the Prior Lake Planning Commission conducted a public hearing on January
27, 1997, to consider an application from Tom Buckingham for a Conditional
Use Permit (CUP) for Buckingham Disposal, Inc. and the City Council heard
the case on March 3, 1997; and
notice of the public hearing on said CUP has been duly published m
ac:ordance with the applicable Prior Lake Ordinances; and
the Planning Commission proceeded to hear all persons interested in this
issue and persons interested were afforded the opportunity to present their
views and objections related to the CUP ofBuckingharn Disposal Inc.; and
the Planning Commission and City Council finds the proposed use consistent
with the Year 2010 Comprehensive Plan; and
the Planning Commission and City Council find the CtJP of Buckingham
Disposal Inc. in harmony with both existing and proposed development in the
area surrounding the proj ect; and
the Planning Commission and City Council fmd the proposed CUP of
Buckingham Disposal is compatible with the stated purposes and intent of the
Zoning Ordinance as they relate to conditionally permitted uses, and further,
that the proposed CtJP of Buckingham Disposal, Iric. meets the criteria for
approval of Ct.JP is contained in Section 7-5 C 1-6 of the Zoning Ordinance
and Section 3 of the City Code.
NOW THEREFORE, BE IT RESOL v"ED BY THE CITY COtJNCIL OF PRIOR LAKE:
that it approve the C1.JP for Buckingham Disposal Inc. for property located at:
5980 Rainbow Parkway, legally described in attached Exhibit A;

Subject to the following:
1. The applicant must submiLa revised site plan indicating improvements to be made that will
meet all criteria of the off street parking ordinance (6.5). All driving!parkingl1oading areas
are to be paved, specifically the drive aisle on the west side of the site and the
parking!storage area on the east side of the site. Such revised plans must be approved by the
Plamring Department.
2. The applicant must obtain a certificate of occupancy for the recycling center from the
building official.
3. The hours of operation are restricted to 9:00 a.m. to 7:00 p.m.
4. The improvements must be done before ce~fied copies of the resolution are released for
recording at the county. The applicant has 30 days to submit plans that meet the
requirements of the ordinance and conditions set forth in this resolution (City Code Section
5-6-5B). The applicant has until one year from the date of adoption of this resolution to
complete the required improvements and record the resolution or the Conditional Use Permit
becomes null and void (Section 5-6-8).
CONCLUSION
Based upon the Findings set forth above, the City Council hereby grants a Conditional Use
Permit for Buckingham Disposal. Tne contents ofPlamring Case File #96-127 are hereby entered
into and made a part of the public record and the record of the decision for this case.

SUBMIT THE REQUIRED SITE AND BUILDING PLANS REQUIRED AS PART OF
THE APPROVAL FOR A CONDITIONAL USE PERMIT #96-127.

the City Council approved a Conditional Use Permit for Buckingham
Recycling Inc. on March 3, 1997; and
Condition #2 of the approving Resolution #97-19 requires the applicant to
obtain a certificate of occupancy; and
Condition #4 of the approving Resolution #97-19 allows the applicant 30
days to submit required plans (City Code Section 5-6-5B); and
In order to obtain a certificate of occupancy, the applicant must submit
structural plans from a registered architect detailing the necessary changes to
comply with the Uniform Building Code; and
The applicant cannot meet the 30 day timeline because of the time necessary
to complete such a review and prepare the required plans and thus, needs an
extension.
NOW THEREFORE, BE IT RESOL YED BY THE CITY COUNCIL OF PRIOR LAKE:
that it approve a 60 day extension for the submission of required plans for the CUP for
Buckingham Disposal Inc. for property located at:
5980 Rainbow Parkway, legally described in attached Exhibit A;
CONCLUSION
Based upon the Findings set forth above, the City Council hereby grants a 60 day extension for
Buckingham Disposal to comply with Condition #2 and #4 of Resolution #97-19. The applicant
must submit the required site and structural plans by June 2, 1997 and complete the required
improvements by March 3, 1998 as approved in Resolution #97-19.

NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE PLANNING
COMMISSION OF THE CITY OF PRIOR LAKE, MINNESOTA, that it
recommends the City Council approve the CUP for Buckingham Disposal Inc. subject to
the following:
1. The applicant must submit a revised landscape plan indicating improvements to be made that
meet all criteria of the landscape ordinance (6.10) as indicated in report including screening
of storage areas with multiple elements (not just a fence).
2. The applicant must submit a revised site plan indicating improvements to be made that will
meet all criteria of the offstreet parking ordinance (6.5). The plan needs to specify what is
paved and what is gravel. All driving/parking/loading areas are to be paved. Also the
revised site plan must indicate where parking spaces are to be striped, as to delineate the
parking areas from the drive aisle and to insure the proper number of parking spaces are
provided.
3. The applicant must provide full size building elevations with dimensions to indicate roof-top
screening and ratio of size of proposed wall signs.
4. The applicant must submit a revised site plan to indicate setback from centerline of CR21
and the access and layout of the site with the new expanded CR21. This must be approved
by the Planning Department.
5. The applicant must obtain a certificate of occupancy for the recycling center from the
building official.
6. The applicant must submit a lighting plan which meets the requirements of the ordinance.
7. The hours of operation are restricted to 9:00 a.m. to 7:00 p.m.
8. The applicant must provide the city with a letter from the MPCA indicating approval of the
site.
9. Outdoor storage of recycling containers must be screened as indicated in Ordinance 95-17.
Such screening, using multiple elements, must be indicated on revised plans.
10. The improvements must be done before certified copies of the resolution are released for
recording at the county. The applicant has 30 days to submit plans that are meet the
requirements of the ordinance and conditions set forth in Resolution 97-02 (City Code
Section 5-6-5B). The applicant has until one year from the date of adoption of Resolution
97-02 to complete the required improvements and record the resolution or the Conditional
Use Permit becomes null and void (Section 5-6-8).
11. The applicant must be in compliance with all city ordinances including those not
specifically detailed in this report.

