Dear Property Owner:
This letter is to notify you that your property is proposed to be assessed for the improvements of
Pike Lake Trail. Please fmd enclosed an Assessment Hearing Notice for Public Improvement
Project #97-17. TIlls notice will be published in the October 18 and October 25, 1997 Prior Lake
American and describes the notice of improvements and the area to be assessed.
The Assessment Hearing is scheduled to be held on November 3, 1997. To provide 14 days
notice on the assessments to the property owners, we have prepared the assessments based on the
actual bid amount received for this project. The proposed front footage rates area as follows:

You may pay the total amount of your Statement of Special Assessments within 30 days after the assessment
hearing without interest. Partial prepayments of assessments will also be accepted, but only within the 30 days

INTRODUCTION:
The purpose of this agenda item is to conduct the Assessment
Hearing and consider adoption of Resolution 97 -XX, approving
the assessment roll, for projects 95-07 Mushtown Road and 97-
17 Pike Lake Trail.
BACKGROUND:
At its regular meeting of October 6, 1997, the Council approved
.. Resolution 97-87 which declared the cost to be assessed and
ordered the preparation of the assessment roll. Also Resolution
97-88 was approved establishing the date of the Assessment
Hearing as November 3, 1997, for the Mushtown Road and Pike
Lake Trail improvement projects.
DISCUSSION:
All benefiting property owners have been mailed a Statement of
Special Assessments which included information pertinent to their
property such as. the total assessment amount and the
assessment rate. A Public Hearing notice has been mailed to
each property owner indicating time and place of the Assessment
Hearing. The Public Hearing Notice has also been published in
the newspaper for two weeks. As of this writing staff has not
heard anything from the property owners.

The assessment rates were calculated per the City's Assessment
. Policy based upon 100% of the assessable project cost for street, .
sewer, and water improvements assessed to the benefiting
properties.
The AssesSment Review. Committee met to evaluate the
. . proposed . 'assessments and made the following findings and
~mmendations to the City Council:

1) In accordance with the policy, some costs are not assessed.
For example, the extra cost to construct the streets to a 9 ton
design is not assessed because a typical residential street is
designed to a 7 ton standard. Also, in accordance with the policy,
the sidewalk portion of these projects is not included in the
assessments to the benefiting properties. Further, oversizing of
the storm sewer on Pike Lake Trail, in accordance with the policy
is not included in the assessments to the properties. Therefore,
the cost for sidewalk, upgrading the roadway from 7 ton to 9 ton,
and oversizing the storm sewer on Pike Lake Trail was su btracted
from the total project costs to calculate the assessments.

2) The Assessment Review Committee recommended that the
Front Footage Assessment method be used for both projects. For
the Mushtown Road project the recommended front footage rate
of assessment for street/stann sewer is $67.50/FF (per front foot).
For the Pike Lake Trail project the recommended front footage
rate of assessment for street/storm sewer is $151.30/FF; for
sanitary sewer, $7.7l1FF; and for watermain. $25.68/FF.
3) Mushtown Road has a total project cost of $387,642.36. It is
proposed to be funded through tax levy and assessments. There
are 14 benefiting properties in the project area. Thirteen
properties are within the Woodridge Estates 3rd Addition and one
property is in the Windstar Addition. As part of the developer's
agreement for the Woodridge Estates 3rd Addition, the developer
pledged $85,177.00 towards the project to pay the assessments
on the 13 lots in Woodridge Estates. The City has a Letter of
Credit from the developer for this amount It is recommended that
$292,340.36 be paid through tax levy and $95.302.00 be
assessed against the benefiting properties. A copy of the
assessment role is atta~hed showing the proposed assessments
. per parcel. '
4) Pike Lake Trail has a total project cost 01$520,709.10. It is
proposed to be funded' through tax levy,. municipal state-aid
funds, . trunk reserve, and assessments. There are 5 benefiting
. properties in the 'project ~a, which include Holy Cross ~utheran
'Church, two parcels owned by Herb Wensmann, one parcel
owned by EdVieriing, and one lot in -the Maple Hill plat owned by
Dave Triebel. It is recommended that $160,144.30 be paid
. through tax levY, municipal state-aid funds, and trunk reserve;
and $360,564.80 be assessed against the benefiting properties. ',' "

Each assessable frontage was detennined per the City's
Assessment Policy u1Jlizing the existing plat drawings on file for
these areas. In the event that a property owner provides a
surveyor justification that the frontage for a parcel is incorrect, the
City Council can adjust the frontage for the parcel and the
resulting assessment
The assessment terms are to be for ten (10) years for paving, and
twenty (20) years for sewer and water. Added to the first
installment (1998) will be an additional 58 days of interest which
accounts for 'the remainder of 1997 following the Assessment
Hearing. An interest rate of 8% will be charged in accordance
with City Assessment Policy.
Prior Lake Code, Chapter 1-13 allows for the defennent of
assessment principal and interest if the following four criteria are
satisfied:
1. Applicant must be 65 years of age or older.
2. The qualifying property must be the homestead of
the applicant
3. Annual gross income shall not exceed the income
limits as set forth by family size according to
Attachment aA- of Ordinance 86-3.
4. Total special assessment to be deferred must exceed
$1000.00.
The property owners have a right to appeal their assessments as
per Minnesota Statutes Chapter 429. Written objections must be
signed and filed with the City Manager prior to the Assessment '
Hearing or presented to the Council at the Hearing.

Resolution 97-87 declared the amount to be assessed on these
projects as $455,850.65. While preparing the Notices to the
property owners it was discovered that there was a $16.15 total
shortage error in the declared amount to be assessed. The
correct amount should have been $455,866.80. The preliminary
assessment rolls were correct as to the assessments to each
parcel, however the math was in error when the total to. be
assessed was calculated for the resolution. We determined there
'. was a $0.60 mathematical error on the Mushtown Road project
and a $15.55 mathematical error on the Pike Lake Trail project.
The notices o(the amount to be assessed on each property sent
to the property owners were correct.
The focus of tonight's hearing is whether the properties have
benefited because of this project, and whether the assessment
has been calculated accurately and in accordance with city policy. .
The alternatives are as follows:
1. Approve Resolution 97 -xx adopting the assessment
roll as submitted.

2. Approve Resolution 97 -xx subject to Council

3. Continue the hearing for a specific reason.

RESOLUTION ADOPTING ASSESSMENTS FOR PROJECTS 95-07 MUSHTOWN'ROAD
IMPROVEMENTS, AND 97-17 PIKE LAKE TRAIL IMPROVEMENTS
MOTION BY: SECOND BY
WHEREAS, pUisuant to proper notice duly given as required by law, the Council has met and
heard and passed upon all objections to the proposed assessments for projects
95-07 Mushtown Road improvements, and 97-17 Pike lake Trail improvements I
and has amended such proposed assessment as it deems just.
NOW, THEREFORE, BE IT RESOL VEn BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
1. Such proposed assessment as amended, a copy of which is attached hereto
and made part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessments shall be payable on an equal principal method extending
over a period of ten (10) years for paving, and a period of twenty (20) years
for sanitary sewer and water. The first installment shall be the annual
principal plus interest calculated from the Public Hearing date to the end of
this year plus twelve months of the next year and shall bear interest at the
rate of eight (8) percent per annum from the date of adoption of this
assessment resolution. To the first installment shall be added fifty-eight (58)
days of interest on the entire assessment from the date of this resolution
until December 31, 1997. To each subsequent'installment when due shall
. be added interest for one year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification
of the assessment to the County Auditor, pay the whole of the assessment
on such property, with interest accrued to the date of the payment except
that no interest will be charged if the entire assessment is paid within thirty
(30) days, and the individual may at any time thereafter, pay to the City's
Finance Director the entire amount of the assessment remaining unpaid,

excepting the installment portion appearing upon the current year's property
tax statement '
4. The City Manager shall forthwith transmit a certified duplicate of this
assessment to the County Auditor to be extended on the property tax lists of
Scott County. Such assessments shall be collected and paid to the City in
- same manner as other municipal taxes.
5. The final project cost apportionment has been detennined to be
$908,351.46 of which $292,340.96, $127,325.00, and $32,818.70 shall be
paid from Tax Levy, Municipal State Aid, and the City's Trunk Re~erve Fund,
respectively, and $455,866.80 to be assessed to the benefited property
owners as per the attached assessment roll.

