This letter is to inform you that your application to subdivide a half acre from the City's
lot in Waterfront Passage Business Park, as shown on the attached survey, has been
approved. The City is requiring a 20 foot drainage and utility easement on the northerly
lot line and easterly lot lines of the parcel to be conveyed. Please have your surveyor
submit the legal description for the easements along with a revised drawing to include
the easements. Once we receive this information, we will draft the deeds to be signed
at the closing. There is a special assessment of $6745.18 that is due upon closing for
this property.
You should also be aware, that when a building expansion is contemplated, the existing
drainage and utility easements will have to be vacated prior to the issuance of a building
permit.

RE: Administrative Lot Split to add .52 Acres to Existing Site
Dear Mr. Horkey:
The City of Prior Lake is proceeding to divide a portion of property from Lot 1, Block 2,
Waterfront Passage Addition to convey to you. The enclosed survey ~ submitted does not
adequately reflect the survey required to complete the lot split. The entire Lot 1, Block 2 of
Waterfront Passage must be indicated including the portion to be conveyed. The existing
legal descriptions and proposed legal descriptions must be on the survey. The revised
survey must show your existing lot and the property you are purchasing as one lot and the
remainder of Lot 1 Block 2 as another lot.
I have contacted Pioneer Engineering regarding the revision. Considering you have paid for
the survey, any revisions must be ordered by you. I have explained to Pioneer what
additional information is necessary. Once we receive the revised survey, we will process
the administrative land subdivision so the deed can be recorded. It is our intention to
process the application in a timely manner.

NOTICE OF PROPOSED ADMINISTRATIVE LAND DIVISION
July 17, 1998
The Prior Lake Planning Department has received an application from the City of Prior Lake
Economic Development Authority (16200 Eagle Creek Avenue SE, Prior Lake, Minnesota)
to consider an Administrative Land Division for the property identified as a part of Lot 1,
Block 2, Waterfront Passage Addition. The proposal is to add an additional half an acre of
land to the Keyland Homes site, thereby creating a 2.14 acre parcel. The purpose of this
subdivision eliminate an otherwise remnant parcel and to provide additional land for a future
addition to the Keyland Homes building.
Section 6-1-3 of the Prior Lake Subdivision Ordinance allows the City Manager or
representative to authorize subdivision approval without a public hearing under the following
circumstances:
1. The division of the parcel will not result in more than three parcels.
2. The property to be subdivided is a lot of record in the office of the County Recorder of
Scott County.
3. The resulting parcels generally conform to the shape and area of existing or anticipated
land subdivisions in the surrounding areas.
4. The division will not cause any structure to be in violation of setbacks.
5. Any easements which may be required by the City must be granted.
6. The owners of the land contiguous to the parcel must be notified in writing, and no
written obiection received within ten davs followinf! notification.
7. Any written objection shall constitute an appeal. Such an objection shall be forwarded
to the City Council who shall hear the objection and decide the matter.
A copy of the Administrative Land Division is attached. Please accept this as official
notification of this proposed Administrative Land Division. Written comments or objections
regarding this matter should be submitted to the Planning Department by July 28, 1998. For