WHEREAS, because of conditions on the subject property and on the surrounding
property, it is possible to use the subject property in such a way that the proposed sign
will not danger to the public safety, have a negative impact on surrounding property or
traffic, and unreasona~ly diminish or impair health, safety, comfort, morals or in any
other respect be contrary to the Zoning Ordinance; and
WHEREAS, the contents of Planning Case 96-127 are hereby entered into and
made a part of the public record and the record of decision for this case. Pursuant to
Section 5-7-16 of the Ordinance Code the sign permit will be deemed to be null and void
six (6) months from the date of approval if the holder of the sign permit has failed to
complete the contemplated improvements.
NOW, THEREFORE, BE IT RESOLVED BY the Planning Commission of the City
of Prior Lake, Minnesota:
A conditional sign permit is granted to permit the construction of a freestanding sign and
wall signs for Buckingham Disposal Inc. as proposed in Exhibit A (the site plan
submitted with the conditional sign permit application contained in Case file 96-127),
attached to and made a part of the resolution with the following conditions:
1. Revised front elevations must be submitted with dimensions such that the proposed
wall signs do not exceed 20% of the front facade as indicated in Section 5-7-7.
2. Revised site plan must indicate the freestanding sign setback.
3. The proposed signs must meet all city ordinances.

City Manager Boyles introduced the item. The business has been operating at the
existing site since 1995, and subsequent amendments to the Zoning Ordinance have
allowed for such facilities upon approval of a Condition al Use Permit. The Planning
Commission has unanimously recommended approval ofthis CUP.

C. Case #96-127 Request for a Conditional Use Permit and Conditional Sign
Permit for Buckingham Disposal.
The hearing was open at 10: 17 p.m. Planner Jenni Tovar presented the Staff Report.
In June of 1995, City staffbecame aware Buckingham Disposal. Inc. had begun
operations at its present facility at 5980 Rainbow Parkway. The firm had not obtained a
certificate of occupancy. In evaluating the business, the Planning Department concluded
the use which Buckingham was making of the site was not permitted in the 1-2 zoning
district. Buckingham appealed the decisions, and their appeal was upheld.
Staff was directed by the City Council to prepare an amendment to the Zoning Ordinance
which would explicitly permit recycling uses like Buckingham's as a conditional use in
the 1-2 zoning district. At the same time, Scott County had been processing a license
application for Buckingham. The County was informed of the City's proposed action,
and the facility would be allowed to operate during the preparation of the Ordinance
revision so that the license application could proceed.
The ordinance amendment was reviewed and approved by the Planning Commission on
December 11, 1995. The item was tabled at the December 18', 1995 City Council
meeting, and documentation indicating the ordinance was passed is not available.
However, based on recollections and actions of city staff to proceed with the Conditional
Use application for Buckingham, it is presumed the ordinance was adopted. Staffis
bringing the ordinance amendment to the City Council on February 3, 1997 for review
again. The amendment will then be published, and the record will be very clear of the
ordinance amendment. In order to not delay Buckingham in their CUP application, staff
is proceeding with both items simultaneously.
The applicant met with Tovar shortly before the meeting and proposed changes for the
driveway acceptable to staff. They also proposed moving the outdoor storage area to the
side property and screen the area. Applicants plan to close off the loading docks and
qate. closinq off all vehicular access to the area.
Staff recommended adopting Resolutions 97-02PC and 97-03PC, recommending the City
Council approve the conditional use permit and the conditional sign permit as presented.
Comments from the Public:
John Cairns, represented Tom Buckingham of Buckingham Disposal, stated the
conditions were acceptable and can work out the details. They will revise the site plan as
discussed.
Tovar stated the Building Official brought to staffs attention the applicant does not have
a Certificate of Occupancy for the use requested. The applicant is aware of the situation
and have 30 days to submit the plans for compliance.
The public hearing was closed at 10:31 p.m.

INTRODUCTION:
On December 30, 1996, the city received an application for
a conditional use permit from Tom Buckingham to operate
a recycling facility in the 1-2 zoning district. The business
has been operating at the existing site since 1995, and
subsequent amendments to the Zoning Ordinance have
allowed for such facilities upon approval of a Conditional
Use Permit (CUP). The Planning Commission has
unanimously recommended approval this CUP, with 11
specific conditions.
DISCUSSION:
Section 7.5(C) sets forth several criteria for approval of a
CUP. These criteria and the staff analysis of compliance
with these criteria are as follows:
1. The proposed use conforms to the district permitted
and conditional use provisions and all general
regulations of this Ordinance.
The proposed use is consistent with the conditional use
provisions for the 1-2 Light Industrial zoning district.
2. The proposed use shall not involve any element or
cause any conditions that may be dangerous,
injurious, or noxious to any other property or
persons, shall comply with the performance
standards listed below.
The Scott County Department of Environmental Health is
in the process of renewing Buckingham's license. A recent
on site inspection by the county revealed that the facility is
in compliance with county regulations. The business has

been in operation since 1995, and the city did not receive
any complaints in 1996.
3. The proposed use shall be sited, oriented and
landscaped to produce harmonious relationship of
buildings and grounds adjacent to buildings and
properties.

ordinance requirements of landscaping and screening.
4. The proposed use shall produce a total visual
impression and environment which is consistent
with the environment of the neighborhood.
Because the building is existing and the use is existing, the
effect on the environment of the neighborhood is minimal.
5. The proposed use shall organize vehicular access and
parking to minimize traffic congestion within the
neighborhood.
The proposed project provides sufficient area for vehicular
parking, however the parking stalls need to be striped and
indicated on the plans. The ordinance requires 1 stall for
each employee. This results in 15 stalls (6 employees at
Becker Arena Products and 9 at Buckingham) required.
The ordinance requires parking areas and drives to be
paved. The plans do not indicate that all of the drives will
be paved (or are currently paved). The access to the

loading docks and areas to be used by vehicles needs to be
paved. Storage areas can remain gravel, but parking and
driving areas must be paved. These areas need to be
identified on the plans. Also, the plans must indicate that
the building is 85' from the centerline of CR21 and
integrate the new CR21 into the plans. The applicant has
provided the city with a plan from Scott County (attached)
depicting the proposed CR 21 and access to the recycling
center. The access is acceptable to staff.
6. The proposed use shall preserve the objectives of this
Ordinance and shall be consistent with the
Comprehensive Plan.
The Comprehensive Plan designates this property as
industrial.
The performance standards are set forth in Section 7.5(D)
and relate to the following factors;
. Fire protection,
. Electrical disturbance,
. Noise,
. Vibrations,
. Odors,
. Air pollution,
. Glare,
. Erosion,
. Water pollution.
The proposed project is not expected to result in any of the
nuisance factors set forth in the performance standards, and
is thus consistent with these standards. Staff does not
anticipate the approval of this CUP increasing any off-site
disturbances.
STANDARDS FOR LIGHT PROCESSING
RECYCLING FACILITIES AND DESIGNATED
RECYCLING CENTERS (ORD. 95-19)
1. Such facilities must meet Minnesota Pollution Control
Agency (MPCA) requirements, or other state
requirements, for recycling facilities.

