I reinspected this site on August 29, 1996. Of the items noted in Mike Leek's
memo dated May 29, 1996, only the parking lot paving has been done. The
following items have not been addressed:
1. The arrangement and possibly the types and numbers of trees, has been
changed on the south side of the building (in front of the main entrance and
the freestanding sign);
2. The spruce trees shown on the northeast corner have not been planted at
this time.
3. The mechanical equipment on the roof has not been screened.
As Mike pointed out in his original memo, if these changes are permanent, a
revised landscaping plan must be submitted and approved. I must also point out
that some of the spruce trees that have been planted are already brown and
wilted, and will most likely have to be replaced before we will release the letter of
credit.

I appreciate your prompt attelltion to the dilenuna we faced on Wedne~day with your engineering
department, as a r~su1t of their request to revis.e our civil plan While we are nJt modifying .Jur
drainage, we are making several other ~hanges that \vere just recently reque:;tt'd Although these
changes add costs. we are more interested in getting our building permit than debating the
necessity of these changes with the city.
We have no major issues with the building inspector, and he ref~rs to our project as .l "sLim dunk"
relative to the submittals \\re have provided to him as we have prepared our working drawmgs
He indicates that his h..nds are basically tied in rdeasing the permit until he obtains a rdeasc from
planning and from engineering.
The last issue, I bdi<;;ve, to surface is the plannjng department's reqlle~t that we tile a spc.:itic
irrigation plan with the city. According to Gary, this must be done before he can issue the
building permit.

to the city for p~{mit. You will note that we ha....e a requirement in our specification, and city
submittal, that the landscaped portion of our site be irrigated. \Ve also show a note on our
landscape plan that the site is to be irrigated.
Nowhere in any of your prior staff comments does it state that it is an absolute requirement to
submit an irrigation plan prior to issuance of the building permit. In fact, we do not J1.lve detailed
mechanical and electrical plans at this point in the project either because we are doing this project
as design build with OUf subcontractors. In other words, we recently awarded all of our bids but
we did not award based on plan and spec in all cases. For example, the obligation of the low
bidder for our landscaping is to prepare an irrigation plan during the course of our con$tru:tion
phase.

1 am enclosing a copy of the memo we received from :Michael Leek, dated May 17, 1995
regarding our site plan review. While item #5 specifically mentions an irogation plan, nowhere.
and in none of the discussions that we had with stat!, was it indicated that we needed the plan
prior to issuance of the building permit.
If ordinance precludes the city from issuing the building permit until this irrigation pbn is
completed, then we would like a verbal authorization to proceed subj,;;ct to payment of our pnmil
fees. \Ve are intending ~o begin excavation at the site on r...10nday, and it is imperative that W~ not
be held up over such an insignificant issue.
My civil (;nginccr is prcs\;;nting multiple copies of a revised civil plall to the city today and, cx.:ept
for this fin.:..1 subject of the irrigation plan, I believe Gary is prepared to issue our penmt

The following items were discussed wirh Dennis Zylla:
1. The plans do not include any lighting plans; the Business Park regulations set
forth specific light levels. The applicants are working on a lighting plan.
2. Th~ plans indicate 3 unscreened, rooftop mechanical units. The applicant has
agreed to do a sight line analysis to determine whether the units would be visible
from the adjacent stn:ets and properties.
3. The landscape plan is "shorr" 9 crees. The applicants wish to defer the planting of
those 9 trees until rhe possible expansion occurs. Based on the discussion earlier
this week. applicants w'i1I be taking a further look at this issue.
4. The plantings along C.R. 21 should be amended so that the tree rypes are
c:onsiSl:ent with Becker Arena, and the proposed Metro Cabinet Building.
S. A specific irrigation system plan should be, and is under development.

My review this afternoon revealed that 1) the parking area in front of the main entrance

The two markets in which E M Products is currently involved are as
follows:
1. Exhaust systems for stationary diesel engines (including silencers and
accessones ).
2. Intake and exhaust silencers for positive displacement (PD) blowers
and compressors.
Major customers in the engine silencer markets are diesel engine OEMs,
such as Caterpillar, Cummins and Detroit Diesel. The majority of this
business is done with the OEM distributor network as well as independent
packagers. Our major competitors in this market, along with their
approximate share of the market are Nelson Industries, Stoughton, WI,
60%, Maxim (Riley-Beard), Shreveport, LA, 20%, and G T Exhaust,
Lincoln, NE, 10%.
Major customers for our intake and exhaust silencers for the PD Blower
and Compressor market are also OEMs, such as Roots, Connersville, IN,
Sutorbilt, Quincy, IL, and M D Pneumatics, Springfield, MO. The OEM
representatives and independent packagers are also current and potential
customers. There are primarily two competitors in this market, Universal
Silencer, Stoughton, WI, with approximately 60% and Stoddard Silencers,
Greys Lake, IL, with 30% market share.
While the two markets are quite diverse, they are similar in their
tel:l111oiogies and manufal:Lwiug procedures. Most of the sales are by
independent manufacturer representatives (currently 21 in the U. S. and
Canada). With a total market potential of between 50 & 60 million
dollars, there is plenty of room for growth in these existing markets.
Additional potential markets that would fit our company profile are gas
turbine silencers, heat recovery silencers, gas pipeline silencers and
emission reduction systems.

TEMPERATURE (1200 DEG. F.) SATIN BLACK LEAD AND CHROME
FREE ENAMEL IS STANDARD WITH OPTIONAL COATINGS

BUILT IN CONNECTION SIZES FROM 1 INCH THROUGH 16 INCHES.

AND ABSORPTIVE-CHAMBER FOR INTAKE AND DISCHARGE
APPLICATIONS. BASIC CONSTRUCTION IS OF CARBON STEEL,
HOWEVER IF SPECIFIED, SILENCERS CAN BE MADE OF STAINLESS
STEEL TO MEET INSTALLATION AND OPERATING REQUIREMENTS. A
GRAY-SATIN LEAD FREE AND CHROME FREE PRIMER IS STANDARD
WITH OPTIONAL COATINGS AVAILABLE.