WHEREAS, pursuant to proper notice duiy given as required by law, the Council has met and
heard and passed upon all objections to the proposed assessments for projects
95-07 Mushtown Road improvements, and 97-17 Pike Lake Trail improvements,
and has amended such proposed assessment as it deems just.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA:
.1. Such proposed assessment as amended, a copy of which is attached hereto
and made part hereof, is hereby accepted and shall constitute the special
assessment against the lands named therein, and each tract of land therein
included is hereby found to be benefited by the proposed improvement in
the amount of the assessment levied against it.
2. Such assessments shall be payable on an equal principal method extending'
, over a period of five (5) years for Trunk Sewer and Water Acreage, a period
of ten (10) years for paving, and a period of ~enty (20) years for sanitary
sewer and water. The first installment shall be the annual principal plus
interest calculated from the Public Hearing date to the end of this year plus
twelve months of the next year and shall bear interest at the rate of eight (8)
percent per annum from the date of adoption of this assessment resolution.
To the first installment shall be added fifty-eight (58) days of interest on the
entire assessment from the date of this resolution until December 31, 1997.
" To each subsequent installment when due shaH' be added, interest for one
year on all unpaid installments.
3. The owner of any property so assessed may, at any time prior to certification
of.the_assessment to the County Auditor, pay the whole of the assessment
on such property, with interest accrued to the date of the payment, except
that no interest will be charged if the entire assessment is paid within thirty
(30) days, and the individual may at any time thereafter, pay to the City's

5. The final project cost apportionment- has been ,determined to be
$908,351.46 of which $292,340.96, $127,325.00, and $32,818.70 shall be
, paid from Tax Levy, Municipal State Aid, and the City's Trunk Reserve Fund,
respectively, and $455,866.80 to be assessed to the benefited property
owners as per the attached assessment roll.
6. The Trunk Acreage Assessment has been determined to be $16,467.50
and is to be asessessed to the benefited property owners as per the attached
assessment roll.

INTRODUcuON:
The purpose of this agenda item is to consider the approval of the
attached Feasibility Report and call for a Public Hearing on 1997
Improvement Projects.
BACKGROUND:
At the January 21, 1997, City Council meeting, Council authorized
staff to prepare a Feasibility Report for the 1997 Improvement
projects as approved by the Council in the 1997-2001 Capital
Improvement Program.
In the adopted Resolution No. 97-03, the following five project
areas were listed to be considered for the report:
1. Mushtown Road from approximately 1,400 feet south of Tower-
Street to the southeast for 2,900 feet to a point approximately
800 feet beyond Ridgewood Court by the construction of
grading, storm sewer, aggregate base, concrete c:.rrb and gutter,
trails, bituminous surfacing, and appurtenant work (Includes
580 feet originally contemplated for construction in 2001).
2. Pike Lake Trail from CSAH 42 south to the proposed north
plat line of Knob Hill by the construction of grading, storm
sewer, utility improvements, concrete curb and gutter,
sidewalk, bituminous surfacing, and appurtenant work.
3. CSAH 42 from Femdale Avenue west to McKenna Road by
the construction of grading, storm sewer, aggregate base,
concrete curb and gutter. trunk sanitary sewer md wate~ain,

project to be constructed with CSAH 21 improvements from
CSAH 82 to CSAH 42).
. 4. Sealcoating of bituminous paved streets throughout the City.
5. Paving of Lakefront Park roads, trails and parking lots by the
construction of grading, storm sewer, aggregate base, concrete
curb and gutter, bituminous surfacing, and appurtenant work.
In the attached Feasibility Report, there are two projects in which a
portion of the cost will be assessed to the benefiting properties.
The projects are as follows:
1. Street reconstruction of Mushtown Road from 1,400 feet south
of Tower Street to 800 feet south of Ridgewood Court to local
City Street Standards.
2. Street reconstruction and utility extensions of Pike Lake Trail
from CSAH 42 south to the north plat line of Knob Hill to
Municipal State Aid Standards.
Also included in the Feasibility Report are other City projects in
which project financing can be leveraged against the MS Chapter
429 Assessment Bond. These projects include the following:
A. CSAH 42 from Femdale Avenue to McKenna Road, the City
cost share of improvement.
B. Seal Coating of bituminous paved streets throughout the City.
C. Paving of Lakefront Park roads, trails and parking lot.
DISCUSSION:
The attached report indicates the estimated City costs for each
project, along with preliminary assessment estimates. At the end
of the Feasibility Report, a project financing summary is included
to show project cost splits. The total estimated project cost of the
five projects is $1,449,135.00.
The following is a commentary on each project with regard to
project need:
Area 1- Mushtown Road
Mushtown road is required to be improved by the City as part of
the an.T'lexation agreement for the :::lat of Woodridge Estates. This

improvement was originally scheduled for 1996 and then
rescheduled to 1997 by the Council.
Mushtown Road has a 24-foot wide bituminous surface from
Panama Avenue (CSAH 23) south 1,400 feet to approximately the
south plat line of Maple Acres, and a 30-foot wide gravel surface
from the bituminous terminus and continues to the south to serve
the township.
A Feasibility Report for this project was prepared by MSA
Consulting Engineers in September, 1995 and determined the
estimated costs of this project and the special assessments against
the property known today as Woodridge Estates 3rd Addition. Per
the developers agreement for W oodridge Estates 3 rd a...'1d the
annexation agreement wit.~ Spring La...lce Township the developer is
required to pay his portion of the Mushtown Road improvements.
The developer has given the City a letter of credit for $85,177.19.
Two roads have been constructed within W oodridge Estates 3rd
Addition to the west edge of the plat and are proposed to connect
to Mushtown Road. Per the annexation agreement these roads
cannot connect to Mushtown until it is improved. The two streets
are Toronto Avenue and Ridgewood Court.
The original feasibility report did not include the installation of a
8' bituminous trail from Toronto A venue to the proposed trail to
the Ponds Athletic complex nor did it include extending the
roadway improvements. This increased the length of the project by
approximately 580 feet. The extension of Mushtown Road
Improvements, an additional 580 feet southerly in the Township, is-
to intersect with a proposed second access road to the Ponds which
was funded as part of the 1996 Park budget and Department of
Natural Resources Grant. This work is to be completed this year
so a gravel access is available. The park access road will be
surfaced with bituminous next year.
'Area 2 - Pike Lake Trail
Pike Lake Trail from CSAH 42 south to Carriage Hills Parkway is
approximately 1/2 mile long and is currently gravel. The plat of
Knob Hill has preliminary plat approval to realign Pike Lake Trail
slightly from Carriage Hills Parkway to approximately 1/4 mile to
the north. It appears that this phase of Knob Hill may be included
with the plat of Knob Hill North and the improvements could be
installed in 1997. Sanitary sewer, watermain, storm sewer, and
streets will be extended to the north plat line.

Scott County is proposing to improve the existing CSAH 42 from
Femdale Avenue west to McKenna Road in 1997 and with this
construction sanitary sewer and watermain will be extended and
stubs provided at Pike Lake Trail. This street construction provides
the opportunity to extend the sanitary sewer south anq loop the
watermain from the Knob Hill Subdivision.
The existing plat of Maple Hill which is located on the east side of
Pike Lake Trail approximately 600 feet south of CSAH 42, Gust
south of the Holy Cross Church) has petitioned the City for
sanitary sewer and watermain for their entire plat. Plans and
specifications have been submitted to the City for review. A
developers agreement is to be prepared to enable the home owners
association to install the utilities in the spring of 1997. Connections
to these utilities cannot be made until the utilities are installed
along Pike Lake TraiL
Area 3 - CSAH 42
Scott County proposes to upgrade' CSAH 42 to four lanes from
F emdaIe Avenue west to McKenna Road in 1997. Along with this
construction the upgrading of CSAH 21 will be bid and
constructed together and the County anticipates that the contractor
would need 2 years to complete the street reconstruction. The City
has bonded for $475,000.00 in 1996 to support our portion of
CSAH 21.
Sanitary sewer and watermain are proposed in conjunction with
this construction. Sanitary sewer is proposed to include a crossing
and the extension of sewer from Pike Lake Trail east to Rolling
Oaks Circle. Watermain trunk line is proposed to extend from~
Femdale Avenue west to Pike Lake Trail.
Street lighting and landscaping for CSAH 21 and CSAH 42 is
contemplated to "match" the existing segments but is not included
in this report. Street lighting on CSAH 21 would be accomplished
by NSP and landscaping by a professional firm subject to public
bids.
Area 4 - Sealcoatin~ of Streets
For four years the City has engaged in an annual program of crack
sealing, patching and seal coating. All three are done as preventive
maintenance to extend the life of the streets. As of 1996, all streets
built prior to 1993 have been seal coated where cost-effective.

