RESOLUTION OF THE PRIOR LAKE CITY COUNCIL TO APPROVE THE
CONTRACT FOR OVERSIZING OF IMPROVEMENTS FOR THE PRIOR LAKE
BAPTIST CHURCH

WHEREAS:
Prior Lake Baptist Church is proposing to construct an addition to the existing
church and school on the property described in Exhibit A; and
WHEREAS:
the Contract for Oversizing of Improvements (Exhibit A) allows the Prior Lake
Baptist Church to install public improvements and to oversize those improvements;
and
WHEREAS:
the Contract for Oversizing Improvements spells out the City's obligations and the
Prior Lake Baptist Church obligations in the installation of those improvements.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE
CITY OF PRIOR LAKE, MINNESOTA, the Mayor and the City Manager are authorized to
sign the Contract for Oversizing of Improvements with Prior Lake Baptist Church.

CONTRACT OF OVERSIZING OF IMPROVEMENTS
This Contract is made this 20th day of April, 1998, by and between the City of
Prior Lake (hereinafter "City"), a Minnesota Municipal Corporation, and Prior Lake
Baptist Church, (hereinafter "Owner").

to facilitate the orderly development of land the City has adopted a
Comprehensive Plan and provided for the location of water distribution
systems;
the City water distribution system is intended to benefit all residents of
the City and not solely Owners property; and
the development of individual properties should provide for the
construction ofwatermains that are built to sufficient size to serve the
individual property and contribute to meeting the needs of future growth
and demand; and
Owner desires to improve Owner's property and in so doing to provide
for municipal water; and
Owner, with the consent of the City, intends to construct a watermain in
the public right-of-way; and .
upon completion, inspection and acceptance by the City, the watermain .
constructed by Owner will become part of the municipal water
distribution systems; and
the City desires Owner to oversize the construction of the watermainon
Owner's property so that the pipe is large enough to serve future growth
and demand; and
City desires to compensate Owner for the additional cost Owner will
incur to oversize the watermain.
NOW THEREFORE, based on the mutual promises and covenants setforth
herein, the sufficiency of which is not disputed, the City and Owner agree as follows:
1. Purpose. The purpose of this Contract is to set out the understanding
between the City and Owner with respect to the construction of a watermain (hereinafter
"Improvement") on Owner's property and the public right-of-way. This Contract
describes the Owner's responsibilities with respectto the method of construction, the
City's requirements pertaining to size and location of the Improvement, inspection of the

Improvement by the City, As-builts drawings, hold harmless and indemnification and
City reimbursement to Owner for the cost to oversize the Improvement.

3. Contract Documents. This Contract consists of the following documents,
each of which is specifically incorporated herein by reference as if fully set forth or
attached (collectiVely referred to as "Contract Documents'').
(a) Site Survey dated Match 24,1998, prepared by Delmar R. Schwanz,RLS.
(b) Plans and Specifications dated March 5, 1998, prepared by Progress Land
Company.
(c) Building Permit #98-149 dated 3/6/98.
(d) City Public Works Design Manual.
4. Location. The Improvement will be constructed in the right-of-way on
owners property legally described on Exhibit A (attached).
5. Oversizine. The Owner and City agree that the Improvement should be
oversized for the benefit of future development, just as Owner was benefited from the
oversizing of Improvements by previous development. Oversizing is the construction of
an Improvement to City specifications that exceeds those that would otherwise be
required of the Owner. The City and Owner agree that the cost to oversize the watermain
is $8,210.97 based on a cost estimate as determined by (1) quotes provided by the Owner
to the City and (2) and City Engineer using the City's Assessment policy based on a [mal
engineering drawing. The calculation ofthe cost to oversize the Improvement is attached
as Exhibit B. The City shall reimburse the owner for the cost of oversizingwithin thirty
(30) days of acceptance of the Improvement by the City Engineer.
If the City Engineer determines additional work as a result of oversizing is required and
provides written authorization to the Owner to proceed with said additional work, the
City shall reimburse the Owner for the costs associated with the additional work. The
cost of the additional work shall be agreed on between the City and Owner and set forth
in the authorization to proceed with the additional work.
6. Construction of Improvement. The Improvement shall be installed in
accordance with the City Public Works Design Manual and any other applicable City
ordinances. . The Owner shall construct the Improvement in accordance with the Contract
Documents submitted to and approved by the City.
7. As-builts. Upon completion of the Improvement and inspection thereof and
prior to acceptance by the City or issuance of a Final Certificate of Occupancy for the
Property, the Owner shall provide to the City a complete set of As-built elevations ina
form prescribed by and acceptable to the City Engineer.

