Prior Lake State Bank hereby establishes an Irrevocable Letter of
Credit in the amount of Twenty Nine Thousand Five Hundred and
00/100 ($29,500.00) U.S. Dollars in your favor for the period
beginning October 20, 2000 and expiring October 20, 2001, for the
account of Wetterlin Corporation-True Value Hardware.
This credit shall be available against your draft at sight on us
accompanied by the original Letter of Credit.
This Letter of Credit sets forth in full terms of our undertaking.
Such undertaking shall not in any way be modified, amended or
amplified by reference to any document, instrument or agreement
referred to herein or in which the Letter of Credit is referred to
or to which this Letter of Credit relates. Any such reference
shall not be amended to incorporate herein by reference any
document, instrument or agreement.
Your draft so drawn must bear this clause: "Drawn under Prior Lake
State Bank, Prior Lake, Minnesota, Irrevocable Letter of Credit

We hereby agree with the drawers, endorsers and bona fide holders
of all drafts drawn on and in compliance with the terms of this
credit that such drafts will be duly honored upon presentation to

Prior Lake State Bank hereby establishes an Irrevocable Letter of
Credit in the amount of Twenty Nine Thousand Five Hundred and

completed and financial obligations to the City have been satis-

Applications will be reviewed by the Development Review Committee. A member of
the Planning Staff will notify the Applicant as to any additional information or
modifications needed. Site Plans, which are non-residential, and have no variance
or other possible applications as required, may be administratively approved. Site
Plans requiring a variance or other possible applications will automatically be
scheduled for a Planning Commission Public Hearing when it has been verified
that the application is complete. Items will be scheduled before the City
Council, by the City Manager, upon Planning Commission Recommendation.

This letter serves as a reminder of the new Zoning Ordinance being effective May 1, 1999. Your
proposed site plan must receive DRC approval and building permit approval prior to May, 1,
1999. If this is not done, then your site plan will be reviewed under the new ordinance;
Please submit your plans as soon as possible. It will take a minimum oftwo-tbree weeks for site
plan approval and it could take up to two weeks for issuance of a building permit after submittal

Dear Brad,
On October 26, 1998, the City received an application for your proposed retail building
on Duluth Avenue. The City is legally responsible to approve or deny your application
within 60 days. An extension can be made if the applicant is provided a written notice of
such an extension.
This letter serves as your notice of the City's extension of time to review your
application. The extension is necessary because specific issues have not been addressed.
Additionally, on December 15, 1998 you expressed your intent to submit new drawings
with a larger building. Therefore,. the City is extending the deadline to review your
application 60 days from December 24, 1998 to February 21, 1999. While it is our intent
to review your application in an expedited manner, we may not be able to approve your
site plan by December 24, 1998 given the current circumstances.

Planning Items
. An irrigation plan is required.
. Need a cost breakdown of the shrubs, trees, sod, and irrigation. The Letter of Credit is to be
125% of the total landscaping costs. (Building Permit Item)
. Outdoor mechanical equipment is to be screened with multiple elements.
. Need detail on trash enclosure.
. Need a letter from Holiday stating the grading and retaining wall you are proposing to
construct is permissible. (Building Permit Item)
. Need specifications on exterior lighting and foot candles at the property line. Current plan
does no show them at the property line. Indicate what mitigative measures will be made to
reduce glare upon the adjacent residential properties.
. Need tree replacement plan. 39 Caliper inches are to be replaced. Are you intending to
donate trees to the city or make a cash donation for significant trees removed?
. Need specifications on building and roof materials proposed.
. Address how the "back" of the building can be modified as not to be so intrusive facing
Maplewood. Perhaps adding windows or continuing the porch will soften the appearance.
. Proposed signage requires separate sign permit from PlanninglBuilding Departments.
. Required berm along Duluth Avenue must be 30" in height (958 el.). A retaining wall along
the parking lot side of the berm may be necessary to achieve this.
. Grading Plan indicates the building to be at an elevation of 760.0, I believe this is a
typographical error and should read 960.0.
. Landscape berms on grading plan do not match berms on landscape plan.

· Minimum size of trees is 212 inches. The total trees required is 25. The landscape plan gives
you credit for 24 trees. 10% Of the minimum required trees are to be oversized (312" or 8'
tall). We will give you credit towards the minimum required trees of there are any to be
saved. An irrigation plan is required. The three landscape islands need to be planted with
shrubs/trees. State that "All disturbed areas to be sodded" on the landscape plan. Plantings
are required around trash enclosure. .