this year. A program of cracksealing and patching will continue as

in past years. This will be 'funded exClusively through., the "
operating budget. There is no need to use bond proceeds for
sealcoating this year and it is recommended this project not
. advance any further. The sealcoating program will be revisited in
1998.
Area 5 - Lakefront Park
The City Council has earmarked $75,000 for Lakefront Park
Improvements in the 1997 Capital Improvement Program. The
allocation of these funds, if any, will be dependent upon the resultS
of the Parks and Library Referendum.
Staff will make a presentation on the Feasibility Report and will
discuss the merits of each project. Council can eliminate any
project or portions of a project at this time. The City is required to
assess a minimum of 20% of the bond amount per bonding
requirements.
If the Council approves the Feasibility Report, the Chapter 429
special assessment projects require public hearings to be conducted
prior to implementing the project. Staff would also conduct
Informational Meetings prior to the Public Hearings to help the
residents understand and answer any questions.
The 1997 improvement projects are proposed to be financed by
special assessments, property taxes, Street Collector Funds, and
Trunk Reserve Funds. Funding sources and amounts are as shown
below:

The feasibility report raises a number of issues for City Council
determination:
A. Mushtown Road
1.
The construction of the 580' of Mushtown Road within the
Township was originally contemplated for improvement by
the City in the year 2001 at a cost of $75,000 to be drawn
from the Collector Street Fund. The feasibility report
includes this segment as a bid alternate in hopes of

receiving a better price than if the project were done alone
in 2001. The sole reason for constructing the additional
580' is to provide for a second access and egress to Ponds
Park as contemplated in the park's development plans.
Attached is a Collector Street Fund recap for Council
information. The issue before the courts is Collection fees
received as part of the building permit. The issue of
Collector fees as part of the developer's agreement is not
part of this case. Of the total Street Collector Funding,
$308,330 were collected through developer'~ agreements.
While there is still some risk, there may be less risk
associated with this funding source than building permit
related Collector fees.
T'ne Council should determine if this segment should be bid
as an alternate or not at all. If bid, the Council will have to
decide the source of funding for this work. TIlls decision
can be made by the Council at bid award later this year.
B. Pike Lake Trail
1. Pike Lake Trail cannot be fully funded through special
assessments. Consequently, the expenditure of $114,104
from the Collector Street Fund is contemplated. Does the
Council believe ,such an expenditure to be appropriate?
Because Pike Lake Trail is a Municipal State Aid Road, an
MSA allocation could be used in lieu of the Collector Street
Funds. Currently, MSA funds are programmed for the
extension of Fish Point Road through Cardinal Ridge 5th
Addition.
C. CSAH 42
1.
Proposed landscaping and lighting improvements for
CSAH 42 are identical, to the improved segments of this
roadway. While amounts are not included in thefeasibility
report, landscaping would be contemplated to match the
easterly segments of the roadway within Prior Lake. The
work would be publicly bid. The lighting contemplated is
intersection only which is consistent with the remainder of
CSAH 42. Lighting would be installed by the public
utility. Does the Council believe that these proposals are
appropriate?

D. Lakefront Park
1. By, the time this report is received by the Council, we will
know if the referendum was successful. If so. the $75,000
Lakefront Park allocation should be deleted as such
improvements will be paid for by the referendum bond
issue. If the referendum is unsuccessful, the $75,000 would
be generally earmarked for Lakefront Park Improvements
in accordance with the master plan previously adopted by
the City Council.
ALTERNATIVES:
The alternatives are as follows:
1. Provide staff direction on each issue area and any others as the
Council deems appropriate.
2. Approve Resolution 97-XX receiving the Feasibility Report
and establish a Public Hearing date as per Resolution 97-XX
with amendments as., appropriate based upon the above
directions.
3. Table this item for a specific reason.
4. Deny Resolution 97-XX.
RECOMMENDATION: Alternative No.1 and 2. Staffrecornmends that the Council accept
the Feasibility Report for the 1997 projects and establish the Public
Hearing date as listed in Resolution 97-XX. Approval of the
Feasibility Report does not grant fmal approval of any project.

TYPE OF WORK
The improvements proposed for construction during 1997 include sanitary sewer,
watermain, storm sewer, sidewalk, bike path, bituminous overlayment, street surface
improvements, and street reconstruction, including grading, concrete curb and gutter,
retaining walls" boulevard restoration and appurtenant work. The proposed project
locations within the city limits of Prior Lake are shown by Exhibit 1. A brief description
of the improvements shown by Exhibit I is as follows:
AREA 1 - Mushtown Road
Mushto\Vn Road from approximately 1,400 feet south of Tower Street tothe southeast for
2,900 feet to a point approximately 800 feet beyond Ridgewood Court by the
construction of grading, storm sewer, aggregate base, concrete curb and gutter,
bituminous trail, bituminous surfacing and appurtenant work.
AREA 2 - Pike Lake Trail,
Pike Lake Trail from CSAH 42 south to the proPosed north plat line of Knob Hill by the
construction of sanitary sewer, watermain, storm sewer, grading, aggregate base, concrete
curb and gutter, concrete sidewalk, bituminous path, bituminous surfacing and
appurtenant work.

CSAH 42 from Femdale Avenue west to McKenna Road by the construction of grading,
storm sewer, aggregate base, concrete curb and gutter, trunk sanitary sewer and
, watermain, trails, bituminous surfacing and appurtenant work.
AREA 4 - Street Sealcoatin~
The seaIcoating of bituminous paved streets throughout the city.
AREA 5 - Lakefront Park Road Pavine
Paving of Lakefront Park roads, trails and parking lots by the construction of grading,
storm sewer, aggregate base, concrete curb and gutter, bituminous surfacing, and
appurtenant work.
LOCATION OF THE PROJECTS
The five projects shown by Exhibit 1- are located in the following areas:
AREA 1 - Mushtown Road
Mushtown Road from the south plat line of Maple Acres approximately 2,900 feet south
past the City limit line within the north half of Section 11 , Township 114 north, Range 22
west, Scott County, Minnesota.
AREA 2 - Pike Lake Trail
Pike Lake Trail from County Road 42 to the proposed north plat line in the plat of Knob
Hill in Section 26, Township 115 north, Range 22 west, Scott County, Minnesota.
AREA 3 - CSAH 42 from Ferndale to McKenna Road.
CSAH 42 from Femdale Avenue to' McKenna Road within the south half of Section 22,
23 and 24, Township 115 north, Range 22 west, Scott County, Minnesota.
AREA 4 - Street Sealcoatin~
The sealcoating of bituminous paved streets will' be on the older streets with excessive
cracks and surface deterioration throughout the city.

DESCR.1.r J.ION OF PROJECT
A more detailed description of the projects that are proposed to be assessed are as
follows:
AREA 1 - Mushtown Road
Mushtown Road runs south-east from Panama Avenue (CSAH 23) for approximately
, one-half mile. The section of road proposed for improvement is shown by Exhibit 2' and
begins where the current bituminous surface ends. That portion of Mushtown Road is
rural in nature with a gravel surface and no curb and gutter. Storm water runoff currently
flows overland to shallow ditches and isolated wetlands. There are three wetlands
adjacent to the road which are recognized by the National Wetlands Inventory map, and
one man-made pond. These existing wetlands and pond are shown on Exhibit 2. If any
filling of the wetlands is done, permits form the Minnesota Department of Natural
Resources and the U.S. Corps of Engineers will be required.
The condition of Mushtown Road is worst in the spring. During the freeze-thaw season,
the gravel road becomes soft and unstable' due to frost action. Proposed improvements
include upgrading the street to a bituminous surface, concrete curb and gutter, and storm
sewer. A permit from the Prior Lake/Spring Lake Watershed District will be required for
the storm sewer improvements.
Scott County records show no defined right-of-way for Mushtown Road except within
platted areas adjacent to the road. The platted section adjacent to Woodridge Estates 3rd
has a 50-foot right-of-way and the preliminary plat application for the Wllldstar
Development has a 33-foot right-of-way. Costs for acquiring the remaining right-of-way
and/or easements are included in the project cost for Mushtown Road. Benefiting
developer of Woodridge Estates 3rd and the developer of the proposed Windstar
Development will be assessed, while the balance of the project costs will be paid from the
Project Levy and the Street Collector Fund.
AREA 2 - Pike Lake Trail
Pike Lake Trail is shown on Exhibit 4. The street is designated as a Municipal State Aid
route. Currently, the street haS a gravel surface and is rural in nature with no curb and
gutter. The terrain is hi~y and is heavily wooded onboth sides of the road. The portion of
Pike Lake Trail south of the Maple Hill Subdivision will be built by the developer as part
of the Knob Hill Subdivision; therefore, costs for the street reconstruction within Knob
Hill are not included in this report. The plat of Maple Hill is proposing to extend the
existing sanitary sewer from the Holy Cross Church property south to serve their entire
plat in the spring of 1997.

