Vacation Application of Richard Mueller
Mr. Mueller called on Wednesday, August 25, 1995, and requested that I "tear up" the
check which he submitted for the review fee. Mr. Mueller withdrew his application after
meeting with Lani (engineering) and Paul (Parks?) and coming to an agreement about
how the public access site adjacent to his house and property will be handled. This
agreement obviates the need for his vacation application.

you recently reported to the City Council on the retention and vacation of lake accesses.
Would you please let me know within the next few days 1) whether this request is
appropriate in light of your recent report, and 2) what ownership interest the City has in
this access.

As owners adjacent to Lot 3 J we are both wi 11 i ng to grant easement to
sewer and drai nage di tch on the North si de of lot -3.
This request was recommended by the City Council at meeting of 6/19/95
after voting on Sceni c overlook.
We have maintained the property (lot -3) for 6 years.
We offer the following options:
1. Vacate lot -3 to Mueller &. BrightJ one half (25') to each. We
(,.)7 wi 11 pay property taxJ if any. At presentJ tax is O.
l/v# ,,/ We wi 11 grant easement as needed and continue to mai ntai n
~p land as we haye since 1989.
2. Leave lot as is for scenic overlookJ with no split rail fence.
We base this on the decision of council to build no fence on
Terrace Circle scenic overlook at 6/19/95 meeting. We
cannot maintain lot with fence.
If fence would be built on 10tJ it would cut out about 10' of
Mueller's yard since house was built facing lake and not on
lot lines in 1930. The same applies to the next four houses
south of lot 2.
3. Vacate 15' of South side of lot -3 to Richard Mueller or sell
for $100.00. If fence has to be installedJ install in the middle
of the remai ni ng 35' J say at 17'. Thi s wi 11 1 eave two
easementsJ sewer &. drain pipe on North side of fence open.
If fence is installedJ we cannot maintain lot; mowing &.