As a follow-up to our meeting on July 22, 1998, the following information is needed as part of
submittal for formal site plan review:
· Site Plan Application and $300 fee
· Landscape Plan signed by a registered landscape architect
· Tree Plan indicating trees to be removed and replacement if necessary
· Lighting Plan indicating location of all light sources and foot candles at property line
· Engineering Issues to be addressed (see Attached)
Also be advised, the outdoor sales/storage area requires a Conditional Use Permit (CUP). The
City Council must approve your CUP. The fee is $350 and part of the application requires the
names and addresses of all property owners (including mailing labels) within 500 feet as
determined by the Scott County Auditor or a certified abstract company. The list must include a
map indicating which properties are listed. The rest of the documents include a survey, site plan,
grading plan, etc. which are required as part of your site plan review.
In order to expedite review of your project, we can proceed through the site plan review
procedure, which is an administrative process. This will result in approval of you site plan and
building exclusive ofthe outdoor storage/sales area. You can then apply for a CUP, which is
approved by the City Council and takes approximately 8 weeks to process. If you prefer, you
can apply for the site plan and CUP to run concurrently or you can get the CUP prior to site plan
reVIew.

The Engineering Department has completed a preliminary review of the subject site plan
and have the following comments:
1. There is a 4" diameter water service stub and a 6" diameter sewer service stub
near the midpoint of the property along Duluth. If a sprinkler system is
required in the proposed building, the 4" water service will have to be
removed and a 6" diameter service installed. If not, the services can be
utilized as they exist.
2. Erosion control and grading issues are not significant at this time and can be
addressed at the time of building permit application and subsequent
construction activity.
3. An interior storm sewer is proposed to collect storm water and connect into
the city system in Duluth Avenue. Provide storm sewer design calculations
and show pipe profiles on the plans.
4. Documentation of legal access to connect the Coast to Coast parking lot to the
Holiday Station Store driveway must be provided to the City.
5. Some of the proposed radii are less than the minimum 25 feet. The turning
radii will have to be reviewed in light of delivery truck traffic.
6. The parking lot entrance/exit on Duluth avenue across from the bank exit must
align horizontally with the bank exit.

Lot 2 Block 2 Brooksville Center 2nd Addition (PIN# 25 177 005 0) is proposed to be developed with a
Coast to Coast Hardware store. The property was initially served with sewer and water utilities in
1972 under Project 72-7. These lots were 100% assessed for sewer & water frontage and trunk
acreage charges.
Since utilities are available to the property site, the cost for the extension of services internally will be the
responsibility of the owner developer. If on-site storm water improvements are required than the parcel
would be subject to a storm water trunk area charge based upon the net lot area of the subject site. This
would be the only development related fee charged on the building permit in addition to the typical fees
associated with the building permit.
There are no outstanding special assessments currently certified against the property. Also, the tax status of
the property is current with no outstanding delinquencies.

I have reviewed the building permit file with respect to the hardware store at 16820
Duluth Avenue. I did find a copy of the permit allowing the outdoor storage on the site
(see attached). This permit included several conditions, among them:
. The site must be kept in neat and orderly condition;
. The shrubs which were to be planted in this location must be relocated on the site.
I also,found a letter to you, dated May 23,2000, requesting renewal of the letter of credit
for landscaping. This letter of credit has not been renewed at this time.
ThB temporary certificate of occupancy issued for this building expires on August 1,
2000. Before a permanent certificate of occupancy will be issued, the following items
must be completed:
1. All disturbed areas must be sodded.
2. The parking area must be striped.
3. All trash, etc., must be removed from the site. The outdoor storage area must be
maintained in a neat and orderly condition.
4. All landscaping must be in place, as well as the irrigation system. The letter of credit
for the landscaping must be renewed for one year following the date of City
acceptance of the project.
There may be other building and engineering issues that must be completed prior to
issuance of a final occupancy permit. Please contact Robert Hutchins, Building Official,
with respect to other issues.
Once all of the above items have been completed, please contact us to schedule a final
inspection. .

I inspected the Coast to Coast Hardware Store on Duluth Avenue on Friday, June
23, 2000. The following items must be corrected prior to final approval:
1. All disturbed areas were to be sodded. The landscape areas along the road
have not been sodded.
2. The area behind the north side of the building was to be sodded. This area has
been paved and is being used for outside storage. The pavement and outside
storage must be removed.
3. There were significant trees located on the north side of the building that were
to be saved. This does not appear to be the case.
4. The parking area has not been striped.
5. There were several use pallets, and other trash on the outside of the building.
This must be removed.
In general, this site was unkempt and the construction did not appear to be
complete. For this reason, I did not review all of the landscaping on the site, nor
was I able to determine if an irrigation system was installed. The developer must
clean the site up and complete all items before we will do a final inspection.

Dear Brad,
On November 5, 1999, the City issued you a temporary Certificate of Occupancy for your
new building at 16820 Duluth Avenue. The temporary Certificate of Occupancy expires
August 1,2000. Attached is a punchlist with 13 items to be completed. One of those
items is landscaping. The City had a Letter of Credit on file for landscaping in the
amount $29,500, which expired on 4/28/00. The LOC should have been renewed for
another year. At this time, the City is asking you to complete the punchlist items,
including landscaping and to provide a Letter of Credit expiring 5/16/01. The LOC is to
be held for one year after the landscaping is installed and inspected. If the punchlist
items are not completed and the LOC extended, the City has the option of not renewing
your Certificate of Occupancy.
We feel the remaining items can be resolved in a friendly manner with your cooperation.

