A RESOLUTION APPROVING A VARIANCE TO REDUCE THE REQUIRED
NUMBER OF PARKING SPACES FROM 24 TO 19 FOR A CONVENIENCE
STORE/CAR WASH
BE IT RESOLVED BY the Board of Adjustment of the City of Prior Lake, Minnesota;
FINDINGS
1. Holiday Station Stores has applied for a variance from the Zoning Ordinance in order
to permit the construction of a car wash addition to an existing structure on property
located in the B-3 (General Business) District at the following location, to wit;
16800 Duluth Avenue SE, legally described as follows:
Lot 1, Block 2, Brooksville Center 2nd Addition, Scott County, Minnesota,
except for the following described parcel:
That part of Lot 1, Block 2, Brooksville Center 2nd Addition, Scott county,
Minnesota, lying Northerly of the following described line: Beginning at a
point on the westerly line of said Lot 1, distant 170.00 feet southerly of the
northwest comer of said Lot 1; thence northeasterly parallel to the northerly
line of said Lot 1, a distance of 192.59 feet more or less to its intersection with
the easterly line of said Lot 1, and there terminating
2. The Board of Adjustment has reviewed the application for variances as contained in
Case #98-116 and held hearings thereon on September 14, 1998.
3. The Board of Adjustment has considered the effect of the proposed variances upon
the health, safety, and welfare of the community, the existing and anticipated traffic
conditions, light and air, danger of fire, risk to the public safety, the effect on property
values in the surrounding area and the effect of the proposed variances on the
Comprehensive Plan.
4. Because of conditions on the subject property and on the surrounding property, it is
possible to use the subject property in such a way that the proposed variances will not
result in the impairment of an adequate supply of light and air to adjacent properties,
unreasonably increase congestion in the public streets, increase the danger of fire, and
danger to the public safety, unreasonably diminish or impair health, safety, comfort,

morals or in any other respec be contrary to the Zoning Ordinance and
Comprehensive Plan.
5. The property was platted in 1979 d the first gas station was constructed in 1980. In
1996 a major renovation of the si e commenced. There is a 25 foot wide private
easement on the property, located 0 the south lot line. This easement is to allow thru
access to the Dairy Queen. The easement results in the use of land that could
otherwise be used to accommodate equired parking.
6. The ordinance does not presently al ow us to count the spaces at the pump islands as
parking spaces. There are 8 pumps, with 2 parking spaces, each on this site. If these
parking spaces are included, the ap licant would exceed the required parking for the
use. The intent of the required par . g spaces is to ensure adequate on site parking
for the use, and to ensure parking d es not encroach onto the public right-of-way, or
adjacent properties. The proposed u e requires 24 spaces. The applicant has provided
15 spaces, along with the 16 spaces t the pumps. This number is consistent with the
intent of the ordinance.
7. The granting of the variances are n cessary for the preservation and enjoyment of a
substantial property right of the app icant. The variances will not serve merely as a
convenience to the applicant, and e necessary to alleviate demonstrable hardship.
The factors listed above do not all w for an alternative reasonable location for the
closet addition to be permitted witho t the variances.
8. The contents of Planning Case 98-1 6 are hereby entered into and made a part of the
public record and the record of decis on for this case.
CO CLUSION
Based upon the Findings set forth abov , the Board of Adjustment hereby approves the
following variance, as shown in attached Exhibit A for proposed car wash addition;
1. A variance to permit 19 parking s aces rather than the required 24 parking spaces
for a the Holiday motor fuel stati n and retail store combination.

Considering the proposed vacation is consistent with the Comprehensive Plan and will
not eliminate a public need, staff recommends approval of the vacation of the drainage
and utility easements.
Kuykendall questioned ifthe City is assured easements will be granted. Tovar said the
property owner is EDA. Documents have been drafted and just have to be signed and
recorded.

permit and variance to construct a car wash for the property at 16800 Duluth
Avenue.