The applicant has provided evidence of an application
to the MPCA (Permit-by-Rule). Staff has not received
any negative information regarding this permit from the
MPCA.
2. The facility does not abut property planned, used or
zoned for residential use.
The property abuts industrial to the north and west and
street R-O-W to the south and east.
3. The facility must meet the requirements for screening
and landscaping contained in Section 6.10 of the
Zoning Ordinance, and the requirements for off street
parking contained in Section 6.5 of the Zoning
Ordinance.
Addressed in CUP analysis on previous pages of this
report. The applicant has revised plans and meets the
ordinance requirements.
4. Storage of recyclable materials outside a principal
building, accessory building, or enclosed containers is
not permitted. Outdoor storage of containers for
recyclable materials is subject to screening
requirements of Section 6.10 generally, and Section
6.1O(F) Parking Lot Landscape specifically.
The applicant is proposing and does have existing
outdoor storage containers for recycling materials.
These are located on the east side of the building.
Therefore, screening of this part of the site must be in
accordance with Section 6.10 and 6.10 (F). A
combination of materials is required such as fence and
plantings or berm and planting, etc. To achieve opacity
80% year round. The applicant's original proposal was
for a 6' slated chain link fence. Revised plans indicate
a combination of fencing and plantings for screening
which meet the requirements of the ordinance.
The applicant indicates a scrap metal area on the site
plan. This has are been enclosed in a proposed
recycling container and relocated to the east side of the
building as indicated on the revised plans.

5. If the facility is located within 500 feet of property
planned, zoned or used for residential use, hours of
operation shall be restricted to 9:00 a.m. to 7:00 p.m.
The facility is located within 500 feet of property used
for residential. This property is located outside of the
city limits to the east. Therefore, the hours of operation
are restricted to 9:00 a.m. to 7:00 p.m.
The City Council must determine if the applicant meets the
requirements for granting a CUP and meets those specific
requirements relating to recycling facilities as listed. The
Planning Commission and staff feel that some of the
criteria have been met and that the plans can be revised to
meet the other criteria.
The attached resolution grants the CUP with specific
conditions to meet the listed criteria within a designated
time frame. Revised drawings & plans (dated 2/19/97)
reflect most of the conditions the Planning Commission
recommended. The attached resolution lists conditions to
address those issues that remain unsatisfied. Revised
drawings & plans must be submitted within 30 days of
adoption of the resolution and completion of the
improvements must be done within one year of adoption of
the resolution.

Disposal Inc. in harmony with both existing and proposed development in the
area surrounding the project; and

C. Case #96-127 Request for a Conditional Use Permit and Conditional Sign
Permit for Buckingham Disposal.
The hearing was open at 10: 17 p.m. Planner Jenni Tovar presented the Staff Report.
In June of 1995, City staffbecame aware Buckingham Disposal. Inc. had begun
operations at its present facility at 5980 Rainbow Parkway. The firm had not obtained a
certificate of occupancy. In evaluating the business, the Planning Department concluded
the use which Buckingham was making of the site was not permitted in the 1-2 zoning
district. Buckingham appealed the decisions, and their appeal was upheld.
Staff was directed by the City Council to prepare an amendment to the Zoning Ordinance
which would explicitly permit recycling uses like Buckingham's as a conditional use in
the 1-2 zoning district. At the same time, Scott County had been processing a license
application for Buckingham. The County was informed of the City's proposed action,
and the facility would be allowed to operate during the preparation of the Ordinance
revision so that the license application could proceed.
The ordinance amendment was reviewed and approved by the Planning Commission on
December 11, 1995. The item was tabled at the December 18, 1995 City Council
meeting, and documentation indicating the ordinance was passed is not available.
However, based on recollections and actions of city staff to proceed with the Conditional
Use application for Buckingham, it is presumed the ordinance was adopted. Staffis
bringing the ordinance amendment to the City Council on February 3, 1997 for review
again. The amendment will then be published, and the record will be very clear of the
ordinance amendment. In order to not delay Buckingham in their CUP application, staff
is proceeding with both items simultaneously.
The applicant met with Tovar shortly before the meeting and proposed changes for the
driveway acceptable to staff. They also proposed moving the outdoor storage area to the
side property and screen the area. Applicants plan to close off the loading docks and
gate, closing off all vehicular access to the area.

Staff recommended adopting Resolutions 97-02PC and 97-03PC, recommending the City
Council approve the conditional use permit and the conditional sign permit as presented.
Comments from the Public:
John Cairns, represented Tom Buckingham of Buckingham Disposal, stated the
conditions were acceptable and can work out the details. They will revise the site plan as
discussed.
Tovar stated the Building Official brought to staffs attention the applicant does not have
a Certificate of Occupancy for the use requested. The applicant is aware of the situation
and have 30 days to submit the plans for compliance.
The public hearing was closed at 10:31 p.m.

ORDINANCE NO. 95-19
AN ORDINANCE AMENDING TITLE 5 OF THE PRIOR LAKE CITY CODE
AND SECTIONS 3 AND 8 OF THE ZONING ORDINANCE, 83-06.
The City Council of the City of Prior Lake does hereby ordain:
Title 5 of the Prior Lake City Code and Sections 3 and 8 of the Zoning Ordinance, 83-06
are hereby amended as follows:
SECTION 8 - DEFINITIONS
8.1
General:
Certain words used in this Ordinance are defined and shall be
interpreted as follow:
RECYCLABLE MATERIALS - Materials that are separated from mixed municipal
solid waste for the purpose of recycling, including, paper, glass, metals, automobile oil,
batteries and other specifically allowed items. Refuse derived material or other material
that is destroyed by incineration is not a recyclable material.
RECYCLING FACILITY - A center for the collection, processing or repair of
recyclable materials for reuse in their original form or use in manufacturing processes.
Recycling facilities may include the following:
Designated Recycling Center: A recycling facility which has complied
with the permitting rules of the Pollution Control Agency and is open a minimum
of 12 operating hours each week, 12 months each year, and accepts for recycling
at least four different materials such as paper, glass, plastic, and metal.
Light Processing Recycling Facility: A building or enclosed space
occupying an area less than 45,000 square feet and used for the collection and
processing of recyclable materials. Processing does not include end-use
manufacturing or industrial use but may include the preparation of material for
efficient shipment or end-user's specifications, by such means as baling,
briquetting, compacting, flattening, grinding, crushing, mechanical sorting, and
shredding.
SECTION 3 - PERMITTED AND CONDITIONAL USES
3.3 STANDARDS FOR LIGHT PROCESSING RECYCLING FACILITIES
AND DESIGNATED RECYCLING CENTERS
1. Such facilities must meet Minnesota Pollution Control Agency (MPCA)
requirements, or other applicable state requirements, for recycling facilities.
2. The facility does not abut a property planned, used or zoned for residential
use.
3. The facility must meet the requirements for screening and landscaping
contained in Section 6.10 of this Ordinance, and the requirements for off-
street parking contained in Section 6.5 of this Ordinance.
4. Storage of recyclable materials outside a principal building, accessory
building or enclosed containers is not permitted. Outdoor storage of
containers for recyclable materials is subject to the screening requirements of
Section 6.10 generally, and Section 6.10(F) Parking Lot Landscape
specifically.
5. If the facility is located within 500 feet of property planned, zoned or used for
residential use, hours of operation shall be restricted to 9:00 a.m. to 7:00 p.m.

