Larry, per your request, we have priced Frost Point work with two options:
2005 Mill overlay with random curb R1R. If we can schedule work with 150m
Street (milling curb, pave), we will do for the same unit prices as 150th Street's
bid schedule, except curb replacement at $1'9.00/LF and a $1,500.00
mobilization. \

Reconstruct per plan in 2006. Northwest Asphalt requests a 15% unit price
increase for labor, equipment, fuel and material increases and for production
loss. In addition, a $33,000.00 lump sum mobilization for equipment mobilization

Dear Mr. Poppler:
Our office has been retained to represent Salon Pacific and Joi Bohn, its owner. It is our
understanding that on July 8, 2005, the water service at Salon Pacific was shut off for the
day. My client further advises that she received the notice of such water shut off the day
prior. Due to this short notice, the Salon had to cancel many appointments that were
scheduled that day. The Salon averages 112 haircuts per day at $32 per cut, and that does
not include coloring, which would be an average of $100. They were able to perform a
few haircuts using water bottles.
I understand that the City has no liability in this matter; however, I am writing simply to
request that Salon Pacific be given as much advanced notice of a water shut off as
possible, so that it can avoid this problem again.

Dear Mr. Poppler:
If this pertains to Mr. Louwagle, please copy him on this. It pertains to the construction schedule
for Candy Cove Trail. The Construction Zone (see attached copy) was left on our door on
Friday, July 29th, leaving us no recourse but this letter, since we are leaving Monday, August 1st
at 6:00 AM for a trip and we will not return until Sunday Morning, August 7th.
The Construction Zone states that Curbing will start on Fairlawn on August 4th and that all cars
must be out by then and until 5 days later to let the cement cure. It also says that street
construction will begin on Candy Cove Trail on August 2nd and last two weeks. It says that
curbing there will begin there August 18th. Flagstaff Circle joins Candy Cove Trail, (and we
have really enjoyed having our car scrape its bottom at that point from time to time). Presumably
Our vehicles must be out somewhere else for 5 days, (from August 18th through August 23rd).
I have medical appointments on the evening of August 8th, Mayo Clinic Visit from August 14th
to August 16th or 17th and a Dental appointment the morning of August 18th. I WILL GO TO
THESE APPOINTMENTS, but I think your schedule will permit our passage. The real sticker is
a Motor Home Rally in Wisconsin for which we have had long-term reservations. We must keep
the RV plugged in to our house (for refrigeration) until the morning of August 21st, at which
time, we WILL leave and be away until August 26th. Your schedule says I can't do this, but I
have no other choice, fresh cement or not. We have been good-natured and cooperative during
this long drawn out project and the workers have tried to accommodate our comings and goings,
but in this case, we will NOT be changing our plans. Unfortunately, hanging this on our door too
late to talk with someone about it leaves me no choice but this letter to inform you of our plans.

The construction season is underway. The City of Prior Lake has executed a contract with
Northwest Asphalt for the construction of the 2005 Improvements. Part of those improvements
include the construction of a catch basin and piping along your property line. The construction of
this catch basin and storm pipe has been on hold until the easements for this work are signed and
recorded.
The City and Contractor need to either move forward with the construction of this catch basin
and piping or eliminate it from the scope of the work. Accordingly please sign the easement
documentation and return it to the City by June 20th. If it is noffetllrned to usby that date, the
City will eliminate this work from the scope ofthe project.

Dear Ms. Evenstad:
As discussed during our June 1 st telephone conversation the City has completed a review of your
complaint related to tree removal/clearing in the City drainage and utility easement on the above
referenced property. Please note that this letter deals only with tree removal/clearing on the
above referenced property and not the adjacent Mediacom property. Prior to construction the
City obtained additional easements and approvals for all construction on the Mediacom property.
Based on our review ofthe building permit for the subject property it appears that approximately
a 5-15 foot wooded area remained in the drainage and utility easement on the western property
line after house construction. During storm sewer construction for City Project #05-01 the
remaining wooded area was cleared and grubbed. Attached for your review is a copy of the
certificate of survey for this property that shows the estimated limits of tree removal by the City
and builder.
The City has also reviewed pre-project information and feels that we have been consistent in
indicating that the easement area on this property would be subject to tree removal/clearing. The
plans are labeled "clear and grub" which indicates complete removal of the trees and brush in
this area. During the pre-project process the property owner referred the City to your builder to
discuss the project. The Assistant City Engineer, Larry Poppler met with your builder and
discussed the project including tree removal prior to construction. At no time did the builder or
previous owner of the lot express a concern related to the tree removal.
In addition to concerns regarding project communication you questioned whether the trees really
needed to be removed at all. The storm sewer that was constructed ranges in depth from 10-15
feet along the property line and therefore it was necessary to have a minimum clear zone of 15