8. License. The Owner hereby grants the City, its agents, employees, officers
and contractors a non-revocable license to enter onto Owners Property to perform all
work and inspections deemed appropriate by the City in connection with the construction
and maintenance of the Improvement.
9. Ownership of Improvement. Upon completion of the Improvement and
final written acceptance by the City Engineer, the Improvement lying within public
easements shall become City property without further notice or action.
10. Warranty. The Owner warrants the Improvement against poor material and
faulty workmanship. The warranty period for the Improvement is two (2) years. Upon
completion of the Improvement and prior to the City's issuance ofa final Certificate of
Occupancy for the Property, the Owner shall provide the city with a warranty or
maintenance bond, in a form acceptable tothe City Engineer, in the amount of
$28,906.00, which number represents one hundred twenty-five percent (125%) of the cost
of the Improvement. The warranty or maintenance bond shall remain in effect during the
warranty period.
11. Prompt Payment to Subcontractors Required. The provisions of Minnesota
Statute Section 471.425, Subd; 4a, attached as Exhibit C are incorporated by reference as
if fully set forth herein.
12. Indemnification. Owner shall indemnify, defend, and hold the City, its
Council, agents, employees, attorneys and representatives harmless against and in respect
of any and all claims, demands, actions, suites, proceedings, liens, losses, costs, expenses,
obligations, liabilities, damages, recoveries, and deficiencies, including interest, penalties,
and attorney's fees, that the City incurs or suffers, which arise out of, result from or relate
to the Improvement and this Contract.
13. Street Maintenance. Owner shall be responsible for all street maintenance until
final written acceptance by the City of the Improvement. Warning signs and detour signs,
if determined to be necessary by the City Engineer, shall be placed when hazards develop
in streets to prevent the public from traveling on same and directing attention to detours.
If and when streets become impassable, such streets shall be barricaded and closed. For
the purpose ofthisparagraph, "street maintenance" does not include snow plowing or
normal sweeping;
14. Third Partv Recourse. Third parties shall have no recourse against the City
under this Contract.
15. Validity. If any portion, section, subsection, sentence, clause, paragraph, or
phase of this Contract is for any reason held invalid, such decision shall not affect the
validity of the remaining portion of this Contract.
16. Waiver. The action or inaction of the City shall not constitute a waiver or
amendment to the provisions of this Contract. To be binding, aniendments or waivers

shall be in writing, signed by the parties and approved by resolution of the City Council.
The City's failure to promptly take legal action to enforce this Contract shall not be a
waiver or release.
17. Recordini:. This Contract shall run with the land. The Owner, at hislher sole
expense, shall recordthis.Contract against the title to the property within ten (10) days of
. the City Council's approval of the Contract. The Owner shall provide the City with a
recorded copy of the Contract.
18. Insurance. Owner, at its sole cost and expense, shall take out and maintain or
cause to be taken out and maintained, until the expiration of the warranty period on the
Improvement, public liability and property damage insurance covering personal injury;
including death, and claims for property damage which may arise out of Owner's work or
the work of its subcontractors or by one directly or indirectly employed by any of them.
Limits for bodily injury and death shall not e less than $1,000,000 for one person and
$2,000,000 for each occurrence; or a combination single limit policy of$I,OOO,OOO or
more. The City shall be named as an additional insured on the policy, and the Owner
shall file with the City a certificate evidencing coverage prior to the City issuing a Final
Certificate of Occupancy. The certificate shall provide that the City must be given (30)
days advance written notice of the cancellation of the insurance.
19. Assi~nment. The Owner may not assign this Contract without the prior written
approval of the City Council.
20. InterDretation. This Contract shall be interpreted in accordance with the
governed by the laws of the State of Minnesota. The words herein and hereof and words
of similar import, without reference to any particular section or subdivision, refer to this
Contract as a whole rather than to any particular section or subdivision hereof. Titles in
this Contract are inserted for convenience or reference only and shall be disregarded in
constructing or interpreting any of its provisions.
21. Jurisdiction. This Contract shall be governed by the laws of the State of
Minnesota.