The following are recommended license conditions for this facility:
1. This license shall be subject to any and all conditions established by the City of Prior
Lake as part of their business license and any other City licenses or Ordinances.
2. The number of waste appliances stored at the facility shall not exceed sixty. Once the
number of appliances reaches sixty, the licensee shall have all appliances removed
from the facility. All appliances that contain hazardous materials (cfc's, pcb capacitors
and mercury shall be removed from the site by an appliance collector or delivered to a
facility that will remove the hazardous material.
3. Used oil and waste batteries shall be managed in accordance with the Scott County
Hazardous Waste Ordinance No. 12.
4. The number of waste tires shall not exceed fifty. The tires shall be stored in an
enclosed building or on an area in direct sunlight, void of any vegetation.
5. Access shall be controlled by whatever means the owner/licensee determines to be
workable. The owner/licensee shall be responsible for removal and proper disposal of
all unacceptable wastes.
6. Only source separated recyclables shall be managed at this site. Mixed municipal solid
waste shall not be transferred, stored in containers other than collection vehicles or
tipped for processing or transfer from this site.
7. An annual report shall be submitted by the owner/licensee listing all recyclables
accepted from Scott County businesses and residents.
8. The applicant shall pay an annual license fee in accordance with the adopted Fee
Schedule.

Tom Buckingham started in the disposal business when he was a senior at BumsvilIe High School.

today. The owner of the first landfill in Scott County, Elmer Buckingham assisted with his son's business up until
the time ofhis death in December, 1985 at the age of 83. Buckingham's mother, Rose, is still active at age 85.

The SavagelPrior Lake businessman said there have been numerous changes in the solid waste disposal
business since he started aver 25 years ago. lilt is an industIy that is constantly changirlg, and the new plans for
disposing of solid wasted will affect us and out customers." He said his company includes a newsletter wi1h 1heir
billings to inform customers about changes in rules that will affect 1heir service.

We are in support of the CUP for BUCKINGHAM DISPOSAL as shown on the plans received
January 10, 1997 and offer the following comments / conditions:
. The westerly access is taken from Credit River Road, which is being turned back to the City as
part of the SAP 70-621-09/ CSAH 21 reconstruction.
. The easterly access is to be taken from CR 12, which is being realigned to intersectfuture
CSAH 21 at a 90 degree angle.
. No berming or landscaping will be allowed within County right-of-way.

INTRODUCTION:
On March 3, 1997, the City Council approved a
Conditional Use Permit for Buckingham Recycling, Inc.
(Resolution #97-19). A provision of that approval
(Condition #4) allowed the applicant 30 days to submit the
necessary plans and up to one year to actually complete the
work.
DISCUSSION:
Condition #2 of Resolution #97-19 was that the applicant
obtain a certificate of occupancy from the building official.
A letter from the Building Official (3/19/97) details the
requirements of Buckingham Recycling to obtain a
certificate of occupancy. Part of this process involves a
complete code review by a registered architect and
submittal of plans indicating changes in the structure that
will bring the building into code compliance with the
Uniform Building Code.
It is this condition (#2) that is taking longer than expected.
The applicant will not be able to submit the required plans
to the city within the 30 day period (by April 3, 1997).
Therefore, an extension is being requested.
ISSUES:
The City Council must determine if an extension is to be
granted. An extension to the 30 day time period will allow
the applicant until June 2, 1997 to submit the necessary
plans. It will not extend the one year allowed to complete
the actual work. The required site and structural
improvements must be completed by March 3, 1998.

SUBMIT THE REQUIRED SITE AND BUILDING PLANS REQUIRED AS PART OF
THE APPROVAL FOR A CONDITIONAL USE PERMIT #96-127.
MOTION BY: SECOND BY:
WHEREAS, the City Council approved a Conditional Use Permit for Buckingham
Recycling Inc. on March 3, 1997; and
WHEREAS, Condition #2 of the approving Resolution #97-19 requires the applicant to
obtain a certificate of occupancy; and
WHEREAS, Condition #4 of the approving Resolution #97-19 allows the applicant 30
days to submit required plans (City Code Section 5-6-5B); and
WHEREAS, In order to obtain a certificate of occupancy, the applicant must submit
structural plans from a registered architect detailing the necessary changes to
comply with the Uniform Building Code; and
WHEREAS, The applicant cannot meet the 30 day timeline because of the time necessary
to complete such a review and prepare the required plans and thus, needs an
extension.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE:
that it approve a 60 day extension for the submission of required plans for the CUP for
Buckingham Disposal Inc. for property located at:
5980 Rainbow Parkway, legally described in attached Exhibit A;
CONCLUSION
Based upon the Findings set forth above, the City Council hereby grants a 60 day extension for
Buckingham Disposal to comply with Condition #2 and #4 of Resolution #97-19. The applicant
must submit the required site and structural plans by June 2, 1997 and complete the required
improvements by March 3, 1998 as approved in Resolution #97-19.

WHEREAS, the Prior Lake Planning Commission conducted a public hearing on January
27, 1997, to consider an application from Tom Buckingham for a Conditional
Use Permit (CUP) for Buckingham Disposal, Inc. and the City Council heard
the case on March 3, 1997; and
WHEREAS, notice of the public hearing on said CUP has been duly published m
accordance with the applicable Prior Lake Ordinances; and
WHEREAS, the Planning Commission proceeded to hear all persons interested in this
issue and persons interested were afforded the opportunity to present their
views and objections related to the CUP of Buckingham Disposal Inc.; and
WHEREAS, the Planning Commission and City Council finds the proposed use consistent
with the Year 2010 Comprehensive Plan; and
WHEREAS, the Planning Commission and City Council fmd the CUP of Buckingham
Disposal Inc. in harmony with both existing and proposed development in the
area surrounding the project; and
WHEREAS, the Planning Commission and City Council fmd the proposed CUP of

CONCLUSION
Based upon the Findings set forth above, the City Council hereby grants a Conditional Use
Permit for Buckingham Disposal. The contents of Planning Case File #96-127 are hereby entered
into and made a part of the public record and the record of the decision for this case.