Proposed improvements includes street reconstruction with storm sewer, retaining walls,
concrete curb and gutter, concrete sidewalk, bituminous trails, and bituminous surfacing.
Street reconstruction provides the opportunity to extend the sanitary sewer and loop the
watermain with the Knob Hill Subdivision.
As shown on Exhibit 5, this road is proposed to be built to a 9 ton design. Pike Lake Trail
from Carriage Hills Parkway to CSAH 42 is designated as a minor collector street. Some
, of the project will be financed by the City Street Collector funds. Benefiting property
owners will be assessed. T runIc Reserve funds will be used to finance the City portion of
the sanitary sewer, watermain, and trunk storm sewer.
FEASmILITY
-From an engineering standpoint, project number 1,2,3, and 5 are feasible, independent of ,
each other, and can be accomplished as proposed, and,not in conjunction with each other
or any other project. So project nwnber 4 (SeaIcoating) has been determined not to be
feasible due to the fact that all city streets built prior to 1993 have been seaIcoated and it
would not be cost effective to sea1coat any streets at this time.
ESTIMATED COST
The following costs were prepared based upon an Engineer's Estimate and are subject to
change, depending on the final design of the project, bids received, and actual work
performed. The method of assessment and rate will be determined at the Assessment
Hearing.
The estimated project cost for each project is for the installation of associated
improvements and includes indirect project costs. Project costs in Areas I & 2 include
special assessments.

The total estimated cost of the proposed improvements is $1,449,135. A portion of these
projects are proposed to be assessed to the benefiting property owners and the remainder

· Councilmember Mader said that a Public Hearing on several items at once could be
confusing. Ifthere were more than one hearing, it could work out better.
· Councilmember Kedrowski said there was only three projects that would be
addressed, and very few residents are involved with two of them.
· City Manager Boyles suggested that each item would be explained, and there would
be an itemized agenda, so it should go smoothly.
· CounciImember Mader expressed concern that citizens would have the opportunity
to speak.
· Acting Mayor Schenck called the question.
Upon a vote, ayes by Kedrowski, Mader, and Schenck, the motion earned.
NEW BUSINESS:
Item 8E, Resolution 97-18 Denying an Appeal from the Decision of the Zoning Officer
Relating to Home Occupation was moved to the first item of New Business by General
Consent.
City Manager Boyles introduced the item and noted that a letter had been received from
forriier Assistant Planner Deb Garross.
Planning Director Rye explained the background. The home owner is operating a home
vending business, and has not obtained a home occupation permit. There is no
documentation of approval on file that the Michaels ever applied for a home occupation
permit. The City received a complaint in October of 1996. In December of 1996, the City
requested that Mr. Michael apply for a permit or cease operation of the home occupation.
TIlls was to set the process in motion that would allow Mr. Michael the opportimity to
appeal the Zoning Officer's decision. Mr. Michael is appealing on grounds of the
interpretation of the ordinance. Staff has concluded that Mr. Michael is required to obtain a
home occupation permit or cease operation of the home occupation. The present activity
cannot be "grandfathered in" because there is no record of any such permit being approved
in the past.
Jim Bates of Huemoeller & Bates, attomey for Mr. Michael, noted that the Planning
Commission recommendation was that it be grandfathered in. The business has existed
since 1989, it should be assumed that'it was thought to be in conformance during that time.
He said it is ridiculous to assume that the list of home occupations in the zoning ordinance
that existed then, while it lists home occupation, would exclude all those occupations not on
the list. He said there was minimal delivery activity, no change to the residential character
of the neighborhood. There was only one employee and very infrequent deliveries.

The purpose of this agenda item is to declare the costs to be assessed,
approve the preparation of the assessment rolls, and set the special
assessment hearing date for Projects 95-07 Mushtown Road, and 97-17
Pike lake Trail.
BACKGROUND:
At the August 18, 1997 Council Meeting, the Council awarded bids for the
1997 improvement projects which included Mushtown Road (Project 95-
07), Pike lake Trail (Project 97-17), and Fish Point Road (Project 97-02).
Fish Point Road has no proposed assessments so it is not included in this
process. The Council approved awarding the bids prior to holding the
assessment hearing as one way to accomplish the projects this late in the
construction season.
Also at the August 18 meeting the Mayor appointed Councilmembers
Kedrowski and Mader to the Assesment Review Committee. The purpose
of the committee is to assist the staff in its evaluation of all properties in
accordance with the City's Assessment Policy and review the staff
,prepared proposed assessment rolls. In addition to the two
Councilmembers, the City Manager, Finance Director, and City Engineer
are members of the committee. The Assessment Review Committee met
on September 29, 1997 to review the projects and the proposed
assessments.
DISCUSSION:
In accordance with the City's Assessment Policy, the Assessment Review
Committee met and reviewed the proposed assessments on each of the

projects. The Assessment Review Committee made the following findings
and recommendations to the City Council:
1) In accordance with the policy, some costs are not assessed. For
example, the extra cost to construct the streets to a 9 ton design is not
assessed because a typical residential street is designed to a 7 ton
standard. Also, in accordance with the policy, the sidewalk portion of
these projects is not included in the assessments to the benefiting
properties. Further, oversizing of the storm sewer on Pike lake Trail, in
accordance with the policy is not included in the assessments to the
properties. Therefore, the cost for sidewalk, upgrading the roadway from
7 ton to 9 ton, and oversizing the storm sewer on Pike Lake Trail was
subtracted from the total project costs to calculate the assessments.
,2) The Assessment Review Committee recommends that the Front
Footage Assessment method be used for both projects. For the
Mushtown Road project the recommended front footage rate of
assessment for street/storm sewer is $67.50/FF (per front foot). For the
Pike Lake Trail project the recommended front footage rate of
assessment for street/storm sewer is $151.30/FF; far sanitary sewer,
$7.71/FF; and for watermain, $25.68/FF.
3) Mushtown Road has a total project cast of $387,642.36. It is proposed
to be funded through tax levy and assessments. There are 14 benefiting
properties in the project area. Thirteen properties are within the
Woodridge Estates 3rd Addition and one property is in the Windstar
Addition. As part of the developer's agreement for the Woodridge Estates
3rd Addition, the developer pledged $85,177.00 towards' the project to
pay the assessments an the 13 lots in Woad ridge Estates. The City has a
Letter of Credit from the developer far this amount. The Assessment
Review Committee recommends that $292,340.96 be paid through tax
levy and $95,301.40 be assessed against the benefiting properties. A
preliminary assessment role is attached showing the proposed
assessments per parcel.
, 4) Pike Lake Trail has a total project cost of $520,709.10. It is proposed to
be funded through tax levy, municipal state-aid funds, trunk reserve, and
assessments. There are 5 benefiting properties in the project area, which
include Holy Cross Lutheran Church, two parcels owned by Herb
Wensmann, 'one parcel owned by Ed Vierling, and one lot in the Maple
Hill plat owned by Dave Triebel. The Assessment Review Committee'
recommends that $160,159.85 be paid through tax levy, municipal state-
aid funds, and trunk reserve; and $360,549.25 be assessed against the
benefiting properties. A preliminary assessment role is attached showing
the proposed assessments per parcel.

a Contract has been let and costs have been detennined for the improvement of Mushtown Road.
Project 95-07, and Pike Lake Trail, Project 97-17 and the contract price for such improvements is
$714,170.65 and the expenses incurred or to be incurred in the making of such improvements
amount to $194. 180.81, so that the total cost of the improvements will be $908,351.46.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR LAKE, MINNESOTA:
1. The portion of the cost of such improvements is to be paid by the City is hereby declared to be
$452,500.81, and the portion of the cost to be assessed against benefited property owners is
declared to be $455,850.65.
2. Assessments shall be payable on an equal principal installment method extending over a period of
10 years for street and stann sewer improvements, and 20 years for sanitary sewer and watennain
improvements. The first installment shall be the annual principal plus interest calculated from the
public hearing date to the end of this year plus twelve months of the next year and shall bear
interest at the rate of a minimum of 8% per annum from the date of the adoption of the assessment
resolution.
3. The City Manager, with the assistance of the City Engineer shall forthwith calculate the proper
amount to be specially assessed for such improvements against every assessable lot, piece or
parcel of land within the district affected, without regard to cash valuation, as provided by law; and
he shall file a copy of such proposed assessment in his office for public inspection.
4. The City Manager shall upon the completion of such proposed assessment, notify the Council
thereof.

