()f1~..~ 4.B 96-026 - MURIEL ROUNAVAR VARIANCE REQUEST FOR 16594 r C- INGUADONA BEACH CIRCLE: STREET AND LAKESHORE VARIANCE fJ^ REQUESTS. The Planning Department received a variance application from Muriel Rounavar who proposes the constn,lction of a new house with attached 3-car garage on the subject site, which is legally identified as Lots 6 and 7, "INGUADONA BEACH", Scott County, Minnesota. The applicant requests 3 variances; 1) a 17.5' lakeshore variance to permit a lakeshore setback of 37' instead of the 54.5' feet permitted under the lakeshore setback averaging provision of the Shoreland Ordinance, and 2) a 5' front yard setback variance to permit a setback of20' instead of the required 25', Michael Leek presented the information from the Staff Report dated April 8, 1996. Staff concluded reasonable use of the property can be had, and legal alternatives exist to accomplish the applicant's objectives and thus the Ordinance criteria had not been met. Patrick Lynch, III, Area Hydrologist of the Department of Natural Resources submitted a letter of objection to the requested variances stating he does not feel an adequate attempt to design a structure which considers the lot constraints and required provisions of the Shoreland Zoning Ordinance had been made. Comments from the public: Bud Waund spoke on behalf of the applicant and the current owners ofthe property. Mr. Waund handed out information packets to the commissioners and went on to explain the proposal and changes. He said he met with Staff and was told of the new Shore land Ordinances and realized the proposed home was too large for the lot. According to Mr. , Waund's calculations and compromises the house does fit into the building envelop. Staff did not previously view the revised plan and calculations. Muriel Rounavar, 16037 Northwood Road NW, lived on Prior Lake for 5 years and owned lake property in Michigan for almost 30 years. She is aware of ecology and the environment and is not trying to put a white elephant on the lot. She feels she is not MN040896.DOC PAGE 6 asking for the world just asking to be fair and would like to see her home on this property. Bill Brastad, 4808 11 th Ave South, Minneapolis, stated they bought the property 42 years ago and at the time the property was in Spring Lake Township. It was a summer cottage. All the neighbors have turned their summer homes into year round homes. He would like the applicant to have the home she really wants. He has been at other hearings and applicants were granted several variances. He is urging for a fair setback from the lake so the buyer's home will not have to be back further from the rest of the neighbors. A recess was called at 8:50 p.m. The meeting reconvened at 8:57 p.m. Comments from Commissioners: V onhof: · Clarification from the staff and applicant's lakeshore measurement. Leek read Ordinance Sec. 9.3D2 regarding setback averaging from the Ordinary High Water (0- H- W) mark or 50 feet whichever is greater, and further explained the measurements. · Measurement from lakeshore - Leek explained the 904 O-H-W measured from the adjoining lots. There is a specific survey that shows the 904 O-H- W elevation. · Cannot see where the hardship criteria has been met especially with the building envelop. Wuellner: · Cannot disagree with V onhof. The law is very exact. · There is no choice but to deny the request. The hardship criteria has not been met. A home can be built within the envelop. Criego: · No further comments. Loftus: · Leek explained the average lakeshore setback. · Rye said the operable dimension is now a setback of 37 feet. · The neighbors are closer to the lake because of existing variances and circumstances. · Question of property being a substandard lot in the Shore land District. Leek stated the lot exceeds 10,000 sq. feet which is substantially larger than the 7,500 sq. feet which is buildable without a variance under the Shoreland Ordinance. · The slope is not a location issue. · Mr. Waund said they are proposing a triple garage. Also a neighbor is interested in buying part of the adjoining Lot 8. If applicant sold part of the lot, she would be able to build the house she designed. They could shift the house on the lot. · Leek said there are a couple of issues related to that and pointed out the lakeshore measurement. Selling part of the lot is shrinking the building envelop. It would also MN040896.DOC PAGE 7 require an administrative land division where variances would be required. The process would have to be approved by City Council. There are many variables being talked about. Kuykendall: . Based on the information there is a buildable area of 40 feet by approximately 75 feet. . Waund: The new plan for the house is proposed at approximately 2,900 sq. feet including the garage. . Leek asked what is the proposed finished lower level of the house be? Mr. Waund said where between 2,200 and 2,300 sq. feet. . The Commission has to work within the variance hardship standards. The applicant can put a reasonable one story house as well as a two story house on the lot. Muriel Rounavar said she wanted a one story as a retirement home and wants all living space on one floor. She doesn't feel the neighbors would like a two story house. Bob DeMarse, 16576 Inguadona Beach Circle, said there is probably not a legal lot size in the area. The applicant would make a reasonable improvement to the area. MOTION BY VONHOF, SECOND BY CRIEGO, TO DENY THE APPLICATION BECAUSE OF FINDING A LACK OF DEMONSTRATED HARDSHIP UNDER THE ZONING ORDINANCE CRITERIA UNDER RESOLUTION 96-12PC. Discussion: The Commission has to follow the restrictions and ordinance. The applicant can build a very nice house within the building envelop. Chairman Kuykendall will draft an annual report. There was a short discussion on Planned Unit Developments. Upon a vote taken, ayes by Andren, Greenfield, and Mader; nays by Kedrowski and Schenck, the motion carried. F. Consider Approval of Resolution 96-43 Denying a Variance Appeal by Muriel Rounavar of Planning Commission