I am in receipt of your letter dated March 7, 1997 regarding your request of a certificate of occupancy for
the recycling facility located at 5980 Credit River Road in Prior Lake. Both Prior Lake City Code Section
5-6-2 and the Uniform Building Code Section 109 require an existing building to be brought up to code
when the use of the structure has been changed. Copies of these code sections have been attached for your
use.
The following items must be addressed prior to the issuance of a certificate of occupancy.
I. A code review for the entire structure completed by an architect registered with the State of
Minnesota must be submitted. This code review must detail what modification if any would be
required to bring the structure into code compliance. Existing and proposed floor plans are
required as a part of the code review process.
2. Building Permits and inspection approvals are required for any proposed alterations and
alterations already completed to the structure.
3. The existing on site sewage treatment system has been classified as a failing system.
Documentation must be provided that the septic tanks are being pumped out on a regular basis,
a copy of a pumping contract will suffice.

INTRODUCTION:
In June of 1995, City staff became aware that Buckingham Disposal. Inc. had begun
operations at its present facility at 5980 Rainbow Parkway. The firm had not obtained a
certificate of occupancy. In evaluating the business, the Planning Department concluded
that the use which Buckingham was making of the site was not permitted in the 1-2
zoning district. Buckingham appealed the decisions, and their appeal was denied.
Staff was directed by the City Council to prepare an amendment to the Zoning Ordinance
which would explicitly permit recycling uses like Buckingham's as a conditional use in
the 1-2 zoning district. At the same time, Scott County had been processing a license
application for Buckingham. The County was informed of the City's proposed action,
and that the facility would be allowed to operate during the preparation of the Ordinance
revision so that the license application could proceed.
The ordinance amendment was reviewed and approved by the Planning Commission on
December 11, 1995. The item was tabled at the December 18, 1995 City Council
meeting, and documentation indicating the ordinance was passed is not available.
However, based on recollections and actions of city staff to proceed with the Conditional
Use application for Buckingham, it is presumed that the ordinance was adopted. Staff is
bringing the ordinance amendment to the City Council on February 3, 1997 for review
again. The amendment will then be published, and the record will be very clear of the
ordinance amendment. In order to not delay Buckingham in their CUP application, staff
is proceeding with both items simultaneously.

REVIEW PROCESS:
The proposed CUP should be reviewed in accordance with the criteria found in Section
7.5(C) of the Zoning Ordinance. Section 7.5(C) provides in significant part that "...A
conditional use shall be approved if it is found to meet the following criteria... ."
Resolution 95-19 outlines the standards and conditions for approval of the CUP for
Recycling Facilities.
SITE ANALYSIS:
The subject site consists of 2.78 acres of land located at 5980 Rainbow Parkway, north
and east of CR21, and about 1/8 mile east of Welcome Avenue. The site is surrounded
by industrial uses. Directly to the north is Prior Lake Mini-Storage, to the west is an NSP
Electrical Transmission Sub-station. To the south is CR21 to the east is Credit River
Township. The entire site is zoned 1-2. The building was constructed in 1985 as an
office warehouse facility.
CONDITIONAL USE PERMIT ANALYSIS:
Section 7.5(C) sets forth several criteria for approval of a CUP. These criteria and the
staff analysis of compliance with these criteria are set forth below;
1. The proposed use conforms to the district permitted and conditional use
provisions and all general regulations of this Ordinance.
The proposed use is consistent with the conditional use provisions for the 1-2 Light
Industrial zoning district.
2. The proposed use shall not involve any element or cause any conditions that may
be dangerous, injurious, or noxious to any other property or persons, shall
comply with the performance standards listed below.
The Scott County Department of Environmental Health is in the process of renewing
Buckingham's license. A recent on site inspection by the county revealed that the facility
is in compliance with county regulations. The business has been in operation since 1995,
and the city has not received any complaints in 1996.

3. The proposed use shall be sited, oriented and landscaped to produce harmonious
relationship of buildings and grounds adjacent to buildings and properties.

4. The proposed use shall produce a total visual impression and environment which
is consistent with the environment of the neighborhood.
Because the building is existing and the use is existing, the effect on the environment of
the neighborhood is minimal.
5. The proposed use shall organize vehicular access and parking to minimize traffic
congestion within the neighborhood.
The proposed project provides sufficient area for vehicular parking, however the parking
stalls need to be striped and indicated on the plans. The ordinance requires 1 stall for
each employee. This results in 15 stalls (6 employees at Becker Arena Products and 9 at
Buckingham) required.
The ordinance requires parking areas and drives to be paved. The plans do not indicate
that all of the drives will be paved (or are currently paved). The access to the loading
docks and areas to be used by vehicles needs to be paved. Storage areas can remain
gravel, but parking and driving areas must be paved. These areas need to be identified on
the plans. Also, the plans must indicate that the building is 85' from the centerline of
CR21 and integrate the new CR21 into the plans. What will be the access to and from the
new roadway? The highway improvements need to be integrated into the plans.
6. The proposed use shall preserve the objectives of this Ordinance and shall be
consistent with the Comprehensive Plan.
The Comprehensive Plan designates this property as industrial.

The performance standards are set forth in Section 7.5(D) and relate to the following
factors;
. Fire protection,
. Electrical disturbance,
. Noise,
. Vibrations,
. Odors,
. Air pollution,
. Glare,
. Erosion,
. Water pollution.
The proposed project is not expected to result in any of the nuisance factors set forth in
the performance standards, and is thus consistent with these standards. Furthermore, the
approval of this CUP will not increase any off-site disturbances, as the business has been
in operation for over a year, with no complaints reported in 1996.
STANDARDS FOR LIGHT PROCESSING RECYCLING FACILITIES AND
DESIGNATED RECYCLING CENTERS (ORD. 95-19)
1. Such facilities must meet Minnesota Pollution Control Agency (MPCA)
requirements, or other state requirements, for recycling facilities.
The applicant can provide a written letter from MPCA indicating compliance.
2. The facility does not abut property planned, used or zoned for residential use.
The property abuts industrial to the north and west and street R-O-W to the south and
east.
3. The facility must meet the requirements for screening and landscaping contained in
Section 6.10 of the Zoning Ordinance, and the requirements for offstreet parking
contained in Section 6.5 ofthe Zoning Ordinance.
Addressed in CUP analysis on previous pages of this report. The applicant needs to
revise plans to meet the ordinance requirements.
4. Storage of recyclable materials outside a principal building, accessory building, or
enclosed containers is not permitted. Outdoor storage of containers for recyclable
materials is subject to screening requirements of Section 6.10 generally, and Section
6.10(F) Parking Lot Landscape specifically.