pass upon such proposed assessment and at such time and place all persons owning property

to be published once in the official newspaper at least two weeks prior to the hearing, and he shall
also cause mailed notice to be given to the owner of each parcel described in the assessment roll

the County Auditor, pay the whole of the assessment on such property, with interest accrued to the
date of payment, to the City Rnance Director, except that no interest will be charged if the entire

· Mayor Andren asked about the designation of Pike Lake Trail as a collector street.
She said her concern is regarding the Vierling property, with 150 feet frontage and
the potential to subdivide. There is a policy in the ordinance to minimi7.e access onto
collector roads. If that property is subdivided, how does the City propose access to
Pike Lake Trail or similar roads in the area?
· City Engineer Dkka said as of today they will replace existing accesses, and the
Vierling parcel in particular depends on the type of development p4vposed. They will
utilize the existing access for that P4VPerty.
· Mayor Andren said the existing access is Vierlings driveway. She asked if that was a
potential problem.
· City Engineer TIkka said there is always potential, but they can't predict it.
· Mayor Andren asked if accesses to that road would come off of other accesses.
· City Manager Boyles said the current curb cut may not be appropriate with a new
subdivision.
· Mayor Andren said they have run into that problem before.
· City Manager Boyles said if the land is subdivided, there will be a public road
extended and sewer and water at the developers expense.
· City Engineer Ilkka said they only proposed to assess 150 feet of the Vierling
property. The actual frontage of the property is 425 feet.
· Mayor Andren asked whether lot 8 of Maple Hills abuts the road.
· City Engineer TIkka said the original plan was for the property owner to get his sewer
from Pike Lake Trail and the water system from a private road. During construction,
he decided to get water from Pike Lake trail.
· Mayor Andren asked whether Knob Hill was being assessed.
· City Engineer TIkka said they are building the south half of the road.

Consider Approval of Ordinance 97-14 Revising Animal Control Ordinance
Requirements .
City Manager Boyles introduced the item and reviewed the agenda report. One of the
Council's Top Priority Objectives for 1997 was to review and revise the Animal
Control Ordinance.- The ordinance needs to be amended because of our OLuwing and
changing City, and the revision of state statute. He said the City Council reviewed
the draft ordinance, and the City has received input from the police department, the
City Attorney, and the prosecutor's office. There are individuals who have called and
expressed concern regarding the ordinance. One wAt'~ essed concern about having
three pets per household and therefore needing a Conditional Use Permit (CUP).
Secondly, there was a concern about the provision in the ordinance regarding the
cleanup of pets' waste within 24 hours. Thirdly there was concern about the statutory
requirement, when an animal is impounded for rabies, it requires a licensed
veterinarian to release the animal. That is a statutory requirement. The City is trying
to protect the rights of pet owners and non pet owners.

Mark Conty from the audience addressed the Council. He said he currently lives in
Apple Valley and is in the process of preparing to move to Prior Lake. He said he
owns three dogs and was concerned with the requirement of obtaining a conditional
use permit with three or more dogs.

City Attorney Pace said they changed the ordinance at the staff meeting to read
"more than three" would require a CUP.

Mr. Conty said there should be more flexibility regarding the number of dogs
allowed.

Councilmember Robbins said regarding the 24 hour clean-up requL.wU.lent, if
someone is gone for the weekend or on vacation, what would be done?

Acting Police Chief Schmidt said that particular provision would be used as a
compliance tool. The police department would discuss the matter with the
homeowner before anything was done.

Councilmember Robbins asked if the annual license renewal was state statute.

City Attorney Pace said no.

Councilmember Robbins said it would save paperwork to have the license
requirement every two years rather than annually.

Mayor Andren said it was to ensure that in the case of a dog biting someone, the dog

This letter serves as McNamara Contracting, Inc's claim for reimbursement for overhead and
profits. This claim is a result of a revised construction plan as described in Change Order # 1 on
the above referenced project.
The revisions included in Change Order #1 have caused the following:
1. Reduced the recovery of overhead costs incurred by McNamara
in the original bidding ofthe project. McNamara includes a 3.0%
overhead factor in each project bid. This is based upon McNamara's
history of bidding costs. Such costs include estimator and office
staff time to review plans, project site, bid documents, office
equipment, and plan costs. The following is our lost overhead:

2. No markup has been included on the items to be paid to Rosti
Construction. The prime contractor normally marks-up sub-
contractor prices. This enables the Prime Contractor to

The markup also is to include a profit margin. Change Order # 1
approved prices from Rosti without any markup for McNamara.
McNamara believes it should be compensated for these items
at our normal 15% markup rate: 7,240.00 x 15%

3. McNamara has incurred substantial additional overhead costs
due to Change Order #1. Extra time has been spent by the job
superintendent, project manager, estimator, and office personnel
in the form of additional site meetings, revised quantity and
price reviews, project scheduling, project supervision, and
contract documents processing. McNamara estimates this cost
to be 40 hours x $60.00

The Prior Lake City Council has approved Change Order No.1 to the contract for
construction of Pike Lake Trail, with the exception of the $5,500 for the overhead on the
wall. This was against my recommendation, but it is the Council's prerogative to do so.
You are entitled to file a claim for reimbursement of the overhead. Please include with
your claim sufficient documented justification for this amount. When I receive your
claim and justification I will review it and present it to the Council.

Dear Mike:
The Prior Lake City Council tabled action on final approval of Change Order No. 1 at
their March 16th meeting. The Mayor was concerned about the amount of overhead
recovery by the prime contractor ($5,510). I was directed to re-visit this issue with you.
I apologize for this delay.
I would very much like to get together with McNamara to discuss this issue. It seems
that if we are to stay with the total $5,510 then the Mayor will want to see
documentation to substantiate this amount. His opinion is that with a reduced contract
amount, the total overhead should be reduced and the contractor should not recover
100% of the overhead allocated to the wall.
In determining what compenstion is due the contractor due to eliminating work, I believe
MnDOT specification 1905 should apply.
The Council asked that it be brought back to their April 6th meeting so if we meet
sometime next week, at your convenience, that would work well.

As a wrap-up of our meeting today I am summarizing the understandings we reached
regarding the deletion of the retaining wall on the subject project.
We agreed to the following:
No change in cost due to deletion of the guardrail.
The 1000 CY figure for additional common excavation is correct and the City will pay for
it at the contract price.
Additional silt fence paid at contract price.
Additional clearing and grubbing, I indicated we should have our inspector and your
superintendent agree on quantities to pay at contract prices. We later found a fax copy
of a Castle Rock Contracting & Tree Service invoice to McNamara dated 10-30-97 in
the amount of $800.00. Therefore, I propose we compensate McNamara for an
additional 0.23 acre clearing and grubbing at the contract price of $2,500/acre clearing
and $1,2501acre grubbing.
Your retaining wall sub-contractor incurred costs for engineering, mobilization, freight,
and re-stocking of $4,250.
McNamara Contracting allocated $5,510 of overhead to the retaining wall that you need
to recover.

