LAND USE APPLICATION

We are planning to buy a home in Prior Lake and want to apply for
a permit to conduct business in this home. The business activity
would consist of inviting not more than six business owners to view
a short video and/or listen to a seminar on the application of our
Database Marketing software. There will be no retail sales
involved.
These meetings would be several times a week. We would not have any
materials stored outside nor would the meetings be apparent to
neighbors, other than. the normal dinner party that families have
from time to time.
There would only be one employee who does not live on the premises
that would be involved with the Seminars. The size of the area will
be kept under 300 square feet and there will be no outside signage
other than that permitted under the Prior Lake Sign Ordinance.

Dear Mr. And Mrs. Harte:
The City of Prior Lake Planning Department has reviewed your application for a home
occupation permit for the property located at 14964 Pixie Point Circle (see attached
legal description). According to your application, the proposed use consists of
Professional Presentation/Seminars.
This letter serves as official notification of approval of your application for a home
occupation permit to conduct the professional presentations/seminars, as described on
your application and in your letter dated 11-13-96. The following conditions apply to this
permit:
1. All material or equipment shall be stored within an enclosed structure.
2. Operation of the home occupation is not apparent from the street right-of-way.
3. The activity does not involve warehousing, distribution or retail sales of merchandise
produced off the site.
4. The home occupation may be carried on by persons residing in the dwelling unit and
not more than one employee who does not reside in the dwelling unit.
5. The home occupation shall be carried on wholly within the principal structure as
described on the application.
6. Exterior displays, signs (other than those permitted under the Sign Ordinance), and
outside storage of materials shall not be permitted.
7. Objectionable noise, vibration, smoke, dust, electrical disturbances, odors, heat,
glare or other nuisance factors shall not be discernible at the property line.
8. The home occupation shall not create excessive automobile traffic within the
neighborhood.

The City of Prior Lake has become aware of two potential violations regarding
the conditions for your Home Occupation Permit (File 96-119) at 14964 Pixie
Point Circle. According to City Ordinance 5-5-8: Home Occupations:
E) The home occupation shall be carried on wholly within the principal
structure. Space within the dwelling devoted to the home occupation does not
exceed ten percent (10%) of the floor area or three hundred (300) square feet,
whichever is greater. No portion of the home occupation is permitted within any
attached or detached accessory building.
F) Exterior Displays, signs (other than those permitted under chapter 7 of this
Title), and outside storage of materials shall not be permitted.
This office would like to solicit your cooperation and community spirit in
responding to these violations on or before August 14, 1997. If this date is
inconvenient, or if you should have any questions regarding this matter, please
feel free to call me at 447-4230, between 8:00 A.M. and 4:30 P.M., Monday
through Friday, and I will be happy to assist you. Please find enclosed a copy of
our City Code pertaining to your violations.

RE: Home Occupation Permit (Case File #96-119)
Dear Ms. Tovar,
Our intentions from the beginning were to be forthright with our plans and to consult with
the City to determine viability. We contacted the City before we purchased our home to
ascertain whether our plans were compatible with your city ordinances. Upon receiving
permission in the form of an approved Home Occupation Permit we proceeded with the
purchase.
In the course of developing our business and marketing strategies the idea of a conference
center was discussed. When we developed a brochure for the Seminars another one was
designed on the conference center theme. Since we didn't want to cause problems in the
neighborhood we consulted with the neighbors that would probably be most impacted.
They visited our home and saw what we planned to do. They seemed to be very
supportive. Several days later, however, we received a phone call questioning whether we
could do all that we planned, particularly the conference center. We put that brochure on
hold while we investigated the parameters of the Permit. Concurrently, we wanted to give
the neighbors time to evaluate their position. Quite frankly, we had forgotten about the
condition on the percentage of the home which could be used.
During this time we received your communication requesting a meeting. We assumed that
one of the neighbors that we had not talked to saw the sign and had some reservations but
did not want to contact us directly. Previously, we had contacted the City about a sign
because the Home Occupation Permit said signs, other than those permitted under the
Sign Ordinance, were not permitted. We wanted to know what kind of sign was permitted
so we called the City offices. We explained that we had just moved to Prior Lake and had
a business in our home and would like to know the restrictions of the Sign Ordinance. We
were only told the size restrictions, it had to be on the house and that it could not be a
neon type. There was no mention that the Ordinance prohibited them altogether. We were
not even told that we needed a permit to put one up. Accordingly, we ordered and
installed a small and tastefully done sign.
Upon rereading the conditions of the Permit we saw that we could not use more than 10%
for business purposes. At which time we abandoned the conference center idea.
Consequently, I was astonished to see a copy of the prototype conference center brochure
at the meeting. I assumed that Katherine had tossed them out or given one to someone.
When I spoke to Katherine after the meeting she said that she still had them. When we
looked in the file we found that one was missing. Evidently, the neighbor we had over had
taken it without our consent and then sent it to you.
As I mentioned at the meeting, we had no intention of pursuing actions which would be in
violation of the Home Occupation Permit. We have preceded each action we have taken
with consultation from the appropriate authorities. Any inappropriate actions have
transpired innocently by misapplication or by being given incomplete information or
requirements. We will comply with the conditions set forth in your letter regarding our
Home Occupation Permit dated 11-15-96, our residence will not be rented out as a
corporate retreat facility.
Please accept our apologies for any misunderstandings that have caused you to
misinterpret our intentions. No solicitations nor advertising was conducted in regards to a
conference center. Enclosed you will find a copy of the brochure we are using. The sign
was purchased and installed after contacting your office and receiving what we perceived
as verbal permission to have one if we met the previously mentioned conditions. Our
intentions have been and will continue to be to conduct business at our home within the
scope of the Home Occupation Permit.

