RE: Lot Line Dispute
Mr. Hechter:
On October 20,1998, Steve Horsman, Zoning Administrator, met with you at 5101
Gateway Street to discuss the recently added parking area east of Snyders. The
additional parking is not compliant with your proposed site plan approval. However, the
parking is in excess of the required parking.
Additionally, it has been brought to our attention that the additional parking may have
been placed over the lot line and on the property of the adjacent old Park Nicollet Clinic.
Based on our site inspections on October 14 and October 20, 1998 and the site plan
approved August 20, 1998, it appears your additional parking was constructed over the
lot line.
The city is considering this matter to be a private property line dispute. Attached is a
survey provided to us by the owners of the adjacent building and where you can contact
them to resolve this issue. Once the issue has been resolved, please inform me of the
outcome as it could affect the parking on your site.

RE: Snyder's Drive-thru Window
Mr. Hechter:
On August 20, 1998, the City approved a site plan to accommodate a drive-thru window
for Snyder's drugstore. Part of that approval required additional parking to be
constructed on the site. Based on an inspection on October 6 and October 14, it
appears the parking added to the west of the existing building in excess of the approved
plans and is located off of your property.
At this point, you must remove the parking area that is not located on your property or
obtain written permission from the adjacent property owner to pave the adjacent parking
area. If this parking is to accommodate parking for your site, an easement should be
obtained and recorded. Should you choose to remove the excess parking area, we
would suggest you work with adjacent property owner (Park Nicollet) to restore the site.
Please contact me by October 26, 1998 with your solution to resolving this matter.

Dear Mr. Leonard:
This letter serves as the City of Prior Lake's approval of your site plan to
accommodate a drive-thru window. Enclosed is a copy of the stamped approved
plans. A building permit is required for the 5 foot opening to be placed in the
masonry wall for the window. In an effort to expedite the process of your project,
we are approving the site plan with the contingency that the building permit for
the window will not be issued until the site work (new parking and traffic island
with established turf or landscaping) is completed or a LOC for 125% of the cost
of the work is received to guarantee completion of the project as approved. If
you choose to submit a letter of credit, cost estimates for the project must be
submitted and approved by the City Engineer.

Dear Mr. Leonard:
The City of Prior Lake Development Review Committee has reviewed the plans
you submitted for the drive-through window at the Snyder's store. We have a
number of concerns about this plan.
First of all, the dimensions on your site plan are not consistent with the
dimensions of the lot shown on the subdivision plat (see attached). Based on
the measurements on the site plan, a portion of the proposed new parking will be
located on the adjacent lot. In addition, the site plan you submitted is
inconsistent with the existing conditions on the site. For example, the actual
parking arrangement does is different than the arrangement shown on the site
plan. It is unclear whether you intend to rearrange the parking on the entire site.
An as-built survey may be necessary in order to clear up these discrepancies.
In terms of the actual design of the drive-through aisle, we also have some
suggestions. Your plan seems to indicate 2 lanes of traffic in addition to the
drive--through aisle. There does not appear to be enough room on the site to
accomplish this. We suggest the drive-through aisle be delineated from the
traffic lanes with curbing and landscaping. Furthermore, there should be no
more than one drive aisle, if that, between the curb and the building.
In the new parking area, there is not adequate width between the parking stalls
and the property line for turning movements. This area must also be redesigned.
In conclusion, the plans you submitted require modification before we can
approve the drive-through window. Once you have revised the plans, please
submit at least 4 full scale copies and one 11" by 17" reduction. The DRC will
then revisit this issue. In order to facilitate the review of this project, all plans
must be submitted to me.

I have received your proposal for a drive-up window for the Snyder Drug Store at 5101
Gateway Street in Prior Lake, MN. In order to provide a thorough review of this request, you
must provide the following information:
1. A site plan for the entire center, showing the building and the total number and layout of
parking spaces on the site.
2. A more specific plan for the drive-up area, including the delineation of the driving lanes,
the separation of the driving lane from the parking area, and and turning movements.
Please submit at least four full-scale copies of these plans, and one 11" by 17" reduction.
Once we have received this information, we will proceed with the review of this project.
Commercial projects such as yours require site plan review and approval by the City
Development Review Committee (DRC). The DRC consists of representatives from each
City Department, and is responsible for ensuring the plan meets all City Code requirements.
This is not a public review process; rather, the staff will review your plans and inform you of
any required changes. If the plan does not meet City Code, we can inform you of the
appropriate review process. .