Watermain modifications due to the 1:3 slope vs. a retaining wall, you were going to
check into. We later found a fax copy of Brown & Cris, Inc. Invoice #97074-A dated
11/17/97 in the amount of $554.40, plus 10% McNamara for $609.84.
The water service stub, we found a fax copy of a Brown & Cris letter dated November
10, 1997 to Gary at McNamara which outlined the cost of the service for a total of
$640.50 plus 10% McNamara for $704.55.
You were going to check if your utility sub-contractor is claiming costs for re-
mobilization. 500
I indicated that the adjustment of sanitary MH-2 by Brown and Cris, Inc. will not be
reimbursed due to the fact that they did not originally construct it per plan. (Bel Invoice
#97074-B dated 12/01/97)

Dear Mr. Treibel:
As you requested, we have arranged to provide a service stub from the watermain in Pike Lake Trail to
service your home. I would like to take this opportunity to explain why this involves an assessment.
The original plan to provide sanitary sewer and water to the residents of the Maple Hill plat called for all the
services to be run in from the interior lateral watermains. Under that plan, I assume, you appropriately
shared in the cost of the watermain construction with the Maple Hill Homes Association.
The original plan, as bid by the City, for Pike Lake Trail did not include this water service stub. This water
stub will be at additional cost to the City. Regardless of what this additional cost is, (the contractor has not
yet given us the price) the City will not pass that cost on to you directly. Instead, the Assessment Review
Committee recommended that the benefiting property, your property, be assessed on a front footage basis
for the watermain as would be done for any other homeowner/property owner in the City in accordance
with the City's Assessment Policy.
What was paid to the City by the Association were development fees and Trunk Acreage charges. You will
not be assessed these fees again. I should note that if you feel you are paying twice for the water you
should discuss this with the Association. You paid them for installation of a water system that your property
receives no benefit from, you will be getting your water service directly from Pike Lake Trail. The proposed
assessment results because your property receives direct benefit from the City project.

think you should go uncompensated for your time. Please invoice the City for your time under
general services. Further, please do not put forth any more effort on behalf of the City in this
regard, unless specifically authorized. We have discussed the shop drawing review effort and we
feel this is something we can handle in-house. If we determine we need assistance, perhaps with
the retaining wall, we will be sure to authorize that for your firm.

are not authorized to do this task on the job. I have no intention of asking to be compensated
for the effort, but it is another example of how well-intentioned people (like Sue and me) can
place the City and us in an uncomfortable position.

Pike Lake Trail Improvements Project 97-17
Dear Mr. Vierling:
As you are aware the City is planning to upgrade Pike, Lake Trail this season. In
conjunction with this project we will be bringing watermain to connect to the Knob Hill
development and it will be available to your property. Sanitary sewer to serve your
property is also planned. The original Knob Hill development plans called for the
developer to bring the sanitary sewer through Pike Lake Trail. Those plans changed, and
the City is now required to bring the sanitary seWer south to serve your property. Due to
these changes your property will be subject to a special assessment.
The City has recently received bids for the construction of improvements on Pike Lake
Trail. These improvements include street, storm sewer, watermain and sanitary sewer.
As your property benefits from these improvements, you will be assessed in accordance
with Minnesota Statute Chapter 429 - Local Improvements, Special Assessments. City
ordinance requires that you connect to sanitary sewer and water within one (I) year of
installation. The following method outlines the assessment process.
Assessment Method: The City Assessment Policy allows for oversized residential
parcels having large frontages to be currently assessed for the first 150 feet of frontage.
Payments will be equal installments of principal for a period of 10 years for street and
storm sewer improvements and 20 years for sanitary sewer and water improvements. In
addition, you will be charged a trunk sewer and water fee of $3500/acre. The remaining
excess frontage, 285 feet, would be deferred for a period of five years or upon
development, whichever occurs first. The estimated assessment amounts are as follows:

On July 21, we had forwarded a proposal letter to you regarding the inspection of a project that
would be the composite of the above-referenced streets. That proposal envisioned Howard R.
Green providing all of the construction administration, field observation, and construction staking
on the composite project. It is my understanding that the City is considering doing portions of
this work with City staff. Specifically, you have determined that the City will handle the
construction administration with your in-house staff. I believe that you are also considering doing
field observation on one or more of the segments. We understand that in order for you to make
a determination as to which portions of the work you may want to handle with City staff, you
would need our previous estimate broken out by street segment.
Since that estimate envisioned the whole project, I went back and revisited the estimating that
we did to prepare it. As you know, there will be a considerable amount of interrelations between
the construction of the three segments. I have prepared a bar chart that illustrates how these
interrelationships may play out. That bar chart indicates that the construction timetable is tight.

HERBERT H. WENSMANN and ELAINE E. WENSMANN, husband and wife,
hereinafter referred to as "Grantors", in consideration of One Dollar ($1.00) and other good and
valuable consideration, the receipt and sufficiency of which is hereby acknowledged, do hereby
grant unto the CITY OF PRIOR LAKE, a municipal corporation organized under the laws of
the State of Minnesota, hereinafter referred to as the "Grantee", its successors and assigns,
forever, a permanent easement for public roadway, drainage and utility purposes over, across,
on, under, and through land situated within the County of Scott, State of Minnesota, as described
on the attached Exhibit "A".
INCLUDING the rights of the Grantee, its contractors, agents, servants, and assigns, to
enter upon the easement premises at all reasonable times to construct, reconstruct, inspect,
repair, and maintain said public roadway, drainage and utility systems over, across, on, under,
and through the easement premises, together with the right to grade, level, fill, drain, pave, and
excavate the easement premises, and the further right to remove trees, bushes, undergrowth, and
other obstructions interfering with the location, construction, and maintenance of said public
roadway, drainage and utility systems.

Dear Mr. Jube:
This letter is intended to outline the phasing plan for the storm sewer improvement and County
Road 42 and Pike lake Trail in the City of Prior lake. The Final Hydraulic Analysis has been
sent to you per separate letter. Enclosed is a highlighted copy of the City Plans on Pike lake
Trail for your reference.
PHASE I - Construction of Pike lakeTrail by City of Prior lake
· Tentatively, the City is scheduled to begin construction on Pike lake Trail on August 25,
1997. This will result in the installation of a 36" RCP at 0.50% at the south right-af-way line
of County Road 42.
· The invert at this point is 846.88.
· Temporary bulk heads will be placed on both sides of the 36" RCP in Phase I.
· The outlet of the Phase I construction will pass through the 36" RCP from STMH5 to STMH6
to 36" apron which discharges into the existing drainage swale in the southeast corner of
County Road 42 and Pike Lake Trail. This flow is directed to the existing 24" culvert under
County Road 42 at this location.
· Note that no runoff is anticipated into the 21" STUB out at STA6+05 to the Wensman
property West of Pike Lake Trail. This commercial property is currently working its way
through the City of Prior Lake's planning approval. Construction is anticipated in 1998.
PHASE II - Construction of County Road 42 by Scott County
· It is anticipated that the County will be implementing this project in late 1997 or early 1998.
The City and County will need to coordinate storm sewer trunk oversizing from County Road
42 to the planned new regional pond north of County Road 42. Howard R. Green Company
would be available to assist as needed.

. In this phase, it is assumed that the trunk storm sewer north of County Road 42 is being
installed. The temporary bulk heads are to be removed from the 36" RCP on Pike Lake
Trail, as the storm sewer system down stream is ready to handle runoff. The County project
will need to connect to this 36" RCP at 0.50% and direct its discharge into the proposed
storm sewer system on County Road 42.
. Once the storm sewer on Pike Lake Trail is connected to County Road 42 the existing 36"
apron at STMH6 can be removed. MH6 should be modified to direct flows to STMH5.
. Note that during Phase II, drainage from the Wensman property will flow through the natural
drainage channel west of Pike Lake Trail to an existing culvert under County Road 42 west
of Pike Lake Trail.
PHASE 111- Wensman Constructs a Holding Pond and Access Road to Pike Lake Trail
. This pond is outleted by the 21" RCP at 1.0% at Station 6+05 with removal of temporary
bulkhead.
This should help you understand the phasing for the storm water management at this location.

TRUNK STORM SEWER ADDENDUM NO.1
Dear Mr. Larson:
The City of Prior Lake has requested modifications to the storm sewer system on the above-
referenced project. This request has been prompted by a proposed commercial development
on land adjacent to Pike Lake Trail, owned by Mr. Wensman. This development is west of Pike
Lake Trail and south of County Road 42.
The City has requested the addition of a 21-inch RCP stub-out at station 6+05 to serve Mr.
Wensman's development, which includes a pond in the vicinity of this 21-inch stub-out. This
additional storm sewer inlet (for future development of the Wensman property) has an effect on
the storm sewer system downstream of STMH 3. This letter will provide the information you will
need to review the revised hydraulics of the City's proposed storm sewer system and the
proposed Addendum No.1. Please note that the oversizing of the storm sewer system that is
proposed in Addendum NO.1 will be funded by the City's Stormwater Management Program.
The City is requesting that State Aid funding be considered based upon the percentage of flow
that relates to the State Aid project.
Enclosed you will find the following attachments:
A. Original Hydraulic Study by Howard R. Green Company that was submitted to State Aid
and subsequently approved.
B. Hydraulic analysis relating to the 21-inch stub-out to serve the Wensman property
prepared by the City of Prior Lake.
C. Final Hydraulic Analysis by Howard R. Green Company which combines the original
system with the impacts of the 21-inch outlet from the Wensman development.
D. Copy of Addendum NO.1 to this project which includes revised plan sheets (2R of 13
and 6R of 13), revised bid forms, and modifications to the specifications per Addendum
No.1.