471.425 PROMPT PAYMENT OF LOCAL GOVERJ.'lMENT BILLS.
Subdivision 1. Definitions. For the purposes of this section, the foHowing terms have
the meanings here given them. .
(a) "Contract" means any written legal document or documents signed by both parties
in which the teons and conditions of any interest or other penalty for late payments are clear-
ly stated.
(b) "Date of receipt" means the completed delivery of the goods or services or the satis-
factory installation. assembly or specified ponion thereof, or the receipt of the invoice for the
delivery of the goods or services, whichever is later.
(c) "Governing board" means the elected or appointed board of the municipality and
includes, but is not limited to, city councils. town boards and county boards. .
(d) "Municipality" means any home rule charter or stannory'city, County, town. school
district. political subdivision or agency of local government. "Municipality" means themet-
ropolitan councilor any board or agency created under chapter 473.
Subd. 2. Payment required. A municipality must pay each vendor obligation accord-
ing to the teons of the contract or, if no contract terms apply, within the standard payment
period unless the municipality in good faith disputes the obligation. Standard payment peri-
od is defined as follows:
(a) For municipalities who have governing boards which have regularly scheduled
meetings at least once a month, the standard payment period is defined as within 35 days of
the date of receipt
(b) For municipalities whose governing boards donot regularly meet at least once a
month, the standard payment period is defined as 45 days after receipt of the goods or ser-
vices or the invoice for the goods or services, whichever is later.
(c) For joint powers organizations organized under section 471.59, the standard pay-
ment period is within 45 days of the date of receipt,_
Subd. 3. Invoice errors. If an invoice is incorrect, defective or otherwise improper, the
municipality must notify the vendor within ten days of the date of receipt. Upon receiving a
corrected invoice from the vendor, the municipality must pay the obligation within the stan-
dard payment period defined in subdivision 2.
Subd. 4. Payment of interest on late payments required. (a) Except otherwise pro-
vided in this section, a municipality shall calculate and pay interest to a vendor if the munici-
pality has not paid the obligation according to the teons of the contractor, if no contract terms
apply, within the standard payment period as defined in subdivision 2. The standard payment
period for a negotiated contract or agreement between a vendor and a municipality which
requires an audit by the municipality before acceptance and payment of the vendor's invoice
shall not be begun until the completiont>f the audit by the municipality.
(b) The rate of interest calculated and paid by the municipality on the outstanding bal-
ance of the obligation not paid according to the terms of the contract or during the standard
payment period shall be 1-1/2 percent per month or part of a month.
(c) No interest penaIties may accrue against a purchaser who delays payment of a ven-
dor obligation due to a good faith dispute with the vendor regarding the fitness of the product
or service. Contract compliance, or any defect. error or omission related thereto. If such delay
undertaken by the municipality is not in good faith, the vendor may recover costs and attor-
ney's fees.
(d) The minimum monthly interest penalty payment that a municipality shall calclllate
and pay a vendor forthe unpaid balance forany one overdue bill of$loo or more is $ID. For
unpaid balances ofIess thanSIOO, the municipality shaIIcalculate and pay the actual interest
penalty due the vendor.
Subd. 4a. Prompt payment to subcontractors. Each contract of a municipality must
require the prime contractor to pay any subcontractor within ten. days of the prime contrac-
tor's receipt of payment from the municipality for undisputed services provided by the sub-
contractor. The contract must require the prime contractor to pay interest of 1-I/2percenr per
month or any part of a month to the subcontractor on any undisputed amount not paid on time
to the subcontractor. The minimum monthly interest penalty payment for an unpaid balance
of $100 or more is $10. For an unpaid balance of/ess than $100, the prime contractor shall
pay the actual penalty due to the subcontractor. A subcontractor who prevails in a civil action
to collect interest penalties from a prime contractor must be awarded its costs and disburse-
ments, including attorney's fees, incurred in brin~ngthe action.
Subd. 5. Applicability. This section applies to all goods. leases and rents, and contracts.
for services, construction. repair and remodeling. Purchases from or contracts for service
with a public utility as defined in section 21 6B.02 or a telephone company as defined in sec-
tion 237.01 that has on file with the public utilities COmmission an approved practice regard-
ing late fees are not subject to this section.