The applicant is proposing and does have existing outdoor storage containers for
recycling materials. These are located on the east side of the building. Therefore,
screening of this part of the site must be in accordance with Section 6.10 and 6.10 (F).
A combination of materials is required such as fence and plantings or berm and
planting, etc. To achieve opacity 80% year round. The applicant is proposing a 6'
slated chain link fence. Additional materials for screening are required.
The applicants indicate a scrap metal area on the site plan. This must be in an
enclosed accessory building or recycling container as indicated. Proper screening of
this area is also required.
5. If the facility is located within 500 feet of property planned, zoned or used for
residential use, hours of operation shall be restricted to 9:00 a.m. to 7:00 p.m.
The facility is located within 500 feet of property used for residential. This property
is located outside of the city limits to the east. Therefore, the hours of operation are
restricted to 9:00 a.m. to 7:00 p.m.
CONDITIONAL SIGN PERMIT
The sign ordinance requires that any signs on uses that are conditional require approval as
a Conditional Sign Permit. The maximum allowed area is:
Wall Signs Cannot exceed 20% front facade, maximum area of200 sq. Feet.
Freestanding Signs Can have 2 sides of75 feet maximum each side, no higher than 20'
above the centerline grade, and setback 10 feet from property line.
The applicant is proposing a 4 by 8 freestanding sign and two wall signs consisting of
108 sq. feet. The applicant needs to provide the city with dimensions of front elevations
such that the ratio of signs can be determined and submit the setbacks of the freestanding
sign on the site plan.
ALTERNATIVES:
1. Adopt Resolution 97-02PC, (recommending the City Council approve the CUP for
Buckingham Disposal) and Resolution 96-03PC, (approving the conditional sign
permit) as presented or with changes recommended by the Commission.
2. Continue the public hearing to a date and time certain to allow the developer
and/or staff to provide additional information specifically requested by the
Planning Commission.
3. Based upon expressed findings of fact, recommend the City Council deny part or
all of the applications based upon inconsistency of the proposal with specific
regulations of the Zoning and Subdivision Ordinances and/or specific policies of
the Comprehensive Plan.

RECOMMENDATION:
Staff recommends Alternative # 1 with no variances to the ordinance. Resolution 97-01
approving the CUP contains the following conditions:
1. The applicant must submit a revised landscape plan indicating improvements to be
made that meet all criteria of the landscape ordinance (6.10) as indicated in report
including screening of storage areas with multiple elements (not just a fence).
2. The applicant must submit a revised site plan indicating improvements to be made
that will meet all criteria of the offstreet parking ordinance (6.5). The plan needs to
specify what is paved and what is gravel. All driving/parking/loading areas are to be
paved. Also the revised site plan must indicate where parking spaces are to be
striped, as to delineate the parking areas from the drive aisle and to insure the proper
number of parking spaces are provided.
3. The applicant must provide full size building elevations to indicate roof-top screening
and size of any wall signs.
4. The applicant must submit a revised site plan to indicate setback from centerline of
CR2l and the access and layout of the site with the new expanded CR21. This must
be approved by the Planning Department.
5. The applicant must obtain a certificate of occupancy for the recycling center from the
building official.
6. The applicant must submit a lighting plan which meets the requirements of the
ordinance.
7. The hours of operation are restricted to 9:00 a.m. to 7:00 p.m.
8. The applicant must provide the city with a letter from the MPCA indicating approval
of the site.
9. Outdoor storage of recycling containers must be screened as indicated in Ordinance
95-17. Such screening, using multiple elements, must be indicated on revised plans.
10. The improvements must be done before certified copies of the resolution are released
for recording at the county. The applicant has 30 days to submit plans that are meet
the requirements of the ordinance and conditions set forth in Resolution 97-02 (City
Code Section 5-6-5B). The applicant has until one year from the date of adoption of
Resolution 97-02 to complete the required improvements and record the resolution or
the Conditional Use Permit becomes null and void (Section 5-6-8).

BACKGROUND/JUSTIFICATION:
Buckingham Companies has been operating a recycling facility in Prior Lake since 1995. The facility accepts recyclables
from the public. The materials include; tires, appliances, used motor oil, batteries, plastics, metal, glass and paper
products. Buckingham Companies is also licensed as a hazardous waste generator with Scott County for batteries and
used motor oil.
Staff conferred with the Attorney's Office and Risk Management and concluded that because limited amounts of recycled
materials are managed at this facility no bond is recommended.
The license conditions attached, are the same as in 1997.
Buckingham Companies has a Conditional Use Permit with the City of Prior Lake.
The City of Prior Lake, the Scott County Attorney's Office and Risk Management have reviewed and approved this
application.

LICENSE CONDITIONS

The following are recommended license conditions for this facility:
1. This license shall be subject to any and all conditions established by the City of Prior
Lake as part of their business license and any other City licenses or Ordinances.
2. The number of waste appliances stored at the facility shall not exceed sixty. Once the
number of appliances reaches sixty, the licensee shall have all appliances removed
from the facility. All appliances that contain hazardous materials (cfc's, pcb capacitors
and mercury shall be removed from the site by an appliance collector or delivered to a
facility that will remove the hazardous material.
3. Used oil and waste batteries shall be managed in accordance with the Scott County
Hazardous Waste Ordinance No. 12.
4. The number of waste tires shall not exceed fifty. The tires shall be stored in an
enclosed building or on an area in direct sunlight, void of any vegetation.
5. Access shall be controlled by whatever means the owner/licensee determines to be
workable. The owner/licensee shall be responsible for removal and proper disposal of
all unacceptable wastes.
6. Only source separated recyclables shall be managed at this site. Mixed municipal solid
waste shall not be transferred, stored in containers other than collection vehicles or

I'm in receipt of your letter dated December 17, 1997. I question your requirements in
regard to the following and in order that we may have a better lUlderstanding:
Slats only need to be installed around the outdoor storage area on the East end of the
property. The slats were not installed on the front gates on the advise of a professional
fence installer for the following reasons:
A.) An open area in the front of the property (at gates) allows a better
measure of security when the site is properly patrolled by law
enforcement.
B.) An open area (at gates) prevents a wind tunnel effect, that could
result in collapse of the fence itself,
The parking lot striping material has been purchased and will be applied weather
permitting by March 3, 1998.
We (Buckingham Disposal, Inc.) teel we have gone above and beyond everything that
has been required of us from the City of Prior Lake since moving our operation to this site
three years ago. Our track record to date should prove this.

