Blair Tremere, Acting Planning Director, presented the information to the Commissioners and explained the
ranking system. Discussion followed and the projects Wet-e pIioritized. This item will be brought back to
the Commissioners at the next meeting for recommendation to the City Council to consider.

Peni Hannes, 15243 Bluedom Circle SE, stated she is requesting a home occupation pelmit to operate a
two station beauty salon in her home that would allow her to be with her faITIily.111e salon would be open
five days a week and she would offer hail' products and supplies on a retail basis and she would employ one
p31t-timeperson.

be approximately 20-25 per week. The Planning Commission has granted simil31' home occupation pelmits
in the past. A basic premise of the home occupation regulations is that a petmit would not be granted to an
operation that would dis11lpt the neighborhood. Staff recommends approval of the application contingent
on the conditions listed in the planning repOlt.
Bob Schafer, 15223 Bluedom Circle, voiced his objections to the home occupation application as he felt the
traffic would invade his pIivacy, be a haz31'd for the childI-en playing in the street, the ordinance states
whel-e businesses should be, and he did not want change.
Comments from the Commissioners were; retail business, numrer of clients, rationale for 1 chair station,
od1er salons with home occupations pemuts, holli's of operation, location of d1iveway, size of lot, walk-in
u'affic, visibility of house numrers, minimal impact of neighborhood, and precedent has been set.

Andrea Nathanson, 17108 Slmt1Se Avenue SW, stated she is requesting a home occupation to operate a
secretalial/bookkeeping service in her home in order to be home with her small child. She has operated
businesses out of her home in Oregon and California. Business would be generated over the phone or by
leaving business cards.
Gina Mitchell, Associate Planner, presented the infOlmation as per plam1ing memo of September 1, 1994.
The applicant proposes to be the only employee offeling the services of word processing, typing. mailing
labels. bookkeeping. resumes, and proofreading. There would be no clientele coming to the home and no
extelior signage. Staff recommends approval with the conditions listed in the plamring repolt.
Comments fOlm the Commissioners were that ail were in SUppolt of the proposal and commended the
applicant for applying for the home occupation pelmit.

INTRODUCTION:
The Planning Department has received an application for a Home Occupation Permit from Perri Hannes
of 15243 Bluedom Circle SE, Prior Lake. The applicant is requesting the Planning Commission to grant
a Home Occupation Permit to allow her to operate a two (2) station beauty salon, with one (1) part-time
employee, in her home. The size of the salon will be approximately 170 square feet of floor area
(meeting state requirements). The applicant proposes to offer hair products and supplies on a retail basis.
The salon is proposed to be open fIve (5) days a week:
Sunday & Monday: closed
Tuesday & Thursday: 10:00 a.m. to 8:00 p.m.
Wednesday & Friday: 9:00 a.m. to 5:00 p.m.
Saturday: 8:00 a.m. to noon
SITE CHARACTERISTICS:
The subject site is part of a neighborhood that is developed with single family homes. This comer lot is
relatively flat, and approximately 90' wide along Bluedom Circle and 150' deep along Fish Point Road,
with roughly 14,000 square feet of lot area. The applicant has a bituminous driveway which can
accommodate at least four cars for off street parking. There is no parking allowed on Fish Point Road.
STAFF ANALYSIS:
A basic premise of the home occupation regulations is that a pemlit would not be granted to an operation
which would disrupt the neighborhood. Disruptive uses are prohibited and can have their pennit revoked.
Incompatible uses are directed to the appropriate business or commercial zones. Stringent guidelines are
placed on all applications per attached Section 6.8, Home Occupations of the Zoning Ordinance.
Perhaps the most significant aspect of a home occupation is the potential impact on the immediate area.
Traffic generated, safety, parking, hours or use, and effects of the occupation itself are important criteria
when considering the application. The type of home occupation permits granted in the past ten years
include: photography studio (by appointment), locksmith, pottery studio (with no sales to the general
public), art studio, flower arrangements sold on consignment basis only, waterski school, glass repair
service (all work conducted off-site), air conditioning repair (all work conducted off-site), wholesale fire
extinguisher sales, teach cake decorating and knitting classes, marine consulting service, computer
consulting, one chair beauty salon, and an accounting practice.
The proposed two chair, two employee beauty salon will impact the neighborhood to a greater degree than
the one station salon that was approved in 1981. This permit was approved subject to: providing ample
parking for customers, limiting employee/operator to one employee (if more than one employee, a more

appropriate location must be found in business section or other appropriate area), city reviewing operation
for conformance at least once a year, and obtaining proper licenses and approval from the state. The
applicant has estimated that the proposed salon's average daily clientele would be 20 - 25 people, creating
in staffs opinion, an excessive amount of traffic within the neighborhood.
ALTERNATIVES:
1. Approve the home occupation permit for a beauty salon at 15243 Bluedom Circle SE as
submitted and/or with conditions deemed appropriate by the Planning Commission.
2. Table or continue the item for specific reasons.
3. Deny the home occupation permit finding that it is inconsistent with the Zoning Ordinance and
other facts as defined by the Planning Commission.
RECOMMENDATION:
Staff is of the opinion that by limiting the number of stations and employees to one, the proposed home
occupation can operate consistent with the intent of the Home Occupation Permit chapter of the Zoning
Ordinance, with the following conditions attached:
1. No off-site parking; ample on-site parking for a maximum of two (2) customer vehicles
must be provided.
2. No exterior signage.
3. No retailing of any products.
4. No other employees beyond the one (1) employee/operator.
5. No more than one (1) station be provided in the salon.
6. The hours of operation be limited to:
Sunday & Monday: closed

HOME OCCUPATIONS: Any home occupation such as an art studio, dress
making, teaching or the professional office of a physician, dentist, lawyer, engineer
architect or accountant, may be pennitted as an accessory use if it complies with the
requirements of this section. The Prior Lake Planning Commission may issue a Home
Occupation Pennit following a hearing for which abutting property owners have been
notified.
A.
The home occupation shall be carried on by a member of the family residing in the
dwelling unit with not more than one employee who is not part of the family.

The home occupation shall be carried on wholly within the principal or accessory
structures.

Exterior displays or signs other than those pennitted under Section 6.4 exterior storage of
materials and exterior indication of the home occupation or variation from the residential
character of the principal structure shall not be pennitted.
D.
Objectionable noise, vibration, smoke, dust, electrical disturbance, odors, heat or glare
shall not be produced.
E.
Articles not produced on the premises shall not be sold on the premises. without a
specified pennit.
F.
The home occupation shall not create excessive automobile traffic within the
neighborhood.

STAFF ANALYSIS:
According to section 5-3-11 of the Ci ty Code, home occupations may be allowed
if they meet a set of criteria as set forth in the code. The intent of this
section of the code is to only allow thos~ uses in a resider .ial area which
are compatible with the environment of the neighborhood. The proposed use
shall not produce or create any excessive di!lturbance in the neighborhood.
The subject neighborhood is Boudin-Oakland, more specifically the Oakland ~
Beach area which was platted in 1976 and is about 90\ developed. The neigh- L.-
borhood consists of medium sized lots and is zoned R-l, single family. In ~

attributable to this use would be insignificant. Parking in the driveway of \
the subject parcel is available. The use would not produce any objectionable
noise, vibrations, smoke, dust, electrical disturbance or any other object-

of this and most home occupation's is service rather than retail. This service
can at least in part relate to the people in the neighborhood since, due to
the size of the business will depend on local support.
STAFF RECOMMENDATION:
Approve the request as applied for. Staff will review the use each year
on the anniversary date for compliance.
