RE: NON-CONFORMING BOATHOUSE, UPPER PRIOR LAKE
Dear Mr. & Ms. Elshaw:
At the request of Cheri Elshaw, I, along with Jenni Tovar of the City of Prior Lake, inspected the failing boathouse on
your P&vperty on May 20, 1998. The two-story structlU'e is constructed into the side of the bank, and extends into Prior
Lake. The structure is in a state of disrepair. Current regulations at both the state and local level prohibit the
reconstruction of the boathouse to its current dimensions or at its current location.
Minnesota Rules 6115.0210, subp. 3, states, in part, that the placement of structures in protected waters shall not be
permitted where the structure is designed or is intended to be used for human habitation or as a boathouse, or is
designed or intended to include walls, a roof, or sewage facilities. Your existing failing structure, historically used for
a boathouse, has an upper level with walls and roof, and contain a sink, range, and heater. It appears it is, or may have
been, suitable for human habitation.
The City of Prior Lake administers and enforces a shoreland zoning ordinance. Their zoning ordinance does not allow
for the reconstruction of the boathouse. It is an existing nonconforming structure. That is, the boathouse was
constructed before land use controls prohibiting it were in adopted.
I recommend the structlU'e be removed and the bank restored. I observed several of the structural support components
of the boathouse were broken, and attempts have been made to shore up the walls of the lower level. In my opinion,
the boathouse in its current state represents a potential hazard.
Should you choose not to remove the boathouse at this time, and it fails completely and falls in to the lake, you will be
ordered to remove it. It may be easier (and less costly) to access the structure now rather than waiting until it has
completely failed. Once it is in the lake, it will be rather challenging to get the appropriate equipment along shore to
remove the debris from the lake and shoreline.
