above transactions. We have also placed the approval stamp on each deed.
As I mentioned to you earlier, the end result of this transaction must be a single lot
owned by Mr. Shanks. In order to accomplish that, he must record a deed with the total
legal description, or somehow establish a single PID number for the new lot.

RE: Site Plan Review for Addition to NBC Products Building
Dear Mr. Shanks:
The City of Prior Lake has completed its review of the site plan for the addition to the NBC
Products building. The following changes or additions must be made before we can approve the
site plan:
1. The required parking setback along Fish Point Road is 30 feet. Your plan shows a 15'
setback. This must be revised.
2. The loading area must be screened with a 4' tall berm and plantings so the total height of the
screen is 6 feet.
3. A 30" berm is required for parking lot screening.
4. A cost estimate for the landscaping is required. A letter of credit equal to 125% of the
landscaping cost estimate will be required before the building permit is issued.'
5. Please verify the number of employees so we can verify your parking requirements. The
parking area shown is adequate for 12 employees.
6. The plans must indicate how roof top equipment will be screened.
7. The building and engineering issues outlined in the letter to Terri Cermak from Bob Hutchins,
dated May 12, 1998, must also be addressed.
Please submit four sets of revised plans addressing the above issues. Once your plans are
approved, we can proceed with the building permit.
This letter is also to notify you the administrative land subdivision has been approved. The City is
working with our attorney to establish a closing date. Once you have officially purchased the
property, and all the plans are approved, we will issue a building permit.

The Prior Lake Planning Department has received an application from the City of Prior Lake
Economic Development Authority (16200 Eagle Creek Avenue SE, Prior Lake, Minnesota)
to consider an Administrative Land Division for the property identified as a part of Lot 1,
Block 2, Waterfront Passage Addition. The proposal is to add an additional acre ofland to
the NBC Products site, thereby creating a 3 acre parcel. The purpose of this subdivision is to
allow an addition to the NBC Products building.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the City Manager or
representative to authorize subdivision approval without a public hearing under the following
circumstances:
1. The division of the parcel will not result in more than three parcels.
2. The property to be subdivided is a lot of record in the office of the County Recorder of
Scott County.
3. The resulting parcels generally conform to the shape and area of existing or anticipated
land subdivisions in the surrounding areas.
4. The division will not cause any structure to be in violation of setbacks.
5. Any easements which may be required by the City must be granted.
6. The owners of the land contiguous to the parcel must be notified in writing, and !!!!..

7. Any written objection shall constitute an appeal. Such an objection shall be forwarded
to the City Council who shall hear the objection and decide the matter.