account of Prior Lake Baptist Church.
This credit shall be available against your draft at sight on us
accompanied by the original Letter of Credit.
This Letter of Credit sets forth in full terms of our undertak-
ing. Such undertaking shall not in any way be modified, amended
or amplified by reference to any document, instrument or agree-
ment referred to herein or in which the Letter of Credit is
referred to or to which this Letter of Credit relates. Any such
reference shall not be amended to incorporate herein by reference
any document, instrument or agreement.
Your draft so drawn must bear this clause: "Drawn under Prior Lake

1. IMPROVEMENTS, MAINTENANCE AND RESTORATION. (a)

cost of repair and maintenance of the northerly 90 feet of the
Driveway Easement shall be paid by the owner of the Anderson
Parcel.
(C) Restoration. If the Driveway Easement or ar.y
improvements thereto are damaged or destroyed by any cause, any
owner who has use for the Driveway Easement may restore it, and
the owner of the other Parcel shall reimburse the owner who paid
for such restoration for the proportionate share of the cost
thereof (determined in accordance with paragraph l(b) above)
togethar with interest on the proportionate share at the maximum
legal rate from the day of completion of the restoration.
(d) Other Rights. Nothing in this agreement shall
prejudice the common law or statutory rights of any owner to
recover from any other owner for negligent or willful acts or
omissions.
2. LIMITATION. No owner of a Parcel shall cause or permit
obstruction of or interference with the rights in or use of the
Driveway Easement by any other owner.
3. GENERAL PROVISIONS. (a) Persons Bound. This agreement
shall bind and inure to the benefit of each owner of the Parcels,
and their respective heir.s, successors and assigns.
(b) Amendment. This agreement may be amended with the
written approval of the record owners of the Parcels.
(C) Plural. The singular shall include the plural, and
the plural may be read as singular, where appropriate, and unless
the context otherwise requires.
(d) Liability. The obligations of the ow~ers of the
Parcels shall be joint and several, except where the context
otherwise requires.
(e) Enforcement. Any owner may enforce, by a
proceeding at law or in equity, or both, any provision of this
agreement. The proceeding may seek to restrain a violation and
to recover the damages resulting therefrom, together with the
costs of the proceeding, including reasonable attorneys' fees.
(f) Captions. The captions in this agreement are
inserted only as a matter of convenience and for reference and do
not limit the scope of this agreement.
(9) Severability. Invalidation of any provision of
this agreement by any court shall not effect the remainder
hereof, which shall continue in full force and effect.

We have reviewed the revised site plan dated March 5, 1998 for the subject project and have the
following comments:
1. It appears that some additional grading will be needed between the northern edge of the north
parking lot and the proposed berm to allow for drainage.
2. The City Attorney is drafting a contract agreement to address the watermain construction and
reimbursement for oversizing. I will fax a copy to you for your review as soon as I receive it.

