Dear Dave,
The Planning Department has reviewed your preliminary request to place a
communication tower on the Vierling property located in the NE~ of SW~ of
Section 24, T 115N, R22 W (PID 25-924-003-0). The property is zoned A-1.
Towers are permitted uses in the A-1 zoning district. Because this property is
located in the rural service area, as defined in the Comprehensive Plan, the
following must be complied with:
1. A tower with antenna is located at least 250' from the centerline of a
public road.
2. The tower and antenna has setbacks equal to one half the height
measured from the base to its highest point.
This property is designated as Agricultural Preserve. The restrictive covenants
for the agricultural preserve states that" wetlands, pasture and woodlands
accompanying land in agricultural use shall be deemed to be an agricultural
use." Therefore, if the proposed tower location is located in a woodland or
pasture it would not be taking away from land being used as specified
agricultural uses as defined in the covenants, and would be permitted. Please
submit a letter from the property owner stating what type of use the land for the
tower is currently being used for as defined in the covenants. Additionally, the
property is not being subdivided, nor is a residential unit being constructed for
the proposed project. Thus, the Planning Department has determined the
proposed use of the property for a communications tower is permitted
within the current zoning ordinance, provided the proposed location is in
an existing woodland or pasture.
We have discussed this with the Department of Agriculture, and they do not
object considering the proposed tower would not be utilizing any land with a
specific agricultural purpose (wetland, woodland or pasture). They also stated
the jurisdiction for such a decision is left to the city.

As we have discussed, the procedure prior to obtaining a building permit is that
of site plan review. Enclosed is an application. Additional application materials
include a survey, tree preservation plan, proposed site plan layout (buildings,
tower, driveway, etc.) building plans and engineering of the proposed structure.
The application fee is $300.00 non-refundable. This fee is separate from the
building permit fee.
The proposed project will be reviewed by an internal committee (Development
Review Committee) consisting of representatives from various city departments.
The DRC meets every Thursday, however, your application must be submitted
no later than one week before the DRC meeting. You do not have to be present
at the meeting. Please submit your application to the Planning Department,
attention to Jane Kansier, DRC Planning Coordinator. She will schedule your
project for a meeting and coordinate the DRC review. Once DRC approval is
given, you can apply for a building permit.

As you are aware, Nextel Communications is attempting to expand coverage of their
Enhanced Specialized Mobile Radio "ESMR" service in the Prior Lake and Savage areas.
Initially, Nextellooked to existing structures on which to locate their antennas (those sites
are noted below) but were unable to secure a location which fits within their radio plan.

* The City of Prior Lake template lease agreement is a "take it or leave it" document
which cannot be altered to include financing language which Nextel requires.
** Although the location fits the radio plan, Savage restricted the location on the
water tank that the antennas could be mounted resulting in a failure of the radio plan.
The next step for Nextel has been to consider a ground build location where they would
construct a communications tower for placement of their antennas. With your
departments suggestion, a location has been selected which fulfills Nexte1's radio plan.
The property located in the NEl/4 SWII4 of Section 24, T115N, R22W (Pill 25-924-
003-0) which is owned by the Vierling family, although north and west of the intended
search area, would fulfill Nextel's required criteria and the Vierlings are amenable to

Location of a telecommunications site on Vierling property
Ms. Tovar:
Based on your recommendation that the City of Prior Lake may be more flexible regarding their
template "Water Tower Antennae Agreement", I again contacted Mr. Ralph Teschner regarding
the issue.
As Ralph had conveyed on January 06, 1998 and again confirmed this morning, his and the
City's position on the template agreement is as follows:
· The City adopted this as their standard agreement on November 4th, 1996 (resolution 96-
106).
· Several other carriers have executed the agreement "as-is" after attempting to modify the
agreement to fit their specific needs.
· Due to the amount oftime that would be required for the city to negotiate and modify the
agreement on a case by case basis, it is not cost effective for them to do so.
· The opinion was and still is that the agreement is to be executed in it's current format.
Nextel, due to restrictions placed on them by their lenders, must have language incorporated into
every agreement. Since the City is unwilling to add this language, Nextel is simply unable to
enter into the agreement.
We greatly appreciate your time and assistance in finding an alternative to the City's water tank.
The information you have requested regarding the placement of a monopole at the Vierling
property is being completed and should be available to you by late next week or early the
following. If I can be of any further assistance, please do not hesitate to call.
