HomeMy WebLinkAbout7D - Deny Vacation of Erie ROW MEETING DATE: AGENDA #: PREPARED BY: AGENDA ITEM: DISCUSSION: CITY COUNCIL AGENDA REPORT JULY 7, 2003 7D JANE KANSIER, PLANNING COORDINATOR CONSIDER APPROVAL OF A RESOLUTION DENYING A REQUEST TO VACATE A PORTION OF THE ERIE AVENUE RIGHT-OF-WAY LOCATED ADJACENT TO 3235 KENT STREET (Case File #03-057) History: Patrick Jolitz has filed an application to vacate the north 8' of the 16' wide platted alley located adjacent to the south property line of the property at 3235 Kent Street. There is an existing home on this property. The alley is currently unimproved. The applicant is proposing to rebuild the existing garage and requires the additional lot area to meet the maximum impervious surface requirements. The alley right-of-way was originally dedicated as part ofthe Spring Lake Townsite plat many years ago. The alley right-of-way is 16' wide. There are utilities located within the alley right-of-way, including a gas main, telephone cable and electric lines. Minnegasco submitted the attached letter objecting to the vacation of the right-of- way unless a permanent drainage and utility easement is maintained over the right-of-way. Current Circumstances: The Planning Commission reviewed this vacation request on June 23, 2003. The Planning Commission recommended denial of the proposed vacation on the basis that it is not in the public interest. The Issues: Minnesota Statutes 412.851 allows the Council to vacate easements or right-of-way by resolution. The statute states, "no such vacation shall be made unless it appears to be in the public interest to do so." The Comprehensive Plan does not specifically discuss utility easements, other than as a function of ensuring access to public utilities. If the Council approves the vacation, this approval should be subject to the condition that an easement over the entire 8' strip be retained and the applicant submit the required easement documents prior to the recording of the resolution vacating the right-of-way. The City Council has three alternatives: 1. Adopt a Resolution denying the vacation. 2. Direct staff to prepare a resolution approving the vacation. 3. Defer this item and provide staffwith specific direction. The Planning Commission and staff recommend Alternative #1. A motion and second to adopt a Resolution denying the vacation of the right-of-way is required. 1:\03 files\03 vacations\jolitz\cc report. doc Page 2 RESOLUTION 03-XX RESOLUTION DENYING THE VACATION OF A PORTION OF THE ALLEY RIGHT-OF- WAY ADJACENT TO THE PROPERTY AT 3235 KENT STREET SECOND BY: MOTION BY: WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, WHEREAS, A petition for the vacation of an 8' wide strip of the alley right-of-way adjacent to the property located at 3235 Kent Street, has been duly presented to the City of Prior Lake, signed by the owners of the property abutting the following described right-of- way situated in the City of Prior Lake, Scott County, Minnesota to wit: Legal Description: That part of the north half of the 16 feet wide alley as platted in Block 30, SPRINGLAKE TOWNSITE, according to the recorded plat thereof, Scott County, Minnesota, which lies easterly of the southerly extension of the west line of the east half of Lot 2, said Block 3 and which lies westerly of the southerly extension of the east line of Lot 1, said Block 30, SPRINGLAKE TOWNSITE, Scott County, Minnesota. Notice of the hearing has been duly published and posted in accordance with the applicable Minnesota Statutes, and A Public Hearing was held on said petition on Monday, July 7, 2003, at 7:00 p.m. in the Council Chambers at the Prior Lake Fire Station #1; and The City Council then proceeded to hear all persons interested in said petition and persons interested afforded the opportunity to present their views and objections to the granting of said petition; and The existing right-of-way is not necessary for the maintenance of public utilities as long as a drainage and utility easement is maintained over this area; and The City Council of Prior Lake has determined that the vacation of said right-of-way would not be in the public interest. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF PRIOR LAKE, that: 1. I. - - -. ~0' i .---_J Dear Ms. Kansier: With reference to the proposed alley vacation mentioned above, CenterPoint Energy Minnegasco does have an existing natural gas main in that portion of the alley proposed to be vacated. Since this gas main is necessary to serve all of the homes on this block, we must object to this proposed vacation unless suitable easement rights are reserved to CenterPoint Energy Minnegasco, pursuant to MnSta 160.29 & MnRule 7819.3200. Please reserve an easement to CenterPoint Energy Minnegasco, created by and within the document establishing the street vacation and filed with the Scott County Recorders office, over all of the area of the alley proposed to be vacated. We may consider removing our objection should the petitioner wish to reimburse CenterPoint Energy Minnegasco the cost of relocating the existing gas main. To discuss this and any other options that may be available please have the petitioner contact Rick Pilon, Senior Administration Engineer, at 612-321-5426.
