HomeMy WebLinkAbout5H - CIC 1118 Plat Approval MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT JUNE 16, 2003 5H JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1118 (TIMBER CREST PARK VILLAGE HOMES) CIC PLAT History: On September 30,2002, the City Council adopted Resolution 02-135 approving the preliminary plat for Timber Crest Park. The preliminary plat consisted of 28.19 acres to be developed with 148 townhouse units. On November 18, 2002, the City Council adopted Resolution 02-189, approving the final Plat for Timber Crest Park. This final plat included all of the proposed lots. Current Circumstances: The applicant is requesting approval of a Common Interest Community (CIC) plat. The purpose of a CIC plat is to allow the subdivision of townhouse or condominium units into lots for each individual unit for sale to individual owners. Essentially, the plat creates a lot around the four walls of an individual unit. CIC plats are typically done following the actual construction of the buildings in question. This is the first of the Timber Crest Park Village CIC plats. It includes 8 units. The CIC plat does not change the number of units or the density of the development. Staff has reviewed the CIC plat and finds it consistent with the approved preliminary and final plat. The Issues: CIC plats do not require a development contract. The required developer improvements were included under a previous final plat, so a Letter of Credit is not necessary. Staff will be available to discuss the details of this plat with the Council. Budget Impact: There are no budget impacts with the approval of these CIC plats since the building has already been built. The City Council has three alternatives: 1. Adopt a Resolution approving the Common Interest Community Number 1118 (Timber Crest Park Village Homes) CIC Plat. 2. Deny the resolution approving the CIC plat. 3. Defer this item and provide staff with specific direction. The staff recommends adoption of Alternative #1 as part of the consent agenda. A motion and second to adopt a resolution approving the Common Interest Community Number 1118 (Timber Crest Park Village Homes) C Plat and authorizing the Mayor and City nag to . n e CIC plat documents is required. 1:\03 files\03 subdivisions\03 cic\timber crest park village\cc report.doc Page 2 RESOLUTION 03-XX RESOLUTION OF THE PRIOR LAKE CITY COUNCIL APPROVING THE COMMON INTEREST COMMUNITY NUMBER 1118 (TIMBER CREST PARK VILLAGE HOMES) CIC PLAT MOTION BY: SECOND BY: WHEREAS: On September 3, 2002, the City Council approved the preliminary plat known as Timber Crest Park, subject to conditions identified by Resolution 02-135; and WHEREAS: On November 18, 2002, the City Council adopted Resolution 02-189 approving the final plat of Timber Crest Park; and WHEREAS: The City Council has found that the Common Interest Community Number 1118 (Timber Crest Park Village Homes) CIC Plat is in substantial compliance with the approved preliminary plat and final plat for Timber Crest Park; and WHEREAS: The City Council has approved the Common Interest Community Number 1118 (Timber Crest Park Village Homes) CIC Plat. NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, prior to release of, and recording of said plat: 1. The recitals set forth above are incorporated herein as if fully setforth. 2. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date of final plat approval. Failure to record the documents by August 16, 2003, will render the CIC plat null and void. 3. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
