Dear Mr. Menke:
I have received your letter dated August 20, 1996. The "pertinent documents" I refer to
in my original letter are the certificate of survey for the land subdivision, and any
required easements, covenants, and so on. In your case, the City did not require any
easements, so the certificate of survey should be the only pertinent document. Once
you have recorded this survey, please transmit a copy, along with the new PID number
for each parcel to the Planning Department.

Dear Mr. and Ms. Menke:
This letter is to inform you that your application to subdivide the parcels described as
Tracts G and H, RL.S. No. 38 and Outlot A, Willows 3rd Subdivision, as shown on the
attached survey has been approved.
In order to implement this administrative land division, all pertinent documents must be
filed with the Scott County Auditor's Office within sixty (60) days of the date of this
approval letter. Copies of the recorded documents, along with the newly assigned Pip's
for each parcel, must then be submitted to the City as evidence that the administrative
land division has been filed.
Please be informed that failure to file this information by October 9, 1996, will void the
approval. I am sorry for the lateness of this letter, and any inconvenience it may have

Thank you for your copy of your July 17 letter to my clients, the Menkes. I am enclosing
their check in the amount of $465.00 as requested. Mr. Menke has already spoken to Mr. Boyles
relative to the propriety of charging this fee, and my clients asked me to make clear they are
making this payment under protest and reserving a right to take action to seek reimbursement at
a later time.
As I understand your letter, this should be the last impediment to completing this matter as

0) are being platted as Tracts A & B of an administrative land division. The tax status of the
property is current for payable 1996. All previous special assessments have been paid. However
Court Order File No. 85-10276 stipulated that the overlay assessment for Project 85-11 in the
amount of $2,390 on Tract G, RLS #38 was to be deferred until at such time that the parcel is
sold or a building permit is applied for with a provision that the assessment shall expire on
December 31, 1995. Because this date has since past, technically the assessment has expired.
Since the proposed administrative land division requires no associated street improvements or
storm water facilities, no storm water fee is applicable.
The area fee calculation for the Collector Street fee excludes Tract B which is to be given credit
for the existing residential home which is located on this parcel. Therefore, the net fee is based
upon the 13,524 sq. ft. represented by Tract A. A summary of the development fees ~
collected upon approval of the administrative lot split is detailed as follows:

NOTICE OF PROPOSED ADMINISTRATIVE LAND DIVISION
July 6, 1996
The Prior Lake Planning Department has received an application from Richard J. and
Judith A. Menke of P.O. Box 9, Prior Lake, Minnesota, to consider an Administrative
Land Division for the property identified as Tracts G and H, R.L.S. No. 38 and Outlot A,
Willows 3rd Addition. The proposal is to re-divide these parcels in order to create 2
buildable lots, according to the attached survey reduction.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the City Manager or
representative to authorize subdivision approval without a public hearing under the
following circumstances:
1. The division of the parcel will not result in more than three parcels.
2. The property to be subdivided is a lot of record in the office of the County
Recorder of Scott County.
3. The resulting parcels generally conform to the shape and area of existing or
anticipated land subdivisions in the surrounding areas.
4. The division will not cause any structure to be in violation of setbacks.
5. Any easements which may be required by the City must be granted.
6. The owners of the land contiguous to the parcel must be notified in writing, and
no written objection received within ten days following notification.
7. Any written objection shall constitute an appeal. Such an objection shall be
forwarded to the City Council who shall hear the objection and decide the matter.
Please accept this as official notification of this proposed Administrative Land Division.
Written comments or objections regarding this matter should be submitted to the

proceed with this matter. I have prepared a new notice for the proposed division, but,

WHEREAS, the undersigned ("Owner") owns Tracts G and H,
Registered Land Survey No. 38, Scott County, Minnesota, together
with Outlot A, WILLOWS 3RD ADD'N, Scott County, Minnesota; and
WHEREAS, Owner intends to rearrange these three parcels into
two lots and desires to create a private drainage easement five
feet on either side of the lines dividing the two lots to be
created; and
WHEREAS, Owner intends this private easement to inure to and
be for the exclusive benefit of only the two lots to be created and
for no other purpose; and
WHEREAS, Owner intends to identify said private drainage
easement on the administrative lot split survey he is preparing for
approval by the City of Prior Lake.
NOW, THEREFORE, Owner hereby states as follows:
1. There is established a private drainage easement over,
under, and across the north 10 feet of the south 15 feet of Tract
G, Registered Land Survey No. 38, Scott County, Minnesota.
2. This private drainage easement shall be for the exclusive
use and enjoyment of the respective owners of what will be the two
lots to be created out of Owner's property and as set forth on the
administrative lot split to be approved and filed by the City of
Prior Lake.
