RYE, PLANNING DIRECTOR YES ....K- NO SEPTEMBER 11, 1995 PRESENTER: REVIEWED BY: PUBLIC HEARING: DATE: INTRODUCTION: The Planning Department received an application for a conditional sign permit from Minnesota Valley Community Church to allow 3, off-premises directional signs. DISCUSSION: Linda Hahn of Minnesota Valley Community Church (hereinafter the Church) contacted Planning staff several months ago. Access to the Church is from Timber Trail, which in turn is accessed from Fish Point Road. The Church has apparently received input indicating that new members and/or guests of the Church have had difficulty in finding the Church. For that reason, the Church wishes to locate 3, off-premises directional signs adjacent to Trunk Highway 13. Two ofthe signs would be located on the South side of the highway; one would be located on the North side of the highway. The proposed contents and construction of the signs is indicated on the attached application and drawings. Staff has been contacted by the 2 affected property owners, who indicated that they assent to the placement of the signs on their property along Highway 13. Section 5-7-6 of the Sign Ordinance provides, in significant part, as follows; Signs That Require a Conditional Sign Permit. ...A conditional sign permit may also be issued for a directional sign for any use which, in the determination of the Planning Commission, incurs substantial hardship from lack of reasonable identification as a result of the location. Such signs are limited to 25 square feet per side; the applicants propose signs that are 6 square feet in area. Such signs must also comply with the yard setback requirements of 16200 Eagle Creek Ave. S.E., Prior Lake, Minnesota 55372-1714 / Ph. Under Section 4.1 (K), the front yard setback from Highway 13 is 50 feet from the "planned right-of-way line". Given the topography of the subject sites, it is clear that signs which complied with the 50 foot setback would be of marginal visibility. There are situations (e.g. Green Heights Inn) where uses have been deemed severely handicapped by lack of visibility and identification. It appears to staff that this situation is distinguishable in a number of respects, however. First, the Church building itself is visible from Highway 13, and it seems that visibility suggest the direction of travel to reach it. Second, the Church is currently identified by a sign on its own property and along Highway 13. Perhaps this sign could be modified to provide directions to the site ofthe Church building itself. Finally, the hardship incurred in this case seems no greater than the hardship suffered by any other business which is lacking direct access from Highway 13. ALTERNATIVES: 1. Approve the conditional sign permit as requested by the applicant. 2. Deny the application because the Planning Commission finds the applicant does not incur substantial hardship from lack of reasonable identification as a result of the location. 3. Table or continue discussion of the item for specific purposes. STAFF RECOMMENDATION: Staff recommends Alternative 2 for the reasons set forth above.
