RESOLUTION APPROVING A CONDITIONAL USE
PERMIT TO ALLOW THE CONSTRUCTION OF
A PUBLIC BUILDING, (PRIOR LAKE
PUBLIC WORKS/PARKS MAINTENANCE FACILITY), WITHIN THE B-P,
BUSINESS PARK DISTRICT ON OUTLOT B,
WATERFRONT PASSAGE ADDITION.

WHEREAS, The City of Prior Lake applied for a Conditional Use Permit, (CUP)
under Section 7.5 of Prior Lake Zoning Ordinance 83-6; and
WHEREAS, the CUP application is to permit the construction of a public building
within the B-P, Zoning District; and
WHEREAS, the Planning Commission held a hearing on the CUP application on July
24, 1995;
WHEREAS, the Planning Commission proceeded to hear all persons interested in said
application and persons interested were afforded the opportunity to
present their views and objections to the granting of said CUP; and
WHEREAS, the Planning Commission adopted Resolution 95-19PC recommending
approval of the CUP subject to 5 conditions contained therein; and
WHEREAS, the City Council of Prior Lake considered the 'CUP on August 7, 1995;
and
WHEREAS, the City Council reaffirms the recommendation of the Planning
Commission to approve the CUP application subject to the following
conditions:
I. Amendment of the Landscape Plan to incorporate additional trees along the berm
located on the north side of the principal building.
2. Successful amendment of the Zoning Ordinance to permit accessory structures within
the B-P, Business Park Zone.
3. Approval of the final plat of "Waterfront Passage 2nd Addition."
4. Site plan approval from the City Development Review Committee.
5. Filing of this document with the Office of the Scott County Recorder.

A RESOLUTION GRANTING A CONDITIONAL USE PERMIT TO ALLOW THE
CONSTRUCTION OF A PUBLIC BUILDING, (PRIOR LAKE PUBLIC
WORKS/PARKS MAINTENANCE FACILITY), WITHIN THE B-P, BUSINESS
P ARK DISTRICT AT OUTLOT B, WATERFRONT PASSAGE ADDITION.
BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. The City of Prior Lake has applied for a Conditional Use Permit, (CUP) under
Section 7.5 of Prior Lake Zoning Ordinance 83-6.
2. The CUP application is to permit the construction of a public building within the B-
P, Business Park Zoning District.
3. The legal description of the subject site is Outlot B, Waterfront Passage Addition.
4. The Board of Adjustment has reviewed the CUP application as contained in Case
#CU9503, and held a hearing thereon on July 24, 1995.
5. The Board of Adjustment has considered the effect of the proposed CUP related to
conformance to the district and all general regulations of the Zoning Ordinance;
compliance with the performance standards listed as items 1-9, Section 7.5D of the
Zoning Ordinance; siting and landscaping of the site to produce a harmonious
relationship of buildings and grounds to adjacent buildings and properties;
provision of a total visual impression and environment which is consistent with the
environment of the neighborhood; organization of vehicular access and parking to
minimize traffic congestion in the neighborhood; preservation of the objectives of
the Zoning Ordinance and consistency with the Comprehensive Plan.
6. The proposed public building, (Public Works and Park Maintenance Facility), can
be approved with conditions which will make it possible to use the subject property
in such a way that the proposed CUP will not result in the impairment of an
adequate supply of light and air to adjacent properties, unreasonably increase
congestion in the public streets, increase the danger of fire, and danger to the public
safety, unreasonably diminish or impair health, safety, comfort, morals or in any
other respect be contrary to the Zoning Ordinance and Comprehensive Plan.

7. The contents of Planning Case CU95-03 are hereby entered into and made a part of
the public record and the record of decision for this case. Pursuant to Section 5-6-8
of the Ordinance, the CUP will be deemed to be abandoned, and thus will be null
and void one (1) year from the date of approval if the holder of the variance has
failed to obtain any necessary, required or appropriate permits for the completion of
contemplated improvement.
CONCLUSION
Based upon the Findings set forth above, the Board of Adjustment hereby grants and
approves the CUP subject to the following conditions:
1. Amendment of the Landscape Plan to incorporate additional trees along the berm
located on the north side of the principal building.
2. Successful amendment of the Zoning Ordinance to permit accessory structures within
the B-P, Business Park Zone.
3. Approval of the final plat of "Waterfront Passage 2nd Addition."
4. Site plan approval from the City Development Review Committee.
5. Filing of this document with the Office of the Scott County Recorder.

