The following is an extract of the September 4, 1979
Prior lake City Council minutes:
Motion by Watkins to approve the subdivision
under Resolution 78-21 of Maves 1st lake
Addition on the basis of providing for the
alteration of the 75' at the building setback
line and contingent upon no sale of either lot
until the buildings are in conformance with the
platted property lines, seconded by Busse and
upon a vote taken it was duly passed.
A certified copy of the division of the subject parcel
(lot 18, Maves 1st lake Addition) is attached.

MINUTES of the Proce.dings of the Villag. Council of the Village of Prior lake In the County of Scott and Stote of
Mian.sota, Including all accounts audited by said Council.
Michael McGuire was present requesting Council IS approval for subdivision
of Maves 1st lake Addition via Resolution 78-21. The reason Council approval
is needed is the building set back line is 751 and the Resolution states
it has to be 801.
Marlis Bluedorn and Della Hotzler, adjacent property owners, were present
at the meeting. Mrs. Hotzler submitted a letter stating that care should
be taken when filling the land where her driveway is because she will have
problems with it. Also, she stated that when any buildings are put up, to
please make sure that the water run-off from the roof does not go on her
property because she cannot take any more water. Neither property owners
objected to the subdivision.
Motion by Watkins to approve the subdivision under Resolution 78-21 of
Maves 1st lake Addition on the basis of providing for the alteration of
the 751 at the building set back line and contingent upon no sale of
either lot until the buildings are in conformance with the platted
property lines, seconded by Busse and upon a vote taken it was duly
passed. .
The letter from Mrs. Hotzler is to be made part of the record.
The Council reviewed the proposed 1980 budget for the hearing scheduled
for September 17, 1979.at 8:30 PM. This is in conjunction with the 1980
Revenue Sharing Plan also scheduled for that date.
Motion by Watkins to adjourn, seconded by Bissonett and upon a vote taken
this meeting was adjourned at 9:18 PM.

Re: Lot 18, Maves 1st Addition
The appl icant is requesting the division of Lot 18, Maves 1st Lake
Addition via resolution 78-21. The appl ication meets the criteria
for division by resolution except that the new lots do have 80~
on a public road but the existing structures do not have legal
set-backs from side property 1 ines. A vast majority of the lots
in Maves Addition are 751 in width and similar acreage, therefore,
the lots are in continuity with the neighborhood.
The proper course of events with respect to division would be to
move all structures to conforming locations. However, it must be
recognized that the expense of lakeshore predidermined division
of this property. The most important factor in development of this
property is the final compliance to ordinance. Alternatives to
the set back problem is to place conditions on the division not
allowing the sale of either lot until the cabin is confmrming or
jerrymandering the property 1 ines around the buildings.

Gentlemen:
I am requesting the subdivision of 156' of Lot 18, Maves 1st
Lake Addition into two lots. Both lots will be considerably
larger in square footage than the Ordinance requires, but are
two feet short of the minimum width.
I have contacted the abutting property owners, and informed
them of what I was proposing, and informed them that it was
scheduled for the September 4, 1979 Council meeting.
There are currently three buildings on the parcel, a trappers
cabin built in the late 1800's, an old garage and a log home.
The old trappers cabin I plan on donating to an organization
such as the Historical Society. The garage will either be
renovated or torn down. The log home, before I can sell it,
will either be moved so it is on one lot, or the lot lines
adjusted in the future so that it would be on one lot.
I will be at the meeting to answer any questions that you
have. .

Dear Mr. Olson,
The City Council of Prior Lake reviewed an application to divide
Lot 18 Maves 1st Lake Addition at their regular scheduled meeting
on September 4, 1979. A motion was made by Watkins to approve the
subdivision in accordance with Resolution 78-21 contingent that
no sale of either lot occur until the buildings are in
conformance with the platted property lines. The motion was
seconded by Busse and upon a vote taken was duly passed.
Be advised that I have inspected tbe property and have determined
that all buildings referenced in the above motion have been
placed in total compliance with platted property lines and the
City Zoning Ordinance. Be further advised that all contingencies
in the matter of the division of Lot 18 Maves 1st Addition, Scott
County, that came before the City Council of Prior Lake on
September 4, 1979, have been fully satisfied.