of your site with respect to the necessary improvements as part of your CUP granted in
1996. The following must be completed prior to issuance of a Certificate of Occupancy:

Dear Mr. Buckingham:
I am in receipt of your letter dated March 7, 1997 regarding your request of a certificate of occupancy for
the recycling facility located at 5980 Credit River Road in Prior Lake. Both Prior Lake City Code Section
5-6-2 and the Uniform Building Code Section 109 require an existing building to be brought up to code
when the use of the structure has been changed. Copies of these code sections have been attached for your
use.
The following items must be addressed prior to the issuance of a certificate of occupancy.
1. A code review for the entire structure completed by an architect registered with the State of
Minnesota must be submitted. This code review must detail what modification if any would be
required to bring the structure into code compliance. Existing and proposed floor plans are
req';lired as a part of the code review process.
2. Building Permits and inspection approvals are required for any proposed alterations and
alterations already completed to the structure.
3. The existing on site sewage treatment system has been classified as a failing system.
Documentation must be provided that the septic tanks are being pumped out on a regular basis,
a copy of a pumping contract will suffice.

BOARD OF ADJUST:'v1ENT: The Planning Commission shall
act as the Zoning Board of Adjustment with identical
composition. membership. officers and terms of office with the
following duties:
(A) Hear, review and authorize variances from the requirements of this
Title and to attach such conditions to the variance as it deems
necessary to assure compliance with the purpose of this Title. Tne
decision of the Board of Adjustment may be appealed to the City
Council by the City Council. the property owner or agent or any other
person aggrieved by the decision of the Board of Adjustment. The
party appealing the Board of Adjustment's decision shall file with the
City Manager a notice of appeal stating the specific grounds upon
which the appeal is made within five (5) working days after the date
of the order of the Board of Adjustment granting or denying the
variance. The City Council shall then hear such appeal and shall
make its decision by resolution or motion within a reasonable time
after the date of the City Council hearing or any continued hearing.
No building permit shall be issued until the appeal period has expired
or, if an appeal is taken, until the City Council has made its decision.
(8) Act in a purely adviSOry manner to the City Council in all cases
except variances, and special exceptions. provided for within this Title.
and transmit its recommendations in writing within sixty (60) days after
a hearing or continued hearing to the City Council for final ac:ion.

cial may make or require other inspections of any construction work to ascertain compliance with

108.8 Reinspections. A reinspection fee may be assessed for each inspection or reinspection
when such portion of work for which inspection is called is not complete or when corrections called
for are not made.
Tnis subsection is not to be interpreted as requiring reinspection fees the tirst time :J.job is rejected
for failure to comply with the requirements of this code. but as controlling the practice of calling for
inspections before the job is ready for such inspection or reinspection.
Reinspection fees may be assessed when the inspection record card is not posted or otherwise
available on the work site. the approved plans are not readily available to the inspector. for failure to
provide access on the date for which inspection is requested. or for deviating from plans requiring
the approval of the building official.

Subject: Appeal to City Code Requirements
Dear Mr. Buckingham,
Thank you for your July 18, 1995 letter. After reviewing the letter, it is clear
that there is a disagreement regarding the interpretation of the zoning
ordinance with regard to recycling operations. Two portions of the City's
ordinance are instructive: Section 2.5 of the Zoning Ordinance entitled "Uses
not designated" provides that:
"A use not specifically designated as permitted or conditional use
anywhere in the City is considered prohibited. In such a case, the
Council, Commission or property owner may request a study by the
city to determine if the use is acceptable and, if so, what zoning district
would be most appropriate for the use, and what conditions and
standards, if any, should be attached to the development of the use. If
found acceptable an amendment to the Zoning Ordinance may be
initiated by the Council or Commission permitting the use."
The City Code goes on to say in Chapter 5-6-4 Appeals that "An appeal from
a ruling of the Zoning Officer may be made by the property owner or agent
. within thirty (30) days after the order utilizing the procedure as follows:
A. The property owner or agent shall file with the Zoning Officer a
notice of appeal stating the specific grounds upon which the appeal
is made.
B. The Zoning Officer shall transmit the appeal to the Board of
Adjustment for study and recommendation at its next regular
meeting.
C. The Board of Adjustments shall make its recommendation within
sixty (60) days and transmit to the City Council for official action.

D. The City Council shall make its decision by Resolution within sixty
(60) days and a copy of the resolution shall be mailed to the
applicant by the Zoning Officer."
Planning Director, Don Rye, has reviewed the City Code with respect to
recycling operations and provided his interpretation. Your July 18
memorandum outlines your interpretation. Don Rye, in his capacity as the
Zoning Officer, does not believe that the Zoning Ordinance addresses
recycling operations as either permitted or conditional uses. Consequently,
you have the opportunity to appeal Mr. Rye's findings to the Board of
Adjustment which is the City's Planning Commission. The Board of
Adjustment, and subsequently, the City Council have the option of
supporting Mr. Rye's interpretation and/or directing that revisions be made
to the Zoning Ordinance to address recycling operations specifically. To
expedite this process, I have interpreted your July 18 letter to be a notice of
appeal as required under the code. I have asked the Planning Department to
initiate the process set forth in 5-6-4 and 2.5.
In the meantime, I must advise you that until the Zoning Ordinance is
revised and your operation comes into complete compliance with the City
Code, Uniform Building Code, County and State Requirements, you may not
operate the facility from this location. To do otherwise is contrary to the law,
and undertaken at your sole and exclusive risk.
Whether or not the Zoning Ordinance is revised to accommodate the recycling
use, it will be necessary for you to submit a building permit application,
supporting materials and fees in order that the work already accomplished
will be deemed legal under the State Building code laws.
Feel free to contact Planning Director Don Rye, or Assistant Planner Deb
Garross, to schedule the appeal you are requesting before the Planning
Commission and City Council.

