After receiving your letter dated October 2, 1996, I asked the staff to review the files on Mr.
Buckingham's business. Our staff has worked on this matter since June, 1995. We have
worked extensively with Mr. Buckingham to resolve this matter, including amending the
Zoning Ordinance to allow this business as a conditional use in the 1-2 district.
Once the Zoning Ordinance was amended, the staff met and corresponded with Mr.
Buckingham on several occasions to assist him in the conditional use process. After several
months, we received the items required for a conditional use permit site plan, with the
exception of a completed application form (attached). Please have Mr. Buckingham submit
the completed application form together with the application fee as soon as possible so that
we can proceed with the approval process.
An application fee is not necessarily intended to cover staff time. Rather, this fee is intended
to cover the cost of processing an application, including notification costs, publishing and so
on. The Council adopted a fee schedule for development applications based on the theory
that the general public should not pay for the costs of these private issues.
Mr. Buckingham has not fulfilled his obligations in this process. These obligations include
submitting the proper application and filing fee. John, if you could expedite the submission
of the completed application and fee, we can move forward on resolution of this issue.

Dear Mr. Boyles:
We are pleased that the several plans for Mr. Buckingham's business have been accepted. Ms.
Kansier's letter of September 23 acknowledges receipt of the plans; but it does not clearly state
that the staff will make a positive recommendation that the conditional use permit be issued.
I would appreciate correspondence from you or someone else on the staff to Mr. Buckingham
that assures that the application will be recommended for approval based on the submitted
plans. I think that is what we have all intended from the beginning. In addition, I question
whether or not a filing fee should be paid. Hasn't the staff work already been accomplished by
mutual agreement and at the direction of the council? It seems to me that Mr. Buckingham has
expended substantial amounts in his effort to accommodate the City and that fairness would now
dictate that the fee be waived since all the work is already done.

Dear Mr. Buckingham:
As of June 7, 1996, it appears the City of Prior Lake has received all of the items required for a
conditional use permit site plan. These are the items you discussed with Mike Leek in February,
1996.
We have not processed this conditional use permit since we have not yet received an application
from you. Attached please find an application form. While you have submitted the necessary site
plans, the additional information is a required part of your application:
1. A complete legal description of your property (this may be obtained from your deed or tax
statement).
2. A filing fee of $350.00
3. Names and addresses of property owners within 500 feet of the exterior boundaries of the
subject property. This list must be obtained from a certified abstract company. Two such

4. Any other supportive information you wish to submit.
Applications for conditional use permits are reviewed first by the Planning Commission and then
by the Council. The Planning Commission meets on the second and fourth Mondays of each
month. The completed application and supporting. data must be submitted at least twenty (20)
days prior to the scheduled hearing.

At the request of Mr. Thomas Buckingham, Buckingham Disposal Inc., we are responding to
the letter from Mr. R. Michael Leek, City of Prior Lake, dated May 28, 1996, regarding the
site plan for the Buckingham Disposal, Inc. Recycling Facility. A copy of the letter is enclosed.
The numbers below reference Mr. Leek's letter.

3. The north and east areas are left unpaved because this area is used for the yard
storage of materials and equipment. There are no established traffic patterns
within this area except for access to the existing loading docks. The existing
gravel surface has worked well for the owner in the past and he expects it to
continue to function well in the future.

previously submitted as a detail, but should be on the site plan as well),
2. The proposed location of a freestanding sign, if you intend to use one,
3. A note explaining the reasons for leaving the Nort4i~d East areas unpaved as
you have previously explained them.

Dear Mr. Buckingham:
This letter will follow up our meeting of this morning. Based on our conversations at that
meeting, the site plan for the Conditional Use Permit should be based on the 1988 survey
produced by Ron Swanson of Valley Engineering and Surveying, and should include the
following information;
1. The proposed landscaping,
2. The location of the proposed storage area for materials containers,
3. The location of existing and/or proposed screening, as well as a description of
the screening materials,
4. The location of proposed signage (any signage would be the subject of
separate sign permits),
5. The location of the existing paved area on the West side of the building. As
you know, city staff will recommend that the area used for traffic movements
on the West should be paved. Paving is not proposed on the North because
that area is not used by your operation. The area to the East would not be
paved either because your operation's storage containers could not readily be
used on a bituminous surface, and would sink into such a surface during the
summer months.

I am sending this letter to provide you with some information about the items to be
discussed at our meeting at 9:30 a.m. on Monday, February 5, 1996.
1. The site plan you submitted for informal review needs to be replaced, revised
or updated with one that is larger, more readable and "to scale". The site plan
is too small to be readable, and does not appear to be "scalable".
2. The site plan should show in detail where on the site, and in what fashion
materials containers and/or vehicles will be stored and parked, as well as the
location and type of screening to be provided.
3. The proposed landscaping should be shown on the site plan as well.
4. While signage is the subject of a separate permit, it would be useful to submit
proposed signage design and specifications. Generally, wall signs may not
exceed 20% of the total building front area. Freestanding signs may not
exceed 75 square feet per side with a maximum of2 sides, and may not
exceed 20 feet above the centerline grade of the adjacent street. The proposed
signage should also be located on the site plan. The current signs are non-
conforming.

Tom Buckingham started in the disposal business when he was a senior . at BumsvilIe High School.
. g afternoons and on weekends he picked up trash in his hometown of Savage with a pickup 1ruck. He sai
father was the person who provided the inspiration and encouragement to build his company in10 what it is
today. The owner of the first landfill in Scott County, Elmer Buclcingham assisted with his son's business up until
the time ofhis dea1h in December, 1985 at the age of 83. BucJdngfuun's mo1her, Rose, is still active at age 85.
75 percent of the business of Buckingham Disposal is residential service exclusively to Savage and Prior

The company also provides roll-off container box rental. The two trucks 1hat deliver and pick up 1he roll-

off construction boxes are the latest technology, featuring a special Hydraulics system developed
manufactured in France. The trucks are even equipped with Cellular phones fur quick dispatdl service to
customers.
Since he added the roll-off boxes to his service, Buclrir1gham said there has been continuous dernfUJd fur
them. "We have a lot of contractors who use them, but there are also individuals who RUt them when they
doing a cleanup project or remodeling at their homes."
The SavagelPrior Lake businessman said there have been numerous chanses in the solid waste disposal
business since he started over 25 years ago. ''It is an industry 1hat is constantly ch~ and the new plans fur
disposing of solid wasted will affect us and out customers." He said his company includes a newsletter with their
billings to inform customers about changes in rules 1hat will affect their service.
"We are a very service oriented and reliable company", said Buclcir1gJ1am,
"We may sound like a big company because we provide service to a lot of cUstomer, but we haw less
10 employees, and 1hat includes my wife Sue, and myself We have a great staff' and crew led by my neph
Shawn Holz, we're a close knit group. Just like family," he said (
They are a growing company and have numerous recycling projecfB and a new filcility located at 980
Credit River Road (County road 21) in Prior Lake, MN. The center is open to 1I1e public but offers BuclcingJIam
customers some vety special incentives. .
Adding Prior Lake to their service area, several years ago, has shown that residents want a fairer system
pricing (volmne based rates) where; you only ''Pay fur what you throwaway."
Buckingham Disposal. customers may obtain a membership card fur hard to recycle items and lawn
clippings "free of charge" simply by stopping at the Center, Monday - Friday, 9:00 am - 3:00 pm, Thum
evenings till 7:00 pm or Saturday from 10:00 am to 4:00 pm.
