CONSIDER APPROVAL OF A RESOLUTION APPROVING AMENDMENT
NO.1 TO THE MET COUNCIL INTERCEPTOR AGREEMENT
Introduction
The purpose of this agenda is to approve Amendment No. 1 to the Met Council
Interceptor Agreement.
Historv
Effective July 13, 2006 the City of Prior Lake and Met Council entered in to an
Agreement to transfer ownership of the Prior Lake Sewer Interceptor from the
Met Council to the City from the Maintenance Center to the CR 82/83
intersection. Because this facility primarily serves the City and is no longer
regional the Met Council exercised its right to transfer the interceptor to the
City. The Agreement with the City included several repairs that were to be
made prior to the transfer occurring.
Current Circumstances
The Met Council has completed all of the repairs with the exception of a sewer
lining repair in the Park Avenue sewer. Because the City is completing a
sewer lining project this year the Met Council would like the City to include the
repair in our project. This is similar to how we handled the L58 Lift Station
repair back in 2006 with the Met Council. Staff has completed an estimate and
determined the costs to be $37,500. This Amendment recognizes the repairs
that have already been made and details the reimbursement to the City for
lining the sewer.
The proposed Amendment is consistent with the intent of the original
Agreement and staff recommends approval.
There are not issues with the amendment.
The Met Council is paying for the repairs so the amendment does not have a
financial impact to the City. The financial impact to the City is long term
maintenance of the interceptor. However the City has previously agreed to
this maintenance so it is not a new financial impact. The Met Council
Agreement reached by the City in 2006 provided the City with the best
scenario available with the interceptor turn-back.

A RESOLUTION APPROVING AMENDMENT NO.1 TO THE PRIOR LAKE INTERCEPTOR

WHEREAS, On July 13, 2006 the City of Prior Lake and Met Council executed the Prior Lake
Interceptor Transfer Agreement; and
WHEREAS, All of the repairs required by that amendment have been completed with the exception
of the Park Avenue sewer lining; and
WHEREAS, The Met Council has requested the City complete these repairs; and
WHEREAS, The Met Council will reimburse the City $37,500 for the repairs; and
WHEREAS, It is in the City's best interest to complete the repairs as part of the 2008 Sewer Lining
Project.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The Mayor and City Manager are authorized to execute amendment no. 1 to the Prior Lake
Interceptor Transfer Agreement.
3. The $37,500 shall be deposited in Utility Fund Account #601-49005-501 for inclusion in the 2008
Sewer Lining Project.