feet on each side of the pipe for safe installation of the sewer. This resulted in removal of the
remaining trees adjacent to the house. In addition to the minimum clear zone area for storage of
dirt and construction materials is also needed. At the rear of the lot it was necessary to remove
up to 15 feet of trees and brush within the easement to install a storm sewer manhole. In order to
reduce the impact area the City would have needed to require special construction methods such
as a trench box. This construction method would have increased project time and cost to tax
payers. Please remember that the City previously acquired this easement for the purpose of
maintaining drainage and utilities, specifically the in-place sanitary sewer. Over time the
easement became overgrown with trees and brush. These trees and brush limit the City's
accessibility to existing infrastructure and therefore are typically maintained as clear zones when
possible.
You have indicated to both City Manger, Frank Boyles and myself that you feel the lot has been
devalued by the project and will not be receiving the estimated assessment benefit of $16,600.00
for the street improvements. The following mechanisms are available to you if you believe you
have not received the proposed benefit:
a) Submit a written objection detailing why you feel the assessment should be reduced to
the Assessment Review Committee in care of the City Manager. This committee meets
prior to the assessment hearing to review and make recommendations regarding the
proposed assessments to the City Council.
b) An owner of property to be assessed may appeal the assessment to the district court of
Scott County pursuant to Minnesota Statutes, Section 429.081 by serving notice of the
appeal upon the Mayor or City Manager of the City within 30 days after the adoption of
the assessment and filing such notice with the district court within ten days after service
upon the Mayor or City Manager.
If you in fact purchase the property we recommend you complete both steps above if you feel the
benefit increase to the property has be negated by the storm sewer construction. In October of
this year the City will hold an Assessment Hearing for the project at which time you can serve
notice of the appeal detailed in item "b" above to the Mayor or City Manager. Additionally at
that meeting you will be afforded the opportunity to speak and have your comments added to the
public hearing record.

Joe,
Per your review comments, our replies are as follows (numbered according to your
comments) :
1. In conjunction with our traffic control plans for CSAH 44, we are recommending that
the speed limit be reduced to 30 mph through the construction zones for safety purposes.
It is our understanding that the required request to Mn/DOT must come from Scott County,
as the Owner of the corridor.
2. We do not know exactly where the County's loop detectors are located along Franklin
Trail. Because the construction limits shown in the street are approximate, it may be
possible (and desirable to the City) to totally avoid any impacts to the County's
detectors. I suggest that we have our contractor field verify the detector locations
prior to completing his pavement removals. If impacts are unavoidable, we will want input
from our contractor as to which intersection control to implement (delay-capable loop
card, or north leg closure) .
3. If this is required (see comment #2), we will close the north leg of the Franklin
Trail intersection according to the County's requirements.
4. We will maintain communication with the County in regards to the magnitude of loop
detector impacts. Our intent is to avoid or minimize these impacts.
5. Closure of the westbound lanes along CSAH 44 at Franklin Trail will be kept to a
minimum during the utility construction at this intersection. Our traffic control plan
requires the signal to be put in all-flash mode during this time.
6. Again, our intent is to avoid or minimize impacts to the County's loop detectors
along Franklin Trail. Are you suggesting that the City must replace non-impacted loop
detectors, too?
7. Handholes associated with the existing signal system are shown on the plans. We
also show a handhole to handhole run crossing Franklin Trail based on field locates. Are
you suggesting that this crossing does not exist?
8. In order to safely channelize traffic through the

