DISCUSSION: . Introduction
This agenda item accepts bids and awards a construction contract for the
Brooksville Hills Phase I Improvement Project.
Historv
On July 16, 2007, Council adopted Resolution 07-127 ordering the preparation of
a Feasibility Report for those projects in the 2007 Capital Improvement Program
(CIP) required to follow the Minnesota Statutes Chapter 429 special assessment
process. The Minnesota Statutes Chapter 429 process is required because the
City Council intends to use special assessments to pay a portion of the project.
The roadways studied in the report include Brooks Circle, Fillmore Avenue,
Franklin Trail, and Itasca Avenue. The 2008 Improvement Project is Phase One
of a two phase improvement project. The recommendation of the Feasibility
Report was to proceed with this project.
On November 19, 2007, Council adopted Resolution 07-193 accepting the
Feasibility Report and calling for a Public Hearing on December 17, 2007 for the
2008 Improvement Project.
At the December 17, 2007 Public Hearing, four persons spoke regarding the
project. Comments included concern regarding the pond construction, desire not
to have sidewalks added to the project, and compliments on the rain garden
program.
In addition to the Public Hearing, the City has held two informational meetings to
discuss the project. The last informational meeting was an open house held on
January 9, 2008 and offered residents the opportunity to comment on the
proposed plans. At the open house persons from 16 homes were represented.
City Staff explained the proposed design and took down names for those that
were interested in private driveway restoration. Since the open house, City Staff
has been busy finalizing the design and preparing the plans and specifications
for bidding.
On February 4, 2008, the City Council authorized the advertisement for bids on
this project. Bids were received on March 19, 2008
The project includes storm sewer, sanitary sewer, water main, concrete curb and
gutter, aggregate base, bituminous surfacing, raw water main and appurtenant
work.

Current Circumstances
The City received 14 bids on March 19, 2008. The bids have been checked and
tabulated. S.M. Hentges and Sons Inc. from Jordan, Minnesota submitted the
low bid in the amount of $1,245,733.25. The lowest bid was 30% or $523,275.75
below the engineer's estimate of $1,769,009.00. The bid summary is provided

BID REJECTED
S.M. Hentges and Sons Inc. is a responsible Contractor and has recently
completed the City's Downtown Project, Ring Road Project, and the Hawk Ridge
Sidewalk Project. S.M. Hentges is also under contract to construct the Ida Circle
Improvements. In addition to those City projects, S.M. Hentges and Sons Inc.
has performed considerable work in Prior Lake for the Scott County Highway
Department. These projects include County Road 82, County Road 21 (Franklin
to Adelmann), County Road 83 and County Road 42. Staff recommends that the
City Council award the contract to S.M. Hentges and Sons Inc. as the lowest
responsible bidder.
As discussed previously, the City is utilizing a number of strategies on this project
to reduce costs and protect the wellhead area. These strategies include:
reducing the street widths to 28 feet, construction of a pond in Cardinal Ridge
Park, a voluntary rain garden program, and construction of raw water lines for the
new water treatment facility.
ISSUES:
This project is proposed to be paid for from a number of different funding
sources including: Assessments, Tax Levy, Enterprise Fund, Water Quality
Fund, and Trunk Sewer and Water Fund. Assessments will be based on 40% of
the street and storm sewer improvements. The remaining 60% will be paid
through the tax levy. The City will use the Trunk Sewer and Water Fund to fund
the raw water main improvements. The Water Quality Fund will be utilized to pay
for the pond construction in Cardinal Ridge Park and the voluntary rain garden
program. The Enterprise Fund will be utilized for the sanitary sewer and
watermain improvements. Based on the low bid, all funding sources realized a
significant savings from the budgeted amounts. Quantity overruns or change
orders may affect these overall savings. Prior to the Assessment Hearing, City
Staff will evaluate the quantities for final assessment calculation.

NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are hereby authorized to enter into the City's standard contract with
S.M. Hentges and Sons Inc. of Jordan, Minnesota in the name of the City of Prior Lake for the
Brooksville Hills Phase I Improvement Project (Project #08-011) in the amount of $1,245,733.25.
3. The City Manager is hereby authorized and directed to return to all bidders the deposits made with
their respective bids.
4. The funding sources for the Brooksville Hills Phase I Improvements are as follows:
