RESOLUTION PROVIDING FOR THE VACATION OF DRAINAGE AND
UTILITY EASEMENT WITHIN THE PLAT OF JEFFERSON'S FIRST ADDITION

WHEREAS, the City Council of Prior Lake, on its own motion, endeavors
to vacate the following described drainage and utility
easement situated in the City of Prior Lake, Scott County,
Minnesota to wit:
LEGAL DESCRIPTION
Lots 1 & 2 Block 1, Jefferson's First Addition
WHEREAS, notice of the hearing on said motion to vacate
duly published and posted in accordance with the
Minnesota Statutes; and
has been
applicable
WHEREAS, a public hearing was held
September 8, 1992 at 7:30
Council Chambers; and
WHEREAS, the City Council then proceeded to hear all persons
interested in said motion to vacate and persons interested
afforded the opportunity to ~resent their views and
objections to the granting of sald vacation; and

vacation of said drainage and utility easement would be in

NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF PRIOR
LAKE, that pursuant to Minnesota Statutes 412.851, the above
described easement situated in the City of Prior Lake, Scott
County, Minnesota is hereby vacated.
BE IT FURTHER RESOLVED that this Resolution will be forwarded to the
Office of the County Recorder, Scott County, for appropriate
action.

SEPTEMBER 8, 1992
The Planning De~artment received a vacation
request from V1ktors Konters. Mr. Konters
would like to construct a new single family
dwelling which straddles the lot lines of Lots
1 and 2. The easements abutting the property
lines prohibit development on top of them and
must be vacated prior to building the house.
Jefferson's First Addition is a new four lot
single family subdivision located within the
Shoreland District. Final plat was filed in
May 1992. Only one building permit has been
issued for the subdivision to date.
The site was vacant for many years prior to
subdivision. There would be no reason for
utilities to be located in the newly recorded
easement. Citr records indicate no recorded
easements on e1ther Lot 1 or 2. Responses
received from a mailing sent to area utility
companies indicate there is no reason the
easements cannot be vacated.
The proposed vacation is not in conflict with
the current Comprehensive Plan. No adverse
effect is foreseen.
There are three alternatives:
1) Approve the vacation Resolution 92-26
as requested
2) Deny the vacation
3) Table the vacation and request staff to
provide further information
Staff recommends approval of the vacation as
submitted - Alternative # 1.
Motion to approve Resolution 92-26 is in order.

Planning Commission over the past 4 years. Mayor Andren
presented a Certificate of Appreciation to Ms. Wells and on
behalf of the City Council thanked her for her contribution. Ms.
Wells expressed thanks and ap~reciation for the opportunity to
serve on the Planning Commisslon.
i\; The next order of business was: Public Hearing on Drainage and
'i'k Utility Easement Vacation for Vik Ronters - Resolution 92-26.
The Public Hearing was called to order at 7:40 p.m. by Mayor
Andren. Associate Planner Lucast presented an overhead of the
area and explained the details of the vacation. A short
discussion followed. Vik Konters was present and explained his
request.
MOTION BY WHITE, SECONDED BY KEDROWSKI, TO APPROVE. RESOLUTION
92-26 PROVIDING FOR THE VACATION OF DRAINAGE AND UTILITY EASEMENT
WITHIN THE PLAT OF JEFFERSON'S FIRST ADDITION.
Upon a vote taken, ayes by Andren, Fitzgerald, Kedrowski, White,
and Scott, the motion passed unanimously.
MOTION BY SCOTT, SECONDED BY KEDROWSKI, TO CLOSE THE PUBLIC
HEARING.
Upon a vote taken ayes by Andren, Fitzgerald, Kedrowski, White,
and Scott, the motion passed unanimously.
~ The next order of business was: . Consider Rezoning and
'R~ ComprehensiVe Plan Amendment Applioation from Jim Allen (Westbury
Ponds). Robert Smith from Smith Land Planning Consultants,
Inc., representing the applicant, presented overheads and details
of the Rezoning and Comprehensive Plan Amendment application.
Smith stated that the applicant has been working with staff
regarding concerns and issues raised by the citizens and Planning
Commission members at the Planning Commission hearing. Assistant
City Planner Garross explained the process the Comprehensive Plan
Amendment, Rezoning application and concept site plan/preliminary
plat consideration will be going through. Garross presented
background on the applications, discussed issues in the staff
report and presented the Planning Commission recommendation. The
fOllowing individuals addressed the Council on drainage issues,
traffic concerns and spoke in favor of the Rezone and
Com~rehensive Plan Alnendment: Donald Ramm, 16811 willow Lane,
Chrls JOhnson, 3784 Pershing Street and Tom SChneider, 16840 Elm
Avenue. A letter from Violet Anderson, 3975 Pershing Street was
read into the record VOicing her concern over the location of the
~roposed park in the northern part of the concept plat. Council
lnput followed with discussion on the Comprehensive Plan
Amendment and Rezoninq Application, the proposed changes in land
use, traffic, parJ<1nq and the pUblic hearing notice relative to
the rezoning application. Based on procedural and public notice
re~irements, it wasl1qreed by the Council and applicant that any
action on the rezone application should occur after further
public notice and hearing.
MOTION MADE BY WHITE, SECONDED BY KEDROWSKI, TO APPROVE THE
COMPREHENSIVE PLAN AMENDMENT FOR WESTBURY PONDS FROM R-3 MEDIUM
DENSITY TO R-l LOW DENSITY, AND ~HE B-3 GENERAL BUSINESS TO R-1
LOW DENSITY.