cun:cntly existing and rating any non-rated openings.
This does not make sttuctUrC, exiting. egress. fin: resistance. square footage. height, at use of building
non-compliant to existing building codes. The minimal construetion seems to fit 1.D1der Chapter 34 of the
UBC when allowed by the Building Department. There are other deficiencies in the building. such as
accessibility and energy codes adopted In recent years.
It is our opinion that compliant constrUction is minimal and should not require extensive remodeling to meet all

the City Council approved a Conditional Use Permit for Buckingham
Recycling Inc. on March 3, 1997; and
Condition #2 of the approving Resolution #97-19 requires the applicant to
obtain a certificate of occupancy; and
Condition #4 of the approving Resolution #97-19 allows the applicant 30
days to submit required plans (City Code Section 5-6-5B); and
In order to obtain a certificate of occupancy, the applicant must submit
structural plans from a registered architect detailing the necessary changes to
comply with the Uniform Building Code; and
The applicant cannot meet the 30 day time line because of the time necessary
to complete such a review and prepare the required plans and thus, needs an
extension.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE:
that it approve a 60 day extension for the submission of required plans for the CUP for
Buckingham Disposal Inc. for property located at:
5980 Rainbow Parkway, legally described in attached Exhibit A;
CONCLUSION
Based upon the Findings set forth above, the City Council hereby grants a 60 day extension for
Buckingham Disposal to comply with Condition #2 and #4 of Resolution #97-19. The applicant
must submit the required site and structural plans by June 2, 1997 and complete the required
improvements by March 3, 1998 as approved in Resolution #97-19.

Attached is a signed copy of Resolution #97-19, approved by the Council on March 3,
1997. This resolution approves the conditional use permit allowing a recycling facility on
the property located at 5980 Rainbow Parkway, subject to four conditions. Please note

The purpose of this letter is to advise you the resolution approving your
Conditional Use Permit (CUP) for Buckingham Disposal Inc. on property located
at 5980 Rainbow Parkway must be recorded within 1 year of approval or the
CUP will be null and void per Section 5-6-6 of City Code. Enclosed are two
certified copies of the original and a copy for yourself. One of the copies is to be
recorded at the Scott County Recorders office by March 3, 1998. The other copy
is to be stamped as recorded by the recorders office and returned to the
Planning Department as proof of recording.
Please let me know when you have completed striping of the parking lot. The
recording of the resolution and striping of the parking lot must be done prior to
March 3, 1998 such that a Certificate of Occupancy can be issued prior to the
expiration of the CUP.

Dear Tom:
As you are aware, on January 27, 1997, the Planning Commission recommended that the
City Council approve your CUP application and they approved a conditional sign permit
with specific conditions. The CUP application will be presented to the City Council on
March 3, 1997. In the meantime, if you have obtained any of the information requested
as a condition of approval, or revised plans, it would be helpful submit them to us to have
as much information as possible, by February 21, 1997, for presentation to the City
Council. The following are conditions of approval (as in the resolution):
. A revised landscape plan indicating improvements to be made that meet all criteria
of the landscape ordinance (6.10) as indicated in report including screening of storage
areas with multiple elements (not just a fence).
. A revised site plan indicating improvements to be made that will meet all criteria of
the offstreet parking ordinance (6.5). The plan needs to specify what is paved and
what is gravel. All driving/parking/loading areas are to be paved. Also the revised
site plan must indicate where parking spaces are to be striped, as to delineate the
parking areas from the drive aisle and to insure the proper number of parking spaces
are provided. The plan should also show that the outdoor storage areas have been
combined to the west side of the site as discussed at the public hearing. The plan
must also indicate the setback of signs.
. Full size building elevations with dimensions to indicate the ratio of size of proposed
wall signs. You have 6 months to comply with the conditions of the approved
conditional sign permit.

. Submit the layout of CR. 21. A layout was discussed prior to the public hearing, and
the city needs a copy of this indicating the setback from centerline of CR 21 and the
access and layout of the site with the new expanded CR. 21. This must be approved
by the Planning Department.

. A lighting plan which meets the requirements of the ordinance.
. Outdoor storage of recycling containers must be screened as indicated in Ordinance
95-17. Such screening, using multiple elements, must be indicated on revised plans.
The city received you application for CUP on 12/30/96. Generally, the city has 60 days to
act upon such a request. The public hearing was held on 1/27/97 before the Planning
Commission. Final action (resolution) will occur at the City Council on March 3, 1997.
This is beyond normal time limits (60 days) due to the possible lack of a quorum at the
February 18, 1997 meeting and scheduling. Therefore, the city is extending the normal
time limit on your request an additional 60 days. This will not affect your item being
heard at the City Council on March 3, 1997, and is more ofa technical notification.

A reliable service record is what has kept BucIcingnam in business and growing with communities it

Tom Buckingham started in the disposal business when he was a senior at Bumsville High School.
During afternoons and on weekends he picked up trash in his hometown of Savage with a pickup truck He said
his father was the person who provided the inspiration and encouragement to build his company into what it is
today. The owner of the first landfill in Scott County, Elmer Buckingham assisted wi1h his son's business up until
the time ofhis death in December, 1985 at the age of83. Buckingham's mother, Rose, is still active at age 85.
75 percent of the business of Buckingham Disposal is residential service exclusively to Savage and Prior
Lake residents.
The company also provides roll-off container box rental. The two trucks that deliver and, pick up the roll-
off construction boxes are the latest technology, featuring a special Hydraulics system' developed and
manufactured in France. The trucks are even equipped with Cellular phones for quick dispatcl1 service to
customers.
Since he added the roll-off boxes to his service, Buckingham said there has been continuous demand for
them "We have a lot of contractors who use them, but there are also individuals who rent them when they are
doing a cleanup project or remodeling at their homes. "
The SavagelPrior Lake businessman said there have been nmnerous changes in the solid waste disposal
business since he started over 25 years ago. "It is an industry that is constantly ".hanging, and the new plans for
disposing of solid wasted will affect us and out customers." He said his company includes a newsletter with their
billings to inform customers about changes in rules that will affect their service.
"We are a very service oriented and reliable companY', said Bur.Jcingtlllm
"We may sound like a big company because we provide service to a lot of customer, but we have less than
10 employees, and that includes my wife Sue, and myself We have a great staff and crew led by my nephew
Shawn Holz, we're a close knit group. Just like family," he said
They are a growing company and have numerous recycling projects and a new fiI.cility located at ~
Credit River Road (Cotmty road 2 I) in Prior Lake, MN'. The center is open to the public but offers Buckingh~TJ1
customers some very special incentives. .
Adding Prior Lake to their service area, several years ago, has shown that resid.en1B want a fairer system of
pricing (volmne based rates) where; you only "Pay for what you throwaway. II
Buckingham Disposal. customers may obtain a membership card fur hard to recycle items and lawn
clippings "free of charge" simply by stopping at the Center, Monday - Friday, 9:00 am - 3:00 pm, Thursday
evenings till 7:00 pm or Saturday from 10:00 am to 4:00 pm.
