CONSIDER APPROVAL OF A RESOLUTION AUTHORIZING CITY STAFF
TO COMPLETE THE RYAN PARK LIGHTING PROJECT RESTORATION
Introduction
The purpose of this agenda item is to seek City Council authorization complete
the Ryan Park Lighting Project restoration.
Historv
On April 1, 2007 the City of Prior Lake executed a contract with Collins
Electrical Systems for installation of lights at Ryan Fields. The contract
included restoration of turf areas disturbed by construction. The completion
date for the project was June 30, 2007.
Current Circumstances
The project is complete with the exception of some turf areas which remain un-
restored to project specifications. Last fall the City attempted on several
occasions to resolve the issue but the contractor was unable to complete the
restoration in accordance with specification requirements.
On March 24, 2008 the City, notified Collin's Electrical that the City in
accordance with the contract execute our right to complete the restoration at
the contractors expense in accordance with the specifications. The City has
provided Collins with notice that it is in breach of contract, specified the nature
of the breach and provided Collins with a reasonable and specific period in
which to cure the breach and that if work is not completed within the time
specified in the notice the City would proceed to complete the restoration as
provided for as a remedy. Collins was also notified that time was essential
and staff did meet with them on-site. That period of time has passed. Staff
estimates the restoration will take approximately 1 week and cost less than
$10,000 for staff labor and materials.
With the grand opening of the facility scheduled on May 2, 2008 and a limited
window for the restoration staff has made preparations to complete the work.
The City should exercise the City's rights as provided for in the contract to
complete the restoration at the contractor's expense.
The lighting ceremony for the park is scheduled for May 2nd and restoration
should commence immediately.

FINANCIAL
IMPACT:
The City has retained $18,245 from Collins Electrical as part of the project.
The costs for materials and labor should be deducted from this amount prior to
final project payment.

1. Approve a resolution authorizing staff to complete the Ryan Park Lighting
Project restoration.
2. Table this agenda item for a specific reason.
3. Deny this agenda item for a specific reason and provide staff with direction.

A RESOLUTION AUTHORIZING CITY STAFF TO COMPLETE THE RYAN PARK LIGHTING
PROJECT RESTORATION

WHEREAS, On April 1 ,2007 the City executed a contract with Collins Electrical Systems to
complete the Ryan Park Lighting project; and
WHEREAS, The project is complete with the exception of final turf restoration; and
WHEREAS, The completion date for the project was June 30, 2007; and
WHEREAS, On March 24, 2008 the City notified Collins Electrical Systems via certified mail that it
was in breach of its contact with the City, described the nature of the breach and
provided Collins with a specified date by which the breach needed to be cured. The
notice provided to Collins also invoked the City's nonexclusive remedy to complete the
Work in accordance with Paragraphs 4 and 11 of the contract and that completion of
the Work was time sensitive. Collins failed to cure the breach within the specified time
in the Notice; and
WHEREAS, The City has withheld $18,245 in retainage from the contract amount and this amount
is sufficient to cover the costs to complete the Work; and
WHEREAS, In order to complete the improvements prior to the Ryan Park Lighting Ceremony
scheduled for May 2, 2008 the City needs to complete the restoration.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. City Staff is authorized to complete the restoration in accordance with the contract.
3. All City costs for labor and materials should be deducted from the project retainage in Capital Parks
Account #225-45025-501.
