On December 13, 1996, the Planning Department received an application for a variance
from the Sevcik's. The application was for Impervious Surface exceeding 30% in the SD
on Spring Lake.
The Sevcik's currently have a deck with a screened porch (with a roof). Their intentions
are to rebuild the deck with higher quality materials (i.e. green treated lumber). The new
deck will be the same size and in the same location as the existing deck. Therefore, a
variance is not necessary. The screened porch will be built as a three season porch. This
will not increase the impervious surface. The new porch will be the exact size and in the
same location as the existing screened porch. This is indicated on the surveys.
This deck meets setbacks (50' or averaging) and would be OK. Section 9.3B (1.a.)
allows for existing sites to be remodeled and altered if the impervious surface is not being
expanded. Because nothing is changing, setback or impervious, we are considering this
to be a permitted use.
A variance is not required and the Variance Fee of$125 was refunded to the applicant on
December 19, 1996.

Dear Prior Lake Planning Commission,
The attached application for variance is being submitted prior to our request for
a building permit per procedures outlined to us by the City of Prior Lake
planners.
After examination, and inspection by a Prior Lake Building Inspector, we have
decided that it is necessary to remove the deteriorating existing deck. We are
not proposing to increase the size of the deck in any way but would like to
rebuild it slightly smaller than it exists today with one exception. We would like
to enclose a portion of the lower deck, which is now a screen porch, making it
into a three season porch.
The attached survey clearly shows the position and size of the deck as it relates
to the neighboring homes and decks. The reason for the variance relates to the
percentage of impervious ground involved. Our plans do not include increasing
this percentage in anyway. Our intention is to construct a deck that complies
with City Code and presents a safe and aesthetic structure which can be enjoyed
for many years.
We have been active members of the Prior Lake community since 1989. In
October of 1996 we purchased the property listed above. We have enjoyed
working with the people at the City of Prior Lake and have found them very
helpful in our quest to update this portion of our new property. We anxiously
await your ruling on this matter.