Planning Coordinator Jane Kansier presented the Planning Report dated September 14,
1998 on file in the office of the City Planner.
The staff recommends the requested variance be granted. The use of the spaces at the gas
pumps allows adequate parking on the site, and meets the intent of the ordinance.
The proposed use is generally consistent with the standards for conditional uses. The use
would be appropriate to the proposed location and blend into the neighborhood.
However, before the plans are approved, the following items must be addressed:
1. A new survey showing existing conditions must be submitted. The survey submitted
with the application shows the former buildings which have since been removed.
2. A site plan showing the complete site and the stacking for the vehicles waiting to use
the car wash must be submitted. This site plan should also identify traffic movements
on the site.
3. Extend the curbing and landscape area to the east side ofthe existing building to
better delineate the stacking and driving lane for the car wash.
4. Redesign the 4" sanitary sewer service so that it is not connected into the manhole.
The clean out on this service line must not be located within the public right-of-way.
5. Provide specifications and pavement sections for the parking lot replacement.
6. Car wash runoff must be discharged according to State requirements. The plans must
identify how these requirements are met.
7. The Landscape Plan be modified to include landscaping of the entire site as approved
in Building Permit 96-471 (new station). Any dead/disturbed/missing trees are to be
replaced as part ofthe CUP.
8. A Conditional Sign Permit will be required as part ofthis CUP.
The staff recommended the Planning Commission direct staff to prepare a resolution
approving the variance for the required number of parking spaces, and continue the public
hearing on the Conditional Use Permit to a date and time certain to allow the developer to
provide additional information specifically requested by the Planning Commission.
Comments from the Public:
John Beregi, representing Holiday Station Stores, 4567 West 80th Street, asked the
Commissioners to approve the variance and conditional use permit with staffs conditions
and move on to the City Council. All the conditions can and will be met for some reason
they are not on the plan. Mr. Beregi presented the proposed plan addressing the

conditions. The plan did not show a vacuum which will be built. The car wash was in
the original building addition plans. The addition did not have to go before the City but
the car wash issue did because it is a conditional use.
Cramer questioned the shared easement off Highway 13 with Dairy Queen. He also
questioned the joint parking with Dairy Queen. Kansier pointed out most of the parking
takes place on the Dairy Queen site. The City wants to make sure stacking does not occur
on the Dairy Queen property.
V onhof questioned the common easement and pointed out driving occurs on both sites.
Comments from the Commissioners:
Stamson:
. Does not agree with staff on the variance hardship criteria being met. The sticking
points are the literal enforcement ofthe ordinance would result in undue hardship with
respect to the property. The buildings did not exist at the time the ordinance was written.
The ordinance predates the current buildings.
. The applicant decided to build and did not leave enough parking places. In my mind
the variance hardships have never been met.
. Parking spaces should be counted at the pumps.
. No problems with the Conditional Use Permit. Agreed with items set forth by staff.
. In summary - does not support the variance but does support the conditional use
permit.
Cramer:
. Feels the variance hardship have not been met.
. The definition of parking space for convenience stores should be looked at. This
should not be part of the variance but addressed in the ordinance.
. Agreed with staff s recommendation to continue the conditional use permit.
. Kansier responded staff would make sure conditions are approved before the matter is
before the Council.
V onhof:
. Disagreed with Commissioners.
. The pump spaces should be included with the parking spaces. The majority of people
go to Holiday for gas. Would include the pump spaces.
. The variance hardship has been met.
. Agreed with staff, the store is constrained by the property.
. Would like to see a condition showing an actual flow plan including how the vehicles
are going to be stacked. Show signage.
. Traffic problem on the east side (Duluth Street), recommend either a stop or yield
sign be included.
. Regarding the Conditional Use Permit - No problem having the applicant make the
conditions in the staff report.

Beregi said they are in excess of parking now. If the islands are back in, there would be
24 spaces. Beregi pointed out the car wash was in the original plans for the new building.
This is not a large store and feels constraints with the easements surrounding the
property .
Cramer:
. Feels he can make a case for meeting the hardship criteria. This is not a regular store,
it is a service station. Applicant meets the spirit and intent ofthe ordinance.
Stamson:
. Agreed with Vonhofs point that applicant is sitting on a unique parcel for a service
station and make for a reasonable case for some ofthe variance hardships.
. This is better addressed through an ordinance change.
. Variance hardship is marginally made with regard to parking.