Harte's apply for a home occupation permit. Applicant's letter states their
business activity "would consist of inviting not more than six business owners to

Marketing software." the letter goes on to say "the size of the area will be kept

Based on the application, the home occupation was approved. A letter was sent
listing home occupation criteria as conditions of approval and stating that
"Violation of any ordinance or legal requirement shall be deemed grounds for
immediate revocation of the Home Occupation Permit."

Steve Horsman, Enforcement Officer, receives a complaint and brochure about
the home occupation. The brochure advertises an Executive Center for lease up
to 24 people utilizing the entire facility (the house). A sign had been placed on
the exterior of the house, advertising "Prior Lake Executive Center".
8-4-97
Steve wrote Mr. Harte a letter of potential violation of a home occupation,
specifically citing designated area within the house and signage. The letter
requested a response to the possible violations by 8-14-97.
8-15-97
Steve and I met with Mr. Harte. We told him of the suspected violations based
on the brochure. Mr. Harte questioned who gave us the brochure. "Someone
must be going through my trash, because this was a draft brochure. This
brochure over-represents my business, and the creator was only being creative."
I told Mr. Harte that the City takes violations very seriously. Home Occupations
that violate the ordinance deter from the residential characteristics of a
neighborhood and that business zones are appropriate for larger home
occupations. I cited Mark Michael home occupation appeal to the Council.
specifically informed Mr. Harte of how we must investigate complaints and
apologized for any trouble this may have caused, if in fact, he is not violating City
Ordinance..
In order to bring the complaint matter to a close, Mr. Harte agreed to provide
proof of his compliance including a written statement re-stating his home
occupation and declaring that he is not running a conference center or
conducting his home occupation in any manner as stated in the brochure. The
proof could consist of the actual brochure or other materials from/relating to the
home occupation.
Mr. Harte submitted a completed sign permit application with a $30.00 fee. He
also provided a sign copy with the sign depicted on the front exterior evaluation
of the house.

Building Official Bob Hutchins went to the Harte home to conduct inspections
relating to a previous building permit. He was invited into the lower level of the
home and briefly observed the following:
. A room facing the lake, set up for presentations. There were approximately 6
conference tables with a chairs (estimated 24 chairs).
. There was a room with "business computers". A computer office/display with
much more equipment than for personal use.
. There was a private office with a computer and filing/shelf space. This had
the appearance of a business office with paperwork on the desk.
. There was a "gourmet" style kitchen, open to the conference area. There
was a large dining table with seating for about 8 people.
. The plans indicate a future bathroom. It is assumed the bath was finished
with the rest of the basement, but it was not observed.

Upon review of the City Code, no signs are permitted for home occupations. Mr.
Harte was sent a letter denying his sign permit application. Also sent was
information regarding appeal. Mr. Harte has 10 days for removal of the non-
conforming sign.

We have conducted several business meetings and things have gone smoothly and we
anticipate that they will continue to do so. When we have these meetings one of our goals
is to determine the best possible methods of presentation. One area of concern that has
been expressed is that the participants have some trouble seeing the details on the screen.
Our solution is to give each participant their own monitor, which necessitates a different
location in the house for the meeting . What we would like to propose to you is that we
don't use the area with the round table but use the lower level by my office as the
conference area.
Our proposed change will not increase the home occupation square footage over the ten
percent maximum. The exact measurements from the blue prints will verify that and you
are certainly welcome to come back and look at the layout again.

floor area devoted to the home occupation to be 544 square feet. This area includes two lower
level offices, conference room, and small 2nd kitchen in the laundry room on the main level.
City Ordinance 5-5-8-E, states, Space within the dwelling devoted to the home occupation does
not exceed ten percent (10%) of the floor area or three hundred (300) Square feet, whichever is
greater. The total finished floor area of the residence is 6082 sq.ft., as determined from the
original blue prints, which are part of building permit file #95-138. Ten percent (10%) of the
total floor area allowed results in 608 sq. ft. permitted for home occupation use. Therefore, the
area dedicated to your home occupation is in compliance with the City Code.
In addition, we have reviewed your letter regarding our concerns on the initial theme of your
business and marketing brochure for the Prior Lake Executive Center. Your revised business
plan and brochure, for the Database Marketing Resources, Inc., appears to be in line with the
conditions of your home occupation permit. Also, the removal of your sign, Prior Lake
Executive Center, as required by the City Planning Dept. letter dated August 27, 1997, brings
you into compliance with sign code 5-7-10-G.
