Call to Order: Chairman Lemke called the April 14, 2008, Planning Commission meeting to order at 6:00 p.m. Those present were Commissioners Fleming, Lemke, Perez and Ringstad, Community Development/Natural Resource Director Danette Walthers-Moore, Planner Jeff Matzke, Assistant City Engineer Larry Poppler, Building/Transportation Services Director Jane Kansier and Recording Secretary Connie Carlson. 2. Approval of Minutes: The Minutes from the March 24, 2008, Planning Commission meeting were approved as presented. 4. Consent: None The Commissioners recommended discussing Item 7 A: 2009-2013 Capital Improvement Program scheduled under New Business. Danette Walthers-Moore, Community Development - Natural Resource Director, presented the staffreport dated April 14, 2008, on file in the office ofthe Community Development and Natural Resource Department. Larry Poppler, Assistant City Engineer highlighted the following: . This is the first time the engineering staff has incorporated a 10 year transportation plan into the CIP document. Staff is proposing a more accelerated alternative which would slightly increase taxes. . The second main item is a master park plan. The staff has had to scale back park equipment over the past few years because of the slower housing market. New developments have paid for the neighborhood park equipment. Other highlights included: . 2009 - Public Works - the final stage for the lift station and renovations. . Water Resource line items continue over 5 years. L:\08 FILES\08 PLANNING COMMISSION\08 PC MINUTES\MN041408.doc 1 Planning Commission Meeting April 14, 2008 . 2010 - County Road 12 co-operative project with Scott County. . 2011 - Two reconstruction projects - the industrial park and Arcadia/County Road 21 intersection. . 2012 - New reconstruction accesses and intersection for the south downtown area and the Main Avenue/County Road 22 and Highway 13 area. . 3013 - Ground storage tank and Shady Beach Trail reconstruction. Questions from Commissioners: Lemke questioned the feasibility study - Poppler explained the Main Avenue and Highway 13 access reconstruction alternatives. Lemke asked what the final alignment for County Road 21 and Highway 13 will be. Poppler replied the State does not have funding for this construction and the alignment would remain the same. Fleming questioned the $2.4 Million Dollar fund under the City shares. Poppler said a formula is used to estimate the amounts. Perez questioned the Prior Lake outlet channel repairs. Poppler explained the City is working with the Prior Lake/Spring Lake Watershed District to upgrade the channel and outlet structure. Ringstad commented there are no big subdivisions coming in and it's nice to see the City is being very conscience and react to the park issues. Perez questioned if the new parks are paid for by the developers. Poppler said they were. Some developments do not have the dedicated land and pay a park fee for other park improvements. Perez questioned the proposed 2012 downtown reconstruction - Poppler briefly explained the project includes street reconstruction and streetscape. A parking garage would not be included in the plan. The Commissioners felt there were no changes required. MOTION BY RINGSTAD, SECOND BY FLEMING, TO RECOMMEND APPROVAL OF THE CAPITAL IMPROVEMENT PROGRAM. Vote taken indicated ayes by all. MOTION CARRIED. 5. Public Hearings: Commissioner Lemke read the Public Hearing Statement and opened the meeting. These amendments relate to the following: . Section 1101: General Provisions of the Zoning Code. . Section 1102: Use District Regulations of the Zoning Code. . Modifications to the Zoning Map. Danette Walthers-Moore, Community Development - Natural Resource Director, presented the staff report dated April 14, 2008, on file in the office of the Community Development-and Natural Resource Department. Walthers-Moore reviewed Section 1101; Matzke reviewed Section 1102 and Kansier reviewed the Commercial Sections. On October 25, 2006 the Metropolitan Council approved the City of Prior Lake 2030 Comprehensive Plan. At that time, as is mandated by State Statute, the Zoning Ordinance and Zoning Map were required to be amended to make them consistent with the 2030 Comprehensive Plan. In addition to the proposed amendments for the purpose of meeting State Statute requirements, additional amendments are being proposed with the intention of making the Zoning Ordinance more user-friendly for citizens, business owners, and developers. The vast majority of the proposed amendments are not substantive in nature. Staff reviewed the key areas the Planning Commission should consider relate to some ofthe following: Section 1101: Walthers-Moore . Added definitions in the General Provisions. . Specific sign definitions. . Sales Trailers added as Temporary Use. . Temporary uses in non-residential districts. . Added land use descriptions. . Structural changes in the layouts. There were no changes by the Commissioners. Section 1102: Matzke . Accessory Apartment added as a use in all residential and agricultural districts. . Private and Commercial Stables added as uses in the Agricultural District. . The R-2 and R-3 Districts combined into a single medium density residential district. . Accessory structure regulations changed to include a total maximum square footage per lot of all detached and attached accessory structures. Perez and Ringstad felt the garage door height at 9 feet might be on the low-end; however there should be a maximum for recreational vehicles, etc. The dimensional standards will also control some of the height. Lemke agreed. Staffwill come back with additional information. Animal handling would be removed from the C 1 district. It is still allowed in the C4 district. No existing uses would be affected. . The C-2 and C-4 Use Districts combined into a single General Business Use District. . Additional car wash regulations added to Motor Vehicle Use in the C-l and C-4 Districts. . The C-3 Specialty Business Use District renamed the Town Center Use District in accordance with the 2030 Comprehensive Plan Map. Additional design guidelines were added to the C-3 District. . The C-3T Transitional Town Center Use District was created to correspond with the Transitional Town Center Classification under the 2030 Comprehensive Plan Map. . Convention Halls, Outdoor Sales (Display), Private Entertainment (Indoor), Marinas, and Animal Handling uses in the C-4 District now require Conditional Use Permits. . A Contractors Yard Use conditions added to the 1-1 Industrial Use District. . Parking setbacks and structure setbacks added/revised for the commercial and industrial use districts. Comments from the Commissioners: Perez questioned the motor fuel station sales - Walthers-Moore responded the City Attorney checked into this item and staff will clarify for the next meeting. Staff clarified the transitional district with church expansion. Briefly discussed the maximum height guidelines for the C3 district - 45 feet to the proposed 56 feet which is 4 to 5 floors. Lemke asked ifthere were any problems with the "no smoking" ban. Kansier said the difficulty is there is not going to be room for the smoking shacks. Staff can look into the matter. The Commissioners agreed with staff, the transition district (C3T District) should come in a developmentally orderly manner. Perez suggested referencing the design standards. Staff agreed. Zoning Map: Walthers-Moore . In a limited number of cases, properties were adjusted from one Zoning District to another to make the density consistent with the new density standards approved with the 2030 Comprehensive Plan. . Housekeeping items were adjusted on the Zoning Map to make it up to date (i.e.: lines were added establishing previously approved PUD's, etc). Perez asked ifthe Shoreland District would be included. Walthers-Moore responded it would. There were no comments from the public. MOTION BY RINGSTAD, SECOND BY FLEMING, TO APPROVE THE AMENDMENTS TO SECTIONS 1101 AND 1102 OF THE ZONING ORDINANCE AND ZONING MAP. Vote taken indicated ayes by all. MOTION CARRIED. 6. Old Business: None 7. New Business: The 2009-2013 Capital Improvement Plan was moved as the first discussion item by the Planning Commissioners. 8. Announcements and Correspondence: Walthers-Moore mentioned the May 13, park/natural resource bus tour. Lemke attended the Fountain Hills neighbored meeting and felt all the questions regarding the senior care facility were addressed. Perez noted the City-wide clean up held at Hidden Oaks School, Saturday, April 19th. 9.
