Dear Mr. Corbett,
On January 20, 1998 the City of Prior Lake received a vacation application from you. On
January 30, we sent you a letter explaining what additional information needed to be
submitted in order for processing of your application to proceed. It has been three
months since we notified you of this and we have not heard anything from you. You
have expressed your intentions to wait for adoption of the new Zoning Ordinance and to
discuss the vacation with other property owners in Flagstaff Circle. Therefore, we are
closing the file and sending your original application back to you. If you would like to
proceed with your variance request, please re-submit the application materials, survey and
fee along with the following additional information as previously requested:
. Names and addressed of adjacent property owners of the proposed property to be
vacated. We will need the printout from the county and the names and addresses
on mailing labels. Signatures of property owners adjacent to the vacation should
sign the application or written petition.
· Survey with legal description of property to be vcacated. One full size survey and
one 11" by 17" reduction is necessary.

Dear Mr. Corbett:
On January 20, 1998 the City of Prior Lake received a vacation application from you.
The following information is necessary to continue review of your application:
. Complete and accurate legal description of the property to be vacated. I have
enclosed two samples of a legal descriptions. A legal description is based on
dimensions and measurements starting with an existing legal description of a
property and measuring a certain distance from existing lot lines and property
comers. You can write this yourself, but it must be correct and accurate.
. The survey submitted is not a complete survey. It must include a surveyors stamp
and signature.
. The area indicated to be vacated does not match the description written on your
application. The drawing and legal description must match.
. Names and addressed of adjacent property owners and across the street are
required. This list must come from the Scott County Auditors Office. The names
should also be printed on mailing labels.
Once we receive the necessary information, the notice of public hearing for vacation will
be published in the newspaper. Should your vacation be approved, the legal description
must be drafted by a registered land surveyor and a revised survey indicating the area
vacated must be submitted prior to recording. Please call me if you want to set up a
meeting or have any questions answered.

Your building permit submitted October 3, 1997 is being denied for the following reasons:
. Proposed garage does not meet 25 foot front yard setback requirement.
To proceed with the project as planned, the following must be completed or approved:
. Application for vacation must be received and approved by the City Council. I have given
an application to Mr. Corbett. Part of the application includes a fee, names and addresses of
adjacent property owners, complete legal description of the proposed property to be vacated
and legal description of property with and without the proposed vacated property and a
petition or letter with names, addresses and signatures of all property owners who own land
adjacent to the proposed vacation site; or
. A variance to the front yard setback be applied for. Please call me if you would like to
further discuss this option.
Please be advised that the City of Prior Lake is in the process of adopting a revised Zoning
Ordinance. The Planning Commission has recommended that City Council adopt the revised
ordinance. City Council action is anticipated in January. The revised ordinance will have an
effect on comer lots and setbacks. Enclosed is draft language relating to side yards abutting
streets and the required setback in the R-1 Zoning District. Please call me if you have any
