CONSIDER APPROVAL OF THE 2008 PRIOR LAKE OUTLET CHANNEL
JOINT POWERS AGREEMENT (JPA) PAYMENT
Introduction
The purpose of this agenda report is to approve the City of Prior Lake's 2008
Prior Lake Outlet Channel JPA payment.
Historv
On June 18, 2007 the City Council approved the Prior Lake Outlet Channel
Joint Powers Agreement with the City of Shakopee, Prior Lake Spring Lake
Watershed District and Shakopee Mdewakanton Sioux Community. As part of
that agreement the City agreed to make annual contributions towards
maintenance and improvement of the outlet channel.
Current Circumstances
In accordance with the JPA the City has received our 2008 Invoice in the
amount of $223,208. This amount includes $73,208 required as part of the
JPA for maintenance and improvements made prior to execution of the
agreement.
There are no issues associated with this item.
Funding for this payment is available from the Water Quality Fund and Trunk
Reserve Fund in the amounts of $35,000 and $188,208 respectively.

2) Deny this agenda item for a specific reason and provide staff with direction.

A RESOLUTION APPROVING THE 2008 PRIOR LAKE OUTLET CHANNEL JOINT
POWERS AGREEMENT PAYMENT

WHEREAS, The City of Prior Lake, Prior Lake Spring Lake Watershed District and the City of
Shakopee have executed a Joint Powers Agreements for the maintenance of the Prior
Lake outlet channel; and,
WHEREAS, The City of Prior Lake, Prior Lake Spring Lake Watershed District, City of Shakopee
along with the Shakopee Mdewakanton Sioux Community have drafted a
Memorandum of Agreement as a companion agreement for the same purpose; and,
WHEREAS, Restoration and maintenance of the Prior Lake outlet channel is consistent with
environmental goals set forth in the City Local Surface Water Management Plan and
those set forth in the City of Prior Lake 2030 Vision and Strategic Plan.
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. The 2008 JPA payment in the amount of $223,208 to the Prior Lake Spring Lake Watershed
District.
3. The funding shall be allocated as follows: $35,000 from Water Quality Fund #49420-530,
$188,208 from Trunk Reserve Fund #502-50081-501
