On June 12, 1997, the City received an application for the vacation of a portion of Eagle
Creek Avenue. On June 20, 1997, I sent you a letter outlining the additional information
required before the petition could be processed. It has been more than thirty (30) days
since that letter. Because I have not received any additional information, I am returning
your application and filing fee. If you wish, you may resubmit this application, with all of
the required submittals, at a later date.
For your information, I am also sending you a copy of letter addressed to you and from
the City of Prior Lake staff, dated September 13, 1990. This letter states there are
several utilities located in this right-of-way. These utilities are still in place. Even if the
City were to vacate the right-of-way, an easement would be required, and structures are
not permitted within an easement.

Dear Mr. Anderson:
I did review your site with Verlyn Raaen of the City's Engineering Department.
Preliminary, it does appear that there may be right-of-way which could be vacated. If you
want to pursue the possible vacation you would need to file an application for vacation
with the Planning Department. The application would require the payment of a non-
refundable, $200.00 review fee and would require that you submit a legal description for
the area to be vacated, among other things.
Were your request to vacate a portion of the right-of-way granted, any garage would
require an additional variance. The current fees for variances total $175.00, including a
refundable $50.00 recording fee. Were you to seek an additional variance, a revised
survey would be required.
An issue of concern on your site would be the amount of fill that would be required to
accommodate a garage, and the impact of that fill on drainage to the lake and adjacent
properties.

Avenue S.E. Mr. Anderson, as you may recall, is the gentleman who approached me
about a possible vacation and variance to allow the construction of a garage. Would you
or your staff please review this matter to determine whether it is feasible and/or desirable
to proceed with the vacation of a portion of the R-O- W, and let me know at your earliest
convenience of your conclusions. If you wish to arrange to visit the site, Mr. Anderson's

Dear Chris,
This letter is to inform ~ou of the results of the research that
I conducted on the feasib~lity of vacating a portion of the Eagle
Creek Ave. right of way. I regret to inform you that due to a
number of required utility easements the City of Prior Lake would
not process a vacation application for the location in question.
The site in question has two underground utility lines, gas and
tele~hone, running through it. Both companies would require that
a ut~lity easement be granted if the site was vacated. The width
of the easements, up to 33 feet for the gas line, would make it
impossible for you to build. No permanent structures are allowed
to be built on utility easements. The City also has a watermain
running through that area that would also require a utility
easement. Even if the vacation was granted the easements would
preclude you from building on the site. The water shut-offs
would be located on ~rivate property if the site was vacated and
they would also requ~re easements to be granted.