Darin Holmgren has asked me to pass along the following comments which I had provided on
the plan set for the watermain reconstruction on County Road 44 in Prior Lake. These
changes will need to be incorporated into the plans and specs for county approval.
1. Without Mn/DOT authorization for a lower work zone speed limit, any construction
warning signs (lane shift, etc) shall carry the appropriate advisory speed plaque. This
does not require Mn/DOT authorization.
2. If construction traffic will be entering CSAH 44 at the signal, front loops MUST be
kept in continuous operation at all times. If both southbound traffic lanes remain closed
during construction, arriving construction traffic will have to use Gateway Street SE.
Alternatively, a delay-capable loop card must be temporarily installed in the control
cabinet by county staff (if northbound construction traffic is to enter the site in the
southbound lanes.
3. If front loops are to be removed from operation, the north leg of the intersection
shall be fully closed to all traffic (including contractor's vehicles) with immovable
barrier (i.e. jersey barrier) .
4. Any removal of inplace loop detectors must be coordinated with County staff so that
appropriate cabinet changes can be made.
5. All four east-west Lanes shall be kept open through the intersection whenever
possible, with signal in operation.
6. All loop detectors on the north leg of Franklin Trail will need to be replaced as part
of this project. New loops shall be in Non-Metallic Conduit and shall follow county-
approved specs for installation, inspection, and testing, which must be added to the
construction contract. This will need to be in there before bids are awarded, or added as
a supplemental agreement. County staff must be notified at least two working days in
advance of installation of new detectors, so that locations can be marked in the field.
7. Underground signal components shall be shown on the plan sheet.
Signal plans indicate that there is no conduit run under Franklin Trail, so the signal
should physically be able to be kept in continuous operation.
8. Work zone traffic control and channelization should be consistent with inplace advance
loop detection to the maximum extent possible. Any deviation from this (traffic
approaching the signal missing advance loop detection, or traffic passing over loop
detectors intended for the opposite direction) should only be with prior approval of the
county so that cabinet changes can be made. Any changes or alterations to the traffic
control plan must be approved by Scott County.
9. Portable stop signs shall be provided for any planned signal outage.

drainage along Pleasant Street. The project involves constructing a catch basin on Pleasant Street
and providing an outlet pipe to the wetland to the south. The catch basin and piping would be

A number of years ago this drainage issue was brought to the attention of the Engineering
Department. Part of the process of completing the improvement was to place the project into the
Capital Improvement Program, five year budgeting plan. The improvement is now in the 2005
budget and will hopefully get completed this summer.

easement documentation including a drawing showing the proposed easement location.

Enclosed are three copies of each proposed easement description for the above referenced project.
In regard to the description for the Candy Cove right-of-way, we have neither found nor been provided
with any documentation that would indicate Candy Cove Trail S.E. exists as anything other than a
prescriptive easement (easement rights developing as a result of continuous use). We did not find
descriptions for all of the adjoining properties. Some of the descriptions we did find, however, refer to
the right-of-way as being 60 feet wide and some make no mention of a road. An abstracting company or
title insurance company might have more success tracking the origin and history of the street than we had,
but a way to settle the location and extent of the right-of-way is to map the centerline of the road as
allowed by Minnesota Statutes (505.1792). This process might eliminate the need for individual
easements from the adjoining property owners. Your attorney should review this idea before you act on
it. The description we've prepared is based on the alignment of the existing travelway and improvements.

Dear Mr. and Mrs. Benson:
The City of Prior Lake Engineering Department is currently designing a project which would
improve drainage along Pleasant Street. The project involves constructing a catch basin on
Pleasant Street and providing an outlet pipe to the wetland to the SOllth. The catch basin and
piping would be cons~cted between your property and your neighbor to the east.
A number of years ago this drainage issue was brought to the attention of the Engineering
Department. Part of the process of completing the improvement was to place the project into the
Capital Improvement Program, five year budgeting plan. The improvement is now in the 2005
budget and will hopefully get completed this summer!
An easement on your property is required for the work to be performed. I have attached
preliminary easement documentation including a drawing showing the proposed easement
location.
Please review the documentation and call me at 952-447-9832 with your questions or concerns.
At your convenience, I can meet with you at your home show you the proposed design features.
If everything looks appropriate to you, the City will mail out the official easement documents for
your signature.

reconstruct Centennial s,treet. Part of project includes constructing catch basins in the Centennial
Street cul-de-sac and providing an outlet pipe to the Highway 13 ditch. Currently the drainage on
Centennial Street is flowing and ponding on Mediacom property. The design would allow an
outlet for this area. The catch basin and piping would be constructed along the east property line
(see attached drawing).

Re: City Project No. 05-01 Plan Review
Dear Larry:
Enclosed please find two sets of plans for the above referenced project. The plans reflect the final design of
the project, pending your approval and approval from the various permitting agencies.
The following is a list of design items that we would like your input on:
1. We would like to clarify the extents of "Inserta Tee" installation on Centennial and Candy Cove.
2. The proposed replacement of the outside drop at sanitary MH # 1712 (intersection of Candy Cove
and Woodside) may pose difficulties from a constructability standpoint. Perhaps an inside drop
would be a viable alternative.
3 . We recommend ~e construction of an inside drop where the new sanitary sewer connects to MH
#5352 (intersect~n ofTH 13 and Franklin). The inside drop would have to be constructed so that it
outlets more tluu\' two feet above the invert, so as not to interfere with the flow in the existing 24"
RCP trunk line.
4. We are proposing that catch basin castings on Centennial Street be Neenah R3501-TL castings.
Does the city have a standard casting type for surmountable curbs?
5. Does the city have an established standard for ped ramps? The pedestrian curb ramp detail shown
in the detail sheet conforms to the latest Mn/DOT standard plate. It appears that Prior Lake
Standard Plate #705 does not conform to the latest ADA requirements.
6. The CSAH 44 bituminous patch detail has yet to be confirmed with Scott County.
7. Traffic control and detour plans for the work on CSAH 44 will be sent as they are completed.
8. Will we be reclaiming bituminous surfaces on the project? If so, does the city allow reclaimed
bituminous and aggregate base as a substitute for Class 5 aggregate base?
9 . We contacted Mn/DOT regarding the two culverts at the intersection of Candy Cove and TH 13.
They will inform us of their opinion as to whether the culverts should be replaced.

