CALL TO ORDER - Mayor Andren called the meeting of the Common Council to order on Monday, April 4, 1994 at 7:31 p.m. in the City Council Chambers. Present were: Mayor Andren, Councilmembers, Greenfield, Scott and Schenck, (Councilmember Kedrowski joined the meeting at 7:59 p.m.), City Manager Boyles, Assistant City Manager Carlson, Planning Director Graser, Associate Planner Mitchell, Public Works Director Anderson, Assistant Engineer Loney, Engineering Technician Evans, Attorney Kessel, and acting Recording Secretary Schewe. 2. PLEDGE OF ALLEGIANCE - Mayor Andren led the Pledge of Allegiance and welcomed everyone to the meeting. 3. CONSIDER APPROVAL OF MARCH 21,1994 MINUTES. Councilmember Greenfield indicated that the last line of item of 8B New Business on page five should reflect that Mr. Graser stated that, "It had not been officially abandoned." Council member Greenfield stated that, "nothing had been done to revise the zoning category. II Councilmember Scott indicated that the recording secretary will have to sign the minutes. APRIL 4,1994 The purpose of this item is to consider a conditional use application filed by the Prior Lake Fire Department to locate a public building (fire hall) at 16776 Fish Point Road S.E. See attached Planning Commission report and draft minutes dated March 17, 1994 for details related to this issue. The Planning Commission held the public hearing to consider the conditional use permit on March 17, 1994. There were no residents present at the hearing nor were any comments for, or against, the conditional use permit received by the Planning Department. The Planning Commission reviewed the proposed site plan, expansion potential, traffic issues, drainage, parking and access, and exterior materials proposed. The recommendation of the Planning Commission was stated as follows: "Motion by VonHof, Second by Loftus, to approve a conditional use application by the Prior Lake Fire Department to construct a public building within a R-1, Urban Residential Zone, located at 16776 Fish Point Road. Rational Being the application has met the approval criteria of the City Code." 1. Affirm the recommendation of the Planning Commission to approve the conditional use permit application to allow a public building (fire hall) to be constructed within the R-1 Zoning District at 16776 Fish Point Road S.E. Continue or table the conditional use permit for specific information or additional research. Deny the conditional use permit for specific reasons finding that the proposed use would be inconsistent with the R-1, Zoning District. 2. 3. ITEMI - CONDmONAL USE - PRIOR LAKE FIRE DEPARrMENT As the applicant is the City of Prior Lake, Deb Garross, Assistant City Planner, presented the information as per planning report of March 17, 1994. The purpose of the application is to locate a public building in a R-l District Public buildings are a conditional use permitted within the R-l, Urban Residential Zoning District The subject site is located southwest of the intersection of Fish Point Road and CSAH 21 and the legal description is Lot 1, Block 3, Waterfront Passage AcXlition. The Fire Department services the adjoining townships as well as Prior Lake. Access would be on County Road 21. The building cormnittee and an;hitect have worked very diligently and developed a design that compliments the site and the adjoining properties. DEB GARROSS, ASSISTANT CITY PLANNER _YES ...x.NO MARCH 17, 1994 PRESENTER: PUBLIC HEARING DATE: INTRODUCTION: The purpose of this item is to consider a conditional use application filed by the Prior Lake Fire Department to locate a public building (fire hall) at 16776 Fish Point Road S.E. BACKGROUND: Public buildings are listed as a conditional use within the Zoning Ordinance for the R-l, Urban Residential District. The subject site is located southwest of the intersection of Fish Point Road and CSAH 21 and is legally described as Lot 1, Block 3, Waterfront Passage Addition. See attached maps for site location. The subject site was subdivided by the City of Prior Lake in July, 1993 and later purchased by the City with the intent of constructing a new fire hall on the property. In November, 1993, the citizens of Prior Lake approved a referendum to build a new fire station. The subject site is located within an R-l, zone which requires a 15,000 square foot minimum lot size for uses other than single family and townhomes. The fIre hall is classifIed as a public building and therefore requires a conditional use permit be granted in order to construct the building as proposed. DISCUSSION: A conditional use is defined as "a use which , because of special problems of control, requires reasonable limitations peculiar to the use for the protection of the public welfare and the integrity of the Comprehensive Plan"; a conditional use permit is "a permit issued by the Council in accordance with procedures specifIed in this Ordinance as a flexibility device to enable the Council to assign dimensions to a proposed use or conditions surrounding it after consideration of adjacent uses and their functions and the special problems which the proposed use presents" (Prior Lake Zoning Ordinance 83-6". The Planning Commission should understand that a conditional use is considered to be permitted however, because the use may have a potential for conflict with surrounding uses, the Council has the discretion to apply special conditions to the permit approval. A land use requiring a conditional use permit must follow the specifIc performance criteria listed in the Zoning Ordinance. The Planning Commission and Council determine whether the application can meet the designated Zoning Ordinance conditions and establish any additional conditions it believes necessary and reasonable to protect the existing neighborhood. 