OF A FEASIBILITY REPORT FOR THE 2009 RECONSTRUCTION
IMPROVEMENT PROJECT, CITY PROJECT #09-011
Introduction
The purpose of this agenda item is to initiate the process for local
improvements set forth in the 2009 portion of the 2009-2014 Capital
Improvement Program in accordance with Minnesota Statutes (M.S.), Chapter
429.
Historv
The City uses the Five Year Capital Improvement Program and a Pavement
Management Program to plan its infrastructure improvements and the
financing for capital improvements. The proposed 2009 street reconstruction
program includes street and utility improvements to the Brooksville Hills
neighborhood. This is the second year of a two year program to update the
streets within this neighborhood.
The M.S. Chapter 429 process applies to all projects that will be financed in
whole or part through special assessments or bond proceeds. The first step in
the process is for the Council to order the preparation of a Feasibility Report
for the improvement projects.
The Feasibility Report will address street reconstruction in the Brooksville Hills
neighborhood. In particular for the following streets: Mandan Avenue, Franklin
Circle, Robinson Circle, Summer Street and Itasca Avenue from Summer
Street to Crossandra Street.
Current Circumstances
This project is in the 2009 Capital Improvement Program. The project requires
special assessments and financing through bond proceeds, and therefore
requires the City to follow the requirements of M.S. Chapter 429.
As the Council is aware there are several areas of the City where current
street conditions are quickly deteriorating. As a measure to try to maintain
these areas until full street reconstructions can be performed as detailed in the
1 O-year Transportation Plan staff is proposing to include a neighborhood
resurfacing project with the 2009 reconstruction project. As part of the
feasibility study staff will include estimated costs to resurface the Blind Lake
Trail neighborhood. This neighborhood is not scheduled for reconstruction

until 2018. The Blind Lake Trail area bituminous will be completely
deteriorated prior to 2018 without some significant maintenance.
ISSUES:
The City is required to assess a minimum of 20% of the cost of a public
improvement project completed through the Chapter 429 process and financed
through G.O. bonds. The City will meet the minimum assessment
requirement. The Feasibility Report will determine the estimated costs of the
improvements and identify methods of financing. This 2009 project is
expected to involve 40% assessments for all benefited parcels.
The preparation of the Feasibility Report is only the first step in the public
improvement process. Following receipt of the Feasibility Report, the Council
can schedule a Public Hearing to move forward. Following the Public Hearing,
the Council may consider authorizing the preparation of plans and
specifications. Once completed, the City Council would be asked to approve
the plans and specifications, and authorize advertisement for bids and finally
award a contract. The City is not committed to doing the project at any of the
steps outlined above prior to awarding the contract. The following schedule
outlines an approach to complete the 2009 project.

The Feasibility Report will be completed using City Staff. Soil borings and
preliminary surveying were authorized and performed in 2008 in conjunction
with the 2008 reconstruction project.
The additional costs associated with resurfacing the Blind Lake Trail area will
be included in the study for City Council review. Staff believes these costs will
be less than $100k and can be included in the project bonding with minimal
impact to the taxpayers.
ALTERNATIVES:
There are three alternatives for the City Council to consider:
1. Approve a resolution ordering preparation of a Feasibility Report for
Street reconstruction for Mandan Avenue, Franklin Circle, Robinson
Circle, Summer Street and Itasca Avenue from Summer Street to
Crossandra Street and resurfacing of the Blind Lake Trail area.
2. Deny this item for a specific reason and provide staff with direction.
3. Table this item until some date in the future

A RESOLUTION ORDERING PREPARATION OF FEASIBILITY REPORT
FOR THE 2009 RECONSTRUCTION IMPROVEMENT PROJECT

WHEREAS, it is proposed to construct improvements for Mandan Avenue, Franklin Circle, Robinson
Circle, Summer Street and Itasca Avenue (from Summer Street to Crossandra Street),
including the construction of storm sewer, sanitary sewer and watermain repairs,
aggregate base, concrete curb and gutter, bituminous surfacing, street lights, and
appurtenant work; and
WHEREAS, certain streets in the 1 O-year transportation plan will need substantial maintenance
prior to reconstruction and staff has identified Blind Lake Trail as a candidate for
maintenance resurfacing; and
WHEREAS, staff will include the maintenance resurfacing costs in the feasibility study for City
Council consideration for inclusion in the 2009 reconstruction project; and
WHEREAS, it is proposed to assess the benefited property for all or a portion of the cost of the
improvements, pursuant to Minnesota Statutes, Chapter 429,
NOW THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE,
MINNESOTA as follows:
1. The recitals set forth above are incorporated herein.
2. That the proposed improvements be referred to the City Engineer for study and that the City
Engineer is instructed to report to the Council with all convenient speed advising the Council in a
preliminary way as to whether the proposed improvements are necessary, cost-effective and
feasible and as to whether they should best be made as proposed or in connection with other
improvements, and the estimated costs for the improvements as recommended.
3. The City Engineer is directed to solicit quotes for surveying, televising, and soil borings for the
project.
