A. EP08-106 & 107 Shepherd of the Lake Lutheran Church is requesting a Final
Planned Unit Development Plan for a proposed 62,000 square foot YMCA facility
within the Shepherds Path campus. This property is located north of CSAH 42,

1. Call to Order:
Chairman Lemke called the May 12, 2008, Planning Commission meeting to order at
6:00 p.m. Those present were Commissioners Billington, Lemke, Perez and Ringstad,
Planner Jeff Matzke, Assistant City Engineer Larry Poppler and Recording Secretary
Connie Carlson.

The Minutes from the April 14, 2008, Planning Commission meeting were approved as
presented.

Commissioner Lemke read the Public Hearing Statement and opened the meeting.
A. EP08-106 & 107 Shepherd of the Lake Lutheran Church is requesting a
Final Planned Unit Development Plan for a proposed 62,000 square foot YMCA
facility within the Shepherds Path campus. This property is located north of CSAH
42, east of McKenna Road and south of North Berens Road.
Planner Jeff Matzke presented the Staff Report dated May 12, 2008, on file in the office
ofthe Community Development/Natural Resource Department.
Shepherd of the Lake Lutheran Church has applied for approval of a Planned Unit
Development Final Plan for the portion of the campus that is proposed to contain a future
YMCA facility. The site is located west of Shepherd's Path, east of McKenna Road,
north of CSAH 42, and south of North Berens Road.
The proposed YMCA facility will occupy property that was platted at the time of the first
phase ofthe Shepherd's Path campus. An Administrative Subdivision recently took
place to facilitate a legal description and establish a boundary for a lease agreement
between the church and the YMCA. The remainder ofthe Shepherd's Path campus is
platted as outlots for future development.

On April 7, 2008, the City Council adopted Resolution #08-057 approving the
amendment to the PUD plan for the Shepherd's Path development with the following
conditions:
a Any additional impervious square footage areas granted through this amendment
must be equally deducted from future development phases that take place within
the specific watershed area ofthe YMCA facility.
b The applicant shall provide 100 proof-of-parking spaces on the campus property
located west of McKenna Road to serve as an overflow parking area. The
applicant will be responsible for the installation of the bituminous parking area if
the parking counts warrant it. Ifwarranted, any future development on the west
side of McKenna must incorporate parking to adequately meet the needs of the
YMCA facility at build-out.
c The applicant shall provide a crossing guard at McKenna and North Berens Road
at peak traffic volume times when overflow parking on the west side of McKenna
is utilized (induding Sunday mornings, before and after worship services, and
Wednesday evenings as needed).
d Sixty (60) days after the YMCA facility becomes operational, City staff shall
evaluate the parking situation during peak hours and have the applicant install the
proof of parking if counts warrant it.
e The approved amendment shall not imply approval of any architectural elements,
materials, signage, the splash pad concept, or any PUD thematic elements shown
on the elevations or plans submitted as a part of the amendment application.
The proposed YMCA final PUD plan encompasses 2.34 acres of the Shepherd's Path
campus. The subject area is comprised of the YMCA facility, playground areas, a splash
pad area, and a daycare parking lot. The YMCA structure is proposed to be a total of
50,000 square feet in floor area (floor plans attached) with the option of a 12,000 square
foot expansion area (the future expansion area will need to submit for a Final PUD in
order to proceed with development) and a ground floor area of29,000 square feet. The
structure will be a maximum height of 36 feet (with a third story walk-out elevation on
the south side of the building). In addition, there are mechanical units proposed for the
top of the building that will likely add a limited amount of height to the center and
southern rooftop areas of the structure. The YMCA structure will not exceed the current
height of the existing adjacent church.
With the exception of exterior materials, the final PUD Plan is consistent with the
approved and amended preliminary PUD plan.

The Planning Commission must review the Final PUD and make a recommendation to
the City Council. The staff recommended approval of the Final PUD Plan, subject to the
following conditions:
1. The pre-cast panel material shall be refined/reformulated to more closely mimic the
texture of the exterior materials on adjacent campus structures, prior to proceeding to
the City Council.
2. All engineering issues must be addressed prior to the Final PUD proceeding to the
City Council.
3. The Final PUD Development Contract must be approved by the City Council.
Comments from the Public:
Kermit Mahlum, Shepherd of the Lake Lutheran Church, stated this is an amendment to
their overall campus plan. They have spent a great deal of time planning the YMCA
project and will work (with staff) on refining with the exterior paneling. One ofthe
reasons they are interested in using these panels is because a local manufacturer is in
Savage and the proposed exterior panel have been successful. Mahlum feels they will not
have a problem working through staff's concerns.
Billington questioned ifthere is an engineering reason to use these panels or is it a cost
savings. Mahlum responded it does make a difference in cost however it is not that great.
They feel it is a better as it is an improved panel material.
Lemke questioned the floor area. Mahlum explained it would be an expansion to the
YMCA building to accommodate gym space.
Lemke noted the proposed splash pad play area - what would happen during the off
summer months? Mahlum doesn't think it would be a problem as a number of YMCA
facilities use them. It is not a full blown water park but a step in the right direction for
the little kids.
Billington questioned traffic control. Mahlum felt they probably won't be doing anything
too much different. The last word he heard from Scott County is the proposed stoplight
on County Road 42is two years out.
Billington felt it is a very attractive project for Prior Lake and will support.
Steve Doughty, Pope Associates, explained the panel material samples presented by the
applicant. The panel material can be changed and felt they would work with staff on that
issue. A clarification on the building's third story walkout - it was left: over from a
previous plan, it really is a two story facility.
Billington questioned Doughty ifhe felt the exterior finish was appropriate. Doughty
said he felt the texture was appropriate. The texture does not exactly match the E.I.F.S.
but it works. We're trying to match two different materials. From a design team, (Pope

& Associates) felt this was appropriate and attractive. Doughty said there is still room to
make adjustments - staff and the applicant are getting close.
Billington asked ifhe could live with staffs suggestion. Doughty felt if the panel
material is too fine it will wear to imperfections.
There were no comments from the public and the hearing closed at 6:24 p.m.
Comments from the Commissioners:
Ringstad:
. Would like to echo Commissioner Billington's comments that this is a great asset
to the community and has supported it from the beginning.
. The fayade and material fit in very well with the existing church.
. Hope F ABCON can match the existing surface. It is a local company and it
would be great if a company 5 miles away can produce a product that works.
. It is everyone's hope FABCON can be the contractor.
. Support staff s recommendations and conditions.
Perez:
. Agree with fellow Commissioners on the project. It is good to see the next phase.
. Agree with Commissioner Ringstad and staff on the building's exterior and hope
something can be agreed upon as far as the finish.
. Staff - has the applicant seen the letter sent from the neighbor? Matzke said staff
just received it today and was forwarded on.
. Support.
Lemke:
. Echo comments from the Commissioners. We have seen this project evolving for
a long time. It is a major asset.
. Asked for clarification from staff on Mr. Palla's letter. Matzke responded the
City has been out to the Church area and monitored the project and it meets all
safety regulations. The City has been continually working with the staff and
neighbor on this matter.
. Lemke questioned the construction hours. Matzke replied 7 a.m. to 10 pm.
. Also questioned Mr. Palla's reference to diesel fuel deliveries at 2:00 am. Matzke
responded he should call the police if that happens and we would contact the
applicant and make them aware of the situation.
. If Fabcon, Inc. becomes a contractor for this project would there be a problem
with delivery?
. Mahlum stated this was the first time he ever heard of a diesel truck delivering at
2:00 a.m. He has never seen the generators running after 8 pm. Shepherd of the
Lake is looking into constructing a wall to reduce the sound.
. It looks like the YMCA is at a minimum of300 feet from the neighbor's property.

Billington:
. Support the project from the outset and is a great asset to the community.

APPROVAL OF THE FINAL PUD PLAN SUBJECT TO THE LISTED CONDITIONS.
Vote taken indicated ayes by all. MOTION CARRIED.
This item will go before the City Council on June 2.

Planner Jeff Matzke presented the Staff Report dated May 12,2008, on file in the office
of the Community Development/Natural Resource Department.
On October 25,2006 the Metropolitan Council approved the City of Prior Lake 2030
Comprehensive Plan. At that time, as is mandated by State Statute, the Zoning
Ordinance and Zoning Map were required to be amended to make them consistent with
the 2030 Comprehensive Plan.
In addition to the proposed amendments for the purpose of meeting State Statute
requirements, additional amendments are being proposed with the intention of making the
Zoning Ordinance more user-friendly for citizens, business owners, and developers.
Lemke asked for clarification on the attached and detached garage size. Matzke
explained staff discussions and further discussed at length decided there were many
substandard lots in the community and this would apply to both. Staff talked to the City

of Savage and they felt they were in line with the City of Prior Lake. Matzke explained
the large versus small lots and the restrictions of setbacks, lot size, variances, etc.

. In some instances this can be revisited.
. The size is going to be limited because of the zoning.
. Wondering if we need to set a hard limit.
. Most of the lots the Planning Commission sees are platted and this would only
affect a few properties.

. Allow for reconstruction of water accessory structures to match the existing home
building exterior material.

Commissioner Lemke asked staff to look at school parking in Section 1107. Staff agreed. The
Section will be discussed at the first Planning Commission meeting in June.
Section 1108: Conditional Use Permits, Variances, and Amendments
. Look into the public hearing deadline. (City Attorney is reviewing at this time.)
. Make sure "aggrieved person" is in the definition section.
. Regarding Variances - Could a person apply for a variance if they have a practical
difficulty? Matzke replied this could apply ifit's a building safety code or some other
legislation. It opens the door a little wider.
. Some concern with "practical difficulties" - don't really want to make it easier for
variances. Variance requests have gone down over the past 5 years which is good.
However a property can be expounded by the owners that may not be real practical. It
should not create a flood of variance requests.
