We represent Gary H. Schwartz and Laura E. Elletson in this initial registration
proceeding involving land in Scott County, Minnesota, that is described in the Summons.

you served personally. As the notice indicates, returning the form does not prevent you

RE: Summons in Application for Registration of Land
Dear Suesan:
We recently received the two summonses in Application for Registration of Land, for the
following properties:
1. Gary H. Schwartz and Laura E. Elletson (70-CV-06-8969)
2. Haferman Properties II, LLC and Jonathan L. Haferman and Gail L, Haferman
(70-CV-06-8971 )
The information for each of these summonses is attached.
The City staff has reviewed the City's potential interest in each of these parcels. In the
Schwartz/Elletson parcel, the City has a storm sewer line along the east property
boundary, extending to the lake. We have an easement over the platted portion, but will
need to retain a 15' wide easement over the unplatted portion they are asking to
register.
The Haferman parcels are not located in the City of Prior Lake, and the City has no
interest in these parcels.

Schwartz and Laura E. Elletson, et a1., applicants v. C. Theo Weiland, et a1., defendants, Case
No. 70-CV-06-8969, is served pursuant to Rule 4.05 of the Minnesota Rules of Civil Procedure.
You must complete the acknowledgment part of this form and return one copy of the
completed form to the sender within 20 days.

In the Matter of the Application of Gary H. Schwartz and Laura E. Elletson,
husband and wife, as joint tenants, to Register Title to the following described real estate
situated in Scott County, Minnesota:
The Northeasterly 30.00 feet of Lot 8 (measured at right angles to the Northeasterly
line thereof) and Lot 9, "F AIRLA \VN SHORES", Scott County, Minnesota.
Together with that part of Government Lot 2, Section 25, Township 115, Range
22, Scott County, Minnesota, described as follows: Beginning at the northwest
comer of said Northeasterly 30.00 feet of said Lot 8; thence northwesterly, along
the northwesterly extension of the southwesterly line of said Northeasterly 30.00
feet, to the shore line of Prior Lake; thence northeasterly along said shore line to its
intersection with the northwesterly extension of the northeasterly line of said Lot