4629 Dakota St. S.E., Prior Lake, Minnesota 55372-1714 / Ph. (612) 447-4230 / Fax (612) 447-4245 AN EQUAL OPPORTUNITY EMPLOYER ANALYSIS: The subject site consists of approximately 28,750 square feet of land area and is located adjacent to CSAH 21, identified as a minor arterial in the Comprehensive Plan and Fish Point Road which has been designated as a collector street by the Engineering Department and will be indicated as such in the 2010 Comprehensive Transportation Plan. The site is bounded on the east by the Prior Lake, "Waterfront Passage Business Park", the north by Prior Lake Baptist Church, the west by vacant, R-l zoned land and the south by a C-l, Conservation District. The subject site was chosen by the Fire Department because of its location and good access with respect to their service area. The site and building plans have been designed by the consulting firm of Boarman, Kroos, Pfister, Rudin & Associates, represented by Paul Mickelberg. The Fire Department represented by its building committee, has worked closely with City Hall and the consultant to prepare a site and building design conforming to City codes and aesthetically sensitive to the planned future residential and industrial development within this Planning District. See attached plans for details related to the site plan and proposed building. A consultant from the firm will be present at the hearing to address specific concerns of the Planning Commission or audience. The building will be constructed with burnished block, similar in color to that of City Hall and a metal roof. The proposed structure meets all setback, parking, landscape and other requirements of the Zoning Ordinance. The site plan has been designed to conform with the district, anticipated future land uses and should not cause conditions which would be dangerous to the neighborhood. The fire hall will comply with the performance standards outlined in the Zoning Ordinance for conditional use permits. The approval criteria for conditional uses primarily focus on conformity and integration of the use into the existing neighborhood. The landscape plan and exterior building design have been developed in order to complement the district and anticipated future land uses. ALTERNATIVES: 1. Approve the conditional use to locate a public building (fire Hall) within the R-l, Urban Residential Zone, as requested. 2. Continue or table this item for further information as identified by the Planning Commission. RECOMMENDATION: Alternative #1 with conditions as per Planning Commission discussion. The site was thoughtfully chosen in order to meet fire and emergency service needs of Prior Lake as well as Credit and Spring Lake Townships. The architects and Fire Department building committee have spent countless hours designing the site and building plans to conform with the codes of Prior Lake and anticipated future development. The use will comply with the performance standards outlined in the Zoning Ordinance. The approval criteria for conditional uses primarily focus on conformity and integration of the proposed use into the existing neighborhood. The fire station has been designed specifically for that purpose therefore, staff recommends that the conditional use permit be approved. 7.5 CONDITIONAL USES: Conditional uses as specified within each Zoning District may be allowed or denied by the City Council after recommendations by the Board of Adjustment in accordance with the criteria and provisions listed herein: A Application: Applications for conditional uses. will be filed with the Zoning Officer and shall be accompanied by: 1. An application fee in an amount equal to that set by the City Council. 2. Fifteen (15) copies of a site plan and supporting data which shows the site size and location; use of adjacent land; the proposed size, bulk, use and location of buildings; the location and proposed junction of yards, open space, parking area, driveways, storage areas and accessory structures; the location of all utilities and timing of proposed construction as the Zoning Officer may require. 3. The Zoning Officer at his discretion may require a topographic map to the site and reduced copies of all material suitable for mailing. 4. The names and addresses of all property owners within five hundred feet (500') shall be provided by a certification of an abstract company so that the Zoning Officer may provide notification of the conditional use permit application. (Ord. 90-07) B. Review: The Zoning Officer shall forward copies of the application to the City Council, the Board of Adjustment and, if necessary, to the Consultant Planner for review. 1. The Board of Adjustment shall forward its recommendations within forty-five (45) days unless the petitioner agrees in writing to a time extension. Failure to act within the allotted time shall be deemed to be a favorable recommendation. 2. The City Council may attach such conditions to the approval of any conditional use as may be necessary. The approved site plan and all attached conditions shall be filed by the petitioner with the Zoning Officer within thirty (30) days of final approval. Any development contrary to the approved plan shall constitute a violation of this Ordinance. C. Criteria for Approval: A conditional use shall be approved if it is found to meet the following criteria: 1. The proposed use conforms to the district permitted and conditional use provisions and all general regulations of this Ordinance. 