Dear Mr. Breitbach:
I am writing at the request of Guy Selinske to clarify for you the City of Prior Lake's
requirements for a letter of credit for the above-named improvements. The City requires
a letter of credit in the amount of 125% of the estimated cost of the landscape and
irrigation improvements. The requirement is spelled out at Section 6. 1 O(K)(4) of the
Zoning Ordinance, a copy of which is attached for your information. You may note that
the letter of credit is due for posting with the City at the time of issuance of the building
permit. All developers in the City are apprised of this requirement early in the review
process, just as the contractor for this project was in this case.
I hope this provides the clarification you require for issuance of the letter of credit.

or other debris and other horticulturally appropriate maintenance methods for the
specific type of plant community.
J. Performance Guarantee:
1.
All plants shall be guaranteed by the developer for one year after total project
acceptance.
2.
The irrigation system shall be guaranteed for one year concurrent with the plant
guarantee. This will assure one winter season with a fall shut down and spring
start-up.
The developer shall notify the City prior to total project acceptance, for City 3
concurrence on the acceptability of the complete landscape and irrigation system
installation. The City shall issue a letter accepting the landscape and irrigation
system installation and therein fixing the date for guarantee purposes.

The developer shall post a letter of credit with the City for the complete
landscape and irrigation system installation when the building permit is issued
(plants, irrigation, mulch and edgers). The letter of credit shall be held by the City
and used, if necessary, to effect satisfactory completion of the project in the event
of incomplete or failed work. The value of the letter of credit shall be 125% of the
estimated construction costs for plants, irrigation system, mulch and edgers.
Release of the letter of credit shall occur on the date that the City has reinstated ;."':
and accepted the landscape and irrigation system and notified developer in
writing of such acceptance. Such release date shall not be earlier than ten (10)
days prior to the expiration of the plant guarantee specified in paragraphs (J) 2
and (J) 3 above.

Submission Requirements:
1. Landscape plans must be drawn to scale, show all proposed plants, quantities
and sizes, seed/sod areas/limits, etc. The plan(s) must include the entire project
area. Include project' name, developer, Registered Landscape Architect or
landscape designer, architect, dates, existing site conditions (topography,
vegetation, ponding areas or water bodies, utilities, boundary data, walks, etc.),
proposed site conditions, (grading plan, tree preservation/protection plan, etc.),
site lighting, off site conditions approximately 100 feet beyond the site, and other
site conditions that would be expected to affect landscaping.
2. Calculations to evaluate compliance with the ordinance provisions including: area
in square footage and percentage in total area for building, parking lot (including
driveways), landscape areas and total area; and quantities of trees and shrubs
required and planted or preserved.

3. Supportive plans, details, written narrative notes, cross-sections or other
information as may be required by the Planning Staff that is reasonable and
necessary to demonstrate the design intent and general compliance with this
ordinance, including, but not limited to, items listed under Section (C) 2.
4. Fifteen copies of all plans shall be submitted.

A.
Screening shall be required in residential zones where any offstreet parking area
contains more than six (6) parking spaces and is within thirty (30) feet of an adjoining
residential lot line.
B.
Where any business or industrial use (structure, parking or storage) is adjacent to
property zoned or developed for residential use, that business or industry shall provide
screening along the boundary of the residential property. Screening shall also be
provided where a business or industry is across the street from a residential zone, but not

The Development Review Committee completed its review of the plans you previously
submitted. The following, additional comments are were made in the course of that
review;
1.
Proposed grades around the back side of the building need to be shown
along with proposed grades or spot elevations towards the ditch and 6ll0ng

The curb around the southeast entrance radius needs to be tipped out so
that water does not pond there. The grade is at 0.0% around the radius.
Per City Code 6-6-5:(C) all drainage ways or charmels shall be within
dedicated drainage easements. The east and west sides of the property
should have drainage swales provided within the proposed lOft. wide
drainage easements~o prevent drainage across adjacent lots.
Profiles must be shown for all utilities since they are larger than 4". These
profiles must include type of pipe, percentage of slope, invert elevation,
length of pipe, existing and proposed ground elevations.
Per Ordinance 6. 14H4, all parking areas and drives shall be constructed of
concrete, bituminous or similar durable surface free of dust. The
periphery of all parking areas and drives shall be constructed of "poured
in place" concrete. Two areas on the east and w~t..side of the building

8. The existing sidewalk will have to be removed for the construction of the
two driveways into the site. Pedestrian ramps will be required and shall be
shown the plans. ./~~<-,.

north side of Cottonwood Lane for the construction of the 2 driveways.
Sawcutting of the existing bituminous will be require, and shall be shown
on the plans. A detail of the proposed driveway apron shall be shown.
The final lifts for all roadways in the Business Park have not been

10. A total of24 trees would be the minimum required
(933.5 1.f. divided by 40 = 23.33, rounded up to 24). The plan is 14 trees

11. The ordinance requires that 25% of the minimum required trees be either
coniferous or deciduous. No deciduous trees are shown. Nor does the
plan show 10% of the minimum required trees being of a larger size as
required (3.5" diameter for deciduous canopy and 8 feet high for

Parking Lot Planting:
14.
Landscape islands should replace the proposed painted "no parking" area
at the four comers of the parking lot. Per the Ordinance at least 225
square feet HM~
Additional plantlngs within the 10 foot side yards will help screen the
service drives and service door areas; none is shown on the plan. ~y
A minor adjustment to the location of the 2 spruce along Cottonwood/
Lane would be appropriate to insure a "clear view triangle" as the trees
mature.

