CONSIDER APPROVAL OF A RESOLUTION APPROVING
THE COMMON INTEREST COMMUNITY NUMBER 1121
(LAKE FRONT PLAZA CONDOMINIUM) CIC PLAT
History: In September, 2002, the City approved a site plan for the
construction of the Lakefront Plaza building. This building includes
78 senior apartment units and 12,000 square feet of commercial area.
The building is located on an existing, platted lot.
Current Circumstances: At this time, the developer is requesting
approval of a Common Interest Community (CIC) plat. The purpose
of a CIC plat is to allow the subdivision of the 78-unit apartment
building into lots for each individual unit for sale to individual owners.
The CIC plat also includes three units for commercial space.
Essentially, the plat creates a lot around the four walls of an individual
unit. CIC plats are typically done following the actual construction of
the buildings in question. The CIC plat does not change the number of
units or the density of the development.
Staff has reviewed the CIC plat and finds it consistent with the
approved site plan.
The Issues: CIC plats do not require a development contract. The
required developer improvements were included as part of the
development contract for the construction of the building.
The CIC plat documents submitted to the City do not include the
proper signature line for City approval. The plat must be revised to
include this signature box. This condition is included in the resolution
as a condition of approval.
Conclusion: A copy of the CIC plat is attached to this report. Staff
will be available to discuss the details of this plat with the Council.

BudJ!et Impact: There are no budget impacts with the approval of this
CIC plat since the building has already been built.
The City Council has three alternatives:
1. Adopt a Resolution approving the Common Interest Community
Number 1121 (Lakefront Plaza Condominium) CIC Plat.
2. Deny the resolution approving the CIC plat.
3. Defer this item and provide staff with specific direction.
The staff recommends adoption of Alternative #1 as part of the consent
agenda.
A motion and second to adopt a resolution approving the Common
Interest Community Number 1121 (Lake front Plaza Condominium)
CIC Plat and authorizing the Mayor and City Manager to sign the CIC
plat documents is required.

WHEREAS: on September 4, 2002, the City approved a site plan permit for the construction of a
78-unit apartment building known as Lakefront Plaza; and
WHEREAS: the Lakefront Plaza building is located on an existing, platted lot; and
WHEREAS: The City Council has found that the Common Interest Community Number 1121
(Lakefront Plaza Condominium) CIC Plat is in substantial compliance with the
approved Site Plan for Lakefront Plaza; and
WHEREAS: The City Council has approved the Common Interest Community Number 1121
(Lakefront Plaza Condominium) CIC Plat.
NOW, THEREFORE, BE IT HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF PRIOR
LAKE, MINNESOTA, that it should and hereby does require the following conditions to be met, prior to
release of, and recording of said plat:
1. The recitals set forth above are incorporated herein as if fully setforth.
2. The final CIC plat must be revised to include a signature box for the City approval.
3. The CIC plat and all pertinent documents must be filed with Scott County within 60 days from the date
of final plat approval. Failure to record the documents by September 7,2003, will render the CIC plat
null and void.
4. The Mayor and City Manager are hereby authorized to execute the CIC Plat on behalf of the City.
Passed and adopted this 7th day of July, 2003.
