Our staff has worked on this matter since June, 1995. We have worked extensively with Mr. Buckingham to resolve this matter, including amending the Zoning Ordinance to allow this business as a conditional use in the 1-2 district. Once the Zoning Ordinance was amended, the staff met and corresponded with Mr. Buckingham on several occasions to assist him in the conditional use process. After several months, we received the items required for a conditional use permit site plan, with the exception of a completed application form (attached). Please have Mr. Buckingham submit the completed application form together with the application fee as soon as possible so that we can proceed with the approval process. An application fee is not necessarily intended to cover staff time. Rather, this fee is intended to cover the cost of processing an application, including notification costs, publishing and so on. The Council adopted a fee schedule for development applications based on the theory that the general public should not pay for the costs of these private issues. Mr. Buckingham has not fulfilled his obligations in this process. These obligations include submitting the proper application and filing fee. Ms. Kansier's letter of September 23 acknowledges receipt of the plans; but it does not clearly state that the staff will make a positive recommendation that the conditional use permit be issued. I would appreciate correspondence from you or someone else on the staff to Mr. Buckingham that assures that the application will be recommended for approval based on the submitted plans. I think that is what we have all intended from the beginning. In addition, I question whether or not a filing fee should be paid. Hasn't the staff work already been accomplished by mutual agreement and at the direction of the council? It seems to me that Mr. Buckingham has expended substantial amounts in his effort to accommodate the City and that fairness would now dictate that the fee be waived since all the work is already done. These are the items you discussed with Mike Leek in February, 1996. We have not processed this conditional use permit since we have not yet received an application from you. Attached please find an application form. While you have submitted the necessary site plans, the additional information is a required part of your application: 1. A complete legal description of your property (this may be obtained from your deed or tax statement). 2. A filing fee of $350.00 3. Names and addresses of property owners within 500 feet of the exterior boundaries of the subject property. This list must be obtained from a certified abstract company. Based on our conversations at that meeting, the site plan for the Conditional Use Permit should be based on the 1988 survey produced by Ron Swanson of Valley Engineering and Surveying, and should include the following information; 1. The proposed landscaping, 2. The location of the proposed storage area for materials containers, 3. The location of existing and/or proposed screening, as well as a description of the screening materials, 4. The location of proposed signage (any signage would be the subject of separate sign permits), 5. The location of the existing paved area on the West side of the building. As you know, city staff will recommend that the area used for traffic movements on the West should be paved. Paving is not proposed on the North because that area is not used by your operation. The area to the East would not be paved either because your operation's storage containers could not readily be used on a bituminous surface, and would sink into such a surface during the summer months. The site plan you submitted for informal review needs to be replaced, revised or updated with one that is larger, more readable and "to scale". The site plan is too small to be readable, and does not appear to be "scalable". 2. The site plan should show in detail where on the site, and in what fashion materials containers and/or vehicles will be stored and parked, as well as the location and type of screening to be provided. 3. The proposed landscaping should be shown on the site plan as well. 4. While signage is the subject of a separate permit, it would be useful to submit proposed signage design and specifications. Generally, wall signs may not exceed 20% of the total building front area. Freestanding signs may not exceed 75 square feet per side with a maximum of2 sides, and may not exceed 20 feet above the centerline grade of the adjacent street. The proposed signage should also be located on the site plan. The current signs are non- conforming. I hope these comments are useful to you in preparing for our meeting.