It should be noted that the final discharge from this segment of Pike Lake Trail to County Road
42 is estimated at 42.43 cfs, via a 36-inch RCP at 0.50%. This will require the City and Scott
County to modify the storm sewer system from this project, northerly to the City's Regional Pond
on the northwest quadrant of Pike Lake Trail and County Road 42, per the City's
Comprehensive Stormwater Management Plan.
The City of Prior Lake and Scott County will be coordinating the revisions to their portions of this
trunk storm sewer system. Scott County is currently progressing toward the reconstruction of
County Road 42 in the vicinity of Pike Lake Trail.
Please review this information. It is requested that MnDOT Office of State Aid review the
enclosed Addendum No.1 to S.A.P. 201-114-03 Pike Lake Trail as soon as possible. As
previously noted, the storm sewer oversizing in' Addendum No. 1 will be funded by the City of
Prior lake.

We have completed our review of the storm sewer features of this plan and find that State Aid
funds can bear 76.0 % of the storm sewer costs.

be made by the State Aid Division. We do recommend that #401OH be added to the list of
standard plates, and that the location\elevation of the low point on Pike Lake Trail be changed to
station 1 +69.94, elevation 853.65.
Unless you wish to recommend modifying the amount of State Aid participation, the State Aid
Division will use the above percentages.

June 30, 1997, regarding the above-referenced projects. Attached is a copy of the attendance
sign-up sheet for the meeting on Mushtown Road'and Pike Lake Trail held from 4:00 p.m., to
7:00 p.m., at the fire station.
The following summarizes the comments received:
A) Pike lake Trail
. Request from church for a set of the Plans.
. Sprinkling may be necessary in new church addition for sanctuary. Modify plans to provide
6" ductile watermain, not 2" copper.
. Questions were raised by church regarding their assessments for this project, answered
by City staff. The church also requested consideration for credits relating to existing
sanitary sewer. City staff reviewed policies on standard rates for sewer charges.
. The curb cut for Mr. Wensman's property should match the proposed Development Plan.
Can be adjusted in the field as needed.
. Wensman Development Plan may include future street with utility stubs at south end of
project. This will need to be adjusted when City approval is granted on the plat.
. Mr. Verling indicated an interest in hooking into sanitary sewer service as soon as possible
to eliminate existing holding tank. He will need a permit from the City. He also requested
the City to provide information relating to his costs related to the permit for sewer service.

Dear Greg:
This letter is intended to identify the minimum right-of-way required at this time from
Mr. Wensanen on the west side of Pike Lake Trail. The original concepts had indicated that
as much as 45 feet of easement might be required. Since then, the street has been surveyed
and construction plans are being developed. Currently, the City would be able to construct
the project, per our preliminary plan, with 35 feet of additional right-of-way from
Mr. Wensanen, as indicated in the attached sketch.
Per our previous discussions, you indicated that the City would initiate right-of-way
acquisition discussions with Mr. Wensanen. I would be able to provide you with the legal
descriptions for the 35-foot easement, if requested. It is important for the City to begin
negotiations with Mr. Wensanen at this time.
This project is tentatively scheduled for construction to begin in August of 1997
(approximately 90 days from now). The process to secure the right-of-way can take this
entire time frame. Please initiate these right-of-way negotiations and contact me if you want
the legal descriptions prepared.

Thank you very much for the opportunity to be considered for this work. We are
submitting the following narrative and supporting information in response to your
Request For Proposals (RFP).
We believe that our experience in Prior Lake, and the investigation that we have made
in regard to these particular projects, allow us to completely understand the work that
will be entailed to successfully complete the projects in partnership with your staff. As
directed in the RFP, we will organize our discussions and proposals in the format
specified.
A.
Project Understanding
We perceive these street segments to have much in common with others we have
done in Prior Lake and other settings. They are both existing rural sections that
we will be converting to improved urban sections. Both segments will include
provisions for mixed modal uses, with sidewalks and bituminous trails. While the
design should be fairly straightforward, no two projects are exactly alike, and
both of these segments present some challenges unique to their settings.
Both will involve coordinating street work with pipe work. In addition to the
storm sewer that will be constructed with the streets, sanitary sewer will be
extended to Embassy Circle by others on the Pike Lake Tt.:ail segment. This
means that we will need to not only coordinate the construction scheduling on this
work, but also make sure that adequate provisions are made by those others for
acquiring proper trench density and exact locations of the constructed facilities.
This will be particularly important here since our contract will also be for
extending watermain along the same corridor. The utility issues on Mushtown
Road are much less significant, but there will still be a need for coordinating with
adjacent developers and the Township representatives. We will want to make sure
we fully understand the right-of-way that the Township presently has. If
additional action is necessary on right-of-way, this will really put our schedule
at risk.

The National Inventory shows wetlands in the area of Mushtown Road. Although
we do not necessarily see their presence as a major stumbling block to
implementing the project, we believe that early on in the process we need to
delineate them and to do enough detail design to quantify any encroachments. It
seems unlikely at this point that major mitigation will be necessary, but we need
to lay that issue to rest very soon in the process and to get any permit applications
submitted as soon as possible. Processing time on the permit applications poses
a threat to the very aggressive schedule that we are working toward. It is
conceivable that we will be working with several agencies in this regard,
including the Minnesota Pollution Control Agency, the Minnesota Department of
Natural Resources, the Prior Lake/Spring Lake Watershed District, and the U.S.
Corps of Engineers. The wetlands in the vicinity also raise our concerns slightly
about soils in the area. We are very pleased that the feasibility report recognizes
this possibility by including an allowance for subcutting and for the possible
usage of lateral drain tile.
Design on the Pike Lake Trail segment will need to be very sensitive to
minimizing slope and vegetation disruption. Fortunately, the report recognizes
the need for retaining walls. We will also need to defme how we will handle the
slopes in more detail, early on in the process, to identify possible needs for
additional right-of-way. If additional right-of-way is needed, this also puts our
aggressive schedule at risk.
Since both segments are existing traveled roadways, maintenance of traffic will
be a concern. We will need to devise appropriate temporary measures for keeping
local access in place to the maximum extent possible and practical. This will be
particularly of concern on Pike Lake Trail since the ongoing work on CSAH 21
and CSAH 42 will influence travel patterns in the area. We will need to
coordinate very closely with the Scott County Highway Department in this
regard.
Aside from these special considerations, we will need to implement the
preparation of the plans and specifications following City standards. We are very
familiar with City standards and procedures, so we are confident that we can
complete the design and bidding process very successfully for the City. MSA
will provide the plans and specifications in compatible formats.
B. Organization
Pursuant to our conversation of yesterday, we will not clutter this submittal with
a long discussion of our experience. As you know, I am the designated principal-
in-charge for Prior Lake and will have an active role in the work. Tom Kaldunski
will be our project manager. We have a good group of support people who have

completed many projects in Prior Lake and other similar cities. The Statement of
Qualifications that we recently submitted discusses our experience in some detail.
We would be happy to supplement that information if you feel it is necessary.
c. Detailed Work Plan
We have attached a detailed listing of the various work tasks that we see in the
project and the hours that we estimate it will take us to complete them. This is the
same list that we used on the Fish Point Road submittal. It provides a lot of
detail as to the steps which we think are critical to any project, including this one.
In general, our approach is to foster good communication throughout the process.
We appoint one person to be our primary contact for a client. That person is
responsible for making it easy for the client to get the information they need.
Sometimes that means getting information themselves, or it involves facilitating
direct contact with other MSA staff members. There are always back- up
personnel familiar with Prior Lake. The primary contact person needs to make
sure that the best arrangements are made for keeping the information flow
successful. I am the primary contact person for Prior Lake on all projects.
MSA has become very adept at communications with affected residents during
design and construction phases of the projects. We envision our role here as
assisting the City staff in supplemental meetings with land owners, since the
preliminary hearing process will be complete when we become involved with the
work. We have communication specialists who work with our engineers on these
kinds of effort.
We have previously discussed several design issues under Section A. We will
give careful attention to these design issues. We have recently implemented a
strengthened QA/QC process. That process involves coordination with City staff
at appropriate intervals throughout the design process. It also provides for
internal quality initiatives involving peer review engineers and construction
inspectors for constructablility reviews. Dave Thompson will be valuable here
because of his familiarity with the City and its standards. Because of the potential
wetlands issues, we expect that Dave Nyberg, our water resources engineer, will
also be heavily involved. Tom Kaldunski has served as the LGU representative
in Farmington and he will assist with wetland issues. We believe we have all of
the necessary disciplines in-house necessary to do the work. We do not envision
the need to partner with any outside companies.
Assuming there are not any unforeseen factors which delay the construction bid
solicitation process, we envision that we will be bidding the work in a time of

