Prior Lake, MN 55372-1714 June 6, 2005 Ms. Geneen Evenstad 5366 Centennial St. SE Prior Lake, MN 55372 RE: 2005 Street Reconstruction Project (project #05-01) 5358 Centennial Street Dear Ms. Evenstad: As discussed during our June 1 st telephone conversation the City has completed a review of your complaint related to tree removal/clearing in the City drainage and utility easement on the above referenced property. Please note that this letter deals only with tree removal/clearing on the above referenced property and not the adjacent Mediacom property. Prior to construction the City obtained additional easements and approvals for all construction on the Mediacom property. Based on our review of the building permit for the subject property it appears that approximately a 5-15 foot wooded area remained in the drainage and utility easement on the western property line after house construction. During storm sewer construction for City Project #05-01 the remaining wooded area was cleared and grubbed. Attached for your review is a copy of the certificate of survey for this property that shows the estimated limits of tree removal by the City and builder. The City has also reviewed pre-project information and feels that we have been consistent in indicating that the easement area on this property would be subject to tree removal/clearing. The plans are labeled "clear and grub" which indicates complete removal of the trees and brush in this area. During the pre-project process the property owner referred the City to your builder to discuss the project. The Assistant City Engineer, Larry Poppler met with your builder and discussed the project including tree removal prior to construction. At no time did the builder or previous owner of the lot express a concern related to the tree removal. In addition to concerns regarding project communication you questioned whether the trees really needed to be removed at all. The storm sewer that was constructed ranges in depth from 10-15 feet along the property line and therefore it was necessary to have a minimum clear zone of 15 G:\PROJECTS\2005\11]iShPoint]airlawn\Correspon~!Jdliorlake.com _ 1 _ Phone 952.447.4230 / Fax 952.447.4245 feet on each side of the pipe for safe installation of the sewer. This resulted in removal of the remaining trees adjacent to the house. In addition to the minimum clear zone area for storage of dirt and construction materials is also needed. At the rear of the lot it was necessary to remove up to 15 feet of trees and brush within the easement to install a storm sewer manhole. In order to reduce the impact area the City would have needed to require special construction methods such as a trench box. This construction method would have increased project time and cost to tax payers. Please remember that the City previously acquired this easement for the purpose of maintaining drainage and utilities, specifically the in-place sanitary sewer. Over time the easement became overgrown with trees and brush. These trees and brush limit the City's accessibility to existing infrastructure and therefore are typically maintained as clear zones when possible. You have indicated to both City Manger, Frank Boyles and myself that you feel the lot has been devalued by the project and will not be receiving the estimated assessment benefit of $16,600.00 for the street improvements. The following mechanisms are available to you if you believe you have not received the proposed benefit: a) Submit a written objection detailing why you feel the assessment should be reduced to the Assessment Review Committee in care of the City Manager. This committee meets prior to the assessment hearing to review and make re<?ommendations regarding the proposed assessments to the City Council. b) An owner of property to be assessed may appeal the assessment to the district court of Scott County pursuant to Minnesota Statutes, Section 429.081 by serving notice of the appeal upon the Mayor or City Manager of the City within 30 days after the adoption of the assessment and filing such notice with the district court within ten days after service upon the Mayor or City Manager. If you in fact purchase the property we recommend you complete both steps above if you feel the benefit increase to the property has be negated by the storm sewer construction. In October of this year the City will hold an Assessment Hearing for the project at which time you can serve notice of the appeal detailed in item "b" above to the Mayor or City Manager. Additionally at that meeting you will be afforded the opportunity to speak and have your comments added to the public hearing record.