The following issues need to be addressed prior to the issuance of a building
permit:
· The revised landscape plan adequately addresses screening of the new
parking lot area with a 3' high berm. However, a portion of the berm that
screens the rear parking lot is off the property. Therefore an easement for
the berm must be obtained and recorded or the site plan must be modified to
accommodate the berm on the church property.
· This property is zoned C-1 SD. Impervious Surface cannot exceed 30%.
Impervious surface must accompany survey and be signed by surveyor.

Please note they are still missing a certificate of survey. I informed Scott Crosby and
Randy Quiring today that a site plan certified by a registered engineer does not substitute
for a certificate of survey. They will still be required to submit the survey.

The Engineering Department has reviewed the revised plan for the subject project and
have the following comments:
1. The sewer and water work on parcel #2 will require another permit for utility
connection fees, etc.
2. The location of the existing 4" sanitary sewer wye is 92 feet from the existing
manhole in CR 21. Revise the plan accordingly as this will affect the easement
location.
3. A Scott County permit will be required to work in the right-of-way. Provide the city
with a copy of the approved permit.
4. Please add the City Project # 97-52 to the plan.
5 . We have reviewed the oversizing costs and have attached a revised table. Per our
development contract, engineering is reimbursed only if the city engineer determines
additional work was required. We do not believe reimbursement is warranted in this
case.

Dear Mr. Crosby:
As you know, the procedure for approval of the addition to the Prior Lake Baptist Church
requires Site Plan Approval from the Development Review Committee. Once the site
plan is approved by the DRC, a building permit can be issued. In this case, most of the
building permit items have already been reviewed, so approval of the permit is primarily
awaiting site plan approval.
Enclosed are three memorandums detailing the additional information required for site
plan approval for this addition. Please submit the remaining required submittals to me in
one packet. I will then distribute the information for review and let you know the status
of the application. It is important the additional information be submitted directly to me
and in one submittal. This eliminates piece meal submittals and ultimately expedites the
review of your project.

The following issues need to be addressed prior to the issuance of a building
permit:
· Section 5-5-10 Landscape Ordinance requirements built-in irrigation system
and plan. The cost of the system must be included in landscape estimate
and is part of the Letter of Credit. Need irrigation plan, revised cost
breakdown for landscaping (can be on separate sheet), and a letter of credit
for 125% of the total landscape costs. Parking lot screening is required on
the perimeter of all new parking lots. A combination of shrubs, berm, fencing
is required (Section 5-5-10 F 4). A revised grading plan with contours must
be submitted indicating berm height and locations.
. Need a lighting plan. 0-1 foot candles at the property line.
. Need Cross Access Agreement for shared driveway.
. This property is zoned C-1 SO. Impervious Surface cannot exceed 30%.
Impervious surface must accompany survey and be signed by surveyor.

The Engineering Department has reviewed the revised plan for the subject project and
have the following comments:
1. The sewer and water work on parcel #2 will require another permit for utility
connection fees, etc.
2. The existing 4" sanitary sewer service appears to be below the minimum grade of 2%.
3. Install a clean out on the existing 4" sanitary sewer service at the west right-of way
line.
4. The new sanitary service can be installed at a minimum slope of2%. Add "...or 2%"
to the note. Add a note to install a wye where the new service connects to the main.
Add a clean out at the 90 degree bend in the service pipe.
5. Label the size and type of pipe of the existing sanitary sewer pipe.
6. The easements shown on the plan for the water and sewer services should be private
easements. The city does not require easements on services or water lines on private
property .
7. Label the distance between the proposed 12" water main and the property line (10').
8. Add a note to remove and replace the 24" culvert at the end of the driveway and call
out the type of pipe. This will have to be done in order to construct the watermain.
9. Call out the size and type of pipe for the proposed water service (1" copper).
1 O. Label the setback distance from the parking lot to the residential property line. The
parking lot on the east side of the lot appears to encroach on the setback.
11. Add a note on the plan to protect the existing culvert at Industrial Circle and to