Decision in Case 96-026. - The item was introduced by the Mayor, and Planner Leek explained the request and recommendation per the Staff Agenda Report. The Mayor recognized the petitioner, Ms. Muriel Rounavar, who noted the characteristics of the lot, her desire to not have a narrow dwelling, and the need for a single level living area. She said site and building aesthetics are important. She does not want to put up retaining walls. She introduced Mr. Bud Waund who presented photos and graphic information about the site and the proposed home. He questioned comments by Department of Natural Resources staff regarding the variance, and terminology in City staff report, which were referenced by the Planning Commission. He offered a "reality check" on the ordinance variance hardship standard. He referred to the buildable areas on lots in several newer subdivisions. He said the petitioner is seeking permission to build on a smaller area or "envelope." Also, he cited the typical size of lots in the Sand Point area. He summarized the bases for the two variances, and stated the proposed home would significantly enhance the area. Councilmember Schenck questioned whether the graphic information presented by Mr. Waund was the same as in the agenda packet. Mr. . Waund said the material presented was different, and staff just received the survey because the petitioner just got it. The City Attorney inquired whether the deck shown on the graphics presented to the Council was involved with the variance. Planner Leek said it was not evaluated since it was not part of the original submittal. Mr. Waund said the deck is proposed and w~ designed to comply with ordinance standards. A brief discussion ensued about the deck which would be required to comply with ordinance minimum standards or a separate variance would be required before a permit would be issued. The Mayor asked if "setback averaging" were used, would variances be required? The variance action requested would still be needed. The Mayor questioned the relevancy of averaging since it did not account for line-of-sight or view considerations. Planning Director Rye commented on averaging provisions of the Shoreland Management Ordinance. Councilmember Greenfield inquired about the setbacks of adjoining structures. Planner Leek responded referring to the available site data. Councilmember Kedrowski asked whether the proposed deck would impact ground coverage calculations; Planner Leek said it would not since decks are not calculated as impervious surface. NEW BUSINESS A. Consider Approval of a Lease Agreement with Scott County for Radio Transmitter for Police Communications. - The item was introduced by the Mayor. The City Manager explained the proposed agreement and the recommendation. MOTION BY GREENFIELD, SECONDED BY KEDROWSKI, TO APPROVE THE LEASE AGREEMENT BETWEEN SCOTT COUNTY AND THE CITY OF PRIOR LAKE REGARDING A RADIO TRANSMITTER FOR POLICE COMMUNICATIONS AND TO AUTHORIZE THE MAYOR AND CITY MANAGER TO EXECUTE THE AGREEMENT. Consider Review of Outstanding 1995 and 1996 City Council Directives. - The City Manager reviewed the Staff Agenda Report. Michael Leek Associate Planner/Acting Assistant Planner Consider Approval of Resolution 96-43 Denying a Variance Appeal by Muriel Rounavar of Planning Commission Decision in Case 96-026 May 6, 1996 AGENDA #: PREPARED BY: SUBJECT: INTRODUCTION: On March 25,1996, by Resolution 9612PC (a copy of which is attached) the Planning Commission denied the request of Muriel Rounavar for 1) a 13 foot lakeshore setback variance to permit a lakeshore setback of 37 feet instead of the 50 feet permitted under Section 9.3(0)2, and 2) a 5 foot front yard setback to permit a front yard setback of 20 feet instead of the required 25 feet. The variances were requested in connection with the proposed construction of a new house with attached 3-car garage on property located in the R 1- Suburban Residential and SO - Shoreland districts. The applicant appealed the decision of the Planning Commission, stating "The Building Envelope is too small... ." Initial references to a setback variance of 17.5 feet were based on the setbacks shown on the applicant's survey for the adjacent properties. It was discovered that this survey did not reflect the setback variance granted in 1995 for Lot 5, Inguadona Beach. As a result of the variance granted to Lot 5 the average lakeshore setback would be less than 50 feet, and thus the permitted setback would be 50 feet. ANALYSIS: The Commission's denial of the requested variances was based the following factors; 1. The large size of the subject site (12,332 square feet in area and 111.06' wide at the right-of-way line), 2. The fact that the Section 9.3(0)2 of the Ordinance allows a lakeshore setback of 50 feet rather than 75 feet, and 3. The size of the legal building pad (about 3,445 square feet). The Commission concluded that the applicant could readily construct a similarly-sized residence on the subject site while 16200 ~~&~R~~.E., Prior Lake, Minnesota 55372-1714 / Ph. The survey accompanying the attached report to the Planning Commission identifies the required front and lakeshore setback lines, and clearly demonstrates that there is ample, legal buildable area on the subject site. Judicious redesign of the proposed house and garage would bring them into compliance with the required setbacks, while still permitting a similarly- sized (and substantial) house. ALTERNATIVES 1. The City Council may uphold Ms. Rounavar's appeal of the Planning Commission's denial of her request for variance. 