Vacation of "Waterfront" Platted Within Sunset Shores Public hearing
was called to order at 7:45 p.m. Mayor Andren called the public
hearing to order at 7:45 p.m. Assistant Planner Garross presented an
overhead and discussed details of the request by the applicant, James
Senstad and Colleen Monyihan to vacate property originally dedicated
to the public in 1931 when Sunset Shore was originally platted.
Neither the DNR or public utility companies have indicated any
objections.

INTRODUCTION:
The purpose of this item is to consider a conditional use permit, (CUP), filed by the City of Prior
Lake to locate a public building, (Public Works and Park Maintenance Facility), on Outlot B,
Waterfront Passage Addition. See Exhibit A for reference to the site plan and narrative of the
proposal. Public buildings are listed as CUP's within the B-P, Business Park Zoning District. As
such, in order to construct the maintenance facility as proposed, the City of Prior Lake must
review the site according to the performance criteria for CUP's listed in section 7.5 of the Zoning
Ordinance. (See attached Exhibit B for information related to CUP applications and processing
procedures.
BACKGROUND:
Public buildings are listed as a CUP within the Zoning Ordinance for the B-P, Business Park
District. The subject site consists of approximately 12 acres and is a triangular piece of
property located south of CSAH 21, east of Adelmann Street and north of the south corporate
boundary of Prior Lake. Adjacent land uses to the north and southeast consist of existing
industrial development. The property to the west will be developed with land uses consistent
with the B-P, permitted and conditional uses. The property directly south of the site is located
within Spring Lake Township and is currently zoned for Rural Residential development. The
southern part of the subject site is heavily wooded and will provide an extensive buffer area to
the Township property to the south.
The subject site was subdivided by the City of Prior Lake in July, 1993 and later purchased by
the City, (in 1994), with the express intent of constructing a new maintenance building on the
property, The City Council selected the architect BRW Elness, to prepare plans and
specifications for the 3.0 million dollar project. The City Council approved the building design
and authorized the preparation of plans and specifications for construction of the maintenance
building on June 19, 1995 via Resolution 95-54. See attached Exhibit C for the Council agenda
report and Resolution 95-54 related to this project.

ANALYSIS:
The subject site consists of about 12 acres of land located south of CSAH 21, identified as a
minor arterial in the Comprehensive Plan. Access to the site will be via Adelmann Street. The
site was chosen by the City due to its close proximity to the existing maintenance building,
(located north of Prior Lake Baptist Church), and to serve as a major "anchor" to Waterfront
Passage Business Office Park.
The site and building plans were designed by the consulting firm of BR W Elness, represented
by Jeff Ortel and Pete Keely. The architects have worked closely with staff and under direction
of the City Council, to design site and building plans conforming to City codes and be
aesthetically sensitive to the planned future industrial development within the Business Office
Park. A consultant from the firm will be present at the hearing to address specific concerns of
the Planning Commission and/or audience.
The building will be constructed with brick and decorative block on the front office area, and
aggregate surfaced concrete panel walls on the larger storage areas of the building. The proposal
contains a flat roof system however, a sloped standing seam metal roof is used for accent at the
front office areas. The building has been designed to be compatible with the new fire station
however, features have been incorporated to provide a distinct character of its own. The site plan
indicates a salt/sand storage building which is proposed to be located behind the principal
structure, and nestled in a wooded area, to screen the structure from public view. The landscape
plan indicates proposed materials and location of vegetation on site to accent and provide
screening for the buildings. Staff recommends the landscape plan be amended to provide
additional trees along the berm, located on the north side of the principal building. The building
and site plans will be consistent with all applicable codes and ordinances of the City of Prior
Lake.
ISSUES:
The Public Works and Park Maintenance Building project is complicated and requires the
involvement of many different individuals. The process to date has included the following steps:
Site selection, land negotiation, City Council funds appropriation, submittal and review of
RFP's (request for proposals), from private consulting firms, Council selection ofBRW, Elness
to prepare plans and specifications, staff consultation and BRW development of the site plans
and information necessary to acquire permits and begin construction. The project will also
require the following: Approval of the CUP to locate a public building within the B-P Zone,
approval of the final plat for the subject site to create a buildable parcel, DRC site plan approval,
approval of an amendment to the B-P standards to allow accessory buildings within the B-P
Zone, letting of bids for construction of the project, building permit approval, and the ultimate
construction of the building and site improvements. See Exhibit D, for the final schedule for the
Maintenance Building.
Typically, a CUP application would be considered much earlier in the process than this
application. This project is somewhat atypical in that the City of Prior Lake is the developer,
land owner, and regulatory authority overseeing the development. The project has been designed
according to City Code and ordinance requirements. Staff is of the opinion that the site and
buildings have been designed in a manner that is consistent with the performance criteria
outlined in the Zoning Ordinance. The approval criteria for conditional uses primarily focus on
conformity and integration of the use into the existing neighborhood. The landscape plan and

exterior building design have been developed in order to complement the B- P District and
anticipated future land uses.
One issue that is outstanding related to the CUP proposal concerns the 6,000 square foot,
accessory building proposed to house sand and salt. The current B-P zoning standards are
extremely limited with respect to permitting accessory buildings. The rationale for the
restrictive standard is to discourage accessory structures because there is a tendency to build less
expensive buildings and the structures tend to accumulate outside storage of various materials.
Staff is in the process of drafting language to permit accessory structures within the B- P Zone
provided they be totally screened from public view; are limited in size to 15% or less of the
principal building; are constructed with materials similar to the principal building and are located
in the rear yard of the subject site. The zoning amendment issue is scheduled for consideration
by the Planning Commission on August 14, 1995. The CUP before the Planning Commission
provides for an accessory structure consistent with the objectives mentioned above, however,
approval of the CUP should be conditioned upon amendment to the Zoning Ordinance to permit
accessory structures within the B-P, Business Park Zone.
ALTERNATIVES:
1. Approve attached Resolution 95-19PC recommending that the City Council approve the
proposal to locate a public building (Public Works and Parks Maintenance facility), within
the B-P, Business Park Zoning District.
2. Continue to table this item for further information as identified by the Planning
Commission.
RECOMMENDATION:
Alternative # 1 with conditions as per Planning Commission discussion.
The site was thoughtfully chosen in order to meet public works and park service needs of Prior
Lake. The architects, City Council and staff have spent countless hours designing the site and
building plans to conform with the codes of Prior Lake and anticipated future development. The
use will comply with the performance standards outlined in the Zoning Ordinance for CUP's.
The approval criteria for conditional uses primarily focus on conformity and integration of the
proposed use into the existing neighborhood. The Maintenance Facility has been designed
specifically for that purpose therefore, staff recommends the CUP be approved.
ACTION REQUIRED:
A motion to adopt Resolution 95-19PC as written or with changes directed by the Planning
Commission. Please note that Resolution 95-19PC contains 5 conditions recommended to be
placed on the CUP. The Planning Commission may desire to amend the conditions as per
discussion at the public hearing.

EXHIBIT A
PRIOR LAKE MAINTENANCE BUILDING AND SITE DESCRIPTION
The property is a semi-triangular shaped piece, located adjacent to County Highway
21 and Adelmann Street. Access to the site is from two curb cut locations off of
Adelmann. (There is no drive or street connection to a state or county highway.)
The existing site has a wooded area to the south of the site, which is being saved to
the extend possible and used in part to screen the proposed Salt/Sand Storage
Building. The site is reasonably flat and includes two small potential wetland areas,
each of which are outside of the building or site improvement work.
The site improvements include a filtration pond to pre-filter the majority of the site
storm runoff. Also included are paved roadways, parking areas, a gasoline
dispensing island, above-grade gas storage tanks, a sign monument, storage bins and
other minor items. Berming is incorporated adjacent to the building in order to
diminish the size and height of the facility. Storage bins are also situated into this
berm. In addition to the saving over fifty percent of the trees on site, new
landscaping and trees are provided in excess of the City of Prior Lake Standards.
The main building is slightly under 45,000 square feet in total area, which includes
enclosed space for the storage and maintenance of vehicles, as well as shop space,
office space and related operational spaces for the City of Prior Lake's Parks and
Public Works maintenance crews. A detached 6000 square foot unheated storage
building for storing roadway salt and sand (while improving the City's water quality)
is located in the south western portion of the site.
The building materials of the main building include brick and decorative block at the
front offing areas, and aggregate surfaced concrete panel walls at the larger storage
areas of the building. Flat roofs are predominant but a sloped standing seam metal
roof is used for accent at the front office areas. In general, the appearance will be
similar to the new fire station located in close proximity to this site, and yet have a
character of its own.
The salt/sand storage building is primarily timber construction with a sloped
shingled roof: different in form and material selection from the main building. By
function and type, the two buildings included in the development are incompatible,
and so we have attempted to situate the storage building out of sight and within the
wooded section of the site.
The site and buildings have been designed for expansion in the distant future.
EXHIBIT B:
CONDITIONAL USE PERMIT PROCESS & REQUIREMENTS
CUP PROCESS:
A conditional use is defined as "a use which, because of special problems of control,
requires reasonable limitations peculiar to the use for the protection of the public welfare
and the integrity of the Comprehensive Plan." A conditional use permit is "a permit

CASE #CU95-03 - CONSIDER CONDITIONAL USE PERMIT FOR THE CITY
OF PRIOR LAKE TO LOCATE A PUBLIC BIDLDING (pUBLIC WORKS AND
PARK MAINTENANCE BUILDING) IN A B-P. BUSINESS PARK ZONING
DISTRICT:
Assistant Planner Deb Garross presented the information in the Planning Report dated
July 24, 1995.
The purpose of this item is to consider a conditional use permit, (CUP), filed by the City of Prior
Lake to locate a public building, (Public Works and Park Maintenance Facility), on Outlot B,
Waterfront Passage Addition. In order to construct the maintenance facility as proposed, the City
of Prior Lake must review the site according to the performance criteria for CUP's listed in
section 7.5 of the Zoning Ordinance.
Public buildings are listed as a CUP within the Zoning Ordinance for the B-P, Business Park
District. The subject site consists of approximately 12 acres and is a triangular piece of
property located south of CSAH 21, east of Adelmann Street and north of the south corporate
boundary of Prior Lake.
The subject site was subdivided by the City of Prior Lake in July, 1993 and later purchased by
the City, (in 1994), with the express intent of constructing a new maintenance building on the
property. The site was chosen by the City due to its close proximity to the existing maintenance
building, (located north of Prior Lake Baptist Church), and to serve a~ a major "anchor" to

Waterfront Passage Business Office Park. The City Council selected the architect BRW Elness,
to prepare plans and specifications for the 3.0 million dollar project. The City Council approved
the building design and authorized the preparation of plans and specifications for construction of
the maintenance building on June 19, 1995 via Resolution 95-54.
The site and building plans have been designed to conform to City codes and be aesthetically
sensitive to the planned future industrial development within the Business Office Park. The
building will be constructed with brick and decorative block on the front office area, and
aggregate surfaced concrete panel walls on the larger storage areas of the building. The proposal
contains a flat roof system however, a sloped standing seam metal roof is used for accent at the
front office areas. The building has been designed to be compatible with the new fire station.
The site plan indicates a salt/sand storage building which is proposed to be located behind the
principal structure, and nestled in a wooded area, to screen the structure from public view. Staff
recommends the landscape plan be amended to provide additional trees along the berm, located
on the north side of the principal building. Staff is of the opinion that the site and buildings have
been designed in a manner that is consistent with the performance criteria outlined in the Zoning
Ordinance. The approval criteria for conditional uses primarily focus on conformity and
integration of the use into the existing neighborhood. The landscape plan and exterior building
design have been developed in order to complement the B-P District and anticipated future land
uses.
One issue that is outstanding related to the CUP proposal concerns the 6,000 square foot,
accessory building proposed to house sand and salt. The current B-P zoning standards are
extremely limited with respect to permitting accessory buildings. Staff is in the process of
drafting language to permit accessory structures within the B-P Zone provided they be totally
screened from public view; are limited in size to 15% or less of the principal building; are
constructed with materials similar to the principal building and are located in the rear yard of the
subject site.
Staff recommended approving Resolution 95-19PC to City Council for approval of the proposal
to locate a public building (Public Works and Park Maintenance facility), within the B-P,
Business Park Zoning District.
JeffOrtel ofBRW Elness Architect, Inc. explained the process of the project. Mr.Ortel
expressed the excellent working relationship with City Staff and the overall impact the
facility will have on the City.
There were no comments from the audience.
Comments from Commissioners:
Arnold: concern ofbusinessloffice parks for the City to provide the facilities that are the
anchors for such a park; (Garross - not typical, but the City did the initial subdivision.)
supports the facility; economic savings for the City.
Roseth: questioned the main 3 story building (Mr. Ortel explained the mezzanine area
and the tower); the tower is a non-functional item similar to the fire l}all and city hall

buildings; (Mr. Ortel also explained the salt and sand storage building and its function.);
site for runoff of salt - will not go into the neighboring pond or woods; sewer and water
available; expansion was considered in the design.
Loftus: Would anything negative happen if the ordinance was amended? (Garross-
when the business office park regulations were put together the allowance for accessory
buildings were omitted. It does specify "accessory uses" but there is nothing that is
permitted house any of those types of uses.); important to identify the limitations and
external appearance of the accessory structure.
Criego: Comment on the fuel tanks and gas pumps; (Rye -nothing to prohibit in the
office park as long as rigid conditions are met.) (Ortel- decided on below grade for fuel
tanks; all you will see is a concrete slab and 2 dispensing tanks; the entire storage system
is below grade with extensive monitors around it.)
V onhof: having the detention pond on site is a good plan; issue of a salt and sand facility
and buying the salt and sand off season at a lower price; no impervious surface issues;
further anticipation for development on this site; (Rye - designed for expansion); facility
needs should last approximately 10 years - depends on how fast the City grows; possible
city park in the future; all maintenance, park and public utilities of the City will be stored
on site.

CASE #V A95012 - CONTINUATION OF THE MCKNIGHT & ASSOCIATES
REQUEST FOR VARIANCE FOR THE PROPERTY AT 4660 LORDS STREET:
Associate Planner Michael Leek stated he and Planning Director Don Rye met with Bud
Waund and Brent Johnson of Edina Realty representing the applicants. As a result of the
meeting the site plan was redrawn to reflect the changes in the side yard setback, front
yard setback and a lower impervious surface coverage of 32.9%. The City received a
letter from Pat Lynch, of the Department of Natural Resources recommending denial of
the requested variances. Staff received two calls in opposition to the variances: Barb
Stark, 15283 Edgewater Circle, calling on behalf of herself and husband, stating their
objection to the lakeshore variance and impervious surface coverage. A similar call was
also received from Jerry Meysenbourg.

Commissioner Vonhofread a letter from Walter and Kitty Jobst in opposition to the
variance request.
Bill Packer, 4633 Lords Street, also speaking for John Packer, 4653 Lords Street, is
highly opposed to a two story house. He also stated the City maded him conform to the
regulations for his deck two years ago. He is highly opposed to moving the house 30
feet back from the lake as suggested by the DNR. Mr. Packer feels there is a sincere
hardship on the neighbors; he's ready to look at the home where its been proposed and
move ahead. He expressed opposition to a two story house on the site.
Comments from the Commissioners:
Roseth: The DNR requested moving the house back 30' from the lake which would
result in building a substantially. smaller house; the trend seems to be build as much of a
house as you can on a piece of property; the request substantially meets what the
Commission has been doing the last couple of years; with all of the comments made in
the last few meetings, he is in support of the request.
Loftus: The deck was not included in the impervious surface coverage but does affect
the lot lines and setbacks to the lake; tried to compromise with the ranch vs. two story
house and the restricted building envelope; in previous meetings, it was stated that in
character with the neighborhood, homes were within 20' the lake; cannot support the
DNR's recommendation given with the limitations we have to deal with; suggest to
change Resolution to reflect the modifications on the lakeshore setback.
Arnold: The impervious surface has been reduced significantly; moving to the east is
better; will support.
Criego: The DNR is an advisory body; (Rye - The DNR can appeal in district court
challenging the City's authority to grant that particular variance.); based on all the
information, this is not ideal but a better solution.
V onhof: concurs with the Commissioners.

JUSTIFICATION: The uniqueness of the lot, the fact the road takes a substantial section
out of the property which includes the cul-de-sac which makes it a very small lot to begin
with and a pre-existing development pattern in the neighborhood.
DISCUSSION: Item #3 should be added -lakeshore setback of 20 feet instead of the
normal 75 foot setback requirement.

The key sections of the building are the equipment
maintenance area and shops. In these spaces much of the
preparation is done so that maintenance activities in the
community can take place. Vehicle storage is also high priority
so that the city's multimillion dollar investment in equipment
is well protected.
The building exterior is intended to be reasonably consistent
with the quality found at the fire station #1: The office portion
of the structure will consist primarily of brick in colors which
are similar in many respects to the fire station. The storage
area will be tip up concrete panels which 'are banded and
textured in an effort to provide aesthetic relief for the garage
portion of the building.
Included with this report are building sketches from various
vantage points. The architect will review these plans with the
City Council at the June 19 meeting. Council may wish to
share comments or propose revisions. One decision the
Council should make has to do with a bell or clock tower
proposed on the northern elevation of the building. The north
and west elevation drawings show the clock tower. This
concept is intended to keep this building structurally
consistent with both the fire station .and city hall. Aocording to
the Architect, the cost of the tower is approximately $5,000.
Councilmembers should determine whether, in their
estimation,.. the cost is worth the benefit of retaining the tower.
proposed is within the project budget. If the architect is to
remain with the proposed building schedule, then Council
actions on both issues are required on June 19. If, however,
the Council has major concerns it is still appropriate to defer
action for further study.
ALTERNATIVES: Council has the following alternatives:
L Approve the building design with the clock tower and
authorize preparation .of plans and specifications.
2. App rove the design without the dock tower and authorize
preparation of plans and specifications.
3. Defer action on approval pending thereceiptofadditiortal
information.
RECOMMENDATIONS:Altemative #1. In order to maintain the schedule laid out by the
architect, it would be appropriate for the City Council to approve
the building design and authorize preparation of plans . and
specifications. In my estimation, the clock tower provides a ready
identification for Prior Lake municipal buildings. Given the
productive life of this facility and the image the city is intending to
convey, I believe that the clock tower is a minimal and worthwhile
investment.

a conditional use permit in the B-P, Business Park Zoning District.

conditional use permit must be approved by the Prior Lake
Planning Commission and City Council.

Setting and adjusting the EMCO Infinity II House Side
Shield is as simple as 1, 2, 3.
1. Open housing door.
2. Remove backing from tape on rear of front mask
and insert in front end of housing.
3. Slide House Side Shield under existing door mask

ments, any of the five IES Type
optical systems can be specified
in any size Infinity II. See lamp

For narrow roadways about one
mounting height wide, service
drives and walkways. Best
suited to median lighting of
roadways and to achieve maxi-
mum pole spacing on narrow
roadways and walkways.

IES Type II
For roadways up to 1 ~ mount-
ing heights wide. While distrib-
uting light street side, it still
maintains lateral distribution for
maximum pole spacing.

IES Type III
For roadways over 1 ~ mounting
heights wide. Light is distributed
primarily to the street side. Best
suited for perimeters and for
rectangulafshaped areas when
twin mounted.

Type V sa
For parking lot and area lighting.
This distribution allows poles to
be located in a square pattern
and still maintain required min-
imum values mid-point between
the four poles. By comparison,
a Type V round distribution
would take up to 440/0 more poles
and fixtures to achieve these
same minimum values.

For any application requiring a
forward throw distribution. Light
is reflected sharply in one direc-
tion and back light is minimized.
Best suited for car lots, tennis
