NOTICE OF PROPOSED ADMINISTRATIVE LAND
April 10, 1996
The Prior Lake Planning Department has received an application from Thomas and
Pamela Dauffenbach of 14816 Maple Trail SE., Prior Lake, Minnesota, to consider an
Administrative Land Division for the property identified as Lots 6 and 7, OAKLAND
BEACH 1ST ADDITION. The proposal is to combine these parcels in order to create 1
buildable lot, as per the attached survey reduction.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the City Manager or
representative to authorize subdivision approval without a public hearing under the
following circumstances:
1. The division of the parcel will not result in more than three parcels.
2. The property to be subdivided is a lot of record in the office of the County
Recorder of Scott County.
3. The resulting parcels generally conform to the shape and area of existing or
anticipated land subdivisions in the surrounding areas.
4. The division will not cause any structure to be in violation of setbacks.
5. Any easements which may be required by the City must be granted.
6. The owners of the land contiguous to the parcel must be notified in writing, and
no written objection received within ten d~s following notification.
7. Any written objection shall constitute an appeal. Such an objection shall be
forwarded to the City Council who shall hear the objection and decide the matter.
A copy of the location map are attached. Please accept this as official notification of this
proposed Administrative Land Division. Written comments or objections regarding this
matter should be submitted to the Planning Department by Tuesday, April 23, 1996. For

Dear Mr. Dauffenbach:
Attached for your use is a blank copy of an easement agreement which will convey
easement to the City of Prior Lake. As we discussed, these easements are required as
a part of the approval of the Administrative Land Subdivision/Combination for Lots 6 and
7, Oakland Beach 1st Addition. The required easements include a 10' wide drainage
and utility easement along Glendale Road and a 5' wide drainage and utility easement
along the outside edge of the parcel. Your surveyor should be able to provide you with
a legal description of these easements.
Once you have a legal description of these easements, please fill out the easement
agreement. It is important to note that this document must state that the described area
is for easement purposes. The completed agreement and a revised survey must then
be submitted to the Scott County Auditor's Office. Copies of the recorded documents
must also be returned to the Planning Department. You will not be able to obtain a
certificate of occupancy until this information has been submitted.

Dear Mr. and Mrs. Dauffenbach:
This letter is to inform you that your application to combine Lots 6 and 7, OAKLAJ.~D
BEACH 1 ST ADDITION into 1 lot as shown on the attached survey has been approved
with a condition by the City of Prior Lake.
Attached for your information is a copy of the Assistant City Engineer's memorandum
dated May 1, 1996. The first three comments are for your information. Item 4 indicates
that a 10 foot wide drainage and utility easement will be required along Glendale Road
and 5 foot wide drainage and utility easements will be required along the side and rear
property lines. This will require both revising the survey to show the required easements
and preparing an easement agreement for recording with Scott County.
In order to implement this administrative land division/combination, it is your
responsibility to submit the revised survey and file all pertinent documents (including the
drainage and utility easement agreement) with the Scott County Auditors Office within
sixty (60) days of the date of this approval letter, and submit copies of the recorded
documents for inclusion in File No. 96-033. Pursuant to my discussions with Pamela
Dauffenbach and the City's Building Official, Gary Staber, you may proceed with an
application for building permit, but will not be able to obtain a Certificate of Occupancy
until the above-stated terms are complied with.
Please be informed that failure to file information by July 5, 1996 will void the approval.

We have completed our review of the proposed Administrative Land Division for Lots 6 & 7,
Oakland Beach 1 st Addition that would combine the 2 parcels into one lot. The following are
our comments:
1. Street access for the new house shall be provided from Glendale Avenue which is a
public street with a bituminous surface.
2. Sanitary sewer and water service has been provided to the new parcel in two locations
from the lines that are in the private street along the west edge of the site. The existing 8"
sanitary sewer line is at elevation 905 j: in the private street, so a basement elevation of
909 or higher should work by gravity service.
3. It appears that the plat did not dedicate easements along the lot lines. This is fortunate for
the property owner that wants to combine Lots 6 and 7, and build across both lots. There
will not be any side lot line easements that need to be vacated along the common lot line
in between Lots 6 and 7.
4. With the new lot combination, new easements shall be provided along the outside edge of
the parcel. A 10 foot wide drainage and utility easement is needed along Glendale Road
and a 5 foot wide drainage and utility easement is needed along the side and rear lot lines.
These easements shall be provided to the City prior to release of the building permit.