Highway 13 and County Road 44. The sanitary sewer main is proposed to be

Pleasant Street Utility Improvements
Dear Property Owner:
The City is planning to perform utility improvements along Pleasant Street between
Highway 13 and Duluth Avenue. The sanitary sewer main near the wetland area. is
proposed to be reconfigured and a section of storm sewer added on Pleasant Street. Once
completed, this project will alleviate some of the maintenance issues in this area.
An Open House regarding proposed utility improvements scheduled for Wednesday,
March 16, 2005 between 6:00 - 7:30 P.M. at the Prior Lake Fire Station No.1, 16776
Fish Point Road SE. Plan sheets showing the proposed improvements will be shown and
discussed. Representatives from the City of Prior Lake Engineering Department will be
available to answer your questions.
This Open House is intended to provide a better understanding of the potential
improvements in an informal setting.

To Whom It May Concern:
We have been unable to attend the meetings regarding the street
improvement project being undertaken during the 2005 summer that will
affect our street, (Candy Cove Trail) because of being out-of-town and
because of a surgery schedule. We would like to be on the record, however,
regarding one thing that affects our personal property.
It is our understanding at this point that there will be a sidewalk put in on
our side of Candy Cove Trail (north side). If this is correct, it looks like it
cannot be extended all the way to Highway 13 because the land takes a sharp
dip to a ravine (with several trees there) at the end of our property line. Our
property is the closest to Highway 13 with frontage on Candy Cove Trail.
We would very much prefer not having the sidewalk. Our question is-is
it necessary to extend it all the way past our property? Why would a
sidewalk end on Highway 13 where there are no stop lights and therefore it
would be a hazard? And since there are no sidewalks anywhere in this
neighborhood, why does this part of Candy Cove Trail need sidewalks?

The memo is clarification of the request for proposals (RFP) which was sent out on
October 21, 2004 for Candy Cove Trail, Centennial Street and Misc. Sewer Projects.
1. The televising report for the sanitary sewer on Centennial and Candy Cove
shows that a number of spot repairs are necessary to remove short portions of
vitrified clay pipe (VCP). For example in a number of areas VCP was used for
outside drop manholes. The City would like to see these areas reconstructed
using DIP. The RFP should include time to address these segments on the
plans and show profiles for these short areas. The attached memo further
clarifies these replacement areas and any sanitary service replacements.
2. The televising report for the sanitary sewer on Centennial and Candy Cove
shows that approximately 350 feet of sanitary pipe needs to be completely
replaced. The RFP should include a sanitary plan / profile sheet for this area.
3. All the watermain services and some sanitary services will require replacement.
The watermain saddles will also be replaced. The 04-11 plans show how the
City of Prior Lake annotates these replacements on the plans and this should be
included in the RFP.
4. A 6" watermain is located parallel to the 20" watermain. The 6" cast iron
watermain on Candy Cove Trail will be abandoned and watermain connections
will be made to the 20" ductile iron pipe. The plans should show 8" ductile iron
from the 20" out to the edge of the right of way for both connections. The plans
should also show the 290 linear feet of 6" CIP abandoned.
5. All watermain valves and hydrants will be replaced. The 04-11 plans show how
the City of Prior Lake annotates these replacements on the plans and this should
be included in the RFP.
6. The City does not anticipate any wetland services for this project, but should they
be necessary this would be considered additional work.

7. The completed design for Centennial Street can be utilized for design purposes,
but Centennial Street should be re-surveyed. The RFP should include time for
re-surveying this area. The design must be evaluated as it relates to the new
survey and design changes are possible.
8. The drainage of the Candy Cove area is not clear at this point. The proposer
should include time to research drainage patterns and develop a drainage plan.
The plan may include ponding or other features to accommodate drainage. The
Watershed District may also require storm water features. The feasibility report
will have additional information regarding the proposed plan for drainage.