2. The proposed use shall not involve any element or cause any conditions that may be dangerous, Injurious, or noxious to any other property or persons, and shall comply with the performance standards listed below. 3. The proposed use shall be sited, oriented and landscaped to produce a harmonious relationship of buildings and grounds to adjacent buildings and properties. 4. The proposed use shall produce a total visual impression and environment 64 which is consistent with the environment of the neighborhood. 5. The proposed use shall organize vehicular access and parking to minimize traffic congestion in the neighborhood. 6. The proposed use shall preserve the objectives of this Ordinance and shall be co,nsistent with the Comprehensive Plan. 7. Additional requirements with respect to conditional use in the Conservation District include the following: a) Filling a wetland shall not exceed the flood storage capacity requirements for the wetland. b) The proposed development shall not result in unusual maintenance cost for road and parking areas or the breaking and leaking of utility lines. c) Development shall be permitted in such a manner that the maximum number of trees shall be preserved. The remaining trees shall contain at least fifty (50) percent of the canopy coverage. d) Development shall be accomplished only in such a manner that on-site soil erosion shall be minimized both during construction and when construction activity is completed. e) Wetlands and other water bodies shall not be used as primary sediment traps during development. f) The quality of water run-off and water infiltration to the water table or aquifer shall remain undisturbed by the development of the site. g) The types and density of land use proposed for the site shall be suited to the site. Bedrock conditions shall not present a threat to the maintenance of ground water quality and shall not fail to adequately correct problems due to soil limitations including bearing strength, shrinkswell potential and slope stability. D. Performance Standards: All conditional uses shall comply with the requirements of this section. In order to determine whether a proposed use will conform to the requirements of this Ordinance, the City Council may obtain a qualified consultant to testify. Said consultant service fees shall be bome by the applicant. 1. Fire Protection - Fire prevention and fighting and equipment acceptable to the Board of Fire Underwriters shall be readily available when any activity involving the handling or storage of flammable or explosive material is carried on. 2. Electrical Disturbance - No activity shall cause electrical disturbance adversely affecting radio or other equipment in the vicinity. 3. Noise - Noise which is detennined to be objectionable because of volume, frequency, or beat shall be muffled or otherwise controlled, except fire sirens and related apparatus used solely for publiC purpose shall be exempt from this requirement. 65 4. Vibrations - Vibrations detectable without instruments on neighboring property in any district shall be prohibited. 5. Odors - No malodorous gas or matter shall be permitted which is discernible on any adjoining It or property: 6. Air Pollution - No poUution of air by fly-ash, dust, smoke, vapors, or other substance shall be permitted which is harmful to heaJth, animals, vegetation or other property. 7. Glare - Ughting devices which produce objectionable dired or refled glare on adjoining properties or thoroughfares shall not be permitted. 8. Erosion - no erosion by wind or water shall be permitted which will carry objectionable substances onto neighboring properties. 9. Evens, Engineering Technician IV Re: Fire Hall Date: March 3, 1994 The following is a list of comments and concerns I have on the Fire Hall plans I reviewed. SHEET C2 - SITE GRADING PLAN The proposed pond construction is shown to within the future street RJW. Can additional storm sewer installed and the pond be eliminated? This would require over land drainage to the south and a storm sewer outfall structure to the existing wetland. The proposed grades for the parking lots appear to be very flat. Additional grades need to be shown to insure proper construction of the curb and parking lot. It appears that the low points can be lowered to increase the slopes in the parking lots. ' The plans show a 3" minus crushed rock spillway. This will not be allowed and alternative methods need to be looked at. Example:Rip-Rap, concrete spillway, etc. Erosion control measures need to be addressed. Silt fence and bale checks must be installed per City Standards. SHEET C3 - SITE PLAN The proposed 8' bituminous path should be shown on this sheet or another sheet. Note No.8 needs to include all sidewalks. Concrete valley gutters will be installed at driveways adjacent to Fish Point Road By the city. These should be shown on the plans. SHEET C4 - SITE UTILITY PLAN Water service can be obtained from the westerly side of the site by tapping a new connection to the 16" watermain. This alternative may be less costly than connecting to existing stub. SPECIFICATIONS Proposed agreement between Contractor and City must be reviewed and approved by City Attorney before bidding.
