher than ten feet (10') above natural grade and no more than one hundred twenty (120) square feet in area with a maximum of two (2) sides. Such signs shall not be located within a thirty foot (30') clear view triangle on corner lots and shall be set back a minimum of ten feet (10') from the property line or right-of-way line, whichever is greater. (Setback measurement will be determined from the closest part of the sign to the property or right-of-way line.) 10. Noxious Matter: The emission of noxious matter shall be controlled so that no such emission crosses the lot line of the property from which it originates. Noxious matter shall mean any solid, liquid or gaseous material, including but not limited to gases, vapors, odor, dusts, fumes, mists or combinations thereof, the emission of which is detrimental to or endangers the public health, safety, comfort or general welfare, or causes damage to property. The owner of the property and/or the manager of the business shall comply with a regular inspection schedule as approved by the City and shall submit reports of such inspections to the City. . . I , t " I 11. Restricted Operations: Uses which are accompanied by an excess of noise, vibration, dust, dirt, smoke, odor, noxious gases, glare or wastes shall not be permitted. Noise, odors, smoke and particulate matter shall not exceed Minnesota Pollution Control Agency standards. Glare, whether directed or reflected, such as from spotlights or high temperature processes, as differentiated from general illumination, shall not be visible beyond the lot line of the property from which it originates. 12. Exceptions For Legal Nonconforming Structures: For properties with existing development that are rezoned to BP, the following exceptions will apply. (a) For legal nonconforming structures in a BP district, new construction projects for repairs, remodeling or additions to the 896 City of Prior Lake 5-5-15 5-5-16 structure do not need to meet the standards in this Chapter if the construction increases the size of a structure by less than ten percent (10%) or if it increases the assessor's market value by less than twenty percent (20%). If the construction project increases the size of a structure between ten percent (10%) and fifty percent (50%) or if it increases the assessor's market value between twenty percent (20%) and fifty percent (50%), all the standards in this Chapter do not need to be met, but will be required to meet a reasonable proportion of the requirements as determined by the DRC. (b) For the purposes of determining compliance with the standards in this Chapter, site work not involving the structures on site shall be considered separately from work on the structures. For legal nonconforming uses in the BP District, new construction projects for repairs, remodeling or additions to the parking lot, outdoor spaces, landscaping or other exterior areas do not need to meet the standards in this Chapter if the construction increases the size of these areas by less than ten percent (10%). Construction projects involving an expansion of an exterior area between ten percent (10%) and fifty percent (50%) need not meet all the standards of this Chapter, but will be required to meet a reasonable proportion of the requirements as determined by the DRC. For the purposes of this subsection (H)12(b), adding one inch (1 ") or more of new material to an existing parking lot surface shall be considered an increase of one hundred percent (100%) of the area involved. If you are intending on replanting the coniferous trees in the spring, your Letter of Credit (LOC) must be extended until after the trees are to be planted. The LOC on file expires in February 1999. I would suggest the LOC is extended for six months (August 1999) or until a date when you plan to have all of the trees planted and alive on the site. First, I don't need it. This system is totally unnecessary. Most of my plantings, trees, etc., shall be of the evergreen and pine type, which require "personal" watering, etc. Second, lawn sprinkler systems are a grotesque waste of water! Today, we are trying to conserve and preserve our most important natural resource -- water. We require toilets that only use one and one half, gallons to flush (they don'~ work, but the idea is there). We use "saver"'shower heads, etc: Why would you pass an ordinance to promote wasting water? Sprinkler systenis are horribly inefficient. I see precious water running down the gutter wherever they're used. It's just a "lazy" way to accomplish ajob and we pay for it by "waste." I cannot install this system on my projecUproperty. It's totally against my attitude to conserve and preserve our precious water. May I suggest to Prior Lake to repeal this ordinance which promotes, and forces us to waste, and misuse our water supply. There is no irrigation shown on the plan, however, this is being dealt with by your variance application to waive the requirement. The site requires 30 trees, with atleast 3 oversized trees. The plan indicates 9 oversized trees. While the total number of trees on the lot, is 32, credit is only given for certain size and species of trees as stated in the Landscape Ordinance. The total number of trees given credit for is 22. The ornamental crab apples are counted as % a tree and the 5' Colorado Spruce trees must be a minimum of 6' tall. The fire hydrants in the area must be identified on the survey so we can determine if all parts of the building are located within 150' of a hydrant. The Development Review Committee (DRC) reviewed your site plan on July 17, 1997 and subsequently informed you of necessary changes prior to site plan approval. On July 31, 1997 the City received a building permit application for the proposed structure. Unfortunately, the City cannot issue a building permit until your site plan has been approved by the DRC. Our conversation today indicated that you have made the necessary changes with the exception of an irrigation plan and trash enclosure roof. If your irrigation system is to be designed by a subcontractor, please state this on the landscape plan with language relating of the submittal of an irrigation plan by your subcontractor at a later date. Your plans must include a roof on the trash enclosure for approval. I have enclosed the checklist sent to you on July 17, 1997 noting the required changes.