16. Earth berming is not shown on the plans; if it is intended to provide

17. The 14 additional required trees could be used in the parking islands, the
side yards adjacent to the drive lanes and around the building. With the
required size and tree mix diversity it could supplement the proposed
spruce along C.R. 21 in a more interesting, yet equally effective planting
arrangement.
18. Additional plant species diversity should be considered for some of the
additional shrub and tree plantings required.

As per your request, WestWood has reviewed the Landscape Plan for the p'roposed Metro
Cabinerl American Glass & Mirror site on Cottonwood Lane/County Road" 21 as prepared by Finn-
McDaniais Architects dated March 29,1995. The review consists of quantification and observations
regarding the proposed landscape plan relative to the proposed site plan, site conditions and ordinance
standards.

4. Tree Mix
The ordinance requires that a minimum 25% of the minimum required trees be either coniferous
or deciduous. This has not been satisfied since only 10% is provided (1 equivalent deciduous
tree vs. 10 total trees).
5. Existing Trees

21 are not suitable for credit since they are short-lived species.
6. Plant Species
All plant material used is hardy for this region.
B. Parking Lot Planting
1. The: intcmai parking lot green space is insufficient to meet ordin.mce standards. The area.
involved is about 60' x 175'. The:: calculation.therefore is: (IO,SOOi: sq. it. . 6,000 sq. ft.) x 5% =
225 sq. ft. Required green space.

the building are 126:t sq. ft. (7' x 18') each while the two others towards Cottonwood Lane are
108: sq. it. (6' x 18') each. While 2 of the 4 areas would satisfy the minimum area required if
conv~rted to a cUrb~d planted area, it would be desirable if all four locations were converted to

Waterfront Passage Business Park (Site Plan Review)

The following is a list of items that need to be addressed per my review of
above mentioned project:
1. Per item number (4) four on the Site Plan Application Checklist, profiles shall be
shown for all utilities larger than 4". The proposed utilities are both 6", so in turn
profiles are required. These profiles shall include type of pipe, percentage of slope,
invert elevation, length of pipe, existing and proposed ground elevations.
2. Per Zoning Ordinance 6.14H4, all parking areas and drives shall be constructed of
concrete, bituminous or a similar durable surface free of dust. The periphery of all
parking areas and drives shall be constructed with poured in place concrete curbing. A
curb detail in required. Two areas on the Development Plan appear to be in conflict
with this ordinance. They are located on the east and west sides of the building.
3. Per Zoning Ordinance 6.10Fl, landscape islands shall be installed on 5% of the paved
parking lot if the lot area is in excess of 6000 square feet. Depending on how the
actual paved parking lot is calculated, the square footage is between 7,800 & 12,450.
Concrete islands should replace the proposed painted areas on the four comers of the
proposed parking lot. It appears that the flow of traffic in and out of the parking lot
will have a tendency to cut across the comers. Landscaped islands would prevent this
from occurring.
4. Per Zoning Ordinance 6.1 OH2, all lawn areas and drainage swales shall be sodded.
The Landscape plan is in conflict with this ordinance.
5. Per Zoning Ordinance 6.10H4, all areas to be lawn and landscaped shall have built-in
irrigation system. An irrigation plan shall be required at the time of obtaining the
building permit. This plan should be part of the Landscape plan.
6. The existing sidewalk will have to be removed for the construction of the two
driveways into the site. Pedestrian ramps will be required and shall be shown on the
plans.
7. The existing B618 concrete and gutter will have to removed on the north side of
Cottonwood Lane for the construction of the two driveways. Saw cutting of the
existing bituminous will be required and shall be shown on the plans. A detail of the

bituminous wear course for all the roadways in the Waterfront Passage Business Park
have not been installed. The timing of the wear course installation should be
considered.

1. Accurate certified survey with legal description. I have these on 2 separate sheets.
2. Site plan is attached.

6. Signage plan is shown on elevations sheet.
7. The provisions for fire protection are shown on the Site Utilities plan. The fire lane is
the main entrance drive through the parking lot. There is no parking against the East,
West and North sides of the building.

9. The trash enclosure is shown on the site plan and will be constructed out of similar
materials as the main structure.
10. The luminare plan will be submitted with the information for the building permit.
11. As per our discussion the written narrative is not required.

Applications will be reviewed by the Development Review Committee. A member of
the Planning Staff will notify the Applicant as to any additional information or
modifications needed. Site Plans, which are non-residential, and have no variance
or other possible applications as' required, may be administratively approved. Site
Plans requiring a variance or other possible applications will automatically be
scheduled for a Planning Commission Public Hearing when it has been verified
that the application is complete. Items will be scheduled before the City
Council, by the City Manager, upon Planning Commission Recommendation.