Dear Mr. Crosby:
We received a revised site plan for the Prior Lake Baptist Church on November 24,
1997. In order to process this site pan approval application, we must receive the
following items:
1. Elevations and grades of all existing utilities.
2. Two foot contours of the entire site, and 200 feet beyond the properly boundary line,
as well as elevations of all roads, lakes, streams, and/or wetlands within 200 feet of
the properly.
3. Engineering plans, signed by a registered civil engineer, of all proposed utilities
including the following:
a) Typical section of all parking lots and entrance roads.
b) Plan and profile of all proposed utilities which include the size, type and slope of
pipe.
c) Site grading plan showing existing and proposed contours, drainage direction,
and drainage areas.
4. Erosion control plan showing all construction site erosion control measures. This
plan shall include a schedule of installation and provisions for maintenance during
construction.
5. Drainage plan of the site delineating in which direction and at what rate storm water
will be conveyed from the site. If ponding is required, show the area and all required
storm sewer improvements.
6. Details of all proposed improvements.

On October 27, 1997, I sent you a letter detailing the items which must be submitted in order
to review the site plan for the Prior Lake Baptist Church. I have since received some
additional information, including the landscaping plan and tree preservation plan. We have
also received some of the architectural plans to meet the building code requirements.
However, we still have not received the following items:

The following is arcsponse to the city plan review letters dated October 13, 1997. The following items
shall correspond to your numbered comments. Two revised plan sets are included in and shall become part
of this submittal.
I. Signed Architectural and Structural plans have been submitted to your office. The contractor, Progress
Land Company, shall submit signed civil plans. We have hired a Landscape Architect and his signed
plans shall be submitted to your office when they become available.
2. A soils report shall be submiued to your office by Progress Land Company.
3. A schedule for special inspections is included on the signed Structural plans, which have been
submitted to your office. See sheet 51.
4. Energy envelope calculations are enclosed with this submittal.
5. The electrical contractor shaH submit Illumination Budget Calculations.
6. A S.A.C. determination has. beelllDade and sent to your office.
7. Ventilation for the building shall be shown on Mechanical Plans to be submitted by the Mechanical
Contractor and will comply with all applicable codes.

understanding that the project will go ahead regardJess of the outcome of the variance. Jfthe variance
is not granted, the steeple will have to be reduced in scale or eliminated.
2. A landscape plan in accordance with City of Prior Lake requirements is being prepared and shall be
submitted when it becomes available. Our understanding is that the normal amount of landscape
plantings and berms adjacent to residential property would not apply to the area between the church
and the adjacent residential propcrty in this case because of the church's arrangement to buy the
adjacent property at some point. A letter outlining the agreement is enclosed with this submittal.

The City of Prior Lake Development Review Committee (DRC) received the above
application on October 16, 1997. The DRC is charged to review development applications
within ten (10) business days in order to determine if all materials required by the Zoning
and Subdivision Ordinance have been submitted.
The purpose of this letter is to advise you that the following required items have not been
submitted or are deficient as described. The formal DRC review of these applications will
not begin until such a time as all of the items listed are submitted and are found to be
acceptable to the DRC.
1. A Landscaping Plan and a Tree Preservation Plan
2. A Lighting Plan
3. Location and size of all existing public and private sewers, wa term ains, culverts, etc.,
within 200 feet of the property.
4. Elevations and grades of all existing utilities.
5. Two foot contours of the entire site, and 200 feet beyond the property boundary line, as
well as elevations of all roads, lakes, streams, and/or wetlands within 200 feet of the
property.
6. Engineering plans, signed by a registered civil engineer, of all proposed utilities including
the following:
a) Typical section of all parking lots and entrance roads.

