Excavating/Filling Permit 97-10
Dear Frank:
I had an opportunity to review the above mentioned application as well as your ordinance
on the matter. I first contacted the City of Prior Lake regarding this operation on October
8, 1997. On that day, I personally contacted Verlyn from your Public Works Department.
At that time, there was no permit issued. However, Verlyn stated he would investigate the
complaint. The Shakopee Mdewakanton Sioux Community visited the site and
photographed the operation underway on October 8, 1997. Pictures of the site are
enclosed. It is my belief that if City staff made a visit to the site on October 8, 1997,
the operation would have been stopped, pending a complete application.
The SMSC Land and Natural Resources Department stayed in contact with various City
staff members. However, it was not until the Community requested a copy of the above
mentioned permit did I find out that the operation was operating without a permit for at
least 15 days. Likewise, on October 27, I contacted Sue McDermit and she indicated that
a permit had been issued. However, according to the ordinance, the application lacks a
complete excavation plan, an erosion control plan as specified in Section 9-6-4 paragraph
9. For instance, the existing site map does not:
. Delineate all streams located on, and immediately adjacent to the site.
. Delineate natural drainage patterns on and immediately adjacent to the site.
. Identify the receiving stream of the unaltered site where storm water collects.
. Describe the soils of the site.
· Provide a map indicating soils types.
The permit does not contain a landscape plan of the developed site and other information
pertinent to the particular project. From our indication, the staff did not contact us with
regard to the extraction permit. The Community maintains a water production well less
than 200 feet from the site. No analysis was done by the city staff to review the effect of
this permit with respect to the Community well. Although the Community and the City
have a government to government relationship, we certainly do not want matters like this
to affect our working relationship.