year that is not always conducive to competitive bidding. Because of that, we
foresee that we may need to make special efforts to attract the interest of
qualified construction contractors . We will also need to make sure we do a good
job of bidder question follow-up. We may need to "sell" this job a little.
Additionally, we will need to carefully scrutinize the bids that are submitted to
make sure the bidders are qualified and can do our work, and that the prices bid
are the best we can get. MSA has the necessary experience to ensure proper
contract administration.
D. Schedule
The feasibility report lays out the general schedule requirements. We will work
within them to the greatest extent possible. Although the schedule is very tight,
we can complete the plans and specifications by the June target date. The concern
will be that unforeseen right-of-way or permitting issues delay the construction
bid target date. We have attached a more detailed Gantt Chart to further clarify
our intent.
E. Compensation
The attached spreadsheet sets forth the time estimates that we have made for the
various work tasks along with the hourly rates used to establish them. We think
that those estimates are aggressive. In summary we propose to complete the
Design Phase for a total cost to the City not to exceed $26,400. We propose to
complete the Bidding Phase for a total cost to the City not to exceed $4,000. This
figure does not include permit and advertising fees which we would pass through
to the City at no mark-up. It does, however, include all costs for plans and specs
reproduction and distribution.

REQUEST FOR PROPOSAL FOR ENGINEERING DESIGN SERVICES FOR
PIKE LAKE TRAIL AND MUSHTOWN ROAD
Introduction
The City of Prior Lake is interested in receiving proposals for engineering services
necessary for the design and preparation of plans and specifications for Mushtown Road
and Pike Lake Trail. A feasibility report has been prepared for these projects and is
enclosed. A Public Hearing on these projects is scheduled for April 7, 1997. At this
meeting we will be asking the City Council to consider these projects and authorize the
preparation of plans and specifications and engineering services.
Scone of Services
The project will be divided into two phases, Engineering Design, and Bidding. City
records and information will be made available during all phases.
During the Engineering Design phase, the proposer shall:
1. Perform all necessary preliminary surveying including but not limited to horizontal
and vertical control, existing topography, cross sections, etc.
2. Prepare street and storm sewer construction plans and specifications. All plans shall
be compatible with AutoCad version 13 in Widows 95. All specifications shall be
compatible the Word 6.0 with Windows 95.
3. Prepare construction cost estimates based upon completed plans.
4. Provide a floppy disk (3 1/2") of all data and AutoCad drawings.
During the bidding phase the proposer shall:
1. Prepare bid documents for public bidding process.
2. Submit and obtain approval of the plans and specifications from all required agencies.
3. Prepare the advertisement of bids, duplication and distribution of plans and
specifications to bidders and respond to bidder inquiries. Attend the bid opening. All
costs will be borne by the proposer.
4. Receive, analyze, and tabulate bids and make recommendations to the City for award
ofbid(s).
5. Ensure proper contract execution to include insurance, bonds, etc. required by the
contract specifications.

Two copies of the proposal shall be received no later than 4:00 p.m. on Thursday, March

Submittals are to be delivered in a sealed envelope marked "Proposal Mushtown Road
and Pike Lake Trail". Respondents shall bear all costs and risks associated with preparing
and submitting responses to this request for proposals.
Proposals submitted for the City's consideration are required to include, but not
necessarily be limited to, the information requested in the format outlined below:
A. Project Understanding - A narrative which presents the firm's understanding of the
project requirements and any ideas the firm may have regarding specific aspects of
the project.
B. Organization - Provide background of the firm with particular emphasis on its
experience with projects of similar nature.
C. Detailed Work Plan - A detailed work plan identifying the work tasks to be
accomplished and the budget hours to be expended on each task of the two phases.
The detailed work plan is to include: The firm's overall approach to the project in
general terms, including a discussion of the project management philosophy of the
firm and how it relates to the specific needs of the project, a detailed approach to each
phase of the project, including a discussion of the tasks to be performed and; an
identification of any disciplines that the firm intends to utilize.
D. A detailed project schedule including: identification of key tasks required to complete
the project, expected starting dates, milestone dates, and completion dates should be
identified.
E. Compensation - Compensation shall be classified into two categories. Engineering
Design , and Bidding shall be those provided at a schedule of hourly rates and
proposed with a not-to-exceed maximum project amount. An estimate of the hours
required and project budget should be presented.
The City reserves the right to reject any or all proposals at the full discretion of the City.

Dear Property Owner:
This letter is to notify you that your property IS proposed to be assessed for the
improvements of Pike Lake Trail.
Per the enclosed notice the Public Hearing for Public Improvement Project #97-17 - Pike
Lake Trail, is scheduled to be held on Monday, April 7, 1997 at 7:45 p.m.
All persons desiring to be heard with reference to the proposed improvements will be
heard at this meeting. Written or oral comments will be considered. Please note that this
hearing is not the Assessment Hearing. This public hearing is to consider the
improvement project. A separate assessment hearing will be held after the bids are
received which will occur in late June or early July, 1997, and all pertinent assessments
information will be mailed to each affected property owner prior to the assessment
hearing.
We would like to meet with you to provide a better understanding of the proposed
improvements prior to the Public Hearing, give the property owners a chance to look at
the plans, and answer any questions you might have on the proposed improvements.

Please find attached two Report of State Aid Contracts and supporting documentation for
the referenced projects for right-of-way reimbursement. The City of Prior Lake is
requesting $59,230 for SAP 201-106-03 Carriage Hills Parkway, and $12,670 for SAP
201-114-02 Pike Lake Trail. for a total of $71,900.
Recently, these parcels went through conck...uuation together due to common ownership of
the propeny. Leo and Helen Vierling owned most of the land and their son, Edward
Vierling, owned one parcel. The land involves two SAP routes, Carriage Hills Parkway
201-106-03 which is a new e:lst-west street, and Pike Lake Trail 201-114-02 which tees off
to the nonh. One right-of-way plan was prepared under the construction documents for
SAP 201-106-03. There are l1ctually nine parcels that were involved in the condemnation
hearing-I, lA, 1B, IC, 1D, lE, IF, IG, and 3, as shown on the attached plan sheets 18
and 19. Parcels I, lA, 1B, Ie. 10, IF, and 1G belong to Leo Vierling in SAP 201-106-
03, while parcel IE belonginll to Leo Vierling and parcel 3 belonging to Edward Vierling
are in SAP 201-114-02. As you and I discussed on the phone, we have .t'~\J~Cl.ted the costs
according to the a1Jpudsals, since the condemnation hearing grouped the parcels together
and established a settlement amount diff.:.~.:.UL than the 41JP~o.i..sal.s. I have attached notes and
calculations on how we have arrived at the final amounts.

Dear Ms. Maiers-Atakpu:
The purpose of this letter is to outline the approximate
assessment costs for the development of the above referenced
parcel. These costs are estimates as no construction plans have
been developed; and, consequently no bids for actual costs. In
addition, the charges are based upon the size of the parcel and
the following assumptions are made:
1. 75 foot right-of-way dedication on Pike Lake Trail.
2. 33 foot right-of-way dedication on CSAH 42.
3. Sanitary sewer would be extended 285 feet south of the
proposed CSAH 42 right-of-way line to serve the
building. A current assessment for sanitary sewer would
be based upon $40.00 per foot for a length of 200 feet.
The remainder of the parcel would be assessed (320
feet) when the sanitary sewer is extended. The current
assessment could be assessed over a twenty year period
with interest.
4. Pike Lake watermain would be assessed at a future date
when the work is completed.
5. Sanitary sewer and watermain would be installed parallel
to CSAH 42 in the future with assessments for these
improvements made at the time of installation.
6. Net lot area (640-33) (560-75)/43560 = 6.75 Acres.
(Exclusive of 33 feet & 75 feet right-of-ways)
The following charges/assessments would be made at the time that
the building permit is issued:
