Maintenance of Access Road The access road serving Lots 79 thru 88 Northwood, is a private drive of which the city does not own or possess any street or driveway easements. Therefore, it is a drive the city does not maintain or assume any responsibility for. The proposed redevelopment of Lot 89 Northwood will not have an impact on the traffic of the access road, as this property is accessed directly from Northwood Road. 2. Noise You are concerned about disturbing noise in your neighborhood. The city has several ordinances relating to noise including barking dogs, operation of combustible engines including construction equipment, and disturbing the peace in general. I have enclosed a copy of the combustible engine ordinance. Basically, such equipment cannot operate before 6 a.m. or after 10 p.m. Monday thru Friday. Should you have a questioning or complaint regarding barking dogs or disturbing the peace, please call the police department at 440-3555. 3. Water You are questioning water run-off in the Northwood area. Please be advised the city does not have drainage easements on the lots as we do in newer subdivisions. Therefore, it is more difficult for the city manage storm water run-off on a neighborhood basis. Water run-off is dealt with on a per lot basis when redevelopment of the lot occurs under the building permit process. In regards to the public notice sent to you regarding Lot 89, Northwood, the Planning Commission approved the variances and house location. Drainage will be dealt with when a building permit is applied for. If you are interested in learning more about this particular site development please call me. Information regarding the access road and water drainage are engineering issues. Please fell free to contact the Verlyn Raaen in the engineering department about your concerns. (Ord. 73-12, 7-2-73) OFF-ROAD VEHICLE: Any vehicle which is capable of and is being operated off the public roadway. By way of example but not by limitation, motorcycles, all train vehicles, tractors, four (4) wheel drive jeep-type vehicles. ,It is further specified that an off-road vehicle shall not include a snowmobile. (1979 Code) 11-3-2: OPERATION OF COMBUSTION ENGINES; EQUIPMENT: (A) No combustion engine, except a chain saw, shall be operated within the City without a muffler which will effectively muffle the exhaust noise of the engines. Said engines must have standard mufflers securely anached and not readily disconnected and must remain in constant operation and must reduce the noise of the operation of the motor to the minimum necessary for II""" -' y 11-3-5 11-3-6 11-3-5: PROHIBITED OPERATIONS: (A) The operation of any combustion engine for purposes of harassment of any resident of the City is prohibited, and no such engine shaff be operated so as to create loud and excessive noise or in any way to unduly disturb the peace and privacy of the residents of the City in such a manner as to create a public nuisance thereby. (B) It shaff be illegal to operate any combustion engine or off-road vehicle in a careless, reckless or negligent manner so as to endanger any person or property of another, or to cause injury or damage thereto. (C) It shall be illegal to operate any off-road vehicle while under the influence of intoxicating liquor, narcotics or habit forming-drugs. (0) No person shall permit a use of his premises or his property by any off-road vehicle or combustion engine in violation of the provisions of this Chapter or the statutes of the State. The owner or person in possession of the premises shall be deemed to have permitted the use, as specified in this subsection, under either of the following circumstances: 1. If said owner has granted written permission to the operator, or "_ 2. A parent permitting the use of property by a minor child in violation of this Chapter. (Ord. 73-12, 7-2-73) 11-3-6: VIOLATION; PENALTY: Any person violating the terms of this Chapter shall, upon conviction thereof, be found guilty of a misdemeanor and shall be puniShed by a fine not exceeding five hundred dollars ($500.00), or by imprisonment for a period not exceeding ninety (90) days, or both. Prior Lake, MN 55372-1714 Dear Sirs: I would like answers in writing, to three quick points. (1) Maintenance of Access Road: The access road down to these lots has a very delicate balance; more traffic and/or grading could mean more water down the access road. Furthermore, it is believed Prior Lake should maintain this access road, because there is a fire hydrant on the little road. If there is a fire with property damage, or "Heaven Forbid" personal injury or death, the City of Prior Lake will be 100% liable. (2) Noise: Because I do computer work in my home, I am concerned about disturbing noise at all hours. What are the rules on noise? What is the penalty? (3) Water: Because the construction is a couple lots down from me, it does not directly apply. But heavy rains are a big problem down here. The City of Prior Lake should look at water drainage closely, because City should have to pay for excess water damage. Having submitted my concerns in writing, hopefully, you will also write me back.