The Prior Lake Baptist Church has submitted a site plan for the expansion of the church. These
improvements will require the extension of water utilities to the property terminus. The church is
presently connected to a service line that also provides service to the residential home that used
to be the parsonage home. There will have to be a separation of the existing sewer service line.
Since water and sewer utilities are available to the property site, the cost for the extension of
services internally will be the responsibility of the church. The parcel has not been charged a
trunk water acreage charge or any fees relating to water utilities. Therefore, in addition to these
improvement costs, the Prior Lake Baptist Church will be subject to the following City charges:

We have reviewed the preliminary plan for the church and have made the following list of
items that are required by the Engineering Department:
1. Location and size of all existing public and private sewers, watermain, culverts, etc.
within 200 feet of the property.
2. Elevations/grades of all existing utilities.
3. Two foot contours of the entire site and 200 feet beyond the property boundary lines.
Elevations of all roads, lakes, streams, and/or wetlands within 200 feet of the
property.
4. Plat drawing prepared by a land surveyor registered in the state of MN. -]'l.l:k- ~j~
5. Engineering plans of all proposed utilities including the following:
· Typical section of all parking lots and entrance roads.
· Plan and profile of all proposed utilities which includes size, type and slope of
pIpe.
· Site grading plan showing existing and proposed contours, drainage direction,

· All engineering plans shall be signed by a registered civil engineer.
6. Erosion control plan showing all construction site erosion control measures. Plan
shall include a schedule of installation and provisions for maintenance during
construction.
7. Drainage plan of site delineating in which direction and at what rate storm water will
be conveyed from site. If ponding is required show area and all required storm sewer
improvements.
8. Details of all proposed improvements.

Following are the results of the Preliminary Plan Review for the Prior Lake Baptist Church. Our
review was based on the Minnesota State Building Code (MSBC) which has adopted with
amendments the 1994 Uniform Building Code (UBC).
1. Submit signed architectural, structural, site, HV AC, sprinkler, plumbing plans, and a
Certificate of Survey.
2. Submit a soils report.
3. Submit the Structural Engineer's requirements for Special Inspections. UBC 1701.5.
4. Submit Energy Envelope Calculations.
5. Provide the Illumination Budget Calculations Summary. MN Energy Code Part
76.70.080.
6. A S.A.C. determination must be completed by the Metropolitan Waste Control
Commission. Contact lody Edwards at (612)-602-1113.
7. Ventilation for the building must meet UBC Chapter 12. Provide 15 CFM of
ventilation per occupant.
8. Provide a recycling area. MSBC 1300.4700.
9. Recalculate the 100% allowable area increase. The west setback is approximately
30 feet. Per UBC Section 505 open on four sides: 30' - 20' = 10'..10' X 5% = 50%
allowable increase. Suggest using separation on 3 sides.
10. Future additions may be limited by construction type and location on the property.
11. On-site sewer system and well abandonment plan.
12. Insulation details.
13. Separate permits are required for plumbing, HVAC, fire suppression, electrical, sewer
and water, etc.
14. Sign permits from the Building Department and from the Zoning Department are
required.
15. Site plan elevations to determine drainage and handicap access.
16. Curb cut details for handicap access.

The following issues need to be addressed prior to the issuance of a building
permit:
. Section 5-4-3 Height Regulations allows the Board of Adjustment to grant
variances for structure heights greater than 35' for spires. The proposed
Zoning Ordinance allows for 50% increased height for spires without a
variance.
. Need a landscape plan. Section 5-5-10 Landscape Requirements applies.
Specifically, entry plantings, perimeter trees (1 per 40'), parking lot screening
(30' berm with plantings), sod, irrigation system, 5% of parking lot to be
landscaped, and a Letter of Credit for the required landscaping.
. Parking- Based on 5100 sq. feet is assembly, 10 square feet per seat =510
capacity. 1 per 4 seats = 128 stalls, Plus 9 for office (1 per 250 sq. feet, and
1 per classroom for up to 30 students) = TOTAL 137 stalls required, 103
provided.
. Need a lighting plan. 0-1 foot candles at the property line.
. Signage- Monument must be setback 10' and not in the 40' c1earview
triangle. Maximum height above centerline grade is 6'. Maximum allowable
area is 75 square feet per side, 2 sides maximum.
. Need Cross Access Agreement for shared driveway.
. This property is zoned C-1 SO. Impervious Surface cannot exceed 30%.
. Engineering Issues: driveway width appears to be too narrow, 24' minimum
2 way? Ponding Requirement? Water sewer hook-ups need to be
addressed.
