Dear Ms. Smith:
This letter is in regard to the street address of 5297 140th Street that is currently being
used at your place of business. The Metropolitan 911 Telephone Board keeps track of
address information that is used in order to inform emergency vehicles such as fire,
police and ambulance services of your home and/or business location. All addresses
are filed with the Metropolitan 911 Telephone Board who in turn verifies address
information with the City of Prior Lake. The Prior Lake Planning Department is
responsible to assign aI/legal addresses within the City limits.
Please be advised that the address of 5297 140th Street, which you are currently using
as the address for a day care operation must be changed to 5299 140th Street which is
the legal address for the property. The City of Prior Lake address system is set up to
allow only one address number per property. The use of two address numbers at the
site should be discontinued immediately. Failure to use the correct legal address could
result in a situation whereby an emergency vehicle may be delayed or not able to find
your property because of an inaccurate address.

Dear Ms. Smith:
I am in receipt of your letter dated December 29, 1994 requesting information regarding the
operation of a licensed day care facility at the property identified as 5299 140th Street.
According to the letter there is currently a day care operation which is licensed operating on the
subject site. I have researched this issue and records at the City of Prior Lake indicate there is
a single family home built on the property legally described as: Lot 2, North Shore Oaks First
Addition. The single family home was built in 1972 under the jurisdiction of Eagle Creek
Township and in 1973 annexed to the City of Prior Lake. The subject site is zoned R1 Suburban
Residential. As such, one licensed group family day care facility to serve 14 or few children is
permitted.
Attached please find an excerpt from the City Code which identifies the types of land uses which
are permitted in the R1 Suburban Residential Zoning District. Specifically under Permitted
Uses, Item #10, "Licensed group family day care facility to serve 14 or fewer children is
permitted". Based upon the zoning code requirements the request to operate a second day care
facility which would have the number of children exceeding 14, would not be permitted.
Another issue raised in your letter relates to the use of a second address at the property. The
address of record at City Hall for the site is 5299 140th Street NE. If a second address has
indeed been used at the property and/or if there is a second family living at the home please be
advised that both would be in violation of city code requirements for the City of Prior Lake. The
use of the address 5297 140th Street NE and/or occupation of the single family home by a
second family, should be discontinued immediately. The only way to legally operate a two family
dwelling within the R1 Zoning District is to obtain approval of a Conditional Use permit which
would be issued by the Planning Commission and City Council. No conditional use permit is on
file for the subject site.
In summary, one licensed group family day care facility serving 14 or fewer children is permitted
on site. Because the single family home is located in an R1 Suburban Residential Zoning
District expansion of the existing facility to serve more than 14 children would be a violation of
the Prior Lake Zoning Code. Day care facilities for more than 14 children are only permitted
within the City of Prior Lake in business zoning districts. In order to serve additional children,
the operation would have to be relocated to an appropriate Business Zoning District.

Dear Mr. Tremere,
We are writing in reference to the phone conversation last week
in regards to day care licensing for the Kiddie Korral, Inc.
Currently, we hold a C3 license at 5299 140th Street NE. We
would like permission for the county to give us a license at
5297 140th St NE. The Kiddie Korral has been open since
December 15, 1992. For the past two years the house has had
two house numbers and the county is willing to grant an
additional license with permission from the City of Prior Lake.
The reason that we would like to obtain an additional license is to
be able to better serve the community. We are continually
receiving phone calls to provide care for children, however at
this point we are unable to enroll any additional children because
of our limited license capacity.