Tree Preservation Cash Payment
Attached is a check from Brad Wetterlin, d.b.a. Coast-to-Coast Hardware in the
amount of $3900. This payment is for compliance with the Tree Preservation
Ordinance. Rather than plant replacement trees on site or in a city park, he has
opted for a cash payment to the City. The Ordinance requires this money be placed
in the Park's Department Capital Improvement Fund to be used for maintenance of
City's nursery stock and planting es on ci operty.

(b) Whenever possible, required replacement trees shall be
planted on the site being developed. If a development site cannot
accommodate all the required replacement planting, or planting on
the site being developed is not possible or is undesirable,
replacement trees may also be planted on publicly owned or leased
sites, such as parks, public lake accesses, boulevards. Planting on
such sites shall be done at the discretion of the City. In the event
that planting of replacement trees on the site being developed or
publicly-owned or controlled sites is either not possible or not
desirable, developers shall be required to pay cash in lieu of
replacement trees at a ratio one hundred dollars ($100.00) per
caliper inch of excess tree removal. For example, if a site has one
hundred (100) caliper inches and sixty (60) caliper inches are
removed, the Developer will be required to pay for ten (10) caliper
inches or one thousand dollars ($1,000.00). Cash received in lieu of
replacement trees shall be placed in the Capital Improvement Fund
of the City's Parks Department. and used for maintenance of the
City's nursery stock and planting of trees on public property.
(c) Minimum sizes for replacement trees shall be:
Deciduous - two and one-half inches (21/2.) caliper
Coniferous - six feet (6') in height
(d) Replacement trees shall be from balled and burlapped,
certified nursery stock as defined and controlled by Minnesota
Statutes section 18.44 through 18.61, the Plant Pest Act.
(e) Replacement trees shall be covered by a minimum one-year
guarantee.

Dear Brad,
This letter serves as approval of your site plan. Considering a building permit has been applied for, the
following items need to be address prior to building permit approval:
Planning Items
. A 35' loading berth is required. Please indicate on plans.
. 5% Of the parking area is to be landscaped. Based on my calculation, an additional 177 square feet is
required along with plantings on the islands. This can be accomplished by adding a landscape triangle
on the southerly end of the parking row adjacent to the building and by landscaping the striped triangle
area adjacent to Holiday.
. Need landscaping estimate to include irrigation. The Letter of Credit is to be 125% of the total
landscaping and tree preservation costs. LOC to include tree preservation amount of $4700.

. Trash enclosure materials must be same as or compatible with principal structure.

application for a sign permit.
. Proposed metal siding and roof does not comply with the city's architectural requirements.
. Proposed propane tank cannot be located within the required 50' setback. This must be relocated or
eliminated from the plans.
. Trash enclosure opens into required parking. Relocate the parking stalls or trash enclosure.

. Stormwater trunk area charge will apply when permit is issued and is based on the area of the site.

Following are the results of the preliminary plan review for the Coast to Coast building. Our
review was based on the Minnesota State Building Code (MSBC) which adopted with
amendments the 1997 Uniform Building Code CUBC) with handicap regulations of the Council
of American Building Officials American National Standard (CABO/ANSI).
1. Submit mechanical, plumbing and sprinkler plans. May be submitted at a later date.
2. A structural engineer must provide engineered drawings of the pylon sign
3. Provide a building code analysis ex. type of construction, occupant load, area increase, exiting
calculations, etc.
4. Ventilation for the building must meet UBC chapter 12. Provide 15 CFM of ventilation
per occupant in the M occupancy and 3/4 CFM per square foot in the S-3
occupancy. MSBC 1305.1202.2.7.
5. Provide a location for attic draftstops, UBC 708.3.1.2.2.
6. Calculate required attic ventilation with a cutsheet indicating venting capacities of
soffit and roof vents. UBC 1505.3
7. Provide cutsheet of drinking fountain. ~SBC 1305.1795
8. In rack sprinklers, early suppression fast response sprinklers or an other approved
system that meets the National Fire Protection Association (NFP A) section 231 c is
required for all storage areas where the top of the pile storage is over 12 feet above the
floor or grade.
9. The exterior wall and roof panels are not in conformity with City Code section 4-7-2
which states: Usable Materials: No building permit shall issued for any structure for
which a building permit is required which contains exterior facing materials which
rapidly deteriorate, of which for any reason are, or quickly become unsightly. The
following are examples of such materials: concrete masonry units, common clay
brick, sand lime brick, concrete brick, unfinished structural clay tile, sheet metal, .
either corrugated or plain, and exposed unfinished concrete. Such materials, however,
may be used in a special arrangement or combination with other materials of a
permanent nature with good architectural design and appeal.

This is a preliminary review only. Other code items will be addressed when the final
plans are submitted. The building plans must be reviewed by the Cites Developmental
Review Committee (DRC) which consists of representatives of Planning, Engineering,
Parks, Finance, and Building Departments. The DRC must approve the plans before a
building permits can be issued.