2. The City Council may uphold the denial by the Planning Commission of Ms. Rounavar's request for variance. DISCUSSION: The subject site is wider than required by either the R1 or Shoreland districts. It measures 111.06' along the front property line and 101.20' along the lake shore side, as opposed to 86' and 90' front widthl75' width at OHW required by the districts respectively. At 12,332 square feet in area, it larger than required by the R1 district and the minimum required for non-conforming lots in the shoreland districts (12,000 and 7,500 square feet respectively) There is a narrow strip of land between the property boundary and shoreline. The survey provided by the applicant does not indicate the area of the proposed house. Staff "digitized" the area, and found that the footprint of the house contains about 2,022 square feet. The garage measures about 34' x 34', or about 1132 square feet in area. The proposed driveway is 30' wide at the street; the Zoning Ordinance permits a maximum driveway width of24' at the curb. The survey indicates that impervious surface coverage would be 29%, i.e. less than the permitted 30% coverage. However, the surveyor has included a note that the calculation was based on calculations provided by the owner, and was not verified by looking at a house plan. The communication from Bud Waund, agent for the applicant, to Michael Leek of City staff (a copy of which is attached) indicates that he has used the setbacks for adjacent Lots 5 and 8 in drawing the proposed setback lines. The survey does not show the 46' lake shore setback granted last year for an addition on Lot 5/16604 Inguadona Beach Circle. This grant of this variance was based on the small size of the lot (6,300 square feet), its narrowness (50.71' at the street), and the severe slope on the property. (See Res. 9532PC, a copy of which is attached. Attached to this report is a copy of the survey submitted by the applicant which shows the approximate location of the lake shore setback line permitted under Section 9.3(D)2 and the front setback line. As can be seen from this illustration, there is ample buildable area on the site is the setbacks requirements are met. The minimum distance between these 2 setback lines is about 40'. Variance Hardship Standards: 1. Literal enforcement of the Ordinance would result in undue hardship with respect to the property. This criteria goes to whether reasonable use can be made of the property if the Ordinance is literally enforced. It also goes to whether the applicant has legal alternatives to accomplish the development efforts without the requested variances. The subject site in this case is quite large, and its "buildability" is enhanced by the ability to make use of Section 9.3(D)2 of the Shoreland Ordinance, which reduces the required lake shore setback to 50'. The building pad which results when the setback requirements are applied is also quite large, and would permit reasonable use of the property in the form of the construction of a very substantial house with attached garage. For the above-stated reasons, this criterion is not met. 2. Such unnecessary hardship results because of circumstances unique to the property. Because staff has concluded that literal enforcement of the Ordinance would not result in undue hardship, this criteria is, de facto, not met. Moreover, by virtue of its size and shape, the subject site has no unique characteristics which would necessitate the granting of the requested variance. 3. The hardship is caused by provisions of the Ordinance and is not the result of actions of persons presently having an interest in the property. Because staff has concluded that there would not be an undue hardship if the Ordinance were literally enforced, this criterion is not met. survey. 9626V APC.DOC 2 4. The variance observes the spirit and intent of this Ordinance, produces substantial justice and is not contrary to the public interest. The applicant's request is an example of what is sometimes referred to as "variance/setback creep", i.e. the granting of a variance for one property gives rise to increased requests on adjacent or nearby properties based on the argument that the requested variance is insignificantly greater. Particularly in this case involving a site with substantial buildable area, this sort of "creep" runs counter to the spirit and intent of the Ordinance, and is contrary to the public interest. AL TERNA TIVES: 1. Approve the variances requested by the applicant, or approve any variances the Planning Commission deems appropriate in the circumstances. 2. Table or continue discussion of the item for specific purpose. 3. Deny the application because the Planning Commission finds a lack of demonstrated hardship under the Zoning Ordinance criteria. RECOMMENDATION: Because staffhas concluded that reasonable use of the property can be had, that legal alternatives exist to accomplish the applicant's objectives, and thus that the Ordinance criteria are not met, staff recommends Alternative No.3. Based upon my review, I wish to express opposition to the granting of the variance as requested. Setback averaging was designed to address situations like this one whereby development could occur within the required setback area wi1hout variance. No attempt has been made to meet the standard. Allowing this home closer to the lake will establish a new benchmark for setback averaging when the adjacent parcels are re-developed. The applicant does not appear to have made any effort to design a structure that considers the constraints of the shallow lot. I note the north wall of the three-stall garage is 34"long. This is a great deal longer than a standard garage. If it were reduced to a two stall garage, the entire structure shifted north on the lot, and living space were added to the rear of the garage, I believe the lake setback variance could be eliminated. I have seen better attempts to comply with the required zoning provisions on lots a lot smaller and shallower than this one. The plan does not indicate whether or not a deck is included in the design. The applicant should be made aware that a deck must also meet structure setback. The home design should be looked at carefully to see if doors are included which may result in request for future variance if/when a future addition is planned. I trust the applicant will be required to demonstrate hardship before the Planning Commission. I look forward to reviewing the Findings of Fact and Conclusions for this variance request.