At the September 14, 1998 Planning Commission meeting, the Planning
Commission considered a request by Holiday Station Stores for a variance to the
required parking spaces to allow a car wash addition on the property at 16800
Duluth Avenue. Upon completion of the hearing, staff was directed to prepare a
resolution approving the variance.
DISCUSSION:
Attached is Resolution 98-27PC prepared as directed by the Planning
Commission. This resolution sets forth the finds of fact to grant the requested
variance.
ALTERNATIVES:
1. Adopt Resolutions 98-27PC approving the requested variance to the required
number of parking spaces.

Parking Variance For Holiday Stationstore #198
16800 Duluth Ave., S.E.
The total number of parking spaces currently at this location is 29, with the addition of
the proposed attached car wash we would be reducing the number to 19 (we are required
24). The specific arrangement of parking stalls would be 15 stalls around the front and
side of the building which provides a number of highly accessible and convenient
customer parking and 4 employee stalls out in front ofthe store by the pylon sign, all of
which are current parking locations.
The revised number of parking spaces proposed at this location (19) is consistent with the
total number of parking spaces available at similar volume Holiday stationstores in the
Twin Cities metropolitan area. We have experienced no shortage of parking at
comparable locations around the metropolitan area, and we expect this proposed parking
plan to meet our needs.
Additionally, although the City Ordinance does not "count" fueling positions, our site
design curmetly provides capacity for 16 vehicles at the petroleum dispensing islands.
Those customers purchasing petroleum and patronizing the stationstore will keep their
vehicle at the dispenser island leaving parking spaces available for those customers using
the stationstore without purchasing petroleum. In effect, this creates an added 16 "usable
parking spaces" at the petroleum dispenser islands. This would give us a revised total of
35 parking stalls of which 24 are required.
In summary, given our experience at comparable Holiday stationstores in the Twin Cities
metropolitan area, the revise parking provided at this location should completely serve
the needs of this location.

Lot 1, Block 2, Brooksville Center 2nd Addition, Scott County, Minnesota,
except for the following described parcel:
That part of Lot 1, Block 2, Brooksville Center 2nd Addition, Scott county,
Minnesota, lying Northerly of the following described line: Beginning at a
point on the westerly line of said Lot 1, distant 170.00 feet southerly of the
northwest corner of said Lot 1; thence northeasterly parallel to the
northerly line of said Lot 1, a distance of 192.59 feet more or less to its
intersection with the easterly line of said Lot 1, and there terminating.
REQUEST:
The applicant is proposing to construct an automatic car wash addition to
the existing Holiday Station Store. The Prior Lake Zoning Ordinance
requires a conditional use permit for car wash facilities in the B-3 (General
Business) district. This request also includes a variance to the required
number of parking spaces for the use on this site.

RE: Recording of Approved Variance and Conditional Use Resolutions
Dear Mr. Baregi:
Enclosed are two certified copies of Resolution 98-27PC, approving the variance to the
parking provisions for the Holiday Station car wash, and Resolution 98-113, approving
the conditional use permit for the Holiday Station car wash. Also enclosed is a copy of
each resolution for your files. A copy of each resolution must be recorded at the Scott
County Recorder's office by November 28, 1998. The second copy must be stamped as
recorded by the recorders office and returned to the Planning Department as proof of
recording.
The purpose of this letter is to advise you these resolutions must be recorded within 60
days of approval or the variance will be null and void per Section 5-6-6 of City Code.
Approval of the resolution and the conditional use permit is good for one year following
the date of approval. Failure to complete the improvements within this time period will
also render the approvals null and void.

RE: City of Prior Lake Review for Application Completeness for the Conditional Use
Permit and Variance for the Holiday Station Stores Car Wash
Dear Mr. Baregi:
On August 20, 1998, the City of Prior Lake Development Review Committee (DRC)
received all of the necessary submittals for the above referenced applications. This
letter serves as your official notification that the conditional use permit and the variance
applications are now complete.
The DRC will now begin formal review of these applications preliminary plat. The
tentative date of the public hearing before the Planning Commission is September 14,
1998. We will notify you if this date changes. If necessary, we will also schedule a
review meeting with the DRC prior to the hearing.
The City approval process can be substantially less than 120 days, and we intend to
move this matter through the process in a timely manner which provides a complete,
professional review. Occasionally, however, due to meeting schedules, it is sometimes
necessary to extend the 60 day review period. This letter also serves as your official
notice that the City is extending the 60 day deadline for an additional 60 days from
October 20, 1998, to December 20, 1998